Ron Abraham ordered to pay $16-m

The Former Managing Director of Marpin Telecoms and Broadcasting, Ron Abraham, has been ordered to pay in excess of 16 million dollars to the company’s liquidator.

Eastern Caribbean Supreme Court Judge Justice Brian Cottle ruled on March 02, 2012 that “Ron Abraham carried on the business of Marpin Telecoms and Broadcasting Company Ltd with reckless disregard of the Company’s obligation to pay its debts, and is personally responsible for the debts and other liabilities of the company amounting $16, 261,819 to liquidator Keron Pinard Byrne”.

According to the judge’s ruling, “Abraham was also in breach of trust in relation to the company applying to his personal use of $971,981.65 being the property of the company and that he should pay that sum and that he shall also pay the cost of his application in the sum of $10,000”.

However Abraham said the ruling came as a big surprise.

“I was not aware of it. No one ever served me with anything. I found out on the street that I had a matter with the court and it was dealt with and it took me four days to find out whether the matter was true. I then contacted my lawyer and we are taking action to have it set aside”.

Abraham also claims that he submitted an affidavit to the court and that there was no consultation.

“We have filed in court and want a new hearing date set aside to discuss the matter. We are prepared to fight the case.” He added.

Abraham does not think he should be held responsible for the debt of the company.

Meantime liquidator Keron Pinard Byrne said no matter can go to trial without a lengthy period of due process and “that was fully observed by me and all the orders of the court governing that process were faithfully served by Mr. Abraham in the United Kingdom,”.

He said all necessary documents were filed in the UK.

Back in 2004, the company’s bankers appointed a receiver to protect their interest as a secured creditor and for over four years, the company was fully under the control of the receiver.

The receiver eventually sold the assets of the company to what is now known as Marpin 2K4.

    I am writing from London, UK regarding the man named Ronald Abraham. I saw this man break the monopoly that C&W had over Dominica, and the daniel nd goliath fight he took on and won in the Privy Court here in Downing Street,Westminister. Following the braking of the monopoly that C&W had, this test case was felt all over the Caribbean. Ronald Abraham was able to go back to work and make his dream come true, but people with a dark side were watching and as greed is a very powerful motivator to the weak, they succomed. The Government of Dominica owes Ronald Abraham and needs to honour him,similarly the people of Dominica who know the truth should unite to highlight this and NOT stay silent while this injustice exists. I took inspiration from Ronald Abraham, a man I have met, and I have set up my own Telecoms business called Communications United and am trying to contact him to tell him,it is due to him, and this article is what I find. I will find Ronald Abraham and stand by his side and provide 100% support to try to match a fraction of what he stands for.

    It is amazing how some people can run off their mouth, talking about people when they know nothing about,and is demanding that people shut up!

    I&I you little no name, you do not know anything about Ron Abraham, but there are many of us who knows him, not only when he had money, or when he was head of Marpin, some of us knows his heart, and how kind a person he is, so I think you are the one who need to shut your mouth.

    You are the one who need to shut up because you do not know what the squat you are talking about, people invest in what? What about the people he gave free shares into Marpin, for no other reason, except they were with him from the inception of Marpin.

    He wanted them to benefit something out of the company, for their services rendered when the company was not very prosperous.

    What they gave him in return for his kindness was turn on him when he needed them; they forgot that without him they might not have anything to their miserable name, that was a first in Dominica, tell me how many Dominican employers you know who has ever brought a single Dominican into their business sharing it with people who are not blood related to them?

    Dominicans are a bunch of jealous, greedy and ungrateful people!

    Our people are so bad minded I remember in 1977, we sailed our ship into Dominica, we retained W. H. V. Whitchurch as our agent, there came a time when we wanted supplies, so we went to what they called their supermarket, I gave a young lady a list of all we would need. The lady in her twenties worked hard getting the merchandises ready for me, in appreciation, I decided to give her some money, to a tune of I am sure more than she made on her job in a week.

    Someone saw me when I was giving her the money, he asks me what’s that for, I told the guy, I am only giving her a tip!

    This man informed me ” we do not allow them to take tips here.”

    I simply waited when he walked off, I handed the girl the money, it’s mine right, I give it to whoever I want with no strings attached.

