$50,000 bail offered to ex public officer charged with money laundering

Arah Davis

Retired public officer Arah Davis, who was charged with money laundering on July 12, 2010, formally appeared before a Roseau Magistrate, where she was granted $50,000 bail with two sureties.

She was arrested almost two weeks ago, but reported sick while in police custody and had to be rushed to the Princess Margaret Hospital (PMH) where she remained a patient for a few days.

Among her bail conditions, she is to report to the Roseau Police Station every Friday between 7 a.m. to 7p.m.; not to interfere with witnesses in this matter; not to commit any offense while on bail and was asked to surrender all her travel documents.

The preliminary inquiry into the matter is set for October 14, 2010.

I do not know Ms. davis personally so i cannot comment on that level…. However, I can comment on the stand point of what is wrong and what is right. I do not have the facts but I do understand what money laundering is… With that said…… one will question( whether it is our business or not), how one can attain so much. It is possible that things were given as gifts but when moeny laundering is involved….. all that is thrown out of the window. Like i said and I will say again, I do not know Ms. Davis….. but I have to question her parenting. I know that her kids are no longer “kids” and are of legal age to make their own decisions but why is she a part of his doings in any way shape or form. Sorry people, I cannot condone that.,, The court will do their jobs as well as the attorneys. Keep in mind however, that not because someone may come off as innocent doesnt necessarily mean that they are. THEY JUST HAD DAM GOOD REPRESENTATION. I am not going to try to judge her or anyone because I don’t think that she ever saw this coming…. which therefore means that my turn could be next( not necessarily for the same thing). Hopefully, a lesson will be learnt after all is said and done…. life will go on…. it has too…. God is giving you a second chance to turn your life around… grasp that opportunity should it come. Never make the same mistake twice. Peace

Its all about envy , grudge and hate, the Estate community may know these people personally but alot of you who make ill and negative comment dont even know them. You only see a vehicle you dont even know who driving it sometimes lets be loving and stop hating people who has done nuttin to hurt you. Lets be realistic if a stranger comes to dominica and drives a hummer is nuttin , if he builds a big house is nothing because the system accepted him but the truth is we know nothing of that person but the system accepted him so we do to. When the elite family drive what they want if ok because there parents have or had money the poor man have to start somewhere . A house and a car are materialistic they go they come. Thanks God for life and let god be the judge of mankind and the law the jugde of circumstances

You have no understanding of whats happening you a so naive to the facts of life rum, vodka, scotch, most spirits , ganja and cocaine does one thing to a person gives you a temperary high for a moment . All of these are addictive we need to educate the society and stop playing law officers and trying to point fingers at other people’s children. I am not mad at the public’s opinions, what I am saying is persons should know the true facts before they talk…..INNOCENT UNTIL PROVEN GUILTY. Don’t just jump on the ban wagon and slander a persons name just in the name of talking…..persons like to bring down their people to the gutters they never want to see anyone do good. ALWAYS EMPHASIZE THE NEGATIVE, AS I SAY NEGATIVE WORDS OR COMMENTS MADE ARE ALWAYS REMEMBERED THE GOOD OF A PERSON NEVER IS. I am not saying because someone is religious that they cannot do no crime, what I am saying that she my sister prays, she is not one to get involved in things that involve crime it is not in her nature…..whether or not her name is on a document, that does not mean she knew about it…..persons leave property in the name of family members for one reason or the other…..it does not have to do with crime…….it could be for many reasons…….that does not make her a criminal…..she brought up her children to be good citizens…..they are adults…..she cannot control what anyone of them do just like all other parents can’t even if you try……children no matter what their age do what they want…we all know that. WHAT I AM SAYING BEFORE PEOPLE GO ABOUT SLANDERING SOMEONES NAME NO MATTER WHO THEY ARE, PLEASE KNOW THE FACTS FIRST BEFORE THEY DO SO…..There are many people out there the police should be looking at for money laundering and they are not looking, all of us know that. I ask myself WHY is it they are after my sister because a property is in her name, WHY? She is not the first one, someone has put property in someone else name and she won’t be the last. Its not against the law as far as I can remember. PEACE BE WITH OUR PEOPLE, WE SHOULD RALLY AROUND OUR OWN INSTEAD OF TEARING THEM DOWN…..IT MAKES LIFE SO MUCH EASIER, NO STRESS TO BRING ABOUT PRESSURE, SICKNESS ETC.

