Stand Up For Tiyani!

Dear Editor: It is often said justice delayed justice denied, but justice interfered brings shame on a nation.

Many Dominicans will agree with me that magistrate Tiyani Behanzin has reduced the growing crime rate in Dominica. So Why are some so furious over his actions? Are they afraid to be exposed? Inquiry or no inquiry Tiyani will dispense justice and expose those who areguilty of wrong doing.

Magistrates don’t enact laws but only implement them according to their merits: remember the 80’s -90’s when follow curbed the violence that was taking root in our communities, was there any inquiry? Was the Judicial and Legal Services Commission involved? The drug epidemic has derailed every fabric of society which needs curbing and Tiyani is doing just what is needed and he is within the law. Rosie Douglas his late father feared no foe and even went to prison for what he believed was justice and came out victorious, so will Tiyani after the so-called inquiry.

We cannot allow this unscrupulous behaviour to continue in the house of justice only by a few for personal gains.

Mexico is an example to pounder on; do we want to emulate their actions where our children will adopt these evils? Tiyani has stood his ground and has the backing of every law abiding citizen of the Commonwealth of Dominica. We must remind those who are bent on destroying the good name of this simple young man, will one day, answer questions and the nation will be surprised. “Stand up for justice, stand up for Tiyani”!

a former police officer

WHY ARE WE DOMINICANS TRYING TO PIN DOWN THE ONES THAT ARE DOING BETTER IN THIS COUNTRY

    JAH BLESS THE P.M

I fully back Tiyani. Finally someone implements the law of this country in a manner that can only benefit all law obeying citizens of Dominica in the long run. Of course criminals and people with something to hide do not like him.
Keep on fighting and let us support this man!

Tiyani you have my full support keep doing your job and for those other so call magistrates and lawyers you should be ashamed of yourselves for not wanting the system clean up instead you give meaningless rulings and what happens the criminals laugh in your faces so many bad lawyers and magistrates that just dont want to do the work and all they do is complain to those I say let it go and learn from someone who care about the Island and it’s community stop being a bunch of windbags.

Go Tiyani we are behind you …

  7. I WILL BE IN THE PROTEST TO SUPPORT TIYANI. HE IS CLEANING TOWN. TOO MANY OF OUR YOUNG DOMINICANS ARE OUT THERE GOING MAD ,DUE TO DRUGS SOLD TO THEM BY ADULTS WHO ARE ABOVE THE LAW.
TOO MANY PEOPLE ARE COMMITTING HEINOUS CRIMES IN OUR SOCIETY AND ARE WALKING AWAY FRRE OF CHARGE.
I CONDEM ALL CRIMINAL ACTS AGAINST CHILDREN ,ESPECIALLY SEXUAL ABUSE.

GO TIYANI GET THEM! CLEAN UP OUR TOWN. I LOVE YOUR COURAGEOUS STYLE. YOU DID NOT MAKE THE LAW. THE LAWYERS MADE THE LAWS. YOU ARE JUST ENFORCING THEM TO THE FULLEST.

GIVE US BACK OUR CLEAN AND VIOLENT FREE ENVIRONMENT TO ENJOY AND ROAM FREE.

TIYANI’S COLLEAUGES MUST LEAVE TIYANI ALONE AND ALLOW THE YOUNG MAN TO WORK FREE OF HARASSEMENT. FOLLOW HIS EXAMPLES INSTEAD!

Sounds like you people [such as Mr. If Only You New] who are ‘fed up’ with Mr. Behanzin, junior or otherwise, need to pull up your trousers or perhaps go back to school and get better training so that you can be of more benefit to the challenges and requirement of the 21st century Law. All backward thinking Dominicans need to educate themselves and help move this Island forward instead shuffling from day to day as if from another planet and engaging in fantasies by trying to play armchair politics and spouting utter ignorance.

All those so called lawyers/magistrates that are up in arms because of the shock of seeing the future need to piss or get off the pot. The forward hardworking and law abiding citizens of Dominica don’t want you trying to drag us into the dark ages, lawlessness or out and out anarchy. And all you that are in league with criminal elements that crawl around the underbelly of the beautiful island should pack your things and go somewhere else and see how far you would succeed! This place has been for too long seen as a soft touch. If they had one ounce of intelligence they would try and engage more with those misguided elements that come before them and try and impart better wisdom and a vision of the future.

All of you who are not up to the rigours and standards of your betters (Mr Behanzin is your better why else are you all scheming!) should drop your ignorance, egos and insecurities and learn from him for the sake of the citizens of Dominica whose interests you are supposed to hold paramount before personal pride etc. Stop being so blind by your own backward notions and see that the people of Dominica don’t want to be taken down the path of Kingstown Jamaica or any such place. You would make a better name for yourselves and gain equal recognition if you too showed that that kind of sh*t will not go down in Dominica.

Tiyani seems to have forgotten that he is also a lawyer….When a man’s conversations are flooded with me, I and myself and when he will do anything to get attention, including misrepresent the truth and villify his co-workers and supervisors, I cannot support someone like that. Can someone tell me what the crime rate was before Tiyani came and what it is now. Also might there be other factors which could have influenced this change if any. Like Tiyani says, I am interested in facts and figures not propaganda and hearsay.

