Woman charged for causing Kirk Ian Didier’s death

Didier

Lisette Peter-Thomas of Shawford has been charged for causing the death of44-year-old Kirk Ian Didier by dangerous driving – an incident which occurred on January 5, 2011 at Silver Lake.

She appeared at a Roseau Magistrate’s court today.

Didier was allegedly struck by Peter-Thomas’ Nissan car at about 5 p.m. while walking on the road.  He reportedly sustained head injuries and was transported to the Princess Margaret Hospital but died about an hour and a half later.

The defendant was also stands charged for failing to stop when the accident which caused personal injury to Didier occurred. She faces an additional charge of driving without a valid driver’s license.

Peter-Thomas pleaded not guilty to the two latter charges but was not required to plea to the dangerous driving charge as it is indictable.

She was bailed in the sum of $20,000 with one surety with no bail conditions. She will reappear in court for trial and a preliminary inquiry on June 28, 2011.

Reports are that the driver of the vehicle did not stop immediately after hitting Didier, who was left bleeding profusely on the road for some time before the ambulance arrived.

I am following the blogs and from what I can gather there are no laws in place for that situation. In St. Maarten where I live you can hit someone and leave the scene and you have up untill 24 hours to give up yourself. Very rediculous law !!! (they claim that the person can leave the scene because of shock or afraid what will happen when the family find out) couple months ago a neighbour of mines knocked down a Haitian guy left him in the ditch overnight to die gave himself up to the police the next morning and he walked out of jail ater a few hours of questioning. So you guys are lucky that there are still laws in place to protect people when they get knocked down.

I am saddened to learn of the Drivers actions following the accident. The circumstances surrounding the accident will be tested in court. However to drive away? Wow. Who does that? And when she returns she sat in her vehicle while he remains moaning and groaning on the ground. And when her lawyer comes he simply takes her away? Something is terribly wrong with that picture.

Now the deceased comes from a good family and he aint getto at all. His family reside in the USA..his parents are married and he has sisters. So dont judge him becauseof how he dressed.
No license, borrowed vehicle< driving away from the scene? All this leaves much to be desired..

      January 29, 2011

We could feel her pain if she showed that human side of her, be courteous and just stop, scream to the neighbours or some oncoming vehicle for help or something, because she knew she hit something, but just continuing on, please! U may be her friend and we sympathize with you too, but if it were your brother, father, nephew or uncle,or even your son would you be singing the same song. I honestly doubt it

As a driver we sway from all or most animals on the road, or allow them to cross least we get injured if we knock them, so I really cannot understand your logic. I now feel your pain.

As a family member of Ian.. He was a Paro? A paro doesn’t get a job to climb poles for one of Dominica’s business. Just because he dresses down doesn’t make him a paro. If u spoke to him, you would understand the level of intelligence he had. He was a well respected, very polite young man. So becareful what you say.

BULL-SHEET. If she was in shock, why did she go and get a lawyer? You must be a close friend or family member of that woman that is why you talking so. What about the family of the guy she hit? The report said that she called the police and say “she think she hit someone”. Does that sound like someone who was in shock? As far as I concerned, what she did was stone cold. She hit the guy and left him on the road to die.

F-rees you talking. That was not just a mistake. The Woman hit the guy, drove off, went to get a lawyer, and returned on the scene an hour later. You canna call that just a mistake. A mistake is when you hit someone, you stop and try to help the situation. When you drive off like is an animal you hit, that’s a totally different situation.

I also hope they ask her why she go for her.. first before coming to the scene of the accident and why she never when close to the guy, is an animal then? If she had taken him to the hospital who knows he may be alive today she leave him there to bleed to death like a dog? Why it take the police so long to press charges? They did not kknow what to charge her with? If it was a child of a senior officer she had knowk down charges would be all over the place. One sided justice we have in Dominica.

  32. Truth, Justice, Love, Peace and Unity
    January 28, 2011

It is a crime, a serious matter for drivers to leave the scene of accidents. Once they realize they are involved in an accident, be it wilfully or not, it is imperative that they remain at the scene and telephone the Police. That is the Law. If they fail to do so they will be doubly charged and also charged for the death of anyone who died due to their wilful act and also driving recklessly.
It is better to be honorable and admit one’s fault rather than to drive/run away from accidents. If they remain at the scene and show their remorse the magistrate/judge may very well have empathy for them.
Please do not say that this is unfair and is preferential treatment. Honesty is always the best policy. In so doing the perpetrator(s) may get a lighter sentence.
Believe me this is the way it works world-wide even though the Law is the Law and people msut pay for their negligence. Due to their honesty they and/or their lawyers may be successful in receiving a reduced sentence.
The lady did not intend to kill the man but because she left the scene of the accident and he may have been still alive, she could be held responsible for his death.
On the other hand, as the saying goes, “Always place yourself in another’s shoes/position”, I do feel sorry for her and what she has got herself into. Obviously she regrets what she did.
The Law must perform its duty. Allow the Dominican Law to do so.
May the soul of the young man who died rest in peace.
As well, may God be with his family who are grieving his sudden passing. The grieving process can be a long one and extended over a period of time. It is not something that the family may ever get over.
May God be with this lady who is charged and is undergoing an earthly judgment. God is merciful!
No matter what God sees everyone through their trials and tribulations.

