Bernard Wiltshire gets bail

Dominica’s former attorney general, Bernard Wiltshire, has been placed on EC$50,000.00 bail after he was arrested on Monday January 30, 2012 by the police.

Late last year, Wiltshire who has since filed a civil law suit against the police and government for false imprisonment and arrest, was detained by the police for questioning after he had endorsed a passport form in the name of Younis Abraham.

He is now jointly charged with Harolda Henry of Grand Bay, Lyndon Marie and Nash Mitchell for conspiracy to fraudulently obtain a Commonwealth of Dominica passport.

Henry is an employee of the Dominica Planned Parenthood Association (DPPA) and was granted bail of EC$50,000.00 with her boss Willie Fevrier as surety.

Mitchell and Marie were also each granted bail of the same amount.

In June last year, a high court judge granted bail to Marie and Mitchell (two public servants) who had been remanded on charges related to a major passport scam.

Nash Mitchel and Lyndon Marie received bail in the sum of $75,000 each, with strict conditions.

Among these conditions, Mitchel and Marie are to surrender their travel documents and report to the Roseau Police station three times a week.

The two had initially applied for bail at a Roseau Magistrate’s court but were denied.

Former Agriculture Minister, Athie Martin, stood bail for Wiltshire and the matter is set for trial on May 18, 2012.

Wiltshire’s lawyer David Bruney forcefully asked the court for immediate disclosure in the matter after investigating officer Inspector Matthew Cuffy told the court, “The file was complete but had to be vetted by higher authorities.”

“Your Worship, my client is an officer of the court and needs his name cleared and so we need prompt disclosure so as to proceed with our next course of action,” Bruney told the court.

After being assured that the file was indeed complete from the investigating officer, Magistrate Candia Carette George ordered disclosure for Friday February 3, 2012.

However she stated that it was not being granted because Wiltshire was “an officer of the court but because the investigating officer had stated that the file was complete.”

Speaking from the prisoners dock, Wiltshire told the court that “this is the first time that I am speaking to Nash Mitchell, this is clear political victimization by the government of me. It is disgusting and comes from the top.”

In addition to the 14 charges brought against Marie and Mitchell when they were first charged in May last year, they faced three more charges at a hearing on June 14 and now are slapped with one additional charge.

These included alleged forgery and uttering of forged documents with a view to obtain false passports.

The alleged scam occurred between August 25 2005 and 31 March 2011.

Meanwhile, one other co-accused Kimana James is out on bail after facing five charges in connection with the matter.

    Well well serious allegations that has lead us to arrest Willy boy; In comparison serious allegations against others have gone into hybernation Seco Sico..etc The “Easy-door” has 42 charges filed against him a Magistrate warrant for his arrest; refresh your minds – among them are the break in of Gorn Emmanuel Offices in Roseau; then there is the Fire bombing of his house in St Aroma; SC take infront run to police station and say the ‘Easy-one’ not in that nuh! without any accusation or police interest in the door nuh!! up to now police doh make no arrest; but eh eh they could at least cut a vari by arresting the ‘door’ and then release him so that if the evidence becomes to the fore they could re arrest him again but he apparently is not a Willy. But no sa; as if that was not enough the ‘Easy one’ and the ‘AM PM’ get involved in an alleged fradulent land deal; Matt expose them – they run and pay money back to the State- and say is a mistake!! no police and or DPP press charges nuh in fact according to Sparrow they became ‘Good Citizens’ after that wee; Willy boy you make a mistake and they ready to pin everything on you – hold strong partner; Willy may be under stress but Willy eh dead; the truth shall prevail take time.

    I pride myself to be fair and just and, at the same time, to weigh out situations. In many instances, never to take sides but to speak and write the truth as the circumstances call for it. This is hereditary.
    When I read that Wiltshire had to surrender his passport, I asked myself why did Sarah Lyn Augustine, a Canadian who was a resident of Canada, one who murdered her two young children – babies, was granted bail and was to appear in Court in January this year not be asked to surrender her passport? It appears that she was definitely a flight risk. Why was she allowed to leave DA prior to the Court hearing?
    Was the DPP aware that she left DA or did he find out later that she left DA? It appears to me that a two-tier system, an unfair one exists in DA.
    We have yet to hear further concrete information why the DPP took it upon himself to “discontinue a double-murder case” without a hearing. Something is wrong with your system. A change of DA authorities in every respect is required.
    In all fairness to Bernard Wiltshire, I do not think that he would skip bail and for good. He filed a complaint for false accusation to clear his name. Why would he want to leave DA? If he wanted to leave DA he would have done so previously.
    Some of you authorities do not utilize your basic common sense. Do you have any! You are in dire need of re-training accordingly.
    Be fair and just to all. Never practice preferential treatment towards others, your fellow people.
    As God looks on, hearing and taking note as I always say, the day will come when you will pay a dear price for it. What you sow you shall surely reap in time. No one escapes. This is the Word and promise of Our Lord Jesus Christ who is faithful and true.

