Cabral Douglas to sue gov’t over Tommy Lee Sparta affair

Cabral Douglas is presently preparing to sue the government of Dominica at the Caribbean Court of Justice (CCJ) for what he said was the illegal arrest, dentention, and deportation of controversial Jamaican artiste, Tommy Lee Sparta, and his entourage in 2014.

Tommy Lee, whose real name is Leroy Russell, was to perform at a concert in February 2014 in Portsmouth, organized by Douglas, however, organizations, such as the Dominica Association of Evangelical Churches denounced the artiste’s appearance saying his music glorifies Satan and promotes lawlessness and violence.

On his arrival in Dominica, Tommy Lee, 26, along with his three-member team, Tiasha Oralie Russell, Junior Fraser and Mario Christopher Wallace were denied entry, detained and deported the following day.

The government of Dominica said its action was based in the interest of public safety.

Douglas, who is the son of former Prime Minister, Rosie Douglas, is arguing that the concert was organized in reliance of the relevant free movement provisions outlined in the Revised Treaty of Chaguaramas (RTC) and the action by the government was in breach of the Treaty signed by CARICOM member states.

“Just because Dominica is one of the smaller countries in CARICOM does not excuse the small mindedness demonstrated by the leadership of that country…if anyone can be accused to practicing evil, it’s certainly not Tommy Lee but rather the leadership of Dominica as evidenced by the barbaric, vindictive and inhumane treatment of innocent skilled CARICOM nationals contracted to work in Dominica,” Douglas said.

He stated that the cancellation of the event has given rise various monetary damages claims by him, in addition to the damages claims made on behalf of the Jamaican claimants which have been channelled through the Jamaican office of the Attorney General for various breaches under the Revised Treaty of Chaguaramas (RTC).

“How can Dominica hypocritically advocate for free movement it its capacity as chair of CARICOM on the one hand, whilst arbitrarily detaining, deporting and humiliating skilled CARICOM nationals contracted to work in Dominica on the other?” Douglas questioned, as Prime Minister, Roosevelt Skerrit takes on the chair of the regional bloc effective July 1. “This is an affront to the spirit of regional integration.”

It was reported that the Government of Dominica, on May 3, 2015, announced a desire for an “amicable” negotiated settlement in the matter.

Subsequent to this announcement, Douglas’ legal team led by Jamaica’s Bert Samuels was invited by the office of the Attorney General to submit proof of claims as required by the negotiation process which has been ongoing.

According to Douglas, after spending significant time preparing, substantiating and submitting these claims, it now appears that the Government of Dominica has unilaterally reneged on their commitment to have the matter settled out of court. A letter from the Chambers of the Attorney General, dated May 18, 2016, stated that the government does not accept any liability or responsibility for any of the claims.

“I think the refusal of the Skerrit administration to honour its Treaty obligations as it pertains to the free movement of skilled community nationals not only poses a grave danger to the economic interests Dominican individuals and corporate entities seeking to contract with skilled CARICOM nationals but it also undermines the credibility of CARICOM itself, and Dominica’s position as Chair responsible for the implementation of free movement within its quasi-cabinet,” Douglas argued. “I suspect that Roosevelt Skerrit, a man that has already declared to Dominicans locally that no law/no constitution can stop him is now promoting the same lawlessness within CARICOM. If his objective is to isolate Dominica as a backward police state with no regards for human rights, free movement and free enterprise then he should be man enough withdraw from CARICOM, suspend the constitution and declare martial law in Dominica,”he said.

Douglas has appointed a Trinidad-based Senior Counsel to lead the litigation phase of matter.

“As long as the rule of law still exists within CARICOM, I will be seeking special leave to appear before the CCJ to enforce my rights and the rights of CARICOM nationals under relevant provisions of the (RTC) as I remain committed to the principles of regional integration, human rights and free enterprise which are the foundations of economic development in Dominica and the Caribbean region, as intended by the framers of the
RTC,” he stated.

    Not a fan of Tommy Lee but the whole Uncle Demon thing was a gimmick he ran. Let’s be real, who’s gonna worship Satan after listening to that crap?

    It’s nice to see the church people standing up against ‘devil music’…but where were they when that former gov’t minister that’s been accused of inappropriate behavior was front and center campaigning for his party?

    Why aren’t the church figures standing up for the people of Dominica or attempting to educate them about the terrible so-called leaders?

    With that said, what the gov’t did was unconstitutional. Whether you like Tommy Lee or not, they kinda crossed the line.

      Also the ”leaders” you mentioned were your own people. They were not coming into the country and needed no border clearance. They were not about to make a presentation to the public like Tommy Lee that would influence hundreds of people. Such ”leaders” are dealt with (hopefully) at election time by the public at the polls, or if things get too bad before that (God forbid) they can be dealt with by the police, and taken in to face justice.

    If Rev. Hill and the righteous evangelist feel so strongly about the lyrics of the song that they can justify the state’s action on their behalf then Hill and others should have a permanent presence at the ports of entry to ensure that all homosexuals who enter this country either as artist or as religious or business persons are arrested and deported immediately because their actions sure speak louder than any lyric. Hill and others should also form a censorship committee to advise government on what should be permitted on the cable networks because what we do not want to see and hear in our yard is already in our bedrooms and that of our children. Should I say which makes Tommy Lee lyrics pass as peanuts.