Also can he tell me how many of his matters that are currently on appeal and what the average for previous magistrates is. How many of his cases has he actually written proper notes for. His primary interest seems to be putting on a big show for the public and the press.

How well is he doing as a manager? He is focusing on lawyers because it is easy to criticise them, but co-workers and junior staff are fed up.

If I were the people working with this guy, I would not even bother with him. Let him continue to speak about himself and everything that went on in Court on every street corner and occasion he gets. Most people who actually have a conversation with him get irritated by the third sentence.

      March 28, 2010

Really??? I had a conversation with him and that was not so. Is it that we have our own biases or we want TRUTH?

Personally ,I believe Tiyani should just walk away and leave DA in it’s soup, that’s what we would like happen isn’t it? Well he ain’t moving and some of us just can’t understand that.

What has he done SOOOOO wrong that sides have been taken against him.Come with something valid, not that ego thing again, not that accent thing again, not that he think he all that again.Tell the D/can people something of substance. But no ,as always some think they better than some,we have our passe,we live uptown and they live downtown,we have name they have no name etc etc.

Well let me inform you all ,that s***you all coming with hold no water,D/cans are not (donkeys). We want truth and we want it with no bias.Stop treating folk like shit and expect anything better in return.

Don’t it bother you all that young D/cans grow up dreaming of nothing more than leaving the island and coming back only to breathe clean air once in a while?Don’t it bother you all that for the longest the country is known as the least developed, the under paid and the ignorant (exibiting unlearnt behavior) Don’t it bother you all that right in the OECS before CSME your country men and women held positions of high esteem in other countries and refuse to come home.

Why don’t we come up with a strategic national plan to make gold out of the ore we have lying around the island. Why do we just fight down one another . Everyone that can leave just leaves and the country have brain drain after brain drain and nobody cares.

We say we have a Ton of education but commonsense in most case is missing. Some can’t even write a good paragraph. They all claim to have book sense.,yet they say Tiyani can’t write notes.Let’s shed the chain, slave master condition and mentality.

So if you all won’t do the right thing maybe then we will do it.We will get Tiyani’s school documents from what law school he went and we will get the others from Trinidad,Cave Hill etc and we will compare whether Tiyani is a trained Barrister or not.We want to know the grades, class participation, etc. Then we will let you all crucify him if he is wrong and not trained.,other than that HELL TO THE FREAKING NO.

The AG in DA don’t know orange from yellow in Law. (I wanted to say she don’t know her *** from her *** in law) Sorry DNO but I have to be honest here. Secondly, Dominicans advocate for things when they have no good knowledge of how things should work especially in the crimina justice system. I will not encourage non of my friends to stand up for this so called magistrate. He has a nasty ego and attitude and this won’t take him far. People like that usually sabotage their ownselves eventually.

  13. Dr. Finger
    March 27, 2010

    Deborah,
Its not Tiyani’s job to reinvent the criminal justice system in Dominica. The magistracy is not responsible for rehabilitation of criminals and therefore when he send them to prison without specifying treatment this means that he is aware that such treatment is non existent in Dominica. If you feel so strongly that upon release they will continue to break the law because no rehabilitation was given, then talk to the AG because she is the head of the criminal justice system in D/ca. There is much to be desired from the system of corrections but unfortunately that is not part of the magistracy. Thats why I say, “Tianyi for AG”.

My advice! We need at least 500 people to go out there in support of this magistrate. Its no way they can locke everyone up; Justice must prevail in this country and if he is the man to see that happen then we need everyone to demonstrate on his behalf or have a petition or something.

I am very saddend that the inJustice system in Dominica is trying to muzzle the Ox that treadeth out the corn. Those who are trying to muzzle the Magistrate should be ashame of themselves.,and they probably have their own mischievous agenda for doing this. The Magistrate does not profit from the mischief that is going on in Da, the Muzzlers are the ones that do.Dominica was one of the most usnpoiled nation on earth now not any more ,it is quickly being ravage by modern day “Vile vultures” I live in one of the biggest cities in Modern day Babylon, and at present Dominica has more homicide annually than this city. It is very sad and shameful that while most Dominicans love Dominica and wanst to see her persevere, a remnant including those Muzzlers who want to Muzzle the Magistrate take pleasure in trying to bring down this beautiful nation. The magistrate is a great man and loves children , the youths of this country and lovely Dominica, even the good book says,” Be not weary of the punishment ot Yashua, for Yashua chastizeth those he loves. The Magisttate loves this beautiful country and is trying his best to protect Dominica and it’s citizens from from these Vile Vultures. .Leave the magistrate alone , let him do his work. Dominica never had any thing like him in the past.. My word to the muzzlers is, “He who incites others to war, is worse than he who fights” Let the Muzzlers bring what they have to the table to make Dominica a better nation. Muzlers, where is your shame, have you any left? Let the magistrate do his job and help him to make Dominica a better and safer place, “God save the Commonwealth of Dominica”.

