A man who was shot by the police during a daring daylight robbery at the Marigot Credit Union got bail and walked away from a Roseau court on Monday.
Iam Massicot was on remand at the Dominican State Prison for his role in the crime.
He also spent time as a patient at the Princess Margaret Hospital suffering from a gun shot wound he reportedly suffered during a shootout with the police during the robbery which occurred on March 9, 2012.
Bail was set at $250,000.
As condition of bail Massicot is to report to the Portsmouth Police Station daily, stay away from prosecution witnesses and inform the authorities of any change in address.
Preliminary inquiry into the matter is set to begin at the Marigot Magistrate Court on September 12.
Massicot, along with alleged co-conspirators Mitchel Joseph, Jamie Andrew, Prinston George and Michel Azille, have been charged with attempted murder of Corporal Boycott Yankey, attempted murder of Inspector Oliver Frederick, attempted murder of Corporal Hans Francis, aggravated burglary with the use of firearms on the Marigot Credit Union, conspiracy to possess 9 rounds of 9-mm ammunition, conspiracy to possess one 28” gauge shot gun with intent to endanger lives, conspiracy to possess one sub-machine gun magazine with intent to endanger life, and robbery of $36, 851.45 from the Marigot Credit Union.
Neither the money nor the firearms used in the alleged crime have been recovered by the police.

I am a Domincan by descent. These crime will get worse if nothing is done. I am a former Federal Agent with the Department of Jusitce and now a Police Officer. Bail for a person or persons who committed Armed Robbery and attempted Murder of Police Officers shoudl have no Bail.
When I was in Dominca lsast year the Prison System is a Joke. A structure in the prison system and the court system needs to be strong enough in order that they work hand in hand.
I also agree that possession of a small amount of drugs for a first offense requries bail and not a prison sentence. Attempted murder and bank robery requries no bail. Magistrates and Judges should look at the severtiy of the offenses and if the individuals have prior or pending charges.
Dominica is no way like the U.S.A in criminal activity but it is getting there and what is needed are the same rules and strengths in the law to combat and punish the actions of those that break the laws. I have seen it in murders, bank robbers, drug dealers, crime bosses and many others that I have dealt with and continue to deal with in arresting them. I have studied criminal activity in my education in obtaining my B.A. in the field of Criminology. I was thinking about moving to Dominica. I have many relatives along with my mother, sister and my father who is buried back home. Dominica is still a beautiful island but if the crime does not get stabilized quickly it will be like a volcano erupting.

One may assume that he was also told in the past to not shoot at policemen. Apparently he does not take such advise serious.
So the consequence will be:
Robberies continue (the guys will have to “collect” the money for bail…), and witnesses have to fear for their lives. Eventually the case will be not strong due to a lack of witnesses. And acquittal! and more robberies! and the circle keeps spinning.
In other countries, bail is not granted in such obvious cases. Especially not, when there is a danger of witnesses being influenced or people mysteriously disappearing to neighbouring islands…
True..i am a law an order nut and a i follow alot of cases on TV. People with this serious offences in the states especially repeat offenders can never get bail for this.if they do get bail is house arrest with the ankle sensor and is normally after maybe 2 years..this is very disgraceful.police had to risk dere life shoot there way out of trouble only to have the same dudes out on the street couple months after..

How can a magistrate justify his/ her position on bail for these ROUGES & VAGABONDS as it relates to the facts in this case? Yes they are all innocent until proven guilty but the mere presence of “Primary Evidence” as presented by the police thus far, their past deviancy record, the attempted murder of law enforcement personnel and the fact that they have refused to corporate with law enforcement should have guaranteed a denial of bail. What school did that magistrate go to? Was his/ her decision swayed by the criminals choice of representation? What an insult to our collective intelligence!
We all know that by law bail is not meant to punish an individual but for other reasons deemed necessary one of them being to prevent the defendant from interfering with witnesses. Not only that, but the gravity of the alleged crimes (as reflected by the charges preferred) indicates how violent these ‘alleged perpetrators” can be and the threat they pose to the general public.
While the courts have the final say in matters of bail for serious offenses, it is very very sad to see the said court being part of the criminal justice system has little or no regard for the fellow officers of the court (Police Officers) who risk their live and that of family members simply by being police officers. How dare the court slap the faces of the officers who were almost murdered on that faithful day? When are we going to put things right in this country by saying no when NO needs to be said regardless of whom the NO is being said to.
Yet, on a daily basis we bash our police officers when we believe they are slacking up. How do we expect them to remain motivated, committed and professional when they court system (which they are part of) fail to recognize their hard work and life worth? Sadly, this renforces the common perception that our country and the system is no TETE-EH BAH (Upside down).
It is high time that the Criminal Justice System in Dca get cleansed so that justice can at least be seen to prevail. I will keep praying for my country.

