Court overturns election results; Antigua Prime Minister seat under threat

ST JOHN’S, Antigua, CMC – A High Court judge on Wednesday ruled that the election of three government parliamentarians, including Prime Minister Baldwin Spencer, was invalid, throwing the United Progressive Party (UPP) administration into a tailspin.

However, Justice Louise Blenman has confirmed that Trevor Walker of the government-aligned Barbuda People Movement (BPM) was duly elected to lone seat on the sister island in the March 12, 2009 poll.

On the other hand, Prime Minister Spencer, as well as Tourism Minister John Maginley and Education Minister Jacqui Quinn-Leandro will be forced to demit their seats, making way for either a by-election in those constituencies or a general election.

Based on Wednesday’s decision, the ruling UPP has six of the 17 seats in Parliament, while the opposition Antigua Labour Party (ALP) now command seven. But the UPP also has the support of the BPM.

The ALP has welcomed the court ruling, which leaves the UPP to ponder its next move.

        The index listed 180 countries and D/a was near the top of least corrupt at 34.

      What is significant here is that, persons have continued to say that a judge would never rule against a seating government. Of course the case is different from Dominica. We have dual-citizenship petitions in Dominica, we did not have that in Antigua. Hardcore labourites have already conceded defeat by saying “even if skerrit lose, we have 18 eats”. Interesting times my friend. Keep listening, particularly to the matter in St. Kitts. Don’t let Tony tell you. Read and listen for yourself.

      Find a constitution, read up the section with respect to election disqualification and tell me where you see provisions for bi-election. Tell us here on what grounds based on our constitution that there can be a bi-election in the seats that the UWP are challenging.

    Let me just remind the UWP here that what they are relying on here was thrown out in Antigua and the judge only rule on the fact that the polling stations remained open after the scheduled time to close, which according to the opposition in Antigua was to their disadvantage.

    Some common sense for UWP who said that Labour party paid tickets for people to come and vote. when you transport people from their homes to the Polling station to vote, can some one explain that to me…..

      When Tony makes these statements, it is clearly designed to fool people like you. Before sticking your foot in your mouth you need to first find out what were all the submissions made with respect to bribery. Secondly, you need to find out what the law of Antigua says with respect to bribery. Thirdly, you need to find out what was presented by the ALP as evidence for the alleged bribery. Finally, you need to find out on what grounds did the judge dismiss the claim of the bribery.

      It is only then that you will see things from a proper perspective. Stop making Tony take allu for fools.

      The report indicated that the outcome in the polling station was invalid based on technical issues – the polling station opened too late. The one about bribery and corruption was thrown out.the judge said even if the state paid for the prople to come to vote (1)there was no evidence to suggest that the individual candidates paid for them to vote and (2)there was no evidence that the people voted for any particular candidate.

      So the Dominica case is safely in favour of the DLP

    Dear Folks, do not take this as a ruling in favour of the UWP. This is a ruling in favour of the Antigua Labour Party and no one else. The cases in Antigua and Dominica are not one of the same and should be treated differently. Note that the judge has overturn the election in the constituencies, and not the winner. Meaning the judge says the election was what is not right (or the process). Where as in Dominica the UWP is challenging the winners, the ALP challenged the process!!!

      You are clearly not aware of what each of the five UWP petition says. For that reason, your statements are not entirely correct. Please do your research and come again. While the cases are totally different, there are a few similarities in what was filed. The issue of proper evidence to support the claim is another story. The dual-citizenship petition is actually challenging the electoral process in Veille Case, so do yourself a favor and research, read, educate yourself and come back.

    The situation in Antigua is not the same as in DA ,1st the ruling party in Antigua lost seats in the last election. The seats contested in the courts were very close and the polling station for those areas were suspiciously open late so someone could say if it was opened on time the result may have been different. Now lets look at DA , inspite of all the allegations by the opposition two different independent observer group that the opposition asked for, said the election was fair, no poll
    was opened late and the ruling party gained seats.The two seats that were close in DA if given to the opposition would not make a different in the winner of the DA election. The opposition need at least 12 seats to add to what they already have to win the election in DA. I have not heard any credible person say with a straight face that the UWP have that much seats. Oh and by the way the party that lost in the courts are friends with the UWP and the party that won in the courts, the party that was cheated in the election, was the ANTIGUA LABOR PARTY.     A temporary stay of execution has been granted by a high court judge in Antigua. So in effect nothing changes for the moment. The UPP plans to file a formal appeal to the Eastern Caribbean Courts of Appeal and seek a permanent stay of execution pending the appeal. So for now the present government is still in control.

