UPDATE:Behanzin said dismissal was politically motivated; to seek legal redress

Magistrate Tiyani Behanzin has labeled the government’s non-renewal of his contract as being politically motivated.

The former magistrate, whose contract came to an end on February 28, 2011, reported to work on March 1, 2011 on the basis that he had not been informed as to whether or not his contract was being renewed, according to a release.

He was however presented with a letter this morning from the Ministry of Legal Affairs stating that his contract would not be renewed . This letter came while he was on the job in Portsmouth at about 10:15.

Behanzin told a press conference at the Garraway Hotel this afternoon,that his dismissal had “nothing to do with the magistracy” but was because of him being the son of Rosie Douglas.

“It is political,” he stated.

He believes the letter constitutes wrongful dismissal and he will take the necessary legal channels to deal with the issue. He said according to the law he should have been informed of the non-renewal of his contract three months before it ends, not a day after the contract expired.

Behanzin pointed out his dismissal did not come as a surprise and was actually anticipated much earlier in his magisterial tenure.

He stated the government should own up on what is owed to him and this includes not being called to the bar.

Behanzin is convinced that there was no real basis for him not being called to the bar or to continue his tenure as a magistrate.

“You cannot fight to serve, that’s just nonsense,” he said. “But what is due to Tiyani Behanzin they better make it available because I will deal with them otherwise. And that is one; being called to the bar. Two; this nonsense with the appeals, this nonsense with the so-called inquiry, the foolishness in terms of the communications with all of those people who are involved in the so called conspiracy.”

He continued, “I don’t think my father took so much, over 30-40 years jail for his views. My father was presented with a safe senate seat for life and he told the Canadian government that ‘if I had an opportunity I will do the same thing again.’ So I come from a fighting family. Yes, there are one or two Douglas’ wasting time forming the fool right now. Behanzin is not one of them.”

He revealed that his dismissal letter did not give reason why his contract was not renewed.

The dismissal letter, according to him, stated that he should give up all government property immediately and thanked him for his services. It was signed by the Permanent Secretary of the Ministry of Legal Affairs Esther Thomas.

The conference was chaired by past government press secretary Sean Douglas, a relative of Behanzin. Attorney Don Christopher, who was also present, is representing Behanzin in a civil matter concerning him not being called to the bar.

That matter comes up in the courts on Friday.

    iT Is legally corect to seek redress so you should to that quickly .Every thing in Dominica is political and none of them has studied political science .Just remember that the people votes have you where you are today..Only friends of these so call politicians survive in that place ,Stop this victimization ,you should be proud to have your own as a magistrate.Too much tearing down of our own .Such behaviour is not acceptable any more ,Make certain that you file the biggest lawsuit against the persons concern.The legal system ESPECIALLY THE jUDICIARY SYSTEM should be revisited too much unethical practices Mr prosecutor ,why did you prosecute a case involving your woman ?This conflict of interest,You now father a child for the complainant and your wife has filed for her divorce on grounds of infedelity YOU CHEATER , SO HOW DO YOU ACCOUNT FOR A FAIR TRIAL IN THAT MATTER AGAINST POLICE OFFICER P.C who is on suspension for three years now,why is he being asked to resign when he was convicted for assaulting his girlfriend with whom you have an affair .SOyou see how evidence were tampered with to find the innocent man guilty .We need a fair trial.

    It is very painful and heart braking to see how we can treat our own people, this is a young Dominican who left England to come back home to serve his country.Today he has been destroyed by some people who connot see nothing else but distruction of others well i am afraid for those of us who are outspoken,this man’s sin was to punish the wicked,Drug dealers, killers, rapist,thives,he boath taught criminals how to behave them selves lecture the young, and middle age today his reward is fire.thats why i trust only God for he say in his word curse is the man that put his trust in man, because the arm of flesh will fail you you dear not trust your own.The wicked now got their way they must be happy wait and see how the North will fear out with the crime rate because those evil criminals had much fear for Tiyani but they know with the other’s any lawyer can get them out to commit more crime i am so ashamed. i finish talk.Tiyani God will provide a nother way for you dont stress your self my brother the evil that men do comes right back to hunt them.we see that with Curt Regist murdered after they realease him and with Clement Labassiere now back in jail that is two goast of the court of appeal that came back to hunt them more will come i pray for Dominica.

