Homosexuality laws in Dominica impractical – Sir Brian Alleyne

Former Attorney General and former Chief Justice of the Eastern Caribbean Supreme Court has lent his voice to the raging debate of homosexuality and laws pertaining to it in Dominica.

Speaking on the television program ‘Parbel Talk’ hosted by Parry Bellot on July 25, Alleyne said homosexual acts in the law books are criminal acts and are subject to imprisonment but they are not practical. “It is actually impractical because you cannot actually enter into someone’s house to catch them in the act,” he pointed out.

Alleyne continued, “I think it is totally wrong. What a person does in the privacy of his home with another person is his business, he is answerable to the Lord and not to any one else.”

He said the fundamental issue is whether homosexuality is a crime. “Is it a crime?  Should a person be sent to prison for what he does in his bedroom with the consent of the other party?”

Alleyne said he thinks it is wrong to imprison people for their sexual practices in private between consenting adults and suggested that the Prime Minister show ‘moral leadership’ and act to correct it.

    Dominicans, we have more detrimental problems to focus on than what grown people are doing in the bedroom. We need to focus on the child predator laws, the economy, infrastructure, technological advancement, etc…The single mother population is also through the roof but most of all we need to raise education standards and cultural awareness (teach Creole in school as well as English).
    If we are going to use the bible as our law book then the 90% plus of citizens who fornicate should also get ten years and so should the adulterers.

    For your info Yes abortion is against the law in Dominica.{But you or an under aged child can get one without your parents consent in Roseau for 600.00 E.C. at Dr. Ferrara’s office no questions asked. Or you could do it the traditional Carib way with natural toxic plants that grow wild in Dominica. HHMM I guess that’s one of those laws the so called Christians aren’t very upset about being broken.

While we live it up abroad free of your homophobic,murdering,rapeing,Damn ass men! Send all your battymen abroad we will do our best to love and respect them.I for one think they should all have amnesty to come to any country they please to get away from the torment they have in DA.Do you thinks it’s ok for a foreiner to treat you as inferior?     I am a dominican living abroad. i am not gay but it always bugs me to know why. why are people gay, how can u look at another man and be with him as a woman, what goes through their mind? is admiring someone qualities and achievements gay? what makes u gay?i look at life from that angle. In Dominica we respect every body’s right as to how they should live their lives but please don’t push it down our throuts and say and make us say it is ok and give them the same rights like a man and a woman who is married in a home. what is the world comming to????? live your lives gay people fine, but don’t rub it in our faces and our children faces.     There are many opinions, incorrect spelling ect..However, it is a persons right to express his or her thoughts. Therefore,Here are my thoughts. The law being talked about seemed to be one used as a derternt. personally, I belive homosexuality is not a right, it is a behavior, one that should be discouraged and obliterated. The truth is, it is totally immoral and promotes a decadent behavior. God Abhores such behavior to the point of bringing destruction upon cities.

But only HE who created us, can JUDGE us. NO human kind is in any position to judge and to create laws unless they are a threat to society and to the government. If two homosexual adults consent in mutual sex, that’s they’re choice. just like a man or a woman who has an affair with someone besides their spouse. We will all be judge one day even for acting as GOD.

    As much as some people claim they don’t want to hear about this topic, it seems to always be these articles that get the most comments on DNO!

    Anyway, I agree with Alleyne as far as the legal side of it goes. The “answerable to the Lord” bit is his religious opinion, but I’m glad he did not try to impose it on anyone, which is significantly more civilized an action than can be said for most, unfortunately.

    I write long things on these topics and they vanish under the biblical flood of people writing the same basic comment over and over, so I will be brief(er).

    The primary reason most people here and indeed across the globe have any problem with homosexuality is due to religious teachings. Remove the religious passages and some people may still not like the act, but you can be sure that there will not as much fury as you see in these comments. Such fury would suggest that these people know for certain that their own religious views are correct. But they do not. They cannot. Belief is just something someone chooses to do; it is the opposite of evidence and facts. A scientist does not “believe” in facts, but knows facts. Facts and belief are the opposite.

    And since there is no evidence for any one religion, why act arrogantly as if you KNOW your own views are correct? Do not answer this by quoting biblical verses–that is not an answer. Do not say you “know it” in your heart–that is not an answer. Give evidence.

