$800 fine for stealing hair clipper

hair clipperFabian Joseph, of Pointe Michel who resides at Soufriere, was fined $800 after he pleaded guilty to theft of a hair clipper valued at $300.

The incidend occurred on Feburary 26, 2013.

Reports are that Joseph went to collect some materials at the home of the complainant, saw the hair clipper and walked away with it.

The following day the house owner realized the clipper was missing and when confronted, Joseph denied stealing it.

A few days later, the complainant went to Joseph’s home where he saw a plastic bag which contained the clipper and when asked about it, Joseph continued to deny that he had stolen the item.

Acting on a tip off, the police went to the home of another man who told them that Joseph had sold him the hair clipper but had not yet collected the money.

Joseph was arrested and  it was only then that he admitted to stealing the clipper.

He also apologized to the owner.

In court, he again expressed remorse. “I am sorry for my actions … I am a plumber and father of three,” he said.

But Magistrate Candia George reminded him that he “had breached the trust of someone who had allowed him into his home.”

“You have not wasted the court’s time; it’s your first dishonest offence and make it your last”, she said.

The fine is to be paid by April 30, 2013 or in default, 3 months jail.

    1. His penalty fine for stealing the hair clipper amounted to $800 EC; he could have purchased two hair clippers with that money instead of stealing. (Shakes my head)
    2. The owner of the hair confronted him about the stolen hair clipper even after he found evidence and he still denied it. (Shakes my head)
    3. He could have avoided the fine by admitting and returning the hair clipper instead of waiting for the owner to summon the police. (Shakes my head)

    He has to the pay price for stealing what does not belong to him. He had the nerve to sell it to another. Did he not expect that he would have been the first person to be suspected? This is a lesson for him in the future.
    What is this all about that “he did not waste the Court’s time.” Why do lawyers and magistrates or this magistrate mention it at all? It is irrelevant. It should be struck out of Court proceedings. In addition even though it is his first offence and he has children this should make no difference.
    What is relevant, the home owner entrusted him to perform a job in his home. He noticed the hair clipper and took it. The owner noticed it was missing and immediately suspected him of stealing it. He approached him about it and he denied it.
    The owner got concrete evidence that he had taken it and that he sold it to someone. No doubt this person did not have the funds and told him he will pay him sometime. If he had admitted the theft and had not sold it and returned it to the owner he probably could have avoided a Court case and a fee of $800 or 3 months in prison.
    Whether he admitted his guilt in Court or not, it is still a crime and must suffer the penalty. The punishment must fit the crime.

    It does not matter how much the hair clipper costs – tt could a milliion dollars. This thief had no right to go in the mans house and steal his belonging. Shame on him!!

      They do this so that they could get the magistrate’s empathy and be acquitted. Not smart at all. A crime is a crime. Thou shalt not steal. He breached a trust. He lied about taking the clipper. He sold the item and would have collected money for it. Note how many offences he committed. He now has a police/court record and has tarnished his name. He will never be trusted again. If he is unable to pay the fine, he will be imprisoned. For a small place as Dominica or Soufriere where practically everyone knows each other, he may have difficulty obtaining work. He did not think of all this prior to stealing the item. Who will trust him in their home in the future?

        It does not matter how much money the clipper costs.
        It could be $1,000,000.00, he has no right to go in that man’s house and steal his clipper!!

      who you asking? he not reading what u saying there nah! lol. his maths so bad (he pay more than the price of two clippers!) that I think his english is worse. so he cyah read what u asking him there. :-P