    It is a total disgrace, shamefull and disrepectful and mega unprofessional to have treated a profession that way. It is the so called Permanent Secretaries and top civil servants who allowed themselves to beused to the dirty work of the executive – they do not have any back bone because they know due process and procedures were not followed however thye go with the flow. At the end of the day the victim wins his case in court for wrongfull dismissal and yes the State ends up paying hundreds of thousands of tax payers money. But do you the hurtfull thing you will hear those same PS.s and technical people say in private conversation they knew government would lose the case because the way it was done- dam scamps they are! balls less creatures;

    As far as the contract is concern it is not uncommon for people to continue employment without a renewed contract- but the hurtful thing again and the unprofessionalism there is that the gentleman made every attempt to get a position from the principle ministry through letter and paying visit in person so the least they could have done was to acknowledge him but no the PS could not find the time within the last three months to do that but she could find the time in one day to write this disgracefull letter ending the contract. I am almost certain that within the contract their is a notification clause for both parties to indicate their interest. I tell shameless ballless people in the Public Service. Finally it is not ususal for people to work even if their current contract has expired – it happens all the time – in fact the first contract of the gentleman took 10 months to be sellted therefore he worked 10 months without a signed contract- as we read there are people I know at least three people within the public service who are working on expired contracts waiting for their new contract to finalized- in situations like that one is guided by the terms and conditions of the old contract. If the tose persons were to stay home at the end of their contract the employer mayu well have the right to say that they are no longer interested or have abscorned; the fact remains it is just mere and basic best practice in contrac ts and service to be professional in dealing matters such as this – in my opinion the situation was handle very unprofessionally and I blame the managers of the Public service who allow those politicians to ride over them.

    Tiyani, we grew up in the same village when you lived in Ma Delau house and you have never in any way used your name to gain special treatment. I say this to introduce something President Barack Obama said, “Most people who hate you do not know you.” This quote comes on the heel of things that I read about my friend to suggest that he is showing off and publicly making his employer feel bad in public. Well, I will concur to him being a person who speaks his mind and, that will never change. However, how many of us think or utter despicable things about our employer? I did while I worked in Dominica because the injustice was glaring and while I am trying my best not to insert myself personally in the picture; how would you feel if you trained people on the request of your employer and used them in the supervisor position at positions created for them in a company? Yes, I endure this humiliation and fought my way to being on a black list because the company owner son could not get me to tow his line like the others. That meant lost of position/increase wages but, sometimes one has to stand for something or else fall for everything.

    Therefore, I am 100% in support of Tiyani because he is showing us as his uncle mark said this morning that he should not be victimized because he has different views. He is not spin-less as is the case of many who would be paralyzed should government pull their contracts. Did anyone hear what he said he would resort to doing, “FARMING” the most humble of professions? I ask all his detractors how many of you would be qualified to serve in any profession and do farming when challenges of employment arise. Well, as usual one cannot learn or change if he is not prepared to do so. Dominicans, look around you at the persons causing you or us to be so unforgiving and, think for a minute how long Pharaoh held the children of Israel yet they are a power house today. In conclusion, Jean St. Joe have spunk and spin as we did when Patrick John was voted in even that meant being neglected by PM Mary Eugenia Charles, which eventually did happen. The rest of Dominica need to research what is making them so docile.

No offense intended because the gentleman contract started March 9th 2009 and my Maths tells me that two yrs from that is March 9th 2011. Oh need I go on any further because you might need to ask a lawyer what is a contract bidding parts. I will give you one free B, the duration date is one of the most important parts together with the content of the contract. I rest my case and stop being emotional so in future you can get your facts first before you speak as Mr. Maynard advised.

    WOW, this is so sad to make such good talent go to waste. Regardless of the reason for his dismissal I think he should be told. In addition, the current level of crime compared to the time I was growing up as a child/teenager is too high so I don’t blame his for his harsh sentences in trying to send a message to the public that crimes will not be tolerated.

