Appeal filed in dual citizenship case

Lawyers for two defeated election candidates of the opposition United Workers Party (UWP) have gone ahead and filed their appeal petition in the dual citizenship case against Prime Minister Roosevelt Skerrit and Education Minister Peter St Jean.

They confirm having filed the petition last week.

Earlier this year, High Court judge Gertal Thom dismissed the charges brought by UWP election candidate Ron Green, stating that he had failed to establish his case that Peter  St Jean was by virtue of his own act under acknowledgment of allegiance, obedience or adherence to a foreign power or State.

St Jean won the La Plaine constituency in the 2009 general election, defeating Green.

“I found the evidence of Mr. Felix Prosper to be unreliable. I find that Mr. St Jean was not on nomination day, December 2, 2009 disqualified pursuant to Section 32 (a) of the Constitution of Dominica from being elected as a Member of Parliament,” the judge wrote.

She also ruled that another UWP election candidate, Maynard Joseph, had failed to show that Prime Minister Skerrit was by virtue of his own act under acknowledgement of allegiance, obedience or adherence to a foreign power of State.

The judge ruled that Joseph had failed to provide evidence to show that election rival PM Skerrit by his own act applied for, renewed, or traveled on a French passport.

Among the UWP candidates’ several grounds of appeal are that the learned trial judge erred in law and  came to conclusions which no reasonable judicial officer would come to, and or acted irrationally and/or perversely in making the findings referred to.

They are also claiming that the judge  was wrong in failing to find that an inference, however weak, could be drawn or a case to answer had been made out on the basis on the facts referred to either individually or collectively, that the Respondents had each voluntarily acquired or travelled on French passports, and that their failure to give evidence to rebut these inferences strengthened the case against them and permitted the court to conclude that the Appellants had proved their cases.

The UWP is seeking to have the decision of the trial judge set aside and want Joseph to be declared the winner of the Vieille Case seat.

    One thing I must agree with – There is lot of ignorance and studpidy on this board. While you guys are cursing one another other folks are taking over our land. Look- the UWP has a right to appeal…….That is the process. Skerrit has a right to show or not to show his passport. What’s the problem? Please stop cutting each other up like lettuce.     What the UWP is doing am sure may be right but no one can tell me it’s all for the sake of justice and many of us know it. They are clearly doing so for their own personal reason but certainly not with the main interest of Dominicans at heart. People seem to forget they are a political party so all this emotions you guys coming with you must know that both of them are seeking their interest. I just don’t get it when we the citizens take these guys so serious as if they fighting for us. Every party must play politics to get into office hence the reason they are called political partys. The one in office have to play the best politics to stay in while the other/s have to play their best to get in. Its too often that the citizens get fooled into thinking that the politicians are their best buddy, ofcourse they will try in many ways to help but we take things way to emotional. They are just humans which means they do not have magic wands, people tend to forget that they have to get up their butts and go work no matter who’s in office.

    How are we going to build a prosperous and peaceful nation when matters like these take priority in our discuss, noticeably it has not changed the way Dominicans live, neither brought down the cost of living, or put a meal on a poor family’s table, but certainly a lawyer has been paid.
    I say this to say, the opposition has made a positive step by entering into the house and firmly standing their ground against all odds voicing their opinions and start being the watch dogs of the Government, so therefore I would say kudus to the opposition. BUT the return to court in my opinion is taking a step backward, please bury the hatchet..

    If the efforts of the patriots to restore honor and respect for the constitution is considered a waste of time and money then so be it. I am no supporter of any political party but I’m a proud parent and loyal citizen of Dominica who would like to preserve the sovereignty and dignity of our country. I am absolutely sure that the very same people who condone lawlessness among politicians are concerned about the growing crime statistics in Dominica. The alarming rate of crime and disregard for law and law enforcement can be attributed to many factors other than political misconduct however to pretend that it is OK for political leaders to dump on the constitution is total hypocrisy and symbolic of a people who have lost pride in themselves and basic human self respect. How can a people in this day and age allow a few politicians to walk them into Georgetown to drink the poison- for one man? I have to be fair and state that Ron Green is guilty of deception just the ; maybe less brash and arrogant.

