Shane Degallerie gets 18 years for murder

Shane Degallerie has been sentenced to 18 years behind bars for the murder of Justin Joseph.

The time spent on remand was deducted from the sentence.

Degallerie, of Pottersville, was accused of stabbing Joseph to death on April 23, 2010.

The incident occurred at a shop in Pottersville, after a quarrel.

He was found guilty of the crime last month.

He was sentenced on Friday morning at the High Court in Roseau.

    Whatever happened to just hanging a murderer. Just asking? I remember people getting hanged and we had very little murders. I am all for an eye for an eye. Kill and get killed. Sounds cruel? What about the victim’s family? does anyone care about their pain? I’m really sad about this situation. If it is not self-defense, life in prison or hanging.

    I think that the minimum sentence for murder should be 25 years; nothing less than that.

    In the days of Old Israel, if a person was tried and found guilty of willful murder, he was to be given up to the family of the person he killed so that they would stone him to death. For the wages of sin is death–the Law of God says “thou shall not kill” So murder is a sin in God’s opinion

    If that person’s killing was by self-defense for example, he would be sent to the place which was called “The City of Refuge”–which belonged to his location, there, he should remain until the High Priest of his congregation died–that could sometimes mean much more than 25 years for manslaughter; and stoned to death for willful murder.

    Wickedness and evil conducts will never end in places like Dominica, where the law is inept. This young man took someone’s Life but by the time his prison term is up he could still have a whole Life ahead of him–Lord look upon the innocent, the weak, and the disadvantaged. Amen!

    So the message the high court is sending to the general public.is if some body kill your family is best you kill them back and that will be ok because God said to Hang them They should not go unpunished and the high court say 18 years is enough for murderers shame on them. Let me say something they Trinidad criminals including two police officers killed my two brothers first my brother Jonny Melville was murdered then my Brother Roger Obrian Melville was killed in cold blooded murderers and my brother and sisters neither me can get over it you think it easy to see you berrying your youngers and the murderers walking free

When a loved one is gone, not by the will of God but by the hands of those who care less about another man’s life is incomprehensible. Yes, the Judges/ Magistrates are too lenient on MURDERERS. I did not know you suffered two losses of the same kind. Hearing of the frequency of these crimes and the sentencing the MURDERERS get as punishment makes me sick.       Hello Yolanda, I cannot feel your pain but I want to express my sympathies to you and your family. I would like you to think about the life your brothers would want you to lead.

      Become an advocate to help end the violence in Dominica, if you live in the country. We need to halt the cycle of violence in the country, and I am not sure if hanging them would be the answer. But – in my opinion- life in prison like in the BVI would be a greater punishment than a swift end. But eighteen years (18) for taking a person’s life is unadulterated madness in the country, and there needs to be some type of intervention by Parliament so the constitution can grant the judges greater latitude, if that is the problem.

      I believe that your focus should be on creating a citizen’s group that would pressure Parliament. That I believe would represent a lasting peace for you, and the memory and legacy of your brothers would live for a longtime through your advocacy and because of the work you have done to honor them.

    a couple weeks ago Justice Redhead in BVI sentenced a guy to life without parole for murdering his dominican ex-girlfriend.

    we really need some new judges now. time for a change. bring Justice Redhead to Dominica.

    There is nothing wrong with HANGING that is scriptural. It is time for Dominicans to take to the streets and demonstrate to bring back the DEATH PENALTY and clean the country of those rotten criminals you send them to Jail they come out and go back to the same criminal activities any law or court that fail to impose the death penalty is UNGODLY don’t tell me nothing about old or new testament. The Bible say the murderer shall not go unpunished in Genesis 9 God said the dread of you and the fear of you shall be upon every beast of the field into your hands are they delivered. That is still so today, the rainbow is still there.so why man wants to change the rest the same scripture say And the blood of every man will I require at the hands of man WHOSO SHEDDETH MANS BLOOD BY MAN SHALL HIS BLOOD BE SHED. And the word said that is for Perpetual generations that means everlasting generations the jury’s and Judges must read the scripture before they sentence murderers.       All countries where the death penalty was abolished, people are crying for it to be reinstated. Some politicians do not want it. This is what is holding it back. These days there are too many murders that the death penalty should be reinstated.
      I do not think that Dominica has abolished the death penalty. It just is not being enforced.

    Those jurists are not serious about sending a clear message to those whose everyday wish is to “kill” a man. The man was found guilty for murder. Eighteen years sentence minus 3 years behind bars is no real deterrent. I do not know what is the code of conduct that is used by the judges when handing down a sentence. But it would seem that 18 years is the maximum. It would seem that life sentences for crimes such as murder has gone out of the window. Are the judges imposing their values on the legal system?

    The minister of legal affairs and the Hon. Attorney General must take note and pass the requisite legislation that would mandate a minimum sentence before parole is considered. e.g “I sentence you to 30 years in prison with the possibility of parole after serving a minimum 10 years. In order words, on a sentence of 30 years, you must serve 20 years before any consideration for possible early release. In that way, those who live wishing to “kill” a man will think twice considering that the death penalty is all but removed from the statute books. If after that gruesome “Al Capone” case, the state is not prepared to go for the death penalty, then one wonders what murder conviction they will even want to consider the death penalty. the times demand that we take steps to put in place serious penalties for those ugly crimes. 18 years for murder with the possibility of release after 9 years is just not enough. A life was taken innocently and will never come back. The murder has been given another opportunity to come out perhaps murder another person.

      No it does not…..convicts only serve two thirds(2/3) of their sentence. Which means 12 years with good behavior he might be out within lets say 8-11 years.And thats the truth……

      I don’t think Dominica even has a parole system. This system was introduced in the US to deal with their prison overcrowding problem.