    Dominica has a lot of educated people, however it still has a a VERY HIGH ILLITERACY RATE. Why do you think we still use symbols for elections. These lawyers who do not like Douglas do so because they want to continue to exploit the vulnerable souls of Dominica. The cost of legal representation is extremely high, drug dealers posting bail like crazy and paying up hefty fines. Douglas sentencing for jail time and community service is more likely to teach them a lesson and that is what we need. And even if the court makes money there is still no money invested in rehabilitating the convicted, thus the reason for so many repeat offences. Come on people it only takes common sense to see it is a problems.

    I hope he will at least be called to the bar….

    I am quite appauled by this level of victimization against a man of stature like Mr. Behanzin. It is interesting how our beloved country can wrong persons who are fighting for justice and the well being of our country. This is a continuing trend here; persons can be wrongfully victimized because they are contra the beleives of those who are in power.

    My heart aches for Rosie and Pierro whose vision is not that of those who currently potrait their own agends of satisfying their own selves.

    I shiverwered when listening to the press conference it is high time that we demand change in this country for the future of our children. Mr. Behanzin I am ready to vote for you to take our country to the higher level!!

    there is no law involved in a non renewal of a contract and a magistrate should know that. dont you know the government has the best lawyers in the region at their disposal? they looked at every angle he can come from and they refused. y? because you cannot threaten your employer with legal action to intimidate or bully them into renewing your contract. he used his love of the public to play it against the government. almost like blackmail. renew my contract or i will take you to court and i will place the publication in papers, on tv and radio making everyone know my intentions because they have love for me. if you do not renew my contract it will be a bad political move on your part. thats the alternative he was giving his employers. blackmail. they have the right to not renew the contract. how can he take someone to court for a job which he dont have? if they fired him, different story. i like him but he know how to manipulate the public just like a politician

    Employment law or not , no employee must ever try and embarrass their employer!!!!

    Your employer can be the State or come from the Private Sector but you must never feel you bigger than the employer.

    The same principle holds for Companies with thousands of shareholders and the management themselves may have little or no shares in the company they work for.

    If there are concerns that you have you follow the chain of command and document your concerns as a professional must always do.

    But no, we in Dominica must always showoff our brilliance and try make our employers look stupid in the eyes of all stakeholders.

    Most trained people of Dominica who go and work out of Dominica but refuse to work in Dominica is because they REFUSE to respect persons in authority in Dominica BUT THEY WILL QUICKLY REPECT A FOREIGNER!!!!!!!!!!

    They know that all their actions on the job and out of the workplace is destined to make their employer look Good but for some dam reason when they working in Dominica a good many of their actions is to make their employers look bad.

    Laws are not only interpreted in Black and White – there is the spirit of the law which we fail to grasp and that is what makes the study of law interesting.

    Behanzin was there for the past 2 yrs or so
    and i think last yr had the most murders in our countries history, 15 plus
    so how crime calming down
    Portsmouth his home town had the most shooting last yr
    And if he go up in politics he will get votes but he will still loose
    cause all them bad boys that say the doh voting for nobody
    will happy to vote against him
    I know for sure he would not win in my hometown.

    i like his approach towards crime
    I looked up to him

      Desie, your comments reflect nothing but a confused state of mind stemming from your utter ignorance on the issue at hand . You ask people to ” wise up” ?.I suggest you look at yourself in the mirror and repeat your advise then read and listen more before you make such confused utterances. For some enlightenment let me tell you. Murder is a crime and not crime totally. Behanzin only works in one court district on the north over which he has jurisdiction. He is not a high court judge so murders are not tried in his court only preliminary matters may end up before him. A man living in an Independent Country should have the right to speak out on any issue as he so desires political or not without fear or favor. After all if he is a voting citizen don’t you think he has the right to challenge politicians/governments on issues of concern. Remember governments are the people’s servants not masters. Moreover Behanzins problem is not for speaking but for his stance in some cases which may have implications for some people politically and that’s the crocs of the matter. Do your research

      go ask the cheif magistrate and all the lawers who were working against him everytime…remember the appeal cases to get those guys sentences reduce cuz they say behanzin was too harsh?? result one of the guy a few weeks ago striked an elder with a stone that lead to the elderly mans death…as for the shooting that same guy was remanded by behanzin until his court case with no bail,what happened they overturned it and release the guy..result he shot another guy at a night club in possie in his leg….a guy suspected to be involved in a murder was denied bail cheif magistrate overturned and grant bail..a man accused of rapping a minor was denied bail by behanzin cheif magistrate reversed that and granted bail..result the guy molested that same child a day before he was to reappair in court..