    Furthermore, since other large religions claim damnation for unbelievers, the mere fact that you could be wrong means you will be damned by another religion if you are wrong! What makes your belief system so undeniably right? Because of this, and primarily because of the lack of evidence supporting any religion, this kind of arrogant behavior is absurd. We should allow for the fact that we do not know everything. If two consenting adults want to love each other, who are you to say it is wrong? What proof do you really have? It occurs in nature often, so it is not unnatural. If you personally dislike it, that is fine–but do not then turn around and try to attack or kill people who have been born like that. I don’t like the idea of the act myself, but I accept gay people as human beings, and what they do in the bedroom has no effect on me whatsoever. Why should it be different for someone else, really?

      A friend of mine suffered from dead nerves in his foot. He woke up one afternoon, to find blood all over his floor at home. He looked at his foot just to find out that he had lost 3 of his toes, while he slept, to a dog that belonged to a friend of his. Because of diabetes he lost that foot, through amputation.

      Conscience nurtures Life, and Life function by spiritual instincts, causing your mind to process and produce the Ways of God–the attitude and conducts of Love, because God is Love, Life in human beings. Love is Spirit not of flesh and blood–like human affection or emotions

      The physical body is almost, always, like a groaning tent–unless you do not know of the afflictions of sickness and desease, filth ideas or thoughts of the mind, lust, and the destructive passions that plague the physical body to its demise.

      You do not need the Bible for that information either. Just visit the hospitals, the prison cells, the welfare office, the ghetto, the homeless, and so on. The evidence is all around you

      That tent houses your soul in its death condition, but it can become the Temple of God, when you exist with conscience, guiding your mind, sanctifying your heart, awakening your dead soul, to exist with Life–the ways of Love and the things of Day.

      Homosexuality and its conduct–just like every other fleshly desires, wants, or gratification– is part of the ways of death, the things of night, the existence of darkness–its functions has nothing to do with Life–the Light of your sou.

      I once saw on television how the desire for food turned a normal weight teenager into a 900 pounds human animal. Glutony is a sin; sin brings death; who could deny that truth in that man.

      The struggle of homosexuality–just like every other fleshly desires–is part of the spiritual warfare that comes against Life, which is of Truth, to fight against freedom–the ecstasy of peace and joy, which allows mankind to exist with tranqility, harmony, comfort, warmth–knowing the existence of Day, regardless of the darkness of night around him.

      Again, you do not need the Bible, you do not need to believe in God. Unless you are an individual from outer space; look around you, in your own existence; you will see that this has nothing to do with religion.

      In the first place Life is not about religion–religion is of the wisdom and philosophy of man, who depends on his creator for the energy of Life.

      You decide for yourself, what is done with weeds and what is done with wheat. Is there a difference between the goat and the sheep. Would you choose the existence of Day or the existence of Night–Light or Darkness. Can you deny the existence of those mentioned, that they are different?

      But all of the above are metaphors of the Holy Bible–the Words that Jesus said are Spirit; He tells us that it is the Spirit that gives Life. That is all!

    I usually wouldn’t comment, but I was intrigued by a few of the replies I’ve read so far.
    First off, Mr. Alleyne says that for acts done in the privacy of his home, man is only answerable to God (paraphrasing). Operative phrase there is “in the privacy of his home”. There are many amoral and sordid acts committed in heterosexual bedrooms (between consenting adults of course) that may or may not be worse that buggery.
    By the same token, the terms disgusting, filthy and nasty are all subjective, and laws are not based on “how disgusting” an act is. Usually, criminal law is based on whether or not the act in question is of significant detriment to the state and by extension, society at large.
    As for the comparison to marijuana, I don’t remember the last time I heard a case of SSU breaking into an individual’s home with the intention of catching him smoking. That would be ludicrous. However, you do hear of the police raiding the homes of suspected drug dealers or hoarders of drugs. This would be analogous to the police raiding the home of a pimp or a suspected child pornographer.
    As far as moral issues are concerned, there are many other moral issues that need to be addressed in as well, such as child molestation, gang rapes, and domestic abuse. Some of these acts are perpetrated against children and in my opinion do a lot more damage to their well being than two men having sex in their bedroom (as disgusting as that sounds…).
    To those who dare quote the Bible, have you fornicated? If you answer is no, then go ahead and keep on quoting the Bible as part of your argument. But for the majority of us who fornicate on a regular basis, please, let’s leave the Bible out of this argument.
    Ultimately there are two issues being discussed here; privacy and consent. Two consenting adults engaging in an act that is questionable or taboo causes no harm significant to society. People will bring up the issue of marijuana possession – I personally think that marijuana should be a legalized controlled substance. In any event, individuals “just smoking a joint at home” are hardly ever bothered by the law. It is the pushers and dealers who find themselves in trouble. So marijuana consumption isn’t a valid argument in this case. Plus the effect of exposure to homosexuality on children is inconclusive. The effects or rape and incest however, are as clear as day.
    We are afraid of homosexuals because they are different, much like the whites feared Negroes and the Christians feared the pagans upon their first encounters. Their habits are contrary to ours and their norms are foreign to us. Let us get past the fear and approach the subject logically without a biased mindset.

