Alleged robber shot by police gets bail

Iam Massicot

A man who was shot by the police during a daring daylight robbery at the Marigot Credit Union got bail and walked away from a Roseau court on Monday.

Iam Massicot was on remand at the Dominican State Prison for his role in the crime.

He also spent time as a patient at the Princess Margaret Hospital suffering from a gun shot wound he reportedly suffered during a shootout with the police during the robbery which occurred on March 9, 2012.

Bail was set at $250,000.

As condition of bail Massicot is to report to the Portsmouth Police Station daily, stay away from prosecution witnesses and inform the authorities of any change in address.

Preliminary inquiry into the matter is set to begin at the Marigot Magistrate Court on September 12.

Massicot, along with alleged co-conspirators Mitchel Joseph, Jamie Andrew, Prinston George and Michel Azille, have been charged with attempted murder of Corporal Boycott Yankey, attempted murder of Inspector Oliver Frederick, attempted murder of Corporal Hans Francis, aggravated burglary with the use of firearms on the Marigot Credit Union, conspiracy to possess 9 rounds of 9-mm ammunition, conspiracy to possess one 28” gauge shot gun with intent to endanger lives, conspiracy to possess one sub-machine gun magazine with intent to endanger life, and robbery of $36, 851.45 from the Marigot Credit Union.

Neither the money nor the firearms used in the alleged crime have been recovered by the police.

THIS IS DISGRACEFUL..THE GUNS AND MONEY IS STILL OUTSTANDING AND THEY ARE OUT.Utterly Disgraceful.Vybz kartel in Jail for a witness they cannot get for 2 years now. do they give him bail ..no..they keep him in jail cuz it makes sense. Why would u let loose a guy that shoot at police vehicle while doing an arm robbery at a police station where none of the weapons and money have been found..

I am a Domincan by descent. These crime will get worse if nothing is done. I am a former Federal Agent with the Department of Jusitce and now a Police Officer. Bail for a person or persons who committed Armed Robbery and attempted Murder of Police Officers shoudl have no Bail.
When I was in Dominca lsast year the Prison System is a Joke. A structure in the prison system and the court system needs to be strong enough in order that they work hand in hand.
I also agree that possession of a small amount of drugs for a first offense requries bail and not a prison sentence. Attempted murder and bank robery requries no bail. Magistrates and Judges should look at the severtiy of the offenses and if the individuals have prior or pending charges.
Dominica is no way like the U.S.A in criminal activity but it is getting there and what is needed are the same rules and strengths in the law to combat and punish the actions of those that break the laws. I have seen it in murders, bank robbers, drug dealers, crime bosses and many others that I have dealt with and continue to deal with in arresting them. I have studied criminal activity in my education in obtaining my B.A. in the field of Criminology. I was thinking about moving to Dominica. I have many relatives along with my mother, sister and my father who is buried back home. Dominica is still a beautiful island but if the crime does not get stabilized quickly it will be like a volcano erupting.

so he was told to stay away from prosecution witnesses… how nice!!

One may assume that he was also told in the past to not shoot at policemen. Apparently he does not take such advise serious.

    So the consequence will be:

Robberies continue (the guys will have to “collect” the money for bail…), and witnesses have to fear for their lives. Eventually the case will be not strong due to a lack of witnesses. And acquittal! and more robberies! and the circle keeps spinning.

In other countries, bail is not granted in such obvious cases. Especially not, when there is a danger of witnesses being influenced or people mysteriously disappearing to neighbouring islands…

True..i am a law an order nut and a i follow alot of cases on TV. People with this serious offences in the states especially repeat offenders can never get bail for this.if they do get bail is house arrest with the ankle sensor and is normally after maybe 2 years..this is very disgraceful.police had to risk dere life shoot there way out of trouble only to have the same dudes out on the street couple months after..

I know that these magistrates and judges are reading the comments made by us CITIZENS!. Take heed to the comments being made because the population is getting very agitated and fed up of these Ridiculous sentences and Bails being granted to Criminals which actually supports their activity.
The worst thing is these Criminals attempted to take the lives of the Most important symbol to Law and Order in this country; Namely the POLICE!!. Ever stop to wonder when referencing to sections of law as guidelines to sentencing that What if the Police too become fed up of having their efforts and investigations wasted when Criminals are apprehended and later released on bail etc… And in turn either stop investigating or take a more radical(and Much needed National “Cleansing”) approach to criminal activity in this country? This will without a doubt bring about a Revolution in the Judicial atmosphere in Dominica.

You Magistrates and Judges are becoming a waste of time in this country and its only a matter of time before the people speak with actions rather than comments on radio stations and Blog sites…

    Be Guided accordingly..