it is a shame that dominica has gone down this road. some might say dominicans abroad have no right to give their opinion but those are the same people that ask “why not come back to dominica and improve the country.” with all the lawlessness that is going on what would make any true dominican want to come back? here it is that we finally have a human being with a moral compass who does not play favourites in dispensing justice according to the laws that were written many years ago and he is being critisized for following the law. this is disgracefull to the fullest. everytime i read about these court cases, it is so ridiculous. i know that the individual as a defendant has to be defended by his lawyer but for God sake, if you know you are guilty you cannot make excuses saying that you didn’t know what you were doing or asking for a slap on the wrist. what is wrong with you all????? the laws actually are in dire need of being rewritten to reflect the times that we live in and the crimes being committed. defendents found guilty need to be given the maximum sentence and not just 2-3 years out of a 25 year maximum sentence for example. murderers going free, rapist going free, child molesters going free, drug dealers going free. is this really what dominica has come to?? how can there not be an official recording of cases being called?? how can the prosecution and the defense cross examine or recall witnesses to the stand if the previous session was not documented properly??? the judicial system in dominica is beyond mediocre. granted it is not all on the judge either, the police force lacks so much valuable tools for the job. apparently they do not have the proper systems to collect, record and process evidence. they need proper training, fingerprinting systems, rape kits, evidence kits and the list goes on and on. witnesses are just that a witness. that information is for the prosecution, defense and the court. everyone and their mamma isn’t supposed to know all the ins and outs. that’s how cases get derailed and dismissed. as much as there are other areas in dominica that need to be improved the justice system should be on the top of the list, instead it seems that those in the position to make such improvements choose personal gain over the very ethics they were trained to uphold.

Could not be better said Former Police Officer. As a portsmouth resident, I have had the opportunity to sit at the low court in Portsmouth, and whereas I can admit my knowledge of the laws and the Juridicial systems in this Country is limited, I have seen this Horable man, Tiyani presides over Court proceedings and I think he interpretes the law correctly and his judgements are in keeping with those laws.
I firmyl believe the opposition this young man is receiving are not different from those of Jesus Christ. He came doing good, healing all manner of sicknesses and diseases, and the fellowmen in his days still rated him as one loving food and they sought for his life.
This is basically a matter of Intimidation, thats how his colleagues feel and they are trying to muzzle the voice of a young aspiring Magistrate.

Time and time again, I have heard this honorable young man asking for an Investigastion into the matter that left a young man from Bense/ Calibishe dead in Execution style, and todate nothing has not been done or heard, but here it is a young man with all his energy and passion came over to Dominica and serving his people with a passion that is unprecedented in the juridicial system, and he is labelled in all different ways.

The man has personality traits which will differ from everyone else, and his style will be different from his colleagues but at the end of the exercise, justice is served.

We must be careful that him we will leave unroasted, no law or system will catch him for us. Our prison is over-crowded but we must not make the mistake of allowing everyone to go free because of light sentences, and later we can’t control the lawlessness that will characterize our boys and girls.

We must go back to scriptures, the word of God admonishes us that the law is for the lawless, those who enact the law are only terrors to those that break the law. Read Roman 13. I encourage Tiyani to stand strong, because his rewards are not in man’s hands, but in the hands of the most high.

ummm …excuse me you have already contradicted yourself in the above paragraph. How can your knowledge of DA law be limited and you can say you think he interpretes the law correctly..? lol seriously. You are in no position to give support for how he interpretes the law because as you said your knowledge is very limited.

So because he sending people to jail he is a good magistrate? I hate to be the one to tell you Dominicans that Judges and magistrates their goals shouldn’t be to send people to jail. Their goal as was explained by one of the best judges in the US is to carry out appropriate sentencing taking into account the motives for the crimes and other special circumstances.

This man is not guilty of any wrong doings? So to the chief Magistrate are you telling me when a magistrate fights had to restore law and order in a country this is a crime??

What does the chief Magistrate and her collegues have to hide? What are they afraid of ?? As a Dominican Youth I strongly believe that the table should turn and the enquiry should be for the chief Magistrate and her rallied gang.

Since this Magistrate has come into the legal picture alot has changed; youths who are always in problem with the law etc are trying to change so that they wont have to come before Tiyani, doesnt that say something for him. When people have to appear in court they are pleading with their lawyers for Tiyani not to be the magistrate to deal with their issue doesnt that say something positive for him?

Out of the all the magistrate thats around he is the one who is always on time and ensures that the cases before him are heard for the day? doesnt that say something positive ; it eases up the back logg of unheard cases we have in this country

Is it that the chief magistrate afraid that Tiyani gets her position. are her collegues afraid that their hidden Secrets be exposed. Take a page from his book; Come to court on time 9:00. and do a fair days work for a fair days pay.

The chief Magistrate should have an inquiry to set up some form of probation and remediation to help redeem ad rehabillatite the youths back into society and let incaseration be the last resort . The Magistrate has no choice when Dominica’s only form of punishment tfor mischief is Incaseration. When the Justice system only has incaseration in place that is what is ordered What you see is what you get.. Do somthing to prevent recidivism and fix the Dominica justice system that is impregnated with lot’s of faults’