      Each one is different to the other. Each one would be dealt with separately based on its merit by those

    Cabral Douglas, why can’t you live and let live? Was Sparta not compensated?
    First of all, Sparta was aware that he was not welcomed. However, people as you encouraged him to come to Dominica. If that man had any principles, he would not have come to Dominica. He arrived and was asked to leave. He refused. Bold as he is, he defied the airport authorities. The man was out for trouble.
    Sparta was arrested for murder. The man does not have a good reputation. Why would you want to defend him? Looking for money? I hope you do not get a cent.

    I took notice of the handshake between the Jamaican PM and the pm of the- kingdom-of-darkness at the close of Monday’s Caricom meeting of heads of state….It was conspicuously not a love fest.     • The ”evangelical people” are citizens, tax payers, and voters.

      They have no desire to run the country. They do want God to be honored. When they become aware of
      activity that could be a harmful influence especially to the youth they can speak out (freedom of speech) and may oppose it (freedom of religion) like any other citizen has a right to do.

      When the Association of Evangelical Churches of Dominica speak out against something collectively they do it only after prayerfully studying the issue. At the end of the day the government has the final say. Evangelicals know they must accept this and pray for the government. This is according to Romans 13:1-7.
      Our faith is based upon the Bible. To the best of our ability our application and practice of it must follow
      the scriptures.

        I beg to differ! This action was not through a personal demand, as you seem to be suggesting. It is said that the Government acted on behalf of the people of Dominica; and with the Churches involved it had to be the majority of the people.

        But yes. A person could be arrested, detained, and deported because of his song or songs. Singing is a form of speech. It is a way of saying things.         There were several distasteful things about Pirates of the Caribbean. :twisted: They did Dominica no favor by choosing to produce it there. But if the government and people of Dominica decided to allow it that is their right. It is doubtful if it did much to elevate the nation.

        Why would a production use fairy tails and make believe evil unless the thing they were portraying was meant to be an unreality, a big hee-haw? Not many people think that kind of existence would be something to aspire for even if it was real. Life is too short, and there is too much pain in the world for that kind of nonsense.

      Also on behalf of which people? the show was publicized months before his arrival with exacts dates and venus. The promoters were not contacted by the authorities to inform him that the artist would NOT be allowed to enter far less perform. He acted on behalf of the church monkeys who have no business telling the PM who should come here and who shouldn’t and whose rights as a CARICOM citizen to violate.

    To many hypocrites in Dominica,I am sure he will will this case which will serve the hypocrites and it’s gov’t a lesson…This young man never committed any crime in Dominica ,there was no need to demonstrate against him when in front of our door steps needed cleaning,he was locked up senselessly ,where is the respect for human rights ? Those who call themselves christians ,in the bible it is stated ” He who have never sinned ,let him cast the first stone,thou shall not judge. If you all are christians how would you bring him back to the fold by turning your backs on him if you think that he is on the devil’s side?Just asking. No one is better than the other ,by judging him you are also doing what Jesus said don’t do.You have the right to do what you want let others do what they want.Turn away if you don’t accept what others do.Respect others if you want to be respected.I hope that every one of you who demonstrated against him will help the gov’t to pay him..

    I do not like that Tommy Lee Sparta at all but mr. Douglas is right to sue the government. If we advocating free movement we can not chose only our favourites. Imagine if that was the case you could ban people on grounds of religion, political views or even because you don’t like their looks. Besides you allow that guy land in Dominica and lock him up and he did not even sing or play one note? Man, you calling that democracy?I will never go this concert but that is not right. Is dictatorship we have in this country.

    Unfortunately Tommy Lee is is living up to his controversial life. He is now wanted for questioning by the Jamaican Police in regards to a shooting and has not turned himself in. Guess even the son of Satan despise in his homeland can find rights in Dominica. Hope you lose.

      So because a man is wanted for QUESTIONING, i guess to you that means he is guilty of a crime and has been up to no good, and must turn yourself in, because he is already guilty. No problem River Street. Judge not lest ye be judged yourself.

      • No! Wanted for questioning does NOT mean he is guilty.

        It means he is wanted for questioning. He MUST turn himself in. This means he is required to go the police and say something like ”My name is Tommy Lee … and I understand the police want to talk to me.”

        This is required by LAW. If he does NOT do this he is dodging the police. He is on the lam. This all by itself is a crime. It makes him a criminal even if there is nothing else he could be convicted of.

        When all the facts about Tommy Lee are known and this is added I don’t think it is the side Mr. Isaac wants to be on. For his own sake I hope he will reconsider.

        Mr. Lee can still turn his life around. I hope he does. His talent can be put to better use.

    • Considering Tommy Lee’s present legal status in Jamaica it would not look good for Dominica to give him asylum in Dominica much less allow him to work on the island.

        If I remember correctly he was considered a security risk.

        Anyway Tommy Lee is now wanted by the Jamaican Police for questioning regarding a shooting and is refusing to turn himself in. He is at this time a fugitive, a man running from justice.

        But what amazes me is how you can give me THUMBS DOWN and yet never show me where I am wrong in my comment.

        It is rarely that anybody points out to me a single statement I made and gives me a thread of evidence to prove I am wrong. You have no logic on your side. You have no terms of reference.
        It is impossible to debate with you.

        Even when I recommended a book (written by a Ph.D.) for my opponents to read that backed up what I said and challenged them to counter it by showing me a single statement in the book that was as incorrect I received no reply.

        So just continue to give me your meaningless thumbs down.

    The Attorney General needs to respond on behalf of the Gov’t on this matter. Why isnt the the govt responsible? what claims were substantiated by Mr. Douglas? Why were they not accepted by the AG’s office as reason enough to assume responsibility? This is not a private matter, it involves the good name of the Nation and its people. More details please.