    You know I can call this guy by name but I will not , I will only describe him as someone I meet way back in 1964, he is tall and slender like a pin, or whip, he has been dressing in cowboy boots all of his life, and he live on Kings lane, for many years, when I encounter him at Whitchurch in 1977 he was still wearing his cowboy boots.

    That is the mentality of or people, we have to be a prevention in the life’s of others, if you are doing well, in Dominica, once you stick your best foot out, some wicked Dominican will step on it.

    Yes, they deserted Ron like drunken chickens; they took side with his foe’s (his enemies); that’s how Dominicans operate, when it suits their purpose they go where the honey flows, they will kill the goose that lay the golden, no matter how much they benefited from the golden goose in the past.

    The legal system in Dominica stinks, it sucks!

    This is a conspiracy, how can a judge sits on a case listens to evidence been presented against a defendant in his absent. The judge should ensure that the man was served, thus in his absent Brian ruled against him; thus, he lost the case if there was one by default.

    I am not a lawyer, but I can state here, Brian who; and the liquidator erred, the ruling of the judge is flawed, all Ron has to do is petition the court to ” Set Aside the judgment, and request a date for a new trial!

    We operate within the common law system, unless Dominica as usual where things a backward, and upside down, this Bajan guy must be operating on personal feelings, and instincts but what he has done to me might be illegal, an appeal of his verdict is not even necessary.

    The bottom line is that his ruling in the matter must be set aside.

    If we utilize, and practice under common law system that is the only alternative.

    From what I know myself .. This Gentleman liberalised the industry and this is what his own people doing to him. From what I know myself, I remember when he started that Marpin (Cable TV) Business and I know 1 Gentle man who is deceased who carried and was involved in that Business.

    Ron if you reading this, just lay it at the foot of Jesus. He will see you through. Where were you all those shareholders when he was struggling with his idea and invested all he had in this venture? A typical Dominica syndrome – never want to see their fellowman prosper.

    You have a small business and they think you doing so well that they want to take you out of business. They not looking to do something else but what you are already doing and will undercut and do anything to get u out.

    Dominicans it is time to lift up your fellowman. Then when all you finish, you talking about Chinese, and Haitians. They helping one another but you all will use and abuse and try to run your fellowman off a penny bread and in the end even help to send them to jail.

    Where is the love?

    This man employed many yes the company ran into difficulty but instead of assisting, the others crooked him and you see now. Is that encouraging one son or daughter of the soil to go into business and into positon . No see how much slander and lies against leaders who should be respected. This is just strategy to prevent honest and patriotic persons from going into public office or country upliftment. Who will deter the young ones from going into public office. Then we remain with those undesirables since those who are true will flee from doing anything for Dominica. What happens those negatives or those who think is only they alone should be position and they are the best we will be stuck with them. Dominican open your eyes and let us love our son and daughters of the soil. Give them their flowers whilst alive not whenthey die we remember their achievements and I won;t tolerate ” Is so it is”. We got to change our attitude or we will have a loveless/hearless society in the future.

    Over 80 million dollars of dominica passport money remains unaccounted for in the infamous layou river hotel scandal.

    Isn’t the liquidator the same person that worked on that project??? Just asking not insinuating anything. Then again the skin colour of the individuals on that project was fairer than ron’s.

They squaner and did all sortds of things now they want to fleece poor Ron, where he getting it, they owe him Royalty for liberising the telecommunication system. Marpin better buck up, because their programming is the worst at this time. No respect to its consumers, dropping off programs with no explanation, is so we being treated for all the money we paying. The little vchannels that left, they know at least lotsw of us watching LMN and oh my God its pathetic, constant scrambling you can’t enjoy or follow the story line. Marpin buck up, not that there is much competition, but if all are crap, we might as well pay less for the crap. I am really really fed up with the quality service of Marpin

    Mr. Abraham opened a business in Dominica to help bring jobs and new technology to his fellow Dominican. They took the company from him while it was flourishing!! They did not have the expertise of running a company like MAPPIN and they drove the company into the ground.

    AFTER THIS continued LYNCHING OF MR ABRAHAM, A SON OF DOMINICA, HOW CAN ANY DOMINICAN RETURN TO DOMINICA TO SET UP BUSINESS.