      SO YOU ASKED HOW IS IT CRIME WENT UP…WELL THAT HAS NOTHING TO DO WITH BEHANZIN AND EVERYTHING TO DO WITH THE CORRUPT JUSTICE SYSTEMS WHERE LAWYERS ARE CONSPIRING TO PUT MR BEHANZIN IN BAD LIGHT..

    All I can say is no man is an island and being a marverick is not the way to go!

    Until dated laws have been constitutionally changed via the right medium (through parliament) a magistrate has no business dishing out sentences that are not within those of the country/island.

    Yes there may be justification but that for this in certain cases, but as we are so quick to go on about being in a democracy and not a China, Venezuela, Middle East or any other dictatorship, we need to adhere to the existing laws till they are changed, and not by people taking it upon themselves to extend sentences that are not in line with current laws of the land.

    That sort of behaviour leaves people open to be mistreated or singled out if for whatevever reason one is related to another who isn’t like by the person dishing out the sentence, then they may be giving a a longer sentence that the law says, because of that. (This isn’t how a democracy works or should work, certainly in the modern world so there).

    Dominicans a quick to rush and demonstrate and go on about trivialities, now is the time to request that those laws which you say are outdated (and they are), is changed in the democratic way through Parliament and not by any individual to avoid abuse of this process.

    {Unless we have rights when it suits and no rights in other instances to suit our own agenda}

    When there’s a particular group of people…”The Bar” practically running a country to the ground. Taking advantage of the poor people; misleading them causing more corruption and, you got one, just one, trying to show some light and lead the way from them, what do you expect?

    Just because Tyani used to stand up for what’s so right and speak the truth and represent the people to the best that he could in he’s out now. He exposed them a lil to much; which wasn’t even enough cause so much Dominicans still don’t know the height of unfairness and unjust illgal shit that’s going on between the others in “The Bar”. The ones who are supposed to be opening the eyes of the people and making a head way for and with the nation and they’re doing the opposite.

    Time will tell…. I for one do believe in ninety nine days for the thief and one day for the watch man!

    where are these contracts that allow me to forcefully sit at my job even after the expired date, also compelling my boss to renew on my terms.. Oh wait… then it would not be a contract and I would be running my own business or marble hole game…All this talk about non-renewal of an expired contract!!! Beats me or a 5 ounce bag of common sense that a so called magistrate is making a public argument that on the 8th day god created binding expired contracts – or nonbinding?? what the heck is he trying to make us believe or swallow??? AND GET OFF THESE POLARIZED POLITICAL HIGH HORSES PEOPLE…

      Ask yourself, why was he not previously advised that his contract would not be renewed? Obviously, since he did not receive written notice he assumed that his contract would be renewed or was renewed.
      An ethical employer would notify the employee in writing, a few months in advance, of either termination of contract or renewal of contract.
      The onus was on the employer to notify the employee in advance, either way. This is how it should be done. This is also having respect for the employee.

My conclusion to what has happened to Tiani is that if his contract was renewed he would seek to eradicate or bring down the crime and drug level, but what would that mean for the lawyers? NO SALARY. Therefore they have to ensure that the criminals or repeated offenders are left on the street so that their bank accounts can get fat..Tiyani is in their way, they had to get rid of him somehow.

    Just around the elections of dec 2009, my cousin dreamt that the there will be alot of court battles within the administration that wins the election and our country will have a lot of trouble and conflicts. Right now, sad to say the dream is coming to reality and this administration will not last because of what they are doing. Everything that was revealed is coming to reality so people we are in for the long haul. I’m actually not surprised this is happening.

    Dominicans, we just need to pray and ask God for deliverance on our country, because there is more problems ahead of us if we continue to make all our wrongs right.

    The thing is this guy feels he is so important and the judicial system would crash and burn without him. He is over rated.

    He was bad news for the Government and not an impartial fellow. He has an opinion on everything.

    A Magistrate should be silent on issues as he is a man who decides the fate of others before him.

    He is filing suit….for what exactly wrongful dismissal?

    He should have spent more time regarding the sentencing guidelines.

