UPDATE: Owner of cow in deadly crash not yet located; faces legal action

Police have not located the owner of a cow involved in the accident that claimed the life of David Joseph of Portsmouth.

But legal action may be taken against the owner as he would be committing an offense by having his animal wander away, said Police Public Relations Officer Kenth Matthew on Tuesday.

“Such an owner is likely to suffer from a civil action against him, for the death of this man, being caused by his animal straying on the public road,” he pointed out.

Joseph, 23, collided with the cow at around 6:45 p.m. Monday night while riding the motorcycle of his employer, Kentucky Fry Chicken (KFC), on the Portsmouth public road, police reported.

Joseph was pronounced dead at the Portsmouth Hospital.

The incident brings the total number of fatal road accidents for 2011 to 9, according to police.

Meantime Management of Fine Foods Inc, operators of KFC, has sent out a condolence message to Joseph’s family.

Loose livestock has been an issue of concern to motorists traversing that area of the north of the island as well as to residents in the vicinity of Portsmouth and One Mile area.

    I was once prosecuted and was facing serious jail time for shooting a cow which had strayed unto my vegetable farm.As long as such antiquated laws which forbid the killing of stray animals these things will always occur.An animal without a rope or chain around it’s neck is a wild animal and should not be under the protection of such an antiquated laws Stray cows are allowed to road the air stips without the owners being brought to task.Cant our law makers see that such antiquated laws should be repealed

    You know what alot of people may dislike my statement but I do not care……I think we need to start shooting some of these animals and donate the meat to the homeless homes and hospitals etc….and you will see how fast thier owners will show up and tie them…….

      Now the Police want to talk about owner of animal. This is the norm in Dominica especially in the Point Round to Picard area, you driving day and night and cows, pigs, goats any animal that should be thethered are loose on the road. Someone had to die for the lazy police to say something. My God do not wait till it happens. Be proactive, a young man 23 years of age trying to make a living and he is gone. We see these animals on the road all the time we do abosolutely nothing. Many motorists have had to meet their expenses, I am a victim because of a blasted loose animal just running across the road and no owner for compensation. Who say that the owner will come forward and it will just be a case of a loved one lost in vain. Alas Dominica!!! Am I Dominica? No not at this time. Right away we want to attack Nassief who is providing the employment. We have our part to play in enforcing the laws. Step up Dominica.

        I have said it time and time again. The police officers in Dominica do not seem to be doing their jobs, well not as well or as publicly as the others in the region at least. I am sure many officers are and were aware of the issue but did nothing about it ,d guess what will still not be seen doing anything about it. OH how at times I wish I was commissioner. Isn’t the prime minister minister for security? Thank God Dominica peaceful because the absence of uniformed officers on the streets would just make the place a haven for criminals.       It could happen to anyone, the cow may have just ran onto the road and he was not expecting that. My friend I have seen this happen in seconds and because its a vehicle no one got severly injured but the vehicle got damaged extensively because the driver sometimes hit the animal or swirved and crashed. Until it happens to you, you will never understand. Pray that it doesn’t.

      Consider if you were driving and all of a sudden you see an animal in front of your vehicle. Do you think you would have been able to stop? The animal could have charged at the vehicle. Think also of putting on your brakes and then you may not be able to do so and run into the car. The cow could have been in front of the vehicle and he had no time to veer off the road.
      The be all and end all of it all is that a young man lost his life, 24 years of age who was working hard to earn a decent living for decent-legal pay and looking forward to his future life. This is so sad.
      A cow is a huge animal. Consider its weight. It should not have been on the road or anywhere near a vehicle. OK!

I personally used to do sales back in the day in D/ca and I almost hit a cow while passing through Possie. Thanks to God I geared down to 1st gear and the bus literally nosed dived and everything came to the front of the bus.     hey American are you saying that if a vehicle came out of an unseen/hidden driveway into the road and collides with an oncoming vehicle …the oncoming vehicle is wrong…..i find that hard to believe…i know that anytime one crashes into someone from behind the rear driver is always wrong… but this is a different case in that you may have no time to react…..in most other circumstances you should be driving defensively so that you have time to react for the unexpected….. and as for livestock roaming freely in America where people are lawsuit crazy… i find it hard to believe that the owner of a livestock who was involved in an accident will go scotch free..

