United Workers Party candidate for the Roseau North constituency and opposition senator, Daniel “Danny” Lugay, has been charged with inciting murder of attorney Alick Lawrence arising from statements which he made at a UWP political meeting in Soufriere recently.
Lugay appeared before a Roseau magistrate on Thursday afternoon.
He was granted bail in the sum of EC$8,000.00 with one surety.
He was arrested and charged two weeks after stating at the meeting on July 3, that there are some people who “deserve to die” for keeping Dominica back.
The charge reads in part:
“On the 3rd day of July 2014 at Soufriere Danny Lugay did unlawfully incite the murder of Allick Lawrence by uttering to the people you know not too long ago we met with the electoral commission and I am looking Allick Lawrence in the face, right? and he wouldn’t say a word, you know and these are the guys that are obstructing electoral reform in Dominica, you know. I have said in a public meeting in Fond Cole if I wasn’t a believer, I would take out some people in Dominica you know. My heart is different and that is why I wouldn’t do it, but it have some people that deserve to die in Dominica. Honestly, when you see the sort of things that they do to keep back Dominica.”
Lawrence is a member of the electoral commission.
One week after making the statements, Lugay apologized.
“I sincerely regret the statements and without reservation apologize to the people of the Soufriere Constituency in particular, and the people of Dominica in general,” the UWP senator said. He said he is deeply sorry for the inconvenience the statements may have caused his family, his constituents of Roseau North, colleagues in the UWP and the Parliament of Dominica.
“I ask for the forgiveness of all. I pledge my continued commitment to serve the people of Roseau North and the people of Dominica,” Lugay said.
Lugay has been under fire from the government and others in the Dominica Labour Party, with prime minister, Roosevelt Skerrit, describing the statements as “extraordinary”.
He noted then that his government is not taking the matter lightly and will do everything in its power to protect citizens of the island. Skerrit said he believed that the police should question Lugay “on what are his plans because those statements are very serious statements.”
Since then other DLP and government officials have also called for parliament to censure the UWP parliamentarian and election hopeful.
The prosecution headed by acting inspector Valda Powell did not object to bail and no reporting conditions were included in his bail which was set at EC $8,000.00. The Preliminary Investigation is set for November 17, 2014.
Lugay is represented by attorneys Joshua Francis, Gildon Richards and Cara Shillingford.

Senator Lugay should not have said what he did. However, he did apologise unreservedly and things could have been left at that.
If I were the leader of our country, however I should be far more concerned at what prompted an otherwise peace loving individual to make such remarks. Was he merely expressing a thought, left unsaid by many others?
The evidence is there that we live in a divided society where justice is not dispensed evenly, nor are incomes or privileges. Unless the root causes for the current unease, malaise, discontent and disharmony are exposed and remedied the situation can only get worse. History, even in our own little country teaches us that hard suppression of such sentiments does not help to nurture a stable, happy and truly democratic society and eventually leads to concrete, covert- and/or open resistance.
Our constitution provides for freedom of expression (under 1 B). Senator Lugay may have a a defence under that provision, especially since he did not refer to any individual or group of people in particular.
However, I suspect that something else may be at play here also. The same Constitution disqualifies anyone from being appointed as a Senator or Representative (32 B) if he is serving a sentence of imprisonment (by whatever name called) exceeding twelve monte, even if the execution of such sentence has been suspended. A conviction may therefore take Senator Lugay out of the running as a parliamentary candidate for any constituency in the country.
These are not happy days for Dominica.

Daniel Lugay did not say Alick Lawrence deserve to die. It is high time Dominicans take charge of their country. We need to hold our politicians accountable for their conduct and behavior. It seems moral and ethics no longer matters in our country. Any time a nation see no need for an opposition that is a red flag for disaster. An opposition is a potential government and we must understand that.. There should be a level playing field, if it is wrong it is wrong. The government says what they want and get away from it but on the other hand they criminalize every thing the opposition says. All of this because the UWP failed to accept the provisions of the electoral laws and to show some respect to the Electoral Commission. There is nothing making it mandatory to have Voter ID cards for elections. Further it is the responsibility of every citizen to bring to the attention of the Commission any information with respect to the contamination of the Voters list. The UWP knew of names that should not have been on the list so the onus was on them to write to the Commission indicating which names should be removed. They preferred to go to war instead.