    I was seriously thinking of setting up several businesses in Dominica and had the plans in the works but now I am reconsidering.

    If Dominicans can do this to A SON OF DOMINICA, who labored so hard to give back to OUR DOMINICA, I have no choice but to withdraw my support for doing business in Dominica.

      I always admired Mr. Abraham’s courage but, frankly, wrong is wrong. Let justice prevail. Dominicans seem to have a perverted sense of justice!

    That was just unfair. if it wasn’t for Ron Abraham Lime would still have the monopoly in Dominica. Everyone makes mistakes but we should be thanking this man. It’s because of him we managed to get some variety in telecommunications in dominica. And because of him Marpin can comfortably be offering internet. That is serious injustice.

    What was the rationale for DSS to invest in MARPIN which has so much debt? Were the contributors to DSS informed about the details of that investment? A foreign Co. was allowed to buy DOMLEC as well as MARPIN. That foreign co. now controls electricity and part of the Telecoms business. DSS invested, bought significant shares, in both businesses now owned by that foreign Co.

    Dominicans, imagine Ron paying a heavy price for fighting hard, making serious sacrifices, to break the monopoly that one foreign co. had in the Telecoms business. Ron is not Dominica, too?

    Wiltshire suffered the same fate with his brain-child project, the Waitikubuli Trail. Dominicans beware. Your navel string maybe buried here, but you have to struggle to be Dominican. Trust me.

    Dominica lost millions, repeat, tens of millions of dollars. Passport selling like peas. But Treasury short-changed. No Layou-River Hotel. Strangely, no investigation. No court case. Is so Dominica come !!!!! Dominicans watched all that unfold with Ron, said nothing, did nothing as he was being thrown into the lions den to be slowly eaten up. It is all darkness at the end of the tunnel. Many people like it so.

They were getting all kinds of exhorbitant salaries.They destroyed the company and brought it down the drain until the banks had to put in their people to protect their interest.     We must remove that judge cottle this is the dumbest case i have ever seen in my life. How can an individual be responsible for the debts of a private corporation? Are u people nuts? Have u forgotten a corporation has a board of directors, it is not a sole proprietorship.
    It is clear u fellas hate Ron Abraham with a passion. Ron Abraham was man of the year in Dominican newspapers, he was the man responsible for the breaking of the telecoms monopoly in Dominica, and instead of the man being regarded as a hero,this case is in poor taste and tells alot about Pinard Byrne and the people running marpin today!

      It is just not fear to have Ron in court today. A business he started from scratch. Is Byrne a Dominican? Where was he when Ron went through the struggle to make the business a reputable one? It would be good if all Dominicans with draw their supoport from the company to show our disgust for that ruling.

    Ron; Dominicans wants your blood, they stole Marpin from you; and they found out that you did not commit suicide, so they have to find another way to get you!

    I remember way back in 1976, in Harlow, in Essex, on Potters Street when I told you I was returning to Dominica, where I hope to install a Radio and Television Complex, when you told me it would be better if I build a pay Television Station, when I gave you that little argument, in which I told you Dominicans would not have the money to pay for Cable Television.

    I suppose if Listened to you, I might be in the same boat, and faced the treachery of our people who have thrown that they could at you.

    I am not surprised at anything that I learn about Dominica, you can expect some paid criminal in Dominica to pop up and claim that he/she served you with some summons to appear.

    Someone need to remind that person in advanced that there is something called perjury.

    The other mystery here is that the report is stating that you should pay to the liquidator sixteen million ($16, 261, 819.000) two hundred-sixty-one thousand, eight hundred-nineteen dollars.

    Something does not make sense because $971, 981. 65 = $981, 981. 65.

    I am now wondering how the man arrived at a figure of over sixteen million dollars. Has he added some form of punitive damage to that?

    Something is wrong, however if I were you, unless you have something of equal value value in Dominica, if I were you I would file bankruptcy every year for the rest of my natural in Dominica.

    In America, and Europe, Canada, when someone is bankrupt, nobody can asks them for money, in the United States when one files bankruptcy, not even the IRS can touch them, in Dominica we need to learn to fight fire with fire.