As an Attorney and an officer of the court he should have known it is illegal to sign a passport form for someone you do not know. The is a warning on the passport form of fraudulent information.     This is shocking and is a scandal, selling Dominica passports. Those who do should be tried for treason.
    Dominica should have a constitution against selling its passports.
    Dominica is not for sale and under no conditions should its passports be sold. Those passports as we very well know could end up in the hands of unscrupulous people and non-democratic countries, the enemies of democracy.
    If this is a way to obtain investments in Dominica, it is not worth it. It is like luring investors to Dominica by selling its passports to them. This should never have been allowed. I do hope that this practice ceases once and for all.
    Those who wish to invest in Dominica should follow ethical procedures. They should first be thoroughly investigated and with Police records. They should not be aware that an investigation is being conducted on them. If they have proven to be legitimate investors only then should they be allowed in Dominica to conduct business. By no means should they be promised a Dominican passport or pay for it.
    After residing in DA for five years and they have conducted themselves and their business venture ethically, they could then apply for citizenship in DA. They should never be given a passport or a passport sold to them prior to fulfilling those conditions.
    Finally, those who are employed at the passport office should be employees of integrity and should conduct themselves accordingly. If they did, there would be no reason to suspect them and to arrest them.
    Dominican nationals have paid dearly for this. They have every right to be angry. They are not able to travel to the U.S., Canada and I expect Great Britain without a Visa. This has inconvenienced them and is costly to travel to another country to obtain same. They will be fortunate if they are granted a Visa. I view this as pathetic that DA nationals.

        Their statements will not make news because for now they are innuendoes and not yet proven in Court. The U.S./Canadian/British Media are not interested in that but the news that some countries are selling passports to specifically Arab citizens, residents of non-democratic countries, the enemies of democracy, to other people of questionable character, as also the Mafia and those who are involved in Ponzi schemes. For obviouus reasons they will be interested and it will make international news.
        Once they have obtained DA or other West Indian islands passports, they could obtain a Visa where necessary to obtain same and can travel to many countries of the world. Keep in mind 9-11 and other terrorists’ acts. Those countries are doing their utmost to keep out terrorists, their acts and, if caught, to prosecute them for good reasons.
        Dominica and other West Indian islands are vulnerable to terrorists’ acts. Therefore, those governments and government employees must practice good ethnics and ensure that those passports are not sold and get into the hands of such people.
        In effect, passports should never be sold to anyone. Those who qualify for a passport should only pay for the service of obtaining same and nothing more.
        It should be a criminal offense to sell our DA passports or any passport of other countries. In time may it be an offense. This is the best reason and information that I can offer.

      I would expect that this would make international news and give DA and its authorities additional bad reputation. However, when Sarah Lyn Augustine, a Canadian, murdered her two children in DA and was allowed to leave while on bail without a Court hearing, it appears that it did not make international news, specifically in Canada. I find this strange that some people protected her from prosecution and to leave DA. This is a serious case and an offense, criminal and negligence on the part of those who were involved in this case. Expect that her name will always come up.

    Foreigner sold passports upon passports upon Dominican passports. The operation mis-named, “Economic Citizenship Programme.” Millions were made. Millions were placed in some ESCROW Account somewhere. That particular sales agent promised to build a FIVE-STAR LAYOU RIVER HOTEL. Where all that money go? To whom? Where is the hotel? Companies upon companies formed. KOKOMAKAK Toubonman. For those foreigners, who were the main architects and sales agents at the time, although things went bad, no transparency, No accountability. Nobody could touch them. No arrest. No court case. Not a minute in a cell.

    The Dominican Wiltshire is being hunted, harassed, victimized. No amount of victimization will daunt the spirit of patriots. WE FEAR only our GOD. The other three famous lawyers (Dominicans know them)are Papa God’s angels, they could do no wrong? No arrest, no court for them even, as alledged, they have done wrong? Reflect on those also and see for yourself why none among those three Lawyers will be touched at all. Dominica a Paradise. But some people love the foreigner so much they could sell our passports, make plenty, plenty $$$$$$$ from those sales, FOOL us about Five-Star hotel, take off, and Nothing happens. That foreigner, a major passport sales agent took many Dominicans for Mouton Batali. Wiltshire is the scapegoat.