I have been crying about this law for the longest while, why do we want to punish people for their own sexual preference, i really need someone to explain this to me. We love to jump on the bibble, why we not throwing the bibble at our funicating and adultering leaders, so as long as in penis and vagina then its fine but when it penis and bottom it not fine. WE to damn hypocrite, i remember clearer the PM was interviewd on this issue and he said and i quote ” I run this country on a moral ground” that was a big joke to me, but it also brought tears to my eyes.     I would like to submit to the general public a memo from the word of God which signified that from the begining of mankind, Jehovah God gave man the liberty to choose. Nonetheless he said if you do contrary to what i told you to do, there will be a penalty.
    Therefore, whoever wishes to express that these are consenting adults, this does not make it right. We asked that the moral thing be done, may I ask, by whose standard is your moral measured?       If I choose to be an atheist do you think that I should be subjected to the biblical teachings? I think that the laws of a country should be based on what is wrong and right for the society (who is a victim of someones actions) and not on peoples interpretation of the bible.
      The Holy Bible has some valuable teachings, with the ten commandments being an essential part of it, does that mean that people should be imprisoned for adultery?

        Tell them, Tolerance. I think this wild emphasis on the bible will fade from Dominica and other islands, even Jamaica (which is the worst of them all), over the years to come, as more and more of our youth go abroad and see and learn more about the world and universe at large. But for now, we just have to remain strong and to avoid at all costs reacting with the kind of fury and even violence that some of the fundamentalists do. We must be the models of civilized and moral behavior, and it is only by being as such that we can hope to show that nonbelief or questioning beliefs is not a bad thing.

    I do agree that it is almost impossible to have hard evidence of such an act as one cannot indiscriminately enter another’s home under the premise of investigating such an act. But what would you say to the man who is beating his wife, or a mother who is abusing her child, or an individual who chooses to sleep with a child or animal? Just because it happens in the privacy of one’s own home does not make it right, nor does it exempt the government, whose function is to protect the rights and life of the citizens, from its responsibility to the public. I applaud Brian Alleyne for his courage in voicing his opinion so frankly, but I believe it is the cowards way out. You are taking the easy way out when you say, let everyone do as he/she pleases and he/she will answer to God. God gave us the ability to judge right from wrong and to act in a manner keeping to this. If we do not fight for our society if we do not fight for what is right we are not doing anyone a favour. I agree it is the individual’s choice to do with his/her body what he/she wills, but it does not mean that the society has to become so ambiguous that any criminal may claim shelter under our country’s laws.

    I agree – many Dominican laws are outdated and prohibitive.

    It’s just a shame that there isn’t a homosexual who is willing to stand up and bring a human rights challenge against the law.

    The Constitution includes provisions against racial, sexual, and religious discrimination…and we all know that its discrimination based on sexual orientation/sexuality.

    If it’s behind doors – then it’s their business what they do in public…but as always, these met veye “Domnichen” like to mind people business and throw stones, when their backyards need to be cleaned up.

    Leave the homosexuals be – they are answerable only to GOD – not to you not to me. Just as the adulters, fornicators and the likes are anserable to God, and not YOU…so to should be the gay man/woman

    You know society in trouble when you cannot even depend on learnt men for moral leadership.

    So in Brian’s legal opinion there is nothing wrong with incest between consenting adults in the privacy of their bedroom?

    I just watch these guys with pure amazement you know man because these are the same people that would be first to cast up their nose and condemn if they were to encounter some adult guy having consentual sex with his mother.

    One would think that guys like these that have been married for such a long time and have a succesful marriage would be the first to defend the sanctity of marriage and encourage the youngsters to follow their example. But you never know man…you just never know.

    It is because of this law that some men have gone on to mary women and successfully have children and raise their wonderful families that have contributed so much to Dominica.

    Homosexuality is tabou in our society and should remain so, not adopting laws of other societies that have cost them so much; are now suffering with rampant desease because they relaxed those laws.

      That is a good message. But it is only by the wisdom of faith, that man can nurture the words of those verses above, spoken by the apostle Paul, in their minds, and to realize that the power of sin is in the flesh–no matter what is the form of sin.

