Cyber Crime Act to address online porn-related material

cyber crimeSuperintendent of police, Cuffy Williams, has said that a Cyber Crime Act will be passed in Parliament during the month of November.

Williams, who was speaking at a consultation on Crime and Violence on Thursday  10th October, 2013 said “It is called the Electronic Crime Act and from what I read from the draft, it is going to address all the pornographic videos that has gone viral.”

In recent times, a vast number of pornographic videos and nude pictures involving students, young adults and adults, were being circulated via various social networks.

This resulted in a huge outcry by the general public and a call by members of the National Youth Council for something to be done by the relevant authorities.

In an interview with Dominica News Online, Superintendent Williams said that although the number of reports on the matter had increased, no arrests were made since investigating such matters is extremely difficult.

It is hoped that the Electronic Crime Act will assist in resolving issues such as these, he said.

Before u start singing it’s praises you better find out all the implications involved.

Dominican people, stop being naive on the brink of mental retardation. this isn’t just an act to deter people or ‘catch’ people that spread pictures of ‘girls they don’t like’ online. This goes far deeper than that.

I’ve quoted once and I’ll quote it again:
“Those willing to give up liberty for security deserve neither and will lose both” Benjamin franklin…

    • October 14, 2013

Liberty at the expense of security is false and short lived.

Better give up the liberty to do things that are wrong than lose the security to do what is right.

Unforunately when people do evil it becomes necessary for the government to impose restrictive measures that good people may find inconvenient. It is a price we pay to keep the
      country safe.

yea just like driving drunk it government trying to get legal access to your private vehicle. Every law will have those that opposite it. where will the line be drawn between wanting your freedom to do that you want and projecting the innocent be drawn.we always say how the government trying to invade our privacy until the problem hits home and affects one of our own. that is when we ask where the government.
Their has to be a point where we look out for our fellow man and not just yourself

    • October 14, 2013

      This is so true.

It is a sign of mature thinking when you can look at the bigger picture of things.

I expect we all have those moments when we wish the government would mind its business and leave us alone. Most countries probably have those laws that some people find too imposing and restrictive.

However, it is not likely that the govrnment has any desire to look over our shoulders. Laws are made for a reason. Each law is put in place for the common good. By upholding the laws of our land we make our society a better and safer place in which to live.

Christians believe God has delegated authority to human governments to make and enforce laws (in harmony with His own laws in the Bible). We are suppose to obey these laws and support our governments and those who enforce the laws according to Romans 13:1-7.

Sincerely, Rev. Donald Hill. Pdentecostal Evangelist.

This is a very good thing. In the US, some states are now passing laws to deal with “revenge porn”, sexually explicit material put on the internet without the participant’s knowledge or the against the participant’s wishes.

The electronic crime act is there for our protection. It is common knowledge that people can only be truly free when rules exist and when people abide by these rules. So go ahead, lay down the rules for internet content and internet practices. No one should have to suffer because people stole their credit card number, or their voice or their identity or their private pictures and videos.

My Brothers/Sisters, whenever something new is introduced, or we know little of it (nothing bad in that because it is new to most)there will always be concern and even doubt- our human nature for survival which is good.

But When there is doubt there must then be a quest (search) for knowledge and enlightenment. In this way we can have objective judgment and reasoned input in the discussion.

These are key issues that cybercrime laws usually address:

      OFFENCES
      1. Illegal Access
      2. Illegal Remaining-
      3. Illegal Interception
      4. Illegal Data Interference
      5. Data Espionage
      6. Illegal System Interference
      7. Illegal Devices
      8. Computer-related Forgery

Fraud and related activity in connection with identification documents, authentication
      features, and information
      Aggravated identity theft
Fraud and related activity in connection with access devices
Fraud and related activity in connection with computers
Fraud and related activity in connection with electronic mail
Fraud by wire, radio, or television

      9. Computer-related Fraud
      10. Child Pornography

[Malicious mischief related to] Communications lines, stations, or systems
Importation or transportation of obscene matters
Transportation of obscene matters for sale or distribution