    I observed some of you all taking this thing for a Joke but this is very different from the Dominican Situation and you all have no Idea how many of us lives have been ruined by this Government here. We came here worked hard, fair and honest and because the Government believes the foreigners may have voted for the ALP they came at us with no mercy sending us home left, right and centre and made it so difficult for us we can’t even work to provide for our own kids that were born here.
    Ask any of the Citizens that have return to Dominica either voluntarily or deported and they will tell you of the disgust and disdaine they have for this UPP Government. Some folks as far as 36 years were sent away from here without giving them an opportunity to make it right with the Immigration Authorities like was done in other territories.
    Antigua is in turmoil right now, no work people are being laid off all sorts of things happening here that made life so difficult for foreigners and alot of their own people are in other countries and most of them go to the U.S.A to make their babies yet the good people from Dominica that has provided them with fresh produce for the past 60 years plus and had a great relationship with the Labour Government and was never mistreated in any way is being treated very badly now. One Minister even threatened to come to Dominica and buy the food himself so as to prevent the local hucksters from making a living to feed their families.
    We migrated here to assist with development of our selves and help in the building of this country and when a lot of locals were leaving here and migrating they were left in a quandry here and the Government of the day open its doors to us with no reservations, not even the locals were joining the Police Force they had to be imported from the other territories. This all started when a former Prime Minister beat his rival to come back in the Parliament he was furious and thought to himself it was the foreigners who had done this to him because he had invested heavily in that Community and can’t believe he lost.
    They want a clean slate now and is doing everything to make sure foreigners do not vote in the Country. Now the prayers of the faithful have been answered for all the lives that have been devastated here. Please understand that as law abiding citizens the verdict today had to do mainly with the opening and closing of the polls on time and ballot papers and other stationaries not available on time quite different in Dominica okay, and that is why the Barbuda seat was upheld.       If you were informed of matters before the court in Dominica you will know for example that the petition against DBS and its management is enough to declare the entire election process null and void. yes you heard right, pick up your phone, speak to some lawyers, educate yourself my friend.

    ALL YOU FORGET BY THE TIME THE COURT MATTER COMES AROUND THE UWP ELECTED MEMBERS WOULD HAVE FORFEITED THEIR SEATS? NULE AND VOID, NO MORE POWER . IF THE FIVE PETITION COMES ROUND CAN FIVE DEFEAT EIGHTEEN? STILL NO POWER. EVEN IF , CAN 3 + 5 = 8. 18 -5 = 13. IN THE NEW METRIC MATHS IS 8 MORE THAN 13. WHERE IS THE UWP COMING IN TO FORM THE GOVERNMENT. IT MUST BE BACKWARD MATHS THE UWP IS COUNTING. BE REAL ANYWAY YOU THINK OF IT THE LABOUR PARTY WILL STILL RUN THE COUNTRY HANDSOMELY, WHICH EVER WAY THE DECISION GOES. THE UWP MUST UNDERSTAND THAT THE LABOUR PARTY GIVES THEM BAIT AND KNOWS EXACTLY HOW TO MAKE THEM SPEND MONEY AND THE EXPENSE OF THE PEOPLE OF DOMINICA AND THE LABOUR PARTY STILL COMMANDS. AND DO YOU KNOW WHY? THE PRAYERS OF THE ELDERLY AND LITTLE CHILDREN IS PROTECTING THE PRIME MINISTER AND HIS PARTY OFFICIALS. THEY PRIME MINSTER CARES , CARES ABOUT THE ELDERLY AND THE CHILDREN.

    The decision in Antigua has absolutely no relevance to the election petition before the courts in Dominica. The UWP’s case is very different, however should the court rule in the favour of the UWP, it would not effect the Government as the DLP would still have a distinct majority in the House of Assembly. The resulting by-elections (if they happen) would also likely result in landslide victories for the DLP candidates anyway. So it is much ado about nothing… not unlike the UWP boycott of Parliament.

    The UWP seems to be hellbent on wasting time and in noway interested in working towards the development of our great nation. Maybe they are just to old and tired to contribute? Anyway they should just step aside and let the energetic and enthusiastic Labour Party Government bring Dominica to the next level!

      You need to go read up the constitution. There can be no bi-elections under the circumstances as they are in the matters relating to Dominica. That is what alot of allu do not know. Go and educate yourself.

        In the similar matter concerning Daryl Vaz in Jamaica, the constitution of Jamaica did not mention bi-election under the circumstances but the court ruled for a bi-election anyway. Go educate yourself.

    the cases are not the same, and even if any of the seats were given to the UWP they still cannot form government.

      hmmmmm. I like when allu conceding defeat. The funny thing is allu don’t know the implications for allu party if certain petitions go UWP way. I think the DLP need to undertake a serious education drive across Dominica on the current court matter to avoid heart attacks and strokes.

    The UPP still holds strong in Antigua…. Lester Bird maybe bent on bringing in another money-laundering billionaire from America. The best move that the UPP could make is to hold a by-election in the three constituences that were judged null and void. Keep your head high Boldwin Spencer. You should be bold enough to win all three. Don’t let the Birds get out of their cage. Keep them in hibernation. Let them be permanently migratory Birds. Skerrit should follow suit and have a by-election in Marigot, Salisbury and Roseau Central. At the end of the day, both the DLP and the UPP will be victorious.