    If you perform poorly at your job, do you get a promotion?

    He made some serious mistakes that sent people to prison or fined them far in excess of what the law called for.

    The law should be followed and maybe these persons whom he victimized should sue him for infliction of emotional distress.

        Before Behanzin there were other magistrates and judges and there will always be magistrates and judges to fill any void in Dominica because Dominica is part of the OECS Court of Appeal. There are many lawyers in Dominica who are already called to the Bar and willing to serve.

        was he the best thing within the law? its ok to send someone away for a crime but another thing to send them away for a time that is not within the law books. As far as i heard this is one of the main problems with his court decisions. Its not what he does…but he has to make sure it is done within the law…and if what the law states is not enough…then the law should be amended and he should not take it into his own hands!!! But all that aside…my first thought when i read the story is that …i thought your employer was supposed to give you notice of non renewal of your contract a certain period before the end of the contract!!!…this should also be stated in the contract…so it would be interesting to see what the contract says….so it seems to me like the government has also faulted here. Lets all see how this turns out!

    Wow! What a hoopla. When my contract expired I could not just move in at my old workplace and continue as if I had a contract. Even if the people intended renewing my contract and I moved back into work without one, this would scare the people as to my agenda and force them to send me a letter informing me or reminding me that my contract with them has expired.

    There is always is another side to things.

    There are still Dominicans who are afraid of Sharia Law. Excessive punishment is as bad as too soft punishment as another Party found out with Mr. Emmanuel. Remember the calypso ‘pou yon koko’ and ‘You Follow’?

    It’s a very arrogant and power driven gov’t that does not listen to the voice of the people.

    That move there is a big mistake on the part of the government. Pride goes before a fall. Yes, Behanzin may have said a few things that rubbed you guys the wrong way, but he was a very effective magistrate and an uprising social leader and he has the support of the people.

    Egos should have been kept in check and let the man do his thing. This is a dark day for the judicial system in Dominica. I will wait to see Behanzin’s next move.

      Was Tiyani not supporting the LP? Regardless to what party he was supporting, he was doing a good job, in my opinion. Isn’t that what is needed? One person can not cause a party to lose, however, if hundreds of people is in favor of that one person and that person get ousted you will lose hundreds of votes. THINK PEOPLE, what do we need at home? party, politics, more crime, or safety?

    Come on guys, just yesterday DNO reported that Mr Behanzin was back at work having his contract renewed. so are we saying that it was or it was not renewed. Until that is clear then we are not fully equipped with the facts. Another thing is that, a case been over turned at an appeal does not necessarily mean that the sentence was wrong, it could simply mean that the judge or judges might think that the sentence was a bit harsh or may have taken a few more eliments into account and reduced the sentence, so for someone to comment that they overturned 18 from 19 cases without the facts on all the cases is a bit unfair.

      Dominican Man

      I noticed that the majority of us had missed the important message of that DNO news article yesterday, pertaining to Mr. Benhanzin, based on our response.

      That news article simply said that Mr. Benhanzin had gone back to work, pending a decision of his work renewal from his employer–the Government of Dominica. Up until February 28, 2011, he had not yet received that decision from them. He finally received it at work today.

      I do not know what is the reason for that this decision from the government, but it does seem quite unwelcoming. Mr. Benhanzin seemed a lot like the kind of magistrate we need in the courts of Dominica–if that is what his reappointment would have been about.

      That decision could be quite unfortunate for both, the young man and the government themselves; but time will tell.

      You are talking about God, but you are calling for Dominicans to take matters in their own hands, instead of advising us to maintain faith and trust in His authority, while we listen and watch for the Ways of His plans in us and among us.

      The mentality of Muslims is always about a protest which ends up with the shedding of innocent blood and the taking of innocent lives. It is not hating people–Jesus, the Person Love, which is of Eternal Spirit–our One True God, in Him, advised us to love our enemies. I understand and accept that. But we must hate the evil things that people do. Violent protest that promotes human conflicts, causes the shedding of blood, and taking the lives of innocent people are a few among those evil things.

      Mr Benhanzin is a good man, but he is only one man. Yet still, we do not know, that God may have allowed this decision, to cause this young man to humble himself a bit more, before He can begin His work of authority through him. God does not appoint no one, before his mind is well trained and disciplined to process and products His Ways–the Ways of Love.