Obscene visual representation of the sexual abuse of children
      Sexual exploitation of children
Certain activities relating to material involving the sexual exploitation of minors
Certain activities relating to material constituting or containing child pornography
Misleading domain names on the Internet [to deceive minors]

      11. Identity-related Crimes
      12. SPAM
      13. Disclosure of Details of an Investigation
      14. Failure to Permit Assistance
      15. Harassment Utilizing Means of Electronic Communication
Misleading domain names on the Internet [to deceive minors]
Misleading words or digital images on the Internet
Use of interstate facilities to transmit information about a minor
      Criminal infringement of a copyright
      Criminal offenses [related to copyright]
Unauthorized publication or use of communications

I really hope this helps and DNO post in haste.
We all must be concerned about Cybercrime (ATM SCAMS< IDENTITY THEFT etc.)
We must also be glad that something is being done about it by Government
We must also be mindful to ensure the protection of our privacy.

MOST OF ALL – From 2008 there was consultation on these legislation but the public never seem to be interested until now – never wait for something to happen ATTEND THE CONSULTATIONS !!
I hope this helps brothers & sisters.

      PROCEDURAL LAW

      1. Search and Seizure
      2. Assistance
      3. Production Order
      4. Expedited Preservation
      5. Partial Disclosure of Traffic Data
      6. Collection of Traffic Data
      7. Interception of Content Data
      8. Forensic Software .

      I hope this helps.

      KUNOO:

Freedom of speech is never absolute :!:

You are not allowed to go into a full theater in the middle of a show and yell “FIRE, FIRE, FIRE…”

I am not allowed to tell people lies about another man, like “Joe ……. has a mistress” or “Richard ……. stole $20,000 from his employer…”

A man who runs a shop is not allowed to change the label a on bottle by taking off a “poison” label and putting on a harmless medicine label.

A man is not allowed to steal a piece of work written by somebody else and put his own name on it then publish and sell it.

A man cannot write a book about the benefits of using different plants for medicine and publish it for sale if the book contains half truths, lies, and misleading statements that might cause sickness and death.

A man cannot call himself a professor and go across the country giving speeches or lectures on the prevention and treatment of cancer if he is telling people things that are not true and could result in them harming them themselves or not getting proper medical care.

There are situations where freedom of speech simply does not apply! 8-O

No pornography is harmless. Even homemade porn demonizes the actors, demoralizes the viewers, degrades the home, and is an insult to women. It sends a message to those involved in “big porn” (the name we give to the professional porn industry) that there is a growing market here for porn.

Canada and the States are passing tough anti-porn laws. Their engineers are are working to produce technology to trace porn sites on the internet and also to block the transmission of porn. The overlords of the industry realize that the heat is being turned up and they are looking for safer havens in which to operate.

Make no mistake about it. They will consider the Caribbean. What they want is a country with a growing appetite for porn, ineffective restraining laws, weak enforcement, and a lack of legitimate jobs.

Pornography fuels premarital sex, marital infidelity, and prostitution. It causes rape. It is a contributing factor in crimes of serial rapes and rape-murders.

Porn in a competitive industry. The producers must provide materials to satisfy the sick appetites of a wide range of consumers. This is why there is now group porn, gay porn, child porn, baby porn (!), mutilation porn, and snuff porn (where somebody actually commits suicide or is killed) and YES, it is for real!

Even a small amount of homemade porn sends the wrong message. Your government does not want this filth – this poison – in the country. Much less does it want even a small representation of the porn industry setting up shop and hiring your sons and daughters.

A problem like this always begins small. It is a wise government that sees it coming and stops it dead in its tracks.

Sincerely, Rev. Donald Hill, D.D., Pentecostal Evangelist.