My question is ” How can a country and its people just seat back and allow so much injustice to prevail in their land?”
This, don’t care attitude that I have seen among my people will and I say so with heavy hear, come back and hurt us if we continue to pass the “BUCK” to the other guy. The idea that “OH IT IS NOT MY PROBLEM, SOMEONE ELSE WILL FIX IT.”
I have also noticed that most people are in agreement that crime is wrong until it is their Pal Reps, friends, pastors, or family memebrs that commit the crime. Then all of a sudden it is “oh every body does wrong.”
My people it is time we stand up and put worng in wrong place and right in right place.
What kind of legal system are we allowing in our country to give bail to men who try to kill police officers? Never in any country can this happen!!
Don’t let them take Dominica from us!! If it the Gov’t that is responsible , then let us put the questions to them.

    September 4, 2012

    A joke that man?

How can a magistrate justify his/ her position on bail for these ROUGES & VAGABONDS as it relates to the facts in this case? Yes they are all innocent until proven guilty but the mere presence of “Primary Evidence” as presented by the police thus far, their past deviancy record, the attempted murder of law enforcement personnel and the fact that they have refused to corporate with law enforcement should have guaranteed a denial of bail. What school did that magistrate go to? Was his/ her decision swayed by the criminals choice of representation? What an insult to our collective intelligence!

We all know that by law bail is not meant to punish an individual but for other reasons deemed necessary one of them being to prevent the defendant from interfering with witnesses. Not only that, but the gravity of the alleged crimes (as reflected by the charges preferred) indicates how violent these ‘alleged perpetrators” can be and the threat they pose to the general public.

While the courts have the final say in matters of bail for serious offenses, it is very very sad to see the said court being part of the criminal justice system has little or no regard for the fellow officers of the court (Police Officers) who risk their live and that of family members simply by being police officers. How dare the court slap the faces of the officers who were almost murdered on that faithful day? When are we going to put things right in this country by saying no when NO needs to be said regardless of whom the NO is being said to.

Yet, on a daily basis we bash our police officers when we believe they are slacking up. How do we expect them to remain motivated, committed and professional when they court system (which they are part of) fail to recognize their hard work and life worth? Sadly, this renforces the common perception that our country and the system is no TETE-EH BAH (Upside down).

It is high time that the Criminal Justice System in Dca get cleansed so that justice can at least be seen to prevail. I will keep praying for my country.

    Assertive, NOT Agressive!

What a failure for a judicial system. How can a long listed criminal get bail? on top of that…Neither the money nor the firearms used in the alleged crime have been recovered by the police…”

Bail was set way too low, and if I was in these guys shoes I would try to leave the country. We all know that ppl “pass back door” all the time without being caught. If they could successfully acquire weapons and hid them after pulling such a calculated armed robbery, do you really think that they are one who would remain on island to be made an example? Although I must admit so far the example they set is one which says that I should go and commit crime and expect no punishment

The clearest signal yet and the boldest writing on the wall that Dominica is a doomed soceity where seasoned and hardened career riminals dictates the direction and destiny of this soceity.
How can a country have a justice system and a court that facilitates, colludes and conspires with criminals and is hell bent on rewarding them for inflicting the most heidous crimes on the soceity.
How the hell you mean the weapons used in the crime has nt yet been recovered and the money stolen is still in the criminals possession but you are granting bail. It is such a sad day for a country when it’s courts and it’s justice system cannot be trusted by decent right thinking and law abiding citizens. Dominica is in the throes of danger and disgrace. This court system is busy making this place a snare for civilise people

Dominican nationals have a right to be shocked and upset at this. The Judicial System has failed nationals. They are jokers. They do not take the safety of nationals seriously. How do the police feel about this weak judicial system? I would think that they too are disappointed.
In Dominica that amount of money has not yet been recovered? Unbelievable! Serious and consistent investigations need to be conducted. It must be hidden in someone’s home or hidden somewhere in Dominica.
Granting him bail who committed offences as attempted murders of the police and this type and amount of theft with a firearm, not found, that man and his accomplices (if caught) should remain in prison until the Court case. He is dangerous and a heartless one. He should never be allowed out in the public domain.
I am considering that there could be a reason why he was granted bail, not only to report daily to the Police Station and to stay away from witnesses, that he may be placed under constant surveillance day and night, hoping to catch him with the money. I hope so. The condition should also include a curfew, not going out at nights.
Whoever stood bail for him may have that money. They could be accomplices in aiding and abetting crime.
Judicial System you must do better than that. Dominica needs a better judicial system. They are failing Dominicans.

