Accused murderer of Grand Bay on $500,000 bail

Mwamba Alexander – an accused murderer – who has been on remand at the state prison for the past few months has been granted bail.

The defendant, who appeared before Justice Birnie Stephenson-Brooks at the High Court of Justice on Monday with his lawyer Zena Dyer, was granted bail in the sum of $500,000 with two sureties.

Alexander had surrendered himself to police days after allegedly killing 26-year-old Neddison Bennoit and wounding 41-year-old Irvin Mark  both of Grand Bay,  after an alleged shooting incident outside of a disco in Grand Coulibri, Grand Bay in August 2009.

According to reports, Bennoit sustained a gunshot wound to the chest while Mark was shot in the chest and lower abdomen.

Reports stated that the incident was as a result of a “heated” argument between Alexander and Mark earlier that night.

Alexander allegedly pulled out a gun and started shooting at Mark, who was in a conversation with another man. Bennoit was an innocent by-stander, according to reports.

The conditions to Alexander’s bail are that he surrenders all his travel documents and reports daily to the Grand Bay Police Station between 7 a.m. and 5 p.m.

He was ordered to live with his aunt in Grand Bay, and remain in the confines of her home between the hours of 6:30 p.m. and 6:30 a.m.

Alexander was also ordered to refrain from having any contact- direct or indirect – with  any family member of the deceased or any witnesses in the matter against him.

He is expected to attend court on June 14, 2010 for the preliminary inquiry on the matter.

    I Grand Bay to be a village not a human being. I find when people do thier nonsense, some of you just running on Dominica news online and just bre…………………….. like some type of mule. I am not in sopport of any Magisrate to do thier work and keep who needs to stay behind bars, behinds bars and who needs to be free , free.

    I am fed-up of people just jumping Grand Bay something happen. When is somewhere else it is stiffled.

    what is really going on?what is really going on i say again? how can an acussed convict be out on bail, roaming the streets freeeeeeeeeeeeeeeeeeee, my honest adivce to him is kill again at anytime, because d/ca do not seem to have any law, and he should have no fear because nothing will come ou tof this,, or my next advise is that he flees the country. how can the one who grants him bail expect to set curfew … this does not make any sence whatsoever, how can the families of that inocent victim feel when the see him enjoying the streets on a daily basis. what about the other victim…? i mean come on , give me a break, this cannot be real,, how can there be any justice in dominica? how can we tell the youths to be different , when the is no justice in as simple stuff as A B C ? lord help us , god grant us mercy, lord look over us, the fullfield law states when one cut off one hand , give him the other,, but the first law staes an eye 4 an eye a tooth 4 a tooth, lord grnat us mercy and pardon AMEN

    what about the potential witnesses in this case? do we have a witness protection program in Dominica….WE DON”T! So I would like to know how the police or prosecution is supposed to build a case while the accused is outside….No offense to these D lawyers they are doing their job… as someone said they just find the loopholes in the law to get them off and back on the street…

    The Justice system stinks. Skerrit must look at that legislation again, because that is not right. There should be no bail for a person charged with murder. Let the court hear the case first. I am very disappointed.

    Well I see the trend and new way of legal thinking is that murder is now a bailable offense. While the bail conditions may make it difficult to skip bail and a person is not guilty until he/she is proven to be so, I think that:

    1. It is unfair to the family of the victims who have suffered as a result of the alleged crime to see that the perpetrator is out there living a normal life.

    2. The family of the victim or a potential witnesses may be fearful for his/her lives vice versa the perpetrator should be fearful, if family take the law into their hands.

    I don’t think this is helping any one.

    See, I used to look forward in returning home for vacation but now with the way things are going on in Dominica ( people just killing people and out on the streets walking) I think I’m gonna go elsewhere. People spend more time in jail for possession of cannabis than those who kill. What kind of law does Dominica have. People are not safe anymore in that country. Who knows what those guys will do next when they are let out on the streets again? It only takes seconds to fire a bullet at someone or slash his/her head off. What are these judges or lawyers thinking? What if it was one of their relatives who was murdered, would the murderer be out on bail? Alas poor people in Dominica.There is the saying HOME SWEET HOME but I don’t think this home is sweet anymore

      Oh please…i hope where you are is crime free….the incidents that happen in Dominica is not random– the incidents are between individuals, so that’s the difference.     Take it or leave it, murder has always been a bailable offense under our laws. The difference is that the police cannot give bail to an accused murderer but a judge or magistrate can based on the circumstance outlined in the bail application. Matter of fact, bail for murder should only be granted under special conditions. Therefore the judge did not bring anything from Anguilla or british with her to our shores. If there is a problem, it may be her perception on what constitutes bail for this accused… Just maybe, the judge is not fully aware of precedences for granting bail in such cases in our jurisdiction. Having said that, there is obviously some serious problems in our criminal justice system. Hopefully the AG will take a closer look at this one and do what is right- REVOKE THE BAIL

      But in all fairness I really agree with what you said, where only special cases (if there are any,as far as I see) should be offered bail, and I do hope that the AG will revoke the bail. this is nonsense man, thats how many people out now on bail for murder?

    …. when they in jail they making sure they get one of the Dyers’ (Zena or Gina) for their lawyer so they can get bail, it seems that is a habit now… she must be making a hell of a lot of cash for these kind of cases.

    I don’t have any faith in this justice system anymore cause it doesn’t seem like it working if there still is JUSTICE in Dominica. How many accused murders out on the streets now, that must be a joke or a slap in the face to the public & hard-working police officers!!!

    …. he out on the street now among us civilized citizens of this country, pure BULL*** & injustice, he should remain on remand till his case is due.     Has our justice system fallen apart? I thought when someone killed someone the accused would be remanded in prison until his last day in court when the verdict is read – guilty or not guilty. I can see why they don’t hang people anymore. That’s why these guys are out there killing black is white, and they all run to Zena Dyer … I guess … the others before them were very unlucky.