I hope all the parents who are living off their children dirty actions take heed. Their days are numbered. Your child is not your best friend you are suppose to be the parent. Say no to the smallest material things they bring home. Search their school bags. When they have things you did not buy question them. Befriend the friends parents so you will know whats going on. ALWAYS REMAIN THE PARENT.

    @Michael Davis Esq.:

    Sir

With all due respect, we in the community of Dominica know full well what your nephew does. If you want to defend your family that is your right. But he is a cancer in our society…

So i will pray fervently, that for once the police officers and prosecutors win this case, because enough is enough!

  27. Justgivingmytwocents
    July 13, 2010

Justice is all about how best you can prove your case…. criminally – it’s about beyond a reasonable doubt – it’s not about whether you’re guilty or not! Many an innocent person has gone to jail because such person failed to convince the trier of facts and or jury that his case is stronger than that of his opponent, thus failing to prove his innocence. On the other hand, many a criminal has walked free because said criminal was smart enough to present a story, case, that placed doubt in the mind of the trier of facts or jury.

I always say innocent until proven guilty is a myth – it should be -the most convincing person, with the most convincing story wins the case – and yes people, this is how the justice system works – guilty is when the otherside has proven their case, Guilty in the eyes of the law is whether it can be proven that you did the act (not whether you did the act)… doing the act with the otherside failing to convince is pointless to a so called justice system.

Life is about survival of the fittest, and in the justice system, sometimes the criminals turn out to be the fittest. I say .. more power to the individual who has success in convincing the trier of facts or jury that the client is innocent until proven guilty!!!!!!!!!!!!!!!

Reason why certain people choose to defend those who commit heinous crimes – convincing that what happened is not as it seems takes skills that the layman won’t understand. It’s always easy to blame the justice system… but such a system works if at the end of the day criminal responsibility is based on beyond a reasonable doubt…i’m just saying

    @SERIOUSLY!:

    Amen. Fair statement.

Althouhg we cannot serve judgement, because we do not have all the facts of the case; based on what I have read so far, I find it difficult to believe that she was oblivious of her child’s shenanigans. The majority of parents are always aware of what their children are up to. From what I have gathered on DNO, the “circumstantial evidence” in this case appears to be strong. We will have to wait and see how things unfold.

Of course, it is quite possible that this small fish will be served as a sacrificial lamb while the barracudas swim away unscathed. The Barracudas are the ones moving the strings. We are chipping the tip of the iceberg while living the base intact.

You talk about legal system, what legal system you talking about. There is none, it’s so sad. You kill people you are sure if you can pay a lawyer, or you have a relative or a friend you will walk away as an innocent, happy man. So sad for the grieving family. It’s the same lawyers and them that helping to create the bad, shameful situation in our beautiful country. All you need is money and you can buy any lawyer and from a murderer, a drug dealer, you can be a KING, a NICE guy TOMORROW. People steal, kill and the lawyers, judge, jury provide safety and help. All of them friend and while you paying them they sharing information about your case with each other in the end, you will lose your case. Those suckers are bad! I know they have to live and keep up with their show off live but when you work hard for your money and they crooking you, it’s a shame. Some of us have to speak out and continue to be fair if we have to see change in the country. God bless my country but not those bad ,cruel people spoiling the country.

I read quite afew comments and I have a few questions. In Dominica, is it possible to register a property in your name without your consent or signature? If your child does not have a steady job or even if he does, would you not have an idea of his income? Are parent always as innocents as we think? Those of us with children know how they lie and can deceive. Isn’t it our role as parents to clarify the source of anything? I am not putting blame on anyone. Judgement is for the Lord. Our country is corrupt, the leaders are corrupt, the police service is corrupt and the judiciary is corrupt. Did they investigate the police prosecutor whose name was also mentioned in money laundering? Is this the first time the big fish swims away and they go after the kaayee?

Dominican’s it is up to you to take back your country. If we are to be fair, we must give everyone the same treatment. The bigger ones in the money laundering will just pay off the police and judiciary and then they will make an example of the little ones. In December we made a decision, now we have to live with it.