    Wiltshire may well have signed a passport for someone who he may not know well. This can happen to anyone. I have many friends, especially from my village, that have children I do not know. But if a mother comes to me asking me to help her child, based on the fact that I know her very well, I may be moved to do it….may

    This is something that should not be done, but we have a tendency to feel sorry for people and take people at face value. Now this has happened to Wiltshire, it will help others to be alot more careful in the future.

    On another note, I think Wiltshire arrest is politically motivated, and I personally do not feel that Wiltshire got a cent from this transaction. This is my gut feeling.

    Wiltshire is first but many more behind, so do not laugh too loud, there is a God above who sees all and knows all.

    The passport selling scam never stopped – the UWP started the scandal and when Rossie took office it did not stop. I know for sure that people were traveling with envelopes of passports to Libya and other places in the middle East.

    Why is it Mr Wiltshire is trying to get sympathy. He has been charged for conspiracy to fraudulently obtain a Commonwealth of Dominica passport, why can he not wait for the case to be called so as to produce his evidence in court to prove his innocence,he is an Attorney he should know better, stop politicizing the case.As a former Attorney General this does not reflect highly of him at all to be implicated in such alleged conspiracy.

    The question of his mistreatment by Police after his arrest on the charges and his Law suit against the Police should be done after the the initial charges are dealt with depending on the out come of the case. I think it is arbitrarily foolish to comment on the case since we do not know what evidence the Government has to prove Mr Wiltshire involvement in such conspiracy.

    Obviously, oppositional politics in Dominica is in crisis. Arguably, it may be that the UWP’s most discomforting nemesis is not Roosevelt Skerrit’s maverick populist politics (although it is an obvious thorn), but more profoundly its own obsolete philosophical and instrumental conception of party politics. It appears that the UWP seems yet to recognize and accept that the “electoral professional party” has replaced the “mass bureaucratic party” in conventional politics. I suspect that until the party becomes more adept at this more complex model, it may continue struggling to follow or counter the growing sophistication of party management, especially within the Westminster model. I wish the new leadership well, because Dominica needs a strong opposition (whichever party). I believe that the party leaders may find Angelo Panebianco’s (1988) text Political Parties: Organization and Power useful in developing more successful administrative and campaign strategies.

    Wiltshire, Please don’t deviate from the issue here. It’s not police brutality here. This can be discussed later. Lets discuss your involvement. The role you played and the real reason why you were arrested and now before the court. Whether you intentionally broke the law or not you did it. The Court will decide your fate. You know the police did nothing wrong. It’s their responsibility to investigate such incidents and where there is evidence of wrong doing to prefer charges. The DPP must have directed the police in such a case. Lets hear what he has to say. The police isn’t in the wrong here.

    DNO, please help us readers. Which crime is more heinous, the firebombing criminal offences committed against GON Emanuel and his wife or Wiltshire signing a passport form? Which is more criminal, the alledged 42 charges of FRAUD and other criminal acts committed against GON Emanuel or the signing of the passport form?

    Isn’t the signing of 40 of those same passport forms, by a top lawyer, 40 times worse than the signing of only one by Wiltshire? No arrest. No court case though for that one?

    Didn’t the court issue an arrest warrant for a certain lawyer which was subsequently sent to the police for action? What happened? No arrest. Is so Dominica come? The media, journalists, honest, truthful fearless Dominicans aren’t you seeing the trends? Freightening? Fear No More.

      Have no fear sir, once you have known the individual for more than two years. The problem is when you sign for someone you do not know, e.g. a frienf ask you to sign a form for someone you do not know. By signing that form then you are saying that you do know the person. In short you are lying.

    Finally, some questions will be answered with regards to the passport scam(s). If these defendants are innocent, then, they will be exonerated. Even then, they should use this opportunity to make lemonade with the alleged lemons handed to them.

    A good attorney should use that opportunity to probe into the sale of Dominica’s passports and the economic citizenship scheme. How many passports have been sold? Who bought them? Who sold them? Who profitted? Were all transactions legal? A can of worms has been opened and we should embrace it to seek the answers we were clamouring for. If these defendants have broken the law, then let them face the consequences. So should everyone else who may be involved in any illegal sale of our passports or the misappropriation of funds made from legitimate sales.

    Let the chips fall where they may since justice is served. I would hate to see the country degenerate into chaos and have justice served on a cold dish.

    DNO allows Doc.love to condemn some people, going as far as mentioning the names of those patriots whose time Doc.love thinks is coming to be arrested as well. No censorship. Such comments are OK. Those who dare exercise their God-given Rights, as enshrined in our Constitution, to speak against corrupt practices, should be arrested according to Doc. love. It is just a matter of time?