    I am behind you on this one again, just as I told you a long time ago that Cable & Wireless did not have two feet to stand on against you, thus you priviled; so to I am predicting that this Dominica liquidator will not prevail unless he and his lawyers can prove that they served you in person, at a specific time and date.

    I am pleased I am not a MARPIN subscriber. SAT upgrade needs to be faster and better. But that news item will make me more tolerant to SAT. I really cant understand the system, the investment climate, the Dominican Spirit, and the SUPPORT we need to give to OUR OWN.
    SAT should go on an all out drive to get subscribers to leave Marpin. I am sorry about those who are employed there, but SAT try to absorb they in your workforce. The 9,000 or so subscribers will obviously come to meet you. Mr. Abraham did too much for the telecommunication sector for him to find himself in that predicament. The court system, the liquidators and the business partners have me and many people I hope truly baffled. That whole thing really seems to be “UPSIDE DOWN”

    a true caribbean entrepreneur… a true visionary… thanks to mr abraham… companies like digicel among others can come and open up shop… ron paid the price fighting the giant known now as lime… what if ron had simply stick to internet service… Marpin would be a leader in that field and cable n wireless now lime would still be choking us in monopoly… maybe only now we’d have b.b in d.a lol…

    The man took the company from its “baby” form and raised it to be a “man”, how can he be liable for being “reckless disregard to pay the company’s debts, etc”… he may have taken risks, but that is the BUSINESS world, take risks to gain something. If I was Mr. Abraham I would argue that I was the Managing Director for MARPIN TELECOMS AND BROADCASTING LTD back then, NOT MARPIN 2K4 LTD (which is a whole other company by itself).
    Hold strong my brother.
    But by the way, we waiting on CLICO or else the whole of D/CA will take CLICO to court… it seems that court is the only solution to our problems these days.

    It is a calculated plan to strip Ron naked as if Ron Abraham, the Dominican Telecommunications visionary, is the devil himself. Certainly, there were management problems. But which Co. doesn’t experience difficulties? Ron was crying in the wilderness. Begging for help from his own fellowmen. He was abandoned, cast aside.

    The local Telecoms Co. ended up being bought and controlled by the foreign WRB CO. with Dominica Social Security having major shares in the new Co. now called MARPIN 2K4. The foreign-based WRB Co. also bought over DOMLEC and controls our electricity as well, with DSS again having shares in DOMLEC. Remember, Dominicans and politicians made noise saying CDC (Foreign) Co., which controlled DOMLEC, should go and DOMLEC should be locally owned. But those same politicians in Govt. now sold to WRB, a foreign Co. and only the patriots advocated against the backward move.

    But what about all the money from the sale of passports (ECP)and the many Companies formed? What about the promise of the building of the 5-Star Layou River Hotel? Who were involved? Where did all that money go? Where is the Layou River Hotel? Remember a certain Mr. Chen and $20,000,000.00. of his money into a Co.? The case reached the BVI courts? What about that money?

    Who has been brought to justice for the fooling of Dominicans about using the millions made from the sale of our passports to build that Layou River Hotel? Is that the treatment Ron deserves? If so, then how comes those, whom Dominicans know have been involved in all kinds of corrupt practices at the highest level, continue to be ‘Untouchable?” Absolutely No investigations, No charges, no court, no bringing to justice for those “untouchables.”

    Marpin Ltd. was the brain child of Ronny Abraham, they came and stole the company from under his feet, nowhe has to pay over 16 million dollars to its liquidators . I cant beleive this

      They are saying he mishandled the company’s money; that’s wicked, it is simply a case of ” they say” how can one prove such allegations? The whole issue is hogwash to me, and sensible Dominicans should view it as such.

      How can a matter be heard by a judge in a civil matter with the respondent not present!

      If the man was not served how would he know that some litigation was taking place in which he is involved. If that is true the judge eroded; therefor, Ron’s alternative is to petition the court to set the judgment aside.

      In such matters the plaintiff is obligated to show proof of service, nonetheless, whereas everything is crooked in Dominica some liar is going to come forth and perjurer themselves by claiming that they served him!

      Ron does not have a problem right now, the person who has a problem seems to be the presiding judge, and the liquidator, it seems to me that someone has perpetrated a fraud on the court!