    July 12, 2010

@Judge & Jury?: I don’t understand how the legal system works? Which legal system? The non-existent one that lets criminals walk away? You’re the one who lacks comprehension. Innocent until proven guilty my foot! The murderers and rapists who happen to walk away due to some mishap in court or lack of evidence, are they innocent? I do not know the lady but everyone knows her son and what he does for a living, so don’t come on here talking about evidence. He seems to be a god that’s why you people insist on defending him and his bad deeds, but the God I believe in doesn’t drive a hummer, nor does he ride a motorcycle. Morals and principles don’t change depending on the individuals involved. Wrong is wrong! Attack me all you want but I’m not the one on bail and facing money laundering charges!

Well since they start arresting people for Money Laundering, and arresting that poor old woman, they have many more to arrest. If they really want to start enforcing the law, alot of people will go down, that is 3/4 of Dominica. Look toerie. Even the police and other people in high places.

  36. Smooth Sailing
    July 12, 2010

I have read all the comments with a keen eye and mind, and I am always amazed at the things that our people say. However, I am sought of relieved in the sense that I understand why the things which happen in our society happen. Our mind set is negative.

The lady I will not condemn or critisize for this will acheive no beneficial end. However, I bewildered by the comments of the one who claims to be a lawyer. Some advice to you and anyone who this might be usefull to. An intelligent individual never takes a position based on emotions. Rather, it is made based on objectivity. Nephew or not an individual who has no job or in a country where cost of living is so high is able to afford assets in excess of millions of dollars. Come on! conscience people. And a little knowledge.LAUNDERing the part in uppercase letters means to wash or to make clean. So money laundering literaly translates to making dirty money clean and this is what we are dealing with there. It is a crime to knowingly give illgotten money the semblance of legitimacy.

So – the police say it so – then it is so?

The universe has laws, and all actions have consequences, ALL ACTIONS.. I pray God she will be exonerated, and set free to retire in peace. I pray that she will be sustained, and God will grant her long life, and pardon her mistakes. I pray for her son, maybe it is time to pay attention to God. Your mother raised you better. Little man you are not. The Officers can do their investigation. But competence should be part of the investigation.

Now, my earlier comment spoke of family unity, judge not before the evidence is in, and, my confidence in my sister and her innocence – and – that her son will be proven innocent.

It was also a warning to the to those who may libel and slander.

It was also a further warning to the politicians who are looking for scapegoats – that I could dedicate the rest of my life to eradicate them and bring real justice, crime and punishment to those who use the Little Man for their personal benefit.

I am tired of living in Washington DC anyhow – the beach & sun of living in Roseau will be one of the pleasures of life of going home.

Some dominican see as far as jah allows even though jah would like us to see far into the future. This is nuttin about money laundering its drugs that what the Law wanted and they didnt get it when they search the house so they sqeezing everybody who knows Mr. Gage. The lady is gonna be alright because God is i the mix of all that is happening and this lady can not be responsible for no other adult action. Its her son she carried him for nine months she will mother him and love him till death thats what good mother does they are there for us in good and bad times. This is one of the bad times she will be there for him .

UPTOWN REBEL I SUPPORT YOUR POINT 200%. I’VE MADE THE VERY SAME COMMENT WHEN THE ISSUE CAME UP REGARDING MONEY LAUNDERING. THE POLITICIANS WERE ASK TO DECLARE THEIR ASSETS AND NOT ONE OF THEM DID . THE PEOPLE WHO WERE CHARGED WITH MONEY LAUNDERING WERE THEY CAUGHT IN THE ACT OR THAT THE INVETIGATING UNIT DID SOME UNDERCOVER INVESTIGATION AND PRESENT CIRCUMSTANCIAL EVIDENCE? IF SO THEN LET US GO AFTER THE MINISTER THOSE WHO BECAME RICH OVERNIGHT. THE VERY SAME PEOPLE CONDEMNING THE ALLEDGED DRUG DEALERS AND MONEY LAUNDERERS WITHOUT HARDCORE EVIDENCE ARE THE SAME ONES WHO ASK FOR EVIDENCE WHEN THE POLITICIANS ARE INVOLVED. WHAT HYPOCRACY ON WE THE PEOPLE AND THE POLICE.