Twenty-five years ago before I went through the pain of having my son who was practically raised in church, commit a similar offence as this young man, I would have said like most of you are saying…”Put him in prison and throw the key.” through the pain my family and I experienced and the sense of gladness we experienced when he was bailed, I cannot help but feel for this young man and his family.
It is through pain we are often humbled and no wonder the bible tells us to weep with those who weep and rejoice with those that rejoice.
I am not by any means condoning what these guys did. In fact I am a member of the Marigot Credit Union and I was personally affected. But at the same time I have to put myself in the shoes of family members of these young men and the pain they are going through.
So instead of being so upset that they are bailed, let’s be thankful that they are not our family members and also, let’s hope that it would be a turning point in their lives.
By the way guys, remember that being bailed does not mean it is all over because it is going to be very hard for them not to find themselves behind bars. So let’s be merciful guys cause most of us commenting here are parents, brothers, sisters, and friends of people, and the evil we wish for others might very well be with us tomorow.

The ones to be blame is we the People we should vote for persons that will take up our causes and protect us from those Low lives Dogs” YES I said it” They are Dirt bags who set out to steal by any means necessary with out regard for human lives and their own lives. Oh how my little heart aches over the fact that criminals are constantly doing wrong, and are getting the feeling that they can get away. Our justice system and the West Indies team have something in common. And the commonality is, “lately they haven’t been working well.” I am of the view that some trades need to be made for the betterment of society. I rel sad Boy!

As condition of bail Massicot is to report to the Portsmouth Police Station daily, stay away from prosecution witnesses and inform the authorities of any change in address.

look nonsense, so allu doh think someting going to happen… stay away fom witness. these are the worst magistrates or judges we have in that country.. that man should under no condition get bail.. remmember that boy from bense they axe up his head

    • Easy does it
      September 3, 2012

They got rid of the good magistrates because they want to encourage lawlessness. They want that to be part of our culture.

I can’t understand how repeat offenders, whom have tried to kill officers and rob hard working people’s money are allowed to get bail. Doesn’t the DPP remand these thugs on bail violations at the very least?
How are the police supposed to feel when they put their lives on the line and these thugs walk. I mean really? Is this a joke? I’m all about a fair tail, but its probably time to start taking care of business out there.

You have a point. He committed attempted murder while out on bail for a drug case. This first case was tried about 2 weeks ago..smh at the justice system. Committing an offence while on bail should automatically mean no more bail

  59. hmmmmmmmmmmm
    September 3, 2012

you people single minded and just quick to talk before understanding anything, alleged means suspected not that your guilty of doing it smh
and he spent so long on remanded THEY hAVE NO MONEY,GUNS OR CONFESSIONS IN THER WORDS NO EVIDENCE HOW CAN THEY KEEP THEM IN JAIL??

      September 3, 2012

Didnt they see him when they shot him? Is he suing the police for shooting an innocent bystander, what suspect you’re talking about? The guy got shot in a police shoot out….he should not be bailed, if he is found not guilty, then he is a free man.

    • Anonymous
      September 3, 2012

so I guess it was alleged bullets too? and he had alledged injuries too? Or are you implying that since the only concrete evidence they have is the fact that he was shot by the Police, then the police are the criminals?

    • Not Nice
      September 3, 2012

so with what he was shooting at the police? obviously he was found with a gun in the vehicle half dead! fool

      September 3, 2012

      @ hmmm…

You lack basic common sense. Alleged does not mean he did not commit those crimes. He was caught and was injured. The fact is, he is not yet tried. Therefore he is alleged. It also does not mean that he is not guilty. Where is the money they stole? What happened to it?

that is total BS on our justice system. The people that bailing them more sutiweh given the nature of the crime. These guys are not nice guys who happened to fall on the wrong side of the law; is repeat offenders and gangsters that there. Im just baffled at this decisions. All them fellas granted bail, after all man. I thought the measures would be worse on them given there was attempted murder on police officers. I thought police and law officers was supposed to be looking out for one another and here it is they putting these guys back on the streets. JUST UNBELIEVABLE.

This is Dominica…had he been caught with a joint bail would have been set at $1,000,000.00. This place is the only place you can get arrested, get out and bail and leave your life and not worry about case going to trial cause you’ll be dead by the time your case is called…unless you were arrested for drugs

what the i hearing their..how the hell those guys get bail..Dominica is really lawless..they should discontinue the vehicular accident case against the custom officer in that case…since the people who are suppose to be punished are getting away…

There has been so much unsolved robberies and violent crimes and you mean to say they find the besst thing is to give those they catch bail? Are you serious? Wht is the lesson for the others to learn? A joke that man. I completely dissagree with that. They do the crime then let them do the time. NO to bail for criminals like that .

I am not satisfied with the last statement of this report. Why is it that neither the guns nor the money has been recovered by the police, is it that they are satisfied that just these men were captured. One person must be weaker than the others so they should have pressured him and cause him to talk

Whether they pay it or not they have to prove that they have it whether in cash or kind. Otherwise anybody could bail you.

If they bail out, jump bail, those who stood surety for him will pay for it. They could lose their property/assets.