Bail was set way too low, and if I was in these guys shoes I would try to leave the country. We all know that ppl “pass back door” all the time without being caught. If they could successfully acquire weapons and hid them after pulling such a calculated armed robbery, do you really think that they are one who would remain on island to be made an example? I blame some of our lawyers in town for the level of crimes that we are experiencing. They go before judges and magistrates all the time and you would not believe the lengths that they go to to get their clients out. They say all kinds of things in courts when they know jolly well that their clients are rogues and vagabonds, murderers and thieves. One will say that they are just doing their jobs, fine, but when it hits and reaches home, I would like to know what they will say.

Dominican nationals have a right to be shocked and upset at this. The Judicial System has failed nationals. They are jokers. They do not take the safety of nationals seriously. How do the police feel about this weak judicial system? I would think that they too are disappointed.
In Dominica that amount of money has not yet been recovered? Unbelievable! Serious and consistent investigations need to be conducted. It must be hidden in someone’s home or hidden somewhere in Dominica.
Granting him bail who committed offences as attempted murders of the police and this type and amount of theft with a firearm, not found, that man and his accomplices (if caught) should remain in prison until the Court case. He is dangerous and a heartless one. He should never be allowed out in the public domain.
I am considering that there could be a reason why he was granted bail, not only to report daily to the Police Station and to stay away from witnesses, that he may be placed under constant surveillance day and night, hoping to catch him with the money. I hope so. The condition should also include a curfew, not going out at nights.
Whoever stood bail for him may have that money. They could be accomplices in aiding and abetting crime.
Judicial System you must do better than that. Dominica needs a better judicial system. They are failing Dominicans.

Twenty-five years ago before I went through the pain of having my son who was practically raised in church, commit a similar offence as this young man, I would have said like most of you are saying…”Put him in prison and throw the key.” through the pain my family and I experienced and the sense of gladness we experienced when he was bailed, I cannot help but feel for this young man and his family.
It is through pain we are often humbled and no wonder the bible tells us to weep with those who weep and rejoice with those that rejoice.
I am not by any means condoning what these guys did. In fact I am a member of the Marigot Credit Union and I was personally affected. But at the same time I have to put myself in the shoes of family members of these young men and the pain they are going through.
So instead of being so upset that they are bailed, let’s be thankful that they are not our family members and also, let’s hope that it would be a turning point in their lives.
By the way guys, remember that being bailed does not mean it is all over because it is going to be very hard for them not to find themselves behind bars. So let’s be merciful guys cause most of us commenting here are parents, brothers, sisters, and friends of people, and the evil we wish for others might very well be with us tomorow.

As a Dominican I feel the pain of this bail like all others, but I have come to realize the weakness is in our LAW BOOKS. Left to the police and DPP etc people like this would never step out of prison, but they have to go along with the BOOKS. The offense is a bailable one, plus evidence is sketchy therefore the books made no other provision than bail. My request to those in athourity is to review the LAW BOOKS please. They seem to be outdated for this new day and age Thank You

This place is the only place you can get arrested, get out and bail and leave your life and not worry about case going to trial cause you’ll be dead by the time your case is called…unless you were arrested for drugs

Neither the money nor the firearms used in the alleged crime have been recovered by the police and they are released on bail????..aye domnichen. sometimes i wonder on what basis are these decisions arrived at by our people in the justice system. smh

uh, you do know that they don’t actually pay the stated bail amount, right?
Whether they pay it or not they have to prove that they have it whether in cash or kind. Otherwise anybody could bail you.

If they bail out, jump bail, those who stood surety for him will pay for it. They could lose their property/assets.