A BUSINESSMAN CAN’T GIVE A TRUE ACCOUNT OF THE VILLAS AND BUILDING IN PICARD THEN GO AFTER HIM. THIS IS A CLEAR CASE OF MONEY LAUNDERING. MILLIONS OF DOLLARS TRANSFERING FROM POLITICIANS TO INDIVIDUALS AND SOME OF US THINK IT’S OK WHILE WE CALL FOR THE HEADS OF LOCAL DRUG DEALERS.

I love my mother too much for me to allow something like that to happen to her eh….. what a shame

  65. July 12, 2010

My sister is innocent. Our family will always be united. My nephew will be proven innocent. They are both under the vanguard of our unity.

Now, I have practiced law for a number of years. Washington DC & Roseau is a short flight away. I would be careful of what I write. The litigiousness in my nature – the politics of my mind – can easily be transfered to DA.

    Innocent until proven otherwise.

    July 12, 2010

CLODAGH I RESPECT YOUR OPINION AND I’M NOT HERE TO JUDGE OR CONDEMN THE LADY OR ANYBODY.HOWEVER I AM NOT CONVINCED THAT BECAUSE SOMEONE PRAYS OR DOES NOT HAVE A CRIMINAL RECORD THAT THE PERSON IS INCAPABLE OF COMMITING A CRIME OR CONTINUOSLY INVOLVE HIS OR HERSELF IN ILLEGAL ACTIVITIES. I’VE WITNESSED A SO CALLED RELIGOUS INDIVIDUAL (SOMETIMES PREACHER) IN THE DRUG TRADE RIGHT HERE IN D/CA. I’VE HEARD ALLEGATIONS FROM THE PUBLIC REGARDING THE VERY SAME PERSON. I’M STILL IN SHOCK BUT I’VE KEPT IT QUIET. MY POINT IS THAT LOOKS AND APPEARANCE CAN BE DECEIVING.

CLODAGH YOU CAN’T BE MAD AT PUBLIC OPINION CAUSE WHEREVER YOU GO PEOPLE ARE THE SAME WHETHER IT BE IN THE US, UK, MEXICO, SOUTH AMERICA OR AFRICA. IN A SMALL SOCIETY SUCH AS OURS PUBLIC OPINION COULD EVEN BE MORE BRUTAL CAUSE PEOPLE FEEL THAT THEY ARE CLOSER TO THE FACTS.

I DO AGREE THAT THE COURT OF PUBLIC OPION IS IMATERIAL IN THE COURT OF LAW. THE FACT THAT YOU STAND BEHIND YOUR FAMILY IS GOOD THOUGH CAUSE THIS WHAT FAMILY SHOULD DO.

  68. UPTOWN REBEL!!!
    July 12, 2010

This is sad, real sad and hypocritical…..Let us not pretend to be naive here friends. What happen to the real money launderers?..Yes, i mean the real big time people them that is up to this laundering thing up to their necks. The same ones who cannot or will not give account of the mass wealth that they have accumulated in such a short period of time.Who in some cases have big buildings and villas in other peoples names? Should they get away scotch free,no questions ask?..Oh sorry,i forgot, there are some untouchables in Dominica. The ones who are above the Law.
So,you mean this little ole” lady is the big fish, she is the one who is Laundering all the money that’s coming in brief cases into the Country? The one with other peoples things and property and money on her name?…nice!!!!!. Good job, you guys are on top of things. Please do,alert the media.
She is responsible for all the corruption in your Country…What hypocrisy!..I wonder how some people sleep at night?.Then again, where there is no conscience, and when your soul sold has already been sold to the devil, what is there to expect?.
I do not condone criminality. But if you are going to investigate and arrest..please,do it across the board. No one is or should be above the Law.What is good for the goose should be good for the gander. The Laws are there for all,not some.
I will be waiting,i will be monitoring,i will be listening……..
There is a Law written in the universe, that, whatsoever a person soweth, that is what he/she shall reap…It may not be today,or tomorrow,or the next day,But as sure as the sun will shine, your day of reckoning is approaching.
    May GOD help us all.
    Peace!