    Why are those comments not censored, but accepted and published, while genuine, honest, non-libellous or derogatory comments disallowed? Why do those things happen? Freedom of speech for some, but not for others? censorship of truthful,objective comments, but acceptance of those with names of Dominicans, who Doc. Love hopes that their time is soon to be arrested? DNO, other print or electronic media, media practitioners, patriots, all will face the brunt of the assault.

    I ask DNO, “Wasn’t an arrest warrant signed and issued by the court for the arrest of a certain lawyer?” DNO is aware of that as well as all Dominicans. What happened?
    Censor, censor, censor, but the TRUTH must come to light. Censor that piece again. I will not be surprised. My confirmation of exactly what is going on would be deepened.

    Section F of the instructions for completimg the passport application form states the follwing: The recommender must be a citizen of the Commonwealth of
    Dominica who knows the applicant for two (2) years or more,
    but must not be a member of the applicant’s immediate family.
    The recommender is also required to endorse the reverse side
    of one copy of the photograph with the words:
    “I certify that this is a true likeness of Mr., Mrs. or Miss
    ………………………………….” and add his signature.

    Section 9 of the appliction form notes the following: IMPORTANT: Applicant and recommender (see Section 9) are warned that should any statement contained in their respective declarations
    prove to be untrue, the consequences to them may be serious. The attention of persons who are asked to sign this declaration is specially
    called to the fact that it must be signed from personal knowledge of the applicant and not from information obtained from other persons, and
    the recommender should have known the applicant for a least two (2) years.

        I think not. He is still innocent until proven otherwise. While many seem to be convinced that it is political, I do not.
        Do you believe that the police would arrest him just for political mileage and cannot prove their accusation in court. They have to be convinced that they can obtain a conviction to arrest and charge.

    If in fact Mr. Wiltshire endorsed a passport form in the name of Younis Abraham to fraudulently obtain a Commonwealth of Dominica passport, he should be prosecuted to the full extent of the law. The fact that he is “an officer of the court” only makes it worse! He may have been fooled by some other individual, but if that is the case what does that say about his competency and ability as a lawyer?

      The police investigate and make arrests. They do not prosecute. The Director of Public Prosecution, (DPP), and other prosecutors are the ones who determine whether a case has merit to be prosecuted.

      But I agree with you that the police sometimes over-reach and persecute. In the late 70’s and early 80’s I’ve had my home searched, my bag searched in public without a warrant, (officer was fired after I wrote to the Commissioner), and I had my film taken from my camera and had several M-16’s and 303 rifles pointed at me by Special Unit Task Force officers who were on the verge of arresting sensay and ‘black devil’ revelers in South City. Officer Blanchard also threatened to search and arrest me while going through the Botanical Gardens on my way to SIFOCOL, (at UWI Extra Mural Center at the time- 1977) just because I was wearing a tam and carrying my books in a canvas back pack. So these things are not new. But TMI already. I enjoy my annonimity!!

      So simple-minded! Do your research before making knee-jerk comments. There is an hierarchy in ALL systems of justice the world over. Felony crimes (such that is alleged here) always go through a vetting process (it’s like the grand jury system in the US and other jurisdictions), even after initiating an arrest on probable cause, before the court hears the case on trial.

    The home of a Police Officer, who told Dominicans and the world that he is investigating money-laundering, was FIREBOMBED. What about the status of the investigations into that heinous crime?

    The home of GON Emanuel and his wife were FIREBOMBED. Emanuel filed 42 charges of FRAUD and other criminal acts allegedly committed by another lawyer, who worked in his law firm. What about those investigations, after more than a year?

    The Chief Magistrate signed and issued a Warrant to arrest that Lawyer as relates to that same case filed by GON Emanuel. The warrant to arrest was sent to the police for further action. What happened? The Ag. Chief at the time told Dominicans and the world that no arrest could be done because he, the Ag. Chief, was OUT OF STATE. Dominicans know all about it. No arrest.

    The court’s decision was disregarded, disrespected. Interestingly, the Court has said or done absolutely NOTHING, although its orders were disobeyed. Assets of that lawyer have been frozen by the same court, but no arrest for the UNTOUCHABLE. Instead, TECHNICALITY. JUDICIAL REVIEW. Why are some of our people so blind that they just cannot see where our beloved Dominica is heading? Why are those things accepted by sections of our society? Because of Greed, selfishness, protection for the “Big Boys”, break down of law and order, victimization, Inequality, spiritual and cultural degradation, Mental Slavery, defence and protection of the few UNTOUCHABLES? What is it non Bon Dieu? Your guess is as good as mine. Was Mighty Sparrow correct in singing decades ago, “We Like it so.”