      It is all about money, and if it takes a fraud to obtain free money from the unsuspecting in our country, there are people who prepared to sink themselves in the black mud of the streets of Roseau to victimize someone to rub them of the hard earn money.

      To those of you who has never experience the black mud of the streets of Roseau, just take a look at the feet of those people who like to ware the rubber ” push-in.” you will learn about what the kid is talking about!

      I doh joking eh!

      And I do not wish anyone to remind me about the copper clay mud of Wesley, I am very much aware of it, that is I call myself the mud boy, because I used to walk knee deep in it you see.

      Hhhahah!

      That is nothing new in D/ca, do good and is bad you see in D/ca, all they can do is try and kill you, and then when you leave and go they want you to come back. I should know they did they same thing to my father, arrested him for show and nothing came of it. At least Ron has support.

    Some people have real guts you know. But one day the people who keep playing games with the people of Dominica will have their comeuppance. Ron stay strong my brother. You should have known not to trust those who urged you on until they saw the writing on the wall. See where things are now?

    are the courts serious…something seems wrong,,

    one thing its bad business when you the brain child of your company and trust others with shares espically in these third world countries

    they undermind the poor guy no he is naked in public..wow thats hard i feel for Ron he was a good Dominican investor and visionary in my view you meant well…just got knifed by your own dominican blood….what a shame…

    lesson is and must be learnt for young folks doing business watch your back bros…

      Just as I mentioned below. This man was knifed by his own Dominican. When I heard the news this morning on the News I uttered “Alas”. Dem people was not even there when the man came with his idea way back when. And I saying “Alas” because I know. My friend was one of his best friend (now deceased) and if this is so, he is turnign in the grave. I know so much about the beginning of this Marpin project – Brain child of Mr Abraham.

      What can I say but Mr Ronald Abraham – keep the faith- you are not alone. Put your trust and confidence in the Lord .. He will never leave you nor forsake you. Do not worry about that. Do not worry too much about that. God is a great and mighty Father. You know what you know. You are hurt but as I have said – cry if you have to but take that $16m burden and “Give it all to Jesus. Walk circumspectly and do not sin no matter what the temptations are.

    How Can Mr. Abraham be PERSONALLY liable for the debts in a LIMITED LIABILITY company (MTB Ltd)? And If he was removed from the company for all this time, no longer a shareholder, no longer anything, how can he be responsible for the company’s debt? That’s the responsiblity of those who ran MTB ltd AFTER Mr A’s exit. This doesn’t add up in my eyes, and I’m sure justice will prevail. God is Good, all the time and all the time GOD IS GOOD!

      The Company’s Act allows for Directors to be personally liable for the debts of the companay.

        That is true Marcus, but Marpin Telecoms was in sound financial state when he was ousted. Ron was a technical visionary, and had great foresight on the direction that would have vastly improved Marpin Telecoms.

        However when the goons such “esineD” took over the reigns, they lack complete vision of what it takes to run such a company. As a result Marpin Telecoms demise started there.

        Then all sorts of trumped up stories stared about Ronald Abraham.

      Unless it wasnt operating as an LLC and they have proof that he used the funds obtained thru the company as his own personal piggy bank. Now that would be something eh.

      He can be held liable if he is deemed to be in breach of his “fiduciary responsibility” as an executive of the company. Two key words to look at in that statement is “reckless disregard”. Though in theory directors and managers of company’s are generally absolved of debts of the companys they manage, if an audit is performed and it is determined that an individual with the responsibility to manage the assets of the company did not act in a manner that was in the companys best interest as well as that of its shareholders, that manager/executive can be held as being in violation of his/her fiduciary responsibility and as such, punitive damages can be assessed against that individual. Also, Marpin was a Limited Liability Company – the question now is whether Mr Abraham is accused of wrongdoing outside the bounds of the registered stated business purposes of the company. For example, if Marpin was registered in the corporate registry as a broadcast distributor of television programming and an executive decided to invest in, say soap production, UNLESS the company first changes its business registration to allow for that business, then the company could be deemed to be in violation of its stated business purpose and the executive who made that decision would be in breach of his/her responsibility to properly manage the company based on its stated business purpose(s).