@brown woman: Do ANYONE of you know the lady about whom you speak of……or like everyone else you make your comments without having the true facts at hand; do you know the FACTS, THE TRUE FACTS THAT IS, NOT COMMENTS MADE BY OTHER PEOPLE WHO JUST WANT TO PUT A PERSON DOWN, WHO GET A HIGH FROM SEEING OR HEARING OF PERSONS IN A POSITION BEFORE THE COURTS; EVEN IF SHE IS INNOCENT. A LADY OF MORAL AND ETHICAL CHARACTER, SOMEONE WHO HAS AN EXEMPLARY RECORD IN THE SERVICE AND IN HER PERSONAL LIFE, A PRAYING WOMAN, ONE WHO PRAYS FOR HER FAMILY/FRIENDS, A NATION (OUR PEOPLE) NO MATTER WHAT THEY HAVE DONE; SOMEONE WHO MINDS HER OWN BUSINESS AND TRIES NOT TO SPEAK ILL OF ANYONE WITHOUT KNOWING THE FACTS AND EVEN KNOWING THE FACTS MAY MAKE NO COMMENT. HUMAN LIKE EVERYONE ELSE, SOMEONE WHO CARES FOR HER FAMILY….someone who is likely to make mistakes whether she knows it or not,LIKE EVERYONE ELSE…..EVEN THE SO CALL POLICE,…….she has nothing to do with what is going on……SOMEONE WITH NO CRIMINAL RECORD OR EVER QUESTIONED IN HER LIFE BY THE POLICE, TREATED LIKE A CRIMINAL AND THOSE WHO ARE THE CRIMINALS ARE TREATED BETTER THAN SHE WAS….know your facts before you make comments…..what about the saying “INNOCENT UNTIL PROVEN GUILTY”. TIME WILL TELL LIKE ALWAYS……..placing her magic jack serial number on the newspaper, a magic jack given to her in order for her to make calls to her family overseas and for her family to call her without having to pay the HIGH COSTS OF INTERNATIONAL CALLS….DON’T WE AS A NATION, AS A PEOPLE HAVE BETTER THINGS TO DO……what about the escaped criminals out there, have they been caught…..did you read anything about them, things that have been proven in court, where they have been found guilty…….proven guilty by a jury of their peers….NO, NOTHING…..PERSONS OUT THERE PREFER TO MALIGN A PERSONS CHARACTER WITH UNTRUTHS, SOMETHING THAT HAS NOT GONE BEFORE THE COURTS. This is my humble opinion as a family member, as a Dominican…..ALWAYS THINK OF WHAT YOU SAY ABOUT SOMEONE, NO MATTER WHO THEY ARE, FOR A WORD SPOKEN CAN NEVER BE TAKEN AWAY….GOOD WORDS ARE NEVER REMEMBERED, BAD WORDS OR COMMENTS MEANING TO MALIGN ONES CHARACTER ARE ALWAYS REMEMBERED NEVER FORGOTTEN, NO MATTER WHETHER THE PERSON IS INNOCENT, FOUND INNOCENT BY A COURT THAT IS NEVER REMEMBERED, ITS ALWAYS THE BAD THINGS THAT ARE REMEMBERED. IN LIFE I HAVE LEARNED – NEVER SAY SOMETHING ABOUT SOMEONE THAT WE DO NOT WANT SOMEONE ELSE TO SAY ABOUT US – MEANING – DON’T TALK BAD ABOUT SOMEONE ELSE WHEN WE OURSELVES DON’T LIKE SOMEONE TALKING BAD ABOUT US.

other parents open ur eyes…its a risk to take by putting property on your name..when u can’t account for its legitimacy …so make sure u are prepared for the embarassment and expensive lawyer fees…to defend yourself and in the end dirtying ur image..and as a result you’ll always be looked at by law enforcement officials .

This is a sad image. I grew up seeing Era as one of the mother figures in Bath Estate. This is too sad to see, but it makes me realise that we all have the choice to do what is right, whether or not it involves pleasing or hurting family and friends. Wrong is Wrong and we must live by that and encourage or loved ones to do the same. May the good Lord be with you and your family. May the good Lord guide Dominica and its youth.