      I live in America and it is absolutely true that some animals do roam the streets and collide with vehicles at times resulting in fatality. There is really no recourse except that the vehicle owners insurance company has to repair the damage as well as the hospital bills. If I could attach a photo to this comment I would show you my personal vehicle after colliding with a deer at about 35mph at 7:00 am. The deer was killed and the vehicle had to be towed to the shop so it happens a lot during mating season (which by the way is now). However, no one owns the deers. I do believe that the owners of these cows should be held responsible or the cows should be shot on sight. THAT WOULD SOLVE THE PROBLEM. My sympathies to the family of David and my advice to my people is to work together to come to a prompt and sensible resolution to that problem.

    My condolences goes to the family of the victime .I almost got killed by a wild pig coming home one day, after an all nite shift. the pig was huge, came out of no where and stared to cross the street by the time i apply my brakes it ws to late. the damage cost on the care was over three grand,. the psychological damage is everlasting.may this man r.i.p.

    My family and send our condolences to the family.

    However, I come from the United States, and free range cattle are very common in most of the states West of the Mississippi River. Do not blame the cow for this accident, or the owner of the cow. We are taught in the states that automobile accidents are the sole responsibility of the driver(s). I am not blaming this young man, but to kill a cow with a motorcycle suggests this young man was traveling at a very high rate of speed. Most deer in the United States can survive an accident with a motorcycle, and deer are typically 1/10th the size of a cow.

    As someone who has driven hundreds of thousands of miles, I must say that a large number of drivers on this island do not commute in a safe manner. The new roadway has caused people to drive even more recklessly. I travel this particular route daily, and I have often seen vehicles traveling in excess of 100 km on this strip of pavement. Even with a center line, ~50% of the motorists are traveling at too fast a speed to stay on the correct side of the road.

    Let this man’s death not be in vane; everyone please slow down and drive your vehicle in a safe manner.

      While I understand your reasoning, you are not aware of that particular situation whereby as you approach the brow of a hill you are confronted with at least on dozen cows lying in the middle of the road. To make matters worst, a number of the cows are black and these roads are seldom lit, so in a case like that it really doesn’t matter how fast you are driving, the real danger of colliding with one of these animals is ever so present and most drivers avoid an accident due to mere luck than any other thing.

      The American West has vast open plains where it’s a little easier to see a cow in the road than on a curvy mountain slope. And it’s pretty clear when you’re in grazing land; you won’t find free range cows in downtown Austin, Texas. There just isn’t enough open space in Dominica to let cows run free safely, and the Portsmouth-Picard is too densely populated and heavily trafficked.

        You are correct because you really cannot compare America to Dominica where the infrastructure is so different, the roads are narrow, not well lit, and Dominicans simply cannot afford to share the one ways in and out of their villages with cows. If the owners do not have accommodations for their cattle, do not own them. What…are the cows supposed to be grazing on pitch?

      I am surprised to read your comments. If the cow came out from nowhere and was either on the road or plowed unto the road in front of the vehicle, even to its side, an accident is sure to ensue.
      Put the blame where it belongs, on the owner.
      If stray animals are allowed to roam the roads in Mississippi(there are too many s’s and p’s in that name :) ) then the government is extremely lax to allow it. There is no excuse for this. Should I state that the people are primitive for a U.S. State to allow their animals on the road?
      It will not happen in Canada. As an example, the Law is, dogs have to be on a leash with their owners when they are out in public. As for cows and the likes of such edible animals, they are on a farm and fenced-in and properly secluded from the public which is where they belong.

    People came in the night and took all the meat from the cow. They left the bowels in the bush on the side of the road and this afternoon Town Council personel had to put a big tyre on it and burn it to stop the smelling.

    So there is no cow anymore.And no one owning up to owning the cow. So there it sits.

