Sticky-fingers Goodwill man ends up in court

Nineteen-year-old Kelsey Guye of Goodwill has been fined $1,500 after pleading guilty to theft.

Guye, who was employed at O.D. Brisbane and Sons (Brizee’s Mart), pleaded guilty to stealing $1,611.08 worth of items which included a number of alcoholic beverages namely champagne, Alize, whiskey and Red Cap along with chocolate snacks such as M & M’s and Twix, and bubble gum from the company between 1st December 2011 to 31st July, 2012.

According to the facts presented by prosecutor Valda Powel, members of the police force conducted a search at the home of Kegan Richards, the defendant’s cousin, after the manager of the distribution department of Brizees Mart had reported the matter to the police.

A search was conducted in Richards’ bedroom where the items were found. Richards was arrested and taken to police headquarters for suspicion of handling stolen goods. Richards then revealed to police that the items belonged to Guye.

Guye, who was represented by attorney at law Bernadette Lambert, admitted to stealing the items on different occasions and storing them at his cousin’s house. He also informed the police that his cousin was unaware that the items were stolen.

Lambert, in her plea of mitigation for the defendant, begged the court for leniency stating that he was a young man who made a mistake. She expressed to the court that it was a period of poor judgement on his behalf and stated that she believed that the time he spent in the cell had made him learn his lesson.

Magistrate Candia George allowed the young man to apologise to his father, who was sitting in the court, and gave him a stern warning about his actions.

Three empty bottles of Presidente beer, an empty bottle of red cap and an empty box of Skittles were also recovered.

Guye is to pay the fine by 31st October or spend 4 months in prison. He was also ordered to pay compensation to Brizee’s mart in the sum of $29.75 forthwith or spend one week in prison.

I don’t care. He confessed to it. Let God forgiv him. Wait till someone steals from you or breaks into your hour house then you will understand. Why can’t we just call a spade a spade? Since when Dominicans have a muzzle in their mouth. We are not criticizing but commenting. Check your words people. No one is perfect, but un vole c’est un vole. We all have thieves in our families as well as other sins. Idf it was OK why do we have policemen, courts, judges, lawyers, prisons. Need I go on? What you want us to do give him a candy? No pun intended. Keep the faith and pray for the thieves to repent annd change. Trust me God can make the difference in anyone’s life.

I am so disappointed, when in the state of the economy worldwide, young people keep crying about job availability. Yet, when one is fortunate enough to have a job, he does this nonsense. The punishment should be for stupidity. I would get him to clean Roseau streets for a week. You have so much going for you, WHY? Embarass yourself, your family, young people! You idiot! You want to steal something, you stealing rum and sweetie? Boy, go back to school!!

I dont condone larceny of any form however when employees steal from their employer it only reveals that they have no allegience to their employer. How can an employee have any form of allegience to an employer when he is aware that his employer is exploiting him. These employers are getting away with #$%^&.because of the scarcity of jobs, these low level employees get paid COOLIE wages,

This is the kind of thinking that leads one to believe that there is an inbred culture of dishonesty in Dominica. Why do you feel the need to excuse the dishonesty. Is stealing from an employer an excepted way to redress low wages. The poverty that sparked this kind of behavior in not based on economics but a poverty of of the spirit. If this is the result of being “exploited” then there has to be the question “where is your integrity”

He was also ordered to pay compensation to Brizee’s mart in the sum of $29.75 forthwith or spend one week in prison.

So what i understand is $29.75 = 1 week in prison hmm … so a week in prison cost about $30.00
    a month $120.00.

Now that doesnt make jail sound so bad after all. 8-O .

now kids gonna feel that jail is nothing if they have adequate cash to help themselves.

Seeing that the items were found I am assuming that the sum of $29.75 to be paid forthwith = “Three empty bottles of Presidente beer, an empty bottle of red cap and an empty box of Skittles were also recovered.”

You are young do not throw your youth away. My niece in her 20s was just asking me if I am asking for “more time” – on my birthday :) I am getting old she meant.

Do not try to be saying I could have done things differently for SOME MAJOR BLUNDER – we all have things we could have done differently but a CRIMINAL record – this one is MAJOR.

Try not to get caught up in this – NO ONE LIKES A THIEF.

While I agree with you in some ways, may I ask you; is it not fair to chastise this youth and point out his faults? He clearly got away with this crim and the system knows that is how iit gets started. Now he thinks it’s ok to do it because of a slap on the wrist. If he had gotten caught with a spliff…Stockfarm.

The apology to the father was a good start. The misguided youth should be held in prison. This will firmly fix into his core and soul the misdeeds he has performed and he will be a new man for the experience. That IS the purpose of incarceration.

    • Sarafina!
      August 3, 2012

incarceration for a first offense??? seriously??? wow!! good thing u not de magistrate papa.

    • Justice and Truth
      August 6, 2012

      @ sven moore

Apology is not enough. It is not as if he swore at someone and even then, it would not be enough. Consider stealing and ending up in Court. This is supposedly worst.
Incarceration may not help him. He has to be very strong not to re-offend. It takes willpower. He cannot do this alone. He needs to be rehabilitated. Most of all to go to church, pray and ask God forgiveness, vowing not to re-offend. He has to be sincere about it and determined to live a law-abiding life.

Food? twix, m&ms, champagne, alize… just a bunch of poisons. That guy should get locked up for being stupid. People like him almost always turn up in court againg for related crimes. Defense attorneys suck in cases like this one. “…a young man who made a mistake. She expressed to the court that it was a period of poor judgement on his behalf and stated that she believed that the time he spent in the cell had made him learn his lesson.” Really?

      • Justice and Truth
        August 6, 2012

        @ Rastafari

Some lawyer. This is why I said they should return to Law school. I do not know what type of school they attended. They are projecting that they lack intelligence and basic common sense.
The lawyer could state ‘first time offender’ if this is the case but should not state he made a mistake. So what? He committed a crime and he should pay according to the crime. This is why they re-offend. A leopard does not change its spots overnight.
Time in jail made him learn a lesson? Some lesson. This lawyer is deluding herself. She ran out of words of defense. I should be the Prosecutor. He would not get away.

What part of Goodwill? I recall those days, it was called Upper Goodwill and Lower Goodwill and even higher and lower yet and we know where each segment of society lived. Surely, this has not changed. The area of Goodwill where this man esides should be mentioned or does it have a name. Some of them do give Dominica, the towns, suburbs and villages a bad name.