    Situational morality and selective law enforcement is a definite sign of a very corrupt government and society. Some things /issues are cut and dry and with basic common sense and intelligence we should not be amenable to any political meandering or spin bowling be it from party Blue or Red. What is a definite waste of money and time is the $27 million dollar mansion where Dominicans are too pay back that loan yet Dominicans are not getting even 5% of the return benefit.

    The appeal is the effort of the patriots , those of us who really care about the future of Dominica. Some of us don’t want to leave a legacy of corruption and deception for our children. How many of us would like to tell our children that they must pattern their behavior on that of Roosevelt Skerrit, Petta St Jean , Tony Astaphan and Ron Green. I am sure that if we search the primarily Christian nurtured being very few of us would be proud of the behavior of these characters. So why hold them up on a pedestal. Why not return to country and sincerity of heart and call a spade a spade. I have what about you!!!!! Yes You

    No doubt that Skeritt and St. Jean are not qualified to lead us and the Judge was very bias as expected, when she dismissed the case.
    However, UWP would better serve the concerns of Dominicans by saving this money they are once again going to throw on attorneys. We all know that all judges in the caribbean are mem bet mem pwel, and there is no way they going to make the former judge look bad. Again, don’t forget money talks loudly, just as it may have done with that Bangladeshi news paper.

        hi ibeg to differ as a teacher myself, teachers don’t want students to beat them up. We have restrictions and laws we must follow as teachers lest we get prosecuted by the law, even when it involves our safety and us defending ourselves. This is what needs to be addressed

      Maybe you should spend some time reading and enhancing your intellectual capabilities. Go to the libraries, read the New York Times , listen to intelligent discussions and adopt objectivity. You are living in the US and there is no excuse for your ignorance when there are so many avenues to personal upliftment.Surely you must understand by now that no politician is above the law.

      As minorities in America we cry foul every day because of discrimination , prejudice and biasness every day but injustice somewhere is a travesty everywhere. Why do you cry down preferential treatment for some in some cases and glorify preferential treatment for others in other places.

      Elevate yourself from the bondage of the small island mentality and broaden your mental base. If you are concerned about the country and it’s people your responsibility is to insure the the people charged with the responsibility to govern the policies and affairs of the country are law abiding and people of integrity- nothing less. When they are not Blue , Red or Green you must call the game for what it is.

The country will continue to slide down to the abyss because persons like you are quite prepared to sweep every wrong under the carpet. We may not always agree with every law or rule but until such time as that law or rule is changed, we should abide by it. Skerritt was not forced to call elections the time he did, he knew he was in violation, so why shouldn’t he be called to account for his actions? When you people will want to take a stand for truth it will be too late.

      Am I missing something here. The court has ruled that your take on it is wrong. They do have a right to appeal but I don’t see much of a difference in the rulling. We took the matter to court, the court has spoken, let us prepare for the next election.

    What is wrong with the UWP? It seems they have lost their minds, they certainly do not exercise good judgement! They lost the elections (fair and square), they lost all their election petitions (in the courts) and know they waisting time and money again!

    You would think they would learn from their mistakes and focus on issues important to the Dominican people. They really are lost in the wilderness without any ideas or a clear vision for the future development of our beloved Dominica.

      I am not a Dominican my husband is and his 100% Skeritte and when we talk about Skeritte for him the pm is a god sent so i ask him why are u saying that he replied my father n mother was red so i am red too so i said to him there are persons who were not red in the government then, if u doh like it go back to yr country . i cried like a child but when i remember he cant write his name i stop crying and next day on the radio tony was on then so i say to my self but tony cant write his name too.

What is wrong with the Dominican people? Mr. Wulff is to be accused of accepting favors during his stay as Governor of the State of Lower Saxony.