    I do not know the young man or his family but I am saddened at the loss of his life and for his family who are grieving his loss.
    He was going about his employer’s and himself business and he died in such a manner. This is one death which could have been avoided but for the cow which strayed in the path of his vehicle.
    I thought that the family should sue the owner of the cow for allowing it to stray and in the path of a vehicle which led to his death. I hope that they will get some help from his employer.
    It is strange that the owner has not yet been found. In Dominica? As read on this Website, there is speculation whom the owner is. Surely he is in DA. When found, I expect that he will be arrested. Charges will be laid and he will have to appear in Court to answer to them.
    I do think it is sheer negligence that a cow, a huge animal was not tethered. The owner probably allowed it to graze. Nevertheless, it should have been tethered and kept out of the way of people and vehicles. It may be too that the animal became loose. This could be a probability. One collision with people could cause serious injuries or deaths.
    Owner, be honest. Face the facts of what occurred and please give yourself up. I am certain you will be relieved when you do.
    I wish the young man’s soul God’s peace. R.I.P.
    I wish his family God’s strength during their time of mourning.

      There is not one person on this Website, at least, the comments which I read who stated that KFC should be held responsible. It is ludicrist to make such a statement. However, he was performing KFC’s business. He died on the job. In any case, until the owner comes forth and a case is heard, none of us can make a fair judgment on that.
      Reputable employers will be compassionate and financially assist the family be it with funeral arrangements. KFC has been around for a long time, although not so long in DA. Nevertheless, in the interest of public relations and that an employee lost his life delivering its chicken and fries, etc., I do think that KFC should assist be it with a minimal amount.
      To begin with how much was the young man earning? He is not a rich person and his family would need financial help to bury him in this day and age. I guess he is already buried.
      It is not like in former years when DA did not have a funeral parlour. The cost of this today is exorbitant with those who own it making a mint on the departed and their family.
      Permit me to further inform you. Sometime ago I was at a social function. During a conversation with a fellow Dominican, he told me when he dies he wants to be buried the same day. Figure it out. The cost and no fuss!

    I sympatize with the family of the young man.I am victim of 2 accidents involving cows.I am happy to be alive after a cow ran across the road and damaged the windscreen and front of my car.I arranged and took the cow to my community while I negotiated with the owner.My lawyer advised me to return the cow to the owner ASAP and accept whatever is was willing to pay since all he had to tell me was sorry.I would have to prove to the court that the same cow was involved in accidents before.If the cow was tied less than 16 ft from the road the owner might be charged for nuisance.It appairs that animals have more rights than man

    May the government and police find the owner or owners of that cow,whoever,and handle the situation with no bias.
    Finally there should be strict laws to prevent such accidents from happening….getting reed of all the stray animals not only cows but the goats and especially dogs..I was disgust too see so many stray dogs roaming the streets. That’s a health hazard and accident waiting to happen. Something needs to done!

    As someone who lives in Portsmouth,i have named the picard to point round area “THE COW ZONE”Because countless time cow strolling across the road and you have to Jam Brakes!!!!!

    I remembered i was heading to roseau last year,when i arrived Point round area down the stretch in the night,i just see a Big Black Cow appeared about 10 feet infront the Vehicle.I had to Chebeh Brakes so fast…….

    About Five years ago,a Van colided with a Cow.All the man van front Mashup and the cow bottom was bleeding severly.I don’t know what was the out com of this matter,but people was saying that they may have to kill the cow and sell the meat before it bleed to death.

    Instead of just condolences, shouldn’t the family be compensated by KFC for their loss as this was an “on-the-job” accident? KFC is an international business and they should have insurance coverage for that.

        You are correct, KFC is not responsible for his death, but all I am saying is that it was an “on the job” injury and all international companies have some form of compensation for such loss. Especially KFC.

        If it were the UPS or FedEx delivery person who died while delivering packages, his family would be compensated very well, even if the accident happened in Dominica.

        It is not a matter of who is at fault or who is liable. The cow’s owner if found should be held responsible and punished according to law.

        Nonetheless, Mr Joseph was killed while carrying out his duties as a delivery person for KFC and therefore, KFC should (and does) have insurance coverage for employees who are injured whilst carrying out their duties.

        Regardless of how long he had been employed there, it is not an issue for KFC only but their insurance carrier.