      Otherwise man’s work is still futility, that vanishes in space, as soon as it is completed. If you truly know the One God, whom you have declared; why don’t you send some of the wisdom that you have of His Holy Spirit, to Mr.Benhanzin, instead of calling for a protest in Dominica.

    I foresee a lengthy court battle. Such communication should have been handed to the magistrate, prior to or on the very day when his contract would have ended, not two days into the commencement of his new term.

    So long as notification handed been given of employer’s intention not to renew the contract, then it is only understandable that such would have been translated by the employee to mean that his employer has every intention of renewing the same. and in the case of the good magistrate, he wasn’t at all wrong in such assumption, as under his last contract, he was only given an actual contract, ten months into his employment.

    These folks need to stop playing games.

      Hi Crying. There are some facts you must know. Magistrate Behanzin was hired becase there was a shortage of magistrates to serve on the bench. The nothern district for example did not have a magistrate for months on end and lawyers were complaining that there matters we not being heard.     Who said it was dismissal? It was refusal to renew a contract and I’m sure the government did research before denying renewal. However I did like his morals so i think it should have been renewed. But he was threatening government with legal action even before the decision was made. That is what probably caused this drama. He couldn’t be patient. Sometimes we have to just relax and know when to talk. He spoke too much too soon. But I like his fight on crime and his outspoken way. Just that being outspoken, you must choose your battles and time them well. You cannot threaten a government that employ you when a decision was not yet made.

      he was not dismiss, his contract was just not renewed. Any employer has the choice of renewing or not renewing the contract of a person that works on a contractal basis. It may not be fair but they do have the right to do as they please in regards to renewing or not renewing

        How you mean it may not be fair? When you sign a contract and these are the terms, then it is fair once it abide by the terms. What we may be considering is a breach of contract, if he wasnt given three months notice of non-renewal, or payment in lieu thereof.

    Not renewing a 2 year contract is not really equivalent to being “Fired”
    Generally, an employer is not obligated to keep an employee, nor is the employee obligated to remain with the employer beyond the contract expiration date.
    No reason for not continuing is required by either party.

    I expect that Behanzin will tell us why the Government said they couldn’t renew his contract and also why he thinks that they didn’t renew it.
    Very likely these will be 2 different reasons.
    People have their opinions on whether the Govt should or should not give Mr Benhanzin a new contract.
    At the end of the day its for the chosen few (the Government) to decide.
    And unless there is a clear violation of his human, labor or democratic rights, then the potential politization of this issue is just another stumbling block in Dominica’s development.

    Admin: if your employee opt not to renew your contract, you are technically being fired. Being “fired” is a broad term and is not limited to you going to the boss’s office to get the news or receiving a letter.

    Y’all don’t think having 18 of your 19 convictions overturn by a higher court inept and incompetent? I mean 18 of the man rulings were over turned by the court of appeal on the basis that they were not in compliance with the ACT and you telling me that this Magistrate is worth crying for?

    If it was one of all you family that had received such unjust ruling and couldn’t afford to appeal all you would be singing a different song, for sure.

        MOTS Behanzin sentenced that man to 27 months where as the Law state the MAXIMUM sentence for such a crime was 6 months, so the Court was left with no choice but to release the man.

        Are you implying that because the case was over turned the man killed the elederly man? The man would have still been out if was to serve the full 27 months Tyanni sentenced him to, so your point carries absolutely no weight whatsoever.

        I tell you if it was a family member of yours or you a self that was before tyanni and he gave you an arbitary sentence that is not even on the law books you would be the first to say the man mad.

        GON Emanuel was a great Magistrate, he sentenced within the ambit of the law and the Dame Eugenia didn’t renew his contract. Just something to chew on!!

Imagine a doctor diagnosing someone’s sickness then more experienced doctors keep saying upon review that the diagnosis was wrong. That doctor’s performance review would not look good at all.

          The thing is, our laws are not with the times. Our crimes are far too technologically advanced for out outdated laws and punishment for crimes. Though Mr. Behanzin’s sentences may seem justified, they are not supported by law and hence were overturned. It is apparent the time has come to change the laws to reflect the reality of the times.