  36. COMMON SENSE
    January 28, 2011

At least we can say that for vehicular homicide, perpetrators are not usually jailed. Most times they will get a suspension of their license. In this case, the woman had no license and she even brave enough to plead not guilty. She also brave enough to plead not guilty to leaving the scene. Woman don’t you have a conscience? Oh, I remember; hell no you don’t!! If you had a conscience you would never leave the scene of the accident. If you knew you were legal to drive you would never run away. The people who are supporting you and giving you this advice are just as guilty. They pretend that you killed a dog in the street. That was a human being! It was somebody’s child!! You had no right to be driving!! You cannot drive!! Do you fear God? My Lord! For everybody’s sake just do not waste the court’s time and do not torture the people anymore.

Common Sense I second you on that. Oh she living shawford, she have connections so it could be anyone of US? bull… accidents are just that, but when you leave the scene, and return with lawyer you know damn well you do something wrong. People just riding people in Dominica and getting away with it, this opens up fresh wounds for me, I know how that family feels, been there. He is not an animal, I don’t care what his lifestyle was, he clearly had family who loved him, so because he was a paro and coconut thief according to some of you, his life is worth nothing? The woman knew she had no right to be on the road, panick my arse. Panick yes, but you stopping and check on the man, maybe if she had transported him to the hospital with help, instead of leaving by the road like a pig bleeding he would stand a chance. I don’t care who do it, a life is a life!

All those pleading for her, would sing a different song if they had the experience or if Ian was their family member. Because is Silver Lake he disposable, if this were Castle Comfort or Morne Daniel you all would react differently!

“humm” you’re quite foolish which is quite apparent. She hit the man and DID NOT STOP in other words, HIT AND RUN. She should have stopped called for help and not leave the scene of the accident.

    • Aaaaa
      January 28, 2011

no it couldn’t happen to anyone of us who have a heart! Wicked people alone that will hit someone on the road and not stop or look back. Oh yeah and those of us who follow the rule that says no driving without drivers license or expired license it won’t happen to us either! If we do everything in our power to help others we’ve hurt in an accident then we can be forgiving. Many are too quick to claim oh it wasn’t my fault. She lucky is in DA she do that. Any how she was on US soil her behind would be in jail facing 40 plus years locked up.

Hmmmm interesting… What of the case of the LIME employee who caused the death of the young man of Portsmouth??? We don’t hear anything of that, while she’s up and about walking free. The injustice in this country is alarming.

Cause in that case she did not cause his death; that’s all. He caused his death

The Lime Lady Never caused the Man Death. The Lady’s car was hardly moving when the bike ran into it.
Were u there to see what happened, Well i was, and there is no way one can or should blame this young lady.

So just shut up and wait for the hearing.

I worked at the Magistrate’s court, and i bet to disagree with Proud Dominican, most traffic offences, the Defendants are always bailed with prpper surety…..

She should be in PRISON with no bail ..wicked b++++. Already you was driving without licence and then you hit someone and dont stop to help..i hope you go straight to hell for killing my relative and if it wasnt her car the owner needs to go to prison too for loaning a car to someone without licence

i cannot understand nothing that is going in dominica this girl hit the guy with her car left him there to die and still pleading not guilty and still on bail for 20.000 but if they hold you with a spliff your bail is 200.000 i guess to kill someone in dominica is not a crime but to hold someone with a spliff is a crime.dominica has no law

What I do not understand is this. “why is it she was bailed for an indictable offense, when many at times, other persons who are seen as “poor” are not granted bail?”

I think our justice system in Dominica is biased and is geared towards the so-called upper class and middle class people.

We need a review of the judicial system here in this country.

Because her husband or brother in law is a cop. This woman should be ashamed of herself. Not only was she driving without a license, she left the man on the street to bleed. She clearly had no regard for human life much less the law. They need to make an example of people like her. Too many people in Dominica are driving without a license. Come on people, if you want to drive, go get a license. This is not a game, this is real life. Terrible things, like what happened, can happen if you are not authorized to drive a vehicle.

And shame on the legal system – why did it take this long for her to arriagned??? Is it because the young man that died was from the ghetto?
She should be prosecuted and pay for her actions.
Some sympathy would have been in order if she had just stopped to help the man and rush him to the hospital.

Hey stop that stereotyping, you don’t know the GIRL so how can you assume that she is not “POOR”?

Because she driving a car she is rich? do you know if the car is hers? look they say she doesn’t have a valid Drivers’ License, it could mean that she was taking her chances with somebody elses’ vehicle!!!

I just hate when we try our utmost to profile people, Rich people are chauffer driven!!!