Good…..destroy a person’s life….you should pay…placing neked pics online of persons without their knowledge should be a crime….and no financial punishment…time in jail for such crime

    • October 11, 2013

      Thiny:

I believe a rehabilitation program should be prepared in consultation with Police Superintendent Williams, a social worker, and a pastor who has some background in counseling. It
should be mandatory for those convicted. There should be follow-up. :-o

I think a serious and mandatory fine should be imposed on the performers and those who posted the video online. A jail sentence should be on the table for any and all convicted. I’m not saying a jail sentence should be mandatory but the accused should know that they could be sent to jail. 8)

These are usually young people with their lives ahead of the. The right way is to be redemptive without compromising justice. Pornography is harmful enough  to require hard justice.

Sincerely, Rev. Donald Hill. Pentecostal Evangelist.

:-o To pass anti-porn bills is one thing. To enforce them is another.

To put the new laws on the books may satisfy the public for a time. To enforce them will satisfy justice. 8)

Unless the police do their job and the judges act responsibly the laws will take their place along with other laws on the books reminding historians of insightful moments in the nation’s past. 8-O

The battle against porn can be won. But it must be won now or it is going to go the way of the Columbian war on drugs.

While Rome burned Nero fiddled. While the crime lords take over our countries our leaders play politics.

Our polititians must not wait for the porn industry to arrive. They hear of it they must look for it. When they see it they must go out to meet it. :!:

      21 century? :(

      • October 14, 2013

With knowledge increasing and the incedible advances in science and technology it is difficult to see the kind of laws that will be needed in a few years from now.

Our polititians need to ask some “what if” questions, and be as creative as possible to put laws in place that will serve the next generation.

I find the attitude of some people absolutely appalling. They seem to think it is modern and progressive to be as warped and perverted as possible. They would have us believe that those who live clean, decent, and upright lives are old fashioned, and behind the times.

Sorry! There is nothing modern about sin :!: It is as old as the Garden of Eden.

Welcome to this glorious 21 century. 8-O See the increase in alcoholism. Look at how big governments are losing the war on drugs. See the AIDS epidemic, the incease in mental health issues, and our over crowded jails. Look at the suicide rate going through the ceiling.

You don’t have to be an M.D., Ph.D. or Psy.D. to know something is wrong with our world today! It is a spiritual disease called “sin” that is the root cause of it all! The further mankind moves away from God and His commandments th deeper they sink into the abyss :!: It is not the Christians – the “old fashioned” believers in Jesus Christ – who are having these problems! It is those who refuse to come under His Lordship and live by His rule!

The Apostle Paul wrote “Therefore if any man be in Christ, he is a new creature: old things are passed away; behold, all things are become new.” (2 Corinthians 5:17)

True Christians are those who have received Christ and have trusted His shed blood to wash their sins away. They have committed themselves to live by the Bible. The world is in trouble but as the Apostle Peter says, “…we, according to his promise, look for a new heavens and earth, wherein dwelleth righteousness.” (2 Peter 3:13) :)

The cancer has progressed to stage TWO.

Stage ONE: Porn is on the internet. People who are online can access it.

Stage TWO: Dominican sons and daughters begin appearing in the movies.

Good people decide there will be no stage three!

Stage THREE: Big Porn (the professional porn industry) sees there is an appetite for their products and moves in with job offers for would be performers, shop managers, and sales reps.

“All it takes for evil  to succeed is for good people to do nothing.” (Author Unknown)

Good people do something :!: There is no stage three.

You can stop people from spilling MORE milk. :-D

Dominica will be miles ahead of other nations that did nothing.

I applaud the public in Dominica, along with the members of the National Youth Council, the government, and the police for moving against this evil. :-D

With strong laws in place, proper enforcement, and responsible judges you can stop the spread of this “epidemic” and bring God’s healing to those who have been hurt. 8)

Why should a Canadian care? Let me tell you why. What is posted online in Dominica is viewed across Canada. These viewers include my grandchildren. Many thousands of Canadians make the islands of the Caribbean their vacation land every year. Some of them have come back and told me personally that Dominica is paradise! :-o