      Why? Because God, a Supreme Being of Holiness and Truth is of Spirit–Life in Love–not of flesh and blood. And so, He cannot tolerate the filthy and dead production of fleshly control.

      In Adam and Eve, man’s flesh was first, pure and clean–mesmirized in Truth, giving them complete freedom to exist with Life–dressed in the clothing of Spiritual Light.

      But Adam and Eve fell into the state of sinfulness and death, when they allowed the deception that changed God’s Truth into a lie. Romans 1: 25

      They brought us, their offspring, into this world with that same sinful and death condition.

      If only we, as human beings, would understand that we commit sin, not because we want to do so, but because God has separated His strength of Love–the clean and pure control of Life from our minds.

      That is the reason we continue to accept the lie that forces us to believe we will not survive, if we rebuke or disobey the sinful thoughts or ideas, disallowing their process and product in our mind, because of its carnal state, weakness or death condition.

      It is only when we have acknowledge that truth in us, and to allow God’s blood through His Person flesh and bones–Jesus Christ to redeem us from our sinful nature–the hunger, desire, or wants of the flesh, that we will come to know deliverance.

      For that is the way by which we can become dead to sin, and alive to our Holy God and His ways of Love, through our sincere faith and trust in His ability of mercy and compassion, because God is Love.

      Otherwise, we simply continue to be of no difference in the fleah. Whether our sin is adultery, fornication, infedelity, homosexuality, rape, murder, theft, lying cheating, coveting, idolatry, hate, and so on, all is the functions of unrighteousness before God, and He must execute His wrath of Holiness–not of His Love–against those attitude and conducts of flesh and blood.

      We are all accountable to God alone, not man. The thing that creates the controversy is that, homosexuals choose their lifestyles, just as the rest of us choose to commit our own sins.

      Why then do they demand that everyone else get involved in their personal learned or practiced lifestyle–even wanting us to accept them as we do with couples of male and female?

      That demand is not fair to society, who is always the majority–and especially in a Christian society like Dominica.

    I don’t know what these people want. Whoever is gay can be gay , that is fine with me. But the culture of Dominica, as most gay people know, is that homosexuality is not really appreciated by the majority. Skerrit and any other political leader knows it would be political suicide to even consider anything else. Dominica is a Christian country, very christian. Unless that changes, and our moral values change (the majority) then homosexuality will be a no no. Just stating fact, so to the gays out there, it’s not aimed in your direction.

Your children will come home and say mum, dad this is my boyfriend or this is my girlfriend and they will be of the same sex and I tell you there will be laws against “discrimination.”

    Gays will come here and hold workshops to “sensitize” people towards homosexuals. What a world we live in…well we have to adjust and survive through the times.

    As a muslim, my duty and responsibility is to those who are placed under my care, my children. If they choose that lifestyle, that is between they and Allah. The people of Dominica want sodom and Gomorrah lifestyle, let them have it, who doesn’t hear will feel.

      I join with Portsmouth and the others to rebuke this prophecy for our Dominica, coming from your mind, now written by your authority of words.

      The question is: who put this prophecy in your mind, and why did you obey, even to speak the idea. Is that what you truly want for our Dominica and her people. Don’t you know that God destroyed Sodom and Gomoriah because of this same abomination among the people there?

      We do not need the Bible to tell us that the conducts of homosexuality is immoral, unclean, and unhealthy for those involved. It is not about the persons themselves, it is about their sinful conducts–an abomination before a God of Holiness and Truth–our Sumpreme creator and Sustainer.

      If we believe in a Holy God, we should know that the conduct is an unsacred sight before Him. Why do you believe God would allow such fleshly and sinful conduct to overwhelm the minds of the people of our homeland?

      By our faith in God, and through our spoken word of hope, we will have victory. Why do you call for defeat. Do you not know that words are the most “powerful authority” in our matters and functions as we exist in this world?

      That is why there are people like Portsmouth, the others, and myself. Our word of rebuke, in the name of Jesus Christ, against yours is the reason your prophecy will not prevail.

      And now I add: “So let it be done, that the writing of this prophecy might vanish into space, by the will of God’s Holy Spirit” in the name of Jesus Christ.

      For that prophecy is not of our God of Love–full of mercy and compassion–who gave us our Dominica, a blessed gift of landscape, waters, and the natural beauty of plants and animals.

      If only the people of Dominica would continue in reverend fear of Him, and to give Him the glory!