        It is not easy to obtain a KFC franchise. Corporate stipulates every detail on how you run the business and they provide resources such as product, advertising, inspections, insurance etc.

    Whether or not he was wearing adequate protection, his family is due significant compensation from KFC since he perished whilst in their service. If KFC does not have proper insurance coverage or he was not properly geared up, then they should be sued, unless they agree to do the right thing.
    Action against the cow’s owner must be taken and laws dealing with stray animals enforced, to avoid recurrence of this unfortunate accident.

    I shudder to think what would happen to Dominica in a “class action suit” if this was an American who died that way. Not that an American life is more important than a Dominican, but the authorities would then feel the need to strengthen the relevant laws in this regard and thus make the road safe for all. Not too long ago the Hon. Minister of agriculture issued a stern warning to cattle owners form that particular area. He knew whathe was saying. But as usual the government detractors made mince meat out of that clarion call.

    This was a working young man engaged at the time in earning a livelihood for himself. We sympathy with his family. Mat his soul rest in peace. Youg people it is nit too early to give your life to God. You never know when the time will come.

        I sympathize with the family of the young man; this very sad. However, we must stop blaming the animal. We must also stop with the threats to kill/poison the animals. Be careful there. Yes, it is a crime. So please stay away from killing in any form. What you think is your right may just become your wrong. I know it is hard to accept now.

        The owner is responsible for keeping his animal safely tied. Occasionally animals may get away, but it should not be the norm. Too many Dominicans have animals running about the place, so the laws need to be stronger and enforced. Animals have rights too, whether some people accept it and we are a civilized society. Sometimes the animals are in the sun for hours with no grass and no water. Would you not move to another location? Again the owner is to blame.

        I am sorry, but I tend to see the point of those who think he may have been driving a bit fast. It’s a pity the authorities cannot confirm the details. It is not easy to kill a cow with a bike. The cow could have been a child or a person walking. Tha woul dhave been worse. Perhaps we need a few cameras in certain locations. It also sounds like the road needs better lighting. That may have helped the young man to see better and he might still be alive. There are several issues here.
        We must also be sensitive when posting comments, even when upset. We must learn to disagree without being disagreeable. Peace to all.

    In the cowboy western days, cattle owners use to brand their cattle with names of their ranches so as to identify them when stolen. Maybe then, this should be applied today so that when such accidents happen, the owner can be identified. This will also force owners to make sure their cattle or animals do not stray loosely.

That’s what needs to be done in Dominica – give all owners of cattle, goats, sheep – 30 days to comply, and after that, if any animal is found without a tag or an established brand, seize that animal – either sell it at public auction or kill it and give the meat to the hospital or senior citizen’s home, providing of course that the animal is healthy and free of disease.

    Trust me when the owner sees his animals coming back with slashes he must tie it…

    It seems that all cattle belonging to someone shoul be branded and tagged and that the tags should be regulated by government. This way, occurrences like this can be traced back to the owner. The goverment should form an agency that regulates the cattle and will fine cattle owners when the cattle is found outside of its territory. Then there should be a sub agency that rounds up stray cattle that does not belong to anyone. Then they should start a program with those cattle to feed the hungry. Its simple really. Dominica just needs to start taking action.

    Now, restitution. The owner of that cow should be made to forfeit a sizeable chunk of his/her assets as compensation to this man’s family – personally, I would seize all assets and hand it over.

    Then I would inform all owners of farm animals – restrain your animals or they will be shot. Simple. I’d have a couple police drive round the island focusing on known problem areas – if there are any unrestrained farm animals within 50 feet of public roads that are neither tied nor fenced in, first call the owner – if they cannot come to retrieve their animals within 30 minutes, shoot them dead. You will see how fast they will start building fences.

    Darn, this is so tragic. These stray cattle aren’t only in the Picard/TiBay/Point Round area…One Mile is their capital! A friend and I were coming from a show at Azille Valley about 2 months ago and I personally counted 13 of them camped in the entrance to the Agricultural Station…no rope, no harness, nuttin. And the sad thing about it is only when something irreversible occurs, that’s when the authorities wanna take action. David was such a cool little fella, always on the hustle. I pray that his family and friends find the strength to move on. :(

He was such a nice young man…How the hell can these people have dere cows loose on the streets so…there needs to be a law against that.     I was present back in August when the minister of Agriculture, Matthew Walter, gave a public warning to the cow owners in the Picard, Point Ronde and One Mile area about the way they were letting their cows loose and how dangerous it was to traffic.

