Cutlass-wielding man fined by court

A Salisbury man, who was caught with a cutlass chasing another individual in Roseau on November 4, has been punished by a Roseau magistrate’s court.

Jerwin Victor was fined $ 1,000 for the possession of an offensive weapon, which is to be paid no later than April 30, 2012 or in default he spend four months in prison.

A small quantity of cannabis found in his possession during a routine search on the said date has also left him to face a $500 fine, to be paid by the same date or he spends two more months in jail.

“Officer, them man hit me with a bottle in my head,” he told police who apprehended him at River Bank with the weapon in hand.

The incident occurred at approximately 11:10 p.m. while some police officers were on foot patrol on the East Bridge. They had been tipped that a fight had occurred in the River Bank area and responded accordingly.

When Chief Magistrate, Evelina Baptiste, gave Victor the opportunity to mitigate on his own behalf he was at a loss for words even after been given several chances to do so. The sweat pouring down the first time offender’s face in the air conditioned court room surprised the magistrate and others present, indicating his nerves and possible fright.

In handing down the sentence, Baptiste advised Victor that conflicts should not be resolved with violence, and that no amount of sentencing would offer the help that he truly required.

Victor is a first time offender.

    I KNOW THE GUY HE IS NOT A TROUBLE MAKER BUT HE SHOULD NOT HAVE LEFT HOME WITH A WEAPON AND THE POLICE DID NOT CATCH ANYONE ELSE WITH A WEAPON BUT THEY MUST TRY IDENTIFYING AND PUTTING THE GUY WHO HURT HIM BEFORE THE COURT FOR WOUNDING. ELIE SHOULD LEARN FROM THAT HE EVEN WENT TO ROSEAU WITH GANJA IN HIS POCKETS THAT IS RECKLESSS AND STUPID AND I DONT CARE IF HE IS YOUR BLOOD THAT WAS TWO STUPID THINGS TO DO. MAYBE IT IS TIME TO HAVE VILLAGE FESTIVALS DURING NOVEMBER 4 CELEBRATIONS OK SO YOU CAN ENJOY THE FETE WITH YOUR OWN PEOPLE.     a lapa wez and cold sweat take de man,but he wanted to be de butcher of roseau,anyway i am guessing the police arrested the other assailant,if he said the man bust his head with a bottle,and it is evident that his head was bleeding,i am just looking at justice,nobody has know right to commit an offence and get away scot free,the report here does not say anything in that regard.

    He was still out at 11:10 pm at the River Bank, drinking I suppose? He should have been indoors and sleeping. No TV? :) Are those people whom he claimed hit him with a bottle on his head his friends?
    He was given too much time to pay the fine by April 30, 2012. I suppose that he has to somehow find the money. Is he employed? Hope he will be well and alive then.
    People who are caught with a dangerous weapon as a cutlass, threatening others with it, going after them with the intent to use it whether it is supposedly in retaliation or self defense should really be given a prison sentence. This is what this man deserves.
    On the other hand he should learn not to take matters into his hands but immediately seek out the Police and report the incident. If his story is true, this is where he went wrong for two wrongs do not make a right.
    If they hit him on the head with a bottle, he should sue them. Probably he will be able to get some money to pay to the Court.
    I suppose the money which he is ordered to pay will go towards government legal fees.
    The Chief Magistrate stated, “No amount of sentencing will offer him the help that he requires.”
    Who will provide the help to him and when? Is arrangement made to assist him with counseling which, hopefully, will rehabilitate him even for a first time offender?

    What is the maximum fine for such offences? The court has to send a very strong signal to society, that that law and order has to be preserved at all times. Imagine if the cutlasswielding thug had cout up with the other person – death, dismemberment, etc.

    He should also be given a shorter tiem to pay say December 15th or else he spends Christmas and carnival in jail. Such first time offenders could wreak havoc to a person, family or society. Let us be tough within the applicable law

      U better stay abroad, u donno wha happen if they gang up on him. Some of dem thugs ruthless to eh, sometimes they have to be put in dere place. So you need to get da facts and let the judge decide.