    He said that if his department seized and impounded them, many people would say that government was unfair and unreasonable, so he was appealing to the cow owners to tie up their cows for the safety of all.But they took no notice.

    You see sometimes we have to be hard even if people crticise because it is for the good of all.

    This is an UNNECESSARY death. It has been more than a year since I called on the Parliamentary representative Ian Douglas, the departmrnt of Agriculture and the traffic section of the police to get these animals, off the road. nothing was done and this is the result. The family of the youth must sue the authorities for compensation of this loss of life.
    Moreover, if this is not resolved speedily, the next victim (god forbid) may be a student of the Ross University; WHAT WILL WE SAY THEN?

    Its amazing how u people on here speak in time of tradegy . Almost 80% of household in posie have stray dog(s) and maybe one day you all might be in the same position as the owners of the cattles.

    Everyone from Glanvillia knows who are the cattle owners and knows that there are always stray cattles in the vicinity of picard.
    My dad owns cattles some of which are loose, and a few other owners that i shall not call their names.
    However, my dad cattles always used to be tied up until he became unable to takecare of his cattles and has since “praise” those cattle on half share with a caretaker aka “spot” . I have had several running with MR. spot everytime i visit dominica just to have the cattles tied . Last year i made A visit to dominica to deal specifically with those cattles . I took my boys ( jeff , dock, dunga, jason etc) we went catch all them cattles got them tied. Mr.Spot knows he can’t handle them cattles so he went and loose the cattles (as someone told me they actually saw him ) ,just so he can trick the oldman by selling them one by one then saying some got lost and people stold them.

    My father has since took the matter to a lawyer , and the matter is to brought before the court.
    I am saying all this because i know that it could be one of my dads cattle. I have sent my friend jeff to check by the time he got there the cattle was gone .Only the belly was found in a waven nearby.
    Though i am not sure is my dads cattle i am feeling very sad of the situation.i have spoken to my father today and trust me he is not taking it lightly either.
    Please people , we have it as hard and his familly and i can assure that we ( at least my dad and I, can’t speak for other owners) will be fully co-operative with any investigation.
    Stop saying that the owners are hiding or the owners don’t care.like i said before everyone in glanvillia to petit bay ( teybay)knows who have cattle in the area.

    With respect to the yougman life i am very sad and sorry , no words that i used here will be able to express how i feel . To the family i’ll like to express my sympathy to you all and that i will do again in person shortly.

    i am very sorry for this family’s loss,i too had a bad experience with those cows that roam that area,i was driving down to portsmouth with a friend and i wasnt driving slow so you can imagine as soon as i was taking the bend before t bay baam a cow right infront of me i didnt panick i just swerve to the right and bam the biggest truck ever infront of me if i had panicked my friend and i would not had been alive today,luckily i swung back on the left very quickly,i was shaken up i complained to relevant authorites but i guess nothing was done.so sad eh.

    Another young man gone. Another senseless death. May his soul rest in peace and may his family and close associates be comforted in this time of grief.

    If memory serves me well, sometime ago a flight could not take off from Canefield Airport because of cows that were on the runway. Today, we are hearing that a cow has caused the death of a young man. I believe that it is time that the laws we have catching dust are implemented.

    It is high time that the police start charging people for tethering their animals near or on the Government road, this is an offence, charge them, get your butts of your chairs in the police station and go do some work, this is a problem all over the country, recently I was on my way to La-Plaine and all most hit a cow at Rosalie, the police need to charge them, use the laws of the land. Persons should not be allowed to have animals loose on their property if it is not fenced.

    This is sad sad sad, I don’t know this young boy personally but my heart aches for his family. Hold strong, God will see you through, I’ve been down that road, it is not an easy one to travel.

    If something like that happened in another country we would maybe see an attemp to amend old laws or implement new laws to ensure that something like that do not reoccur, I know this is not a normal thing for policy makers in Dominica to do but I really hope they make this one an exception. To tell you the truth, stray animals are serious problems on our roads, and I am saying that if you can’t keep your pet or animal in your surroundings, it makes no sense to have one. They say they adopting dog, cat, chickens and they got these damn things loose running all around the place, they say they raising cows, goats, they got them running on high ways. We need to be more responsible. I’ve had a few missed accidents because of cows and dogs on the roads, it is sad.

    Dominicans have no respect for the public roads, they park anyway on it, they walk any way on it, they use it as extensions to their yards, some people play sports on the roads, it is crazy, and we got to do everything in our power to ensure something as senseless as this does not repeat itself.

    I am really saddened by that news….

      ESCAPE????? Those things just loose on the roadside. Is not one cow is a whole set of them. We almost knocked a few just about half hour earlier on our way home so that none sense about judging farmer u talking about there nuh? The owner not no damn farmer he just raising those things to kill and sell for christmas and have them on the road creating hazard everyday.

    Boy I always know those cows would cause some major damage. From point round to Pichard they are always on the road with no ropes around their necks. They should get rid of those cows if the owner or owners don’t want them. Now a young man is dead because of some lack of judgement and a broken system. No animals should not be tied within 100 feet from the road. I am just sorry someone had to die for me to write that, but that’s life. We wait for something major to happen before we solve a problem. I really do hope by this weekend the Govenment put a law in place preventing people to have animals close to the road and ask people to call the police when they see these animals within 100 feet from the raod so they can be taken to one on=f the agricultual station.     I have personally called and spoken to the Portsmouth police about the damage and destruction by stray cattle on my property in Picard.

    They came and observed the destruction in progress and informed me that by law, all I can do is if I can catch them, harness them and keep them for a length of time. If no one claims them, I can dispose of them however I please.

    I was also informed by the police that I must provide the cows with food and water during the harnessed period or I could be charged with animal abuse.

    Unable to comply, I continue to chase the cows away, but they gradually destroy my garden.

Any media house would have mentioned the cow as being the cause of the accident. That being said, I extend condolences to the family and friends of this young man.     It is strange and what we may term as weird. I reside in a country where drivers collide with reindeers, bears, etc. Those animals run across the highways/roads in front of the drivers or are on the roads and the drivers could not avoid them. I heard of one (certain that there are more) a West Indian couple who got into such an accident. The man died. Therefore, it is not unusual for this to occur. Stray and wild animals do this all the time. Some find their way to the yards of residents in the City. As I always say, in this part of the world I reside in, there are so many stories of every sort.
    It is unfortunate that he died. My sincere sympathy to his family. I pray that God had mercy on his soul. Rest in peace!
    This prompts me to state that every second, in every part of the world people die. Note how some fellow DA’s have died this year in accidents and previously. Some are sick in the hospitals.
    There is a prayer as I recall from DA as a child, my Catholic upbringing which we are to say daily and as often during the day as we possibly could:
    Most Sacred Heart of Jesus, once in agony have pity on the dying. My Jesus mercy!
    Will you specifically fellow Catholics wherever you reside try to remember it and say it as often as you possibly could? God hears our prayers. He answers them too in His time. He will be pleased with our effort in assisting those souls who especially have no one to pray for them while they are dying and who die suddenly who may not have the time or remember to ask God for mercy and forgiveness.     People taking this for a friggin joke but if anyone of you drive through that area, your life is constantly at risk with these animals. Countless accidents, police can;t do squat, owners won’t take responsibility and now this. For my part all loose animals can die tonight! that is pure BS now man. RIP David :(

    It is ridiculous that in Portsmouth the second town of Dominica, the two main entrances into Portsmouth are the grazing grounds for cows.

    Cows lying on the roads, cows standing around blind corners, brow of hills and when these accidents occur, no one owns them.

    My heart and prayers go out to the family of the young man.

    if there are no owners to move them, i need to collect a few of these cows.

      Driving from portsmouth, these cows just appear out of the grass and decide to step onto the road. Is not today they asking people to tie up their animals away from the public road. I suspect peeps will start losing cow from by main road.