What does complying with the election commission have to do with someone saying the people who prevents progress, and keeps Dominica backward will first have to die so that the country can make some progress?
You see, that is the crap we get from people like you who cannot comprehend the language of others. The present government is in control of Dominica for almost twenty years, we live in a country, where more than ninety (90%) percent of the homes in our country are without indoor flush toilet. When the majority of our people need to have a BM (bowel movement) in the middle of the night, rain, flood, or hurricane storm, they have to go outside and squat over a pit-hole filled with feces, and nasty water.
And when they drop a bit of feces, that dirty splashes up on their gluteus maximums!
With all the cars running on the roads of Dominica, we have no traffic lights in the country, except a one stop and go light on the Bath Estate Bridge. In a modern country there should be two bridges accommodating terrific in both directions; at least that was the only traffic light I saw the last time I visited Dominica. We do not have an International Airport. Be reminded we are in the twenty-first century, traffic are not controlled by people in dressed in black and white uniforms anymore. (only in Dominica).
Our hospitals are behind the times as far as medical equipment are concerned, compounded with medical doctors who are simply general practitioners, who are not specialist in any field of medicine. We have no modern Hotels, no industries, the fools in government are unable to attract investors, all they are concentrating on is the repairing of roads which has been going on for decades. There are more people in the poor house in Dominica today than in any time of our nations’ history!
Crime is out of control, people are killed, and the police are unable to solve their murder, because of incompetence, and rather than the government seeking help from Crime Solving Organization, such as the FBI, Interpol, and Scotland Yard, the government does nothing; such matters are never even discussed by the government. The United States made available two coast guard boats to the government to help curtail the illegal drugs coming into the country. The government also received money to build a base for the coast guard in a certain area. The government has the two boat on dry duck. they have not utilized the boats in the purpose they are intended.
What that indicates? I will tell you, because I am man enough, without fear for my life, or prosecution, or victimization from Dominica government, that the reason they do not want to curtail the drug flow into the country, is because there are ministers of government who may be benefiting from the importation of drugs into the country. How can you talk, and support the nonsense we are experiencing from this waste of time government? If you have nothing important to contribute, remain silent, but do not support these people and their sickness, it is time for them to go, the labor party government is an obstacle in the way of development in our country.

I have just finished reading George Orwell’s “Animal Farm” for the umpteenth time and the parallells in that book and our current state of affairs are endless. The satement made by Mr. Lugay was very reckless. So too were statements made on a political platform on March 12, 2013 by the other Lawrence attorney. To paraphrase him, ..we must let them know that just as [US President] is going after Al Queda, we will go after them…” Every right thinking person knows that when US authorities go after Al Queda and they find them, they “take them out”. The attorney even specified the places where Labourites should go on the Al Queda-like quest viz: Marigot, LaPlaine and Salisbury. And when he was called out for his statement, the Police Commissioner informed the public that he had referred the matter to the DPP to explore criminal liability. What happened? Mr. Lugay apologized. And we are still waiting to hear from the DPP.
Our police are sworn to uphold the laws. Where were they when the Dear Leader publicly declared to the effect that no law or constitution could keep him back?
This is a sad state of affairs. Indeed! Methinks at that rate, the excrement will soon impact the air circulation device. And as a wise man once said, the only thing necessary for evil to triumph is for good men to do nothing.

If a regular man on the street made the same statements, he would not be charged. This is politics. Yes, Mr. Luguy apologized and I commend him on that, but truth be told Mr. Luguy’s statements could have easily stair a regular man in the direct of murder just because it was uttered by him, a political figure. For some of us this may appear trivial but in reality this could have lead to something more damaging. I hope Dominicans are seeing that Tony Astaphan whom no one elected in government is introducing Middle East /Arab style politics in Dominica. Danny lugay made a poor comment that has no ideaplace in a civilized society. However his Comment was an expression of feeling and was in no way a threat directed at anyone nor was he asking anyone to do anything. Ron, in America we enjoy freedom of speech, Individuals have used threatening words against President Obama , the FBI paid them a visit, they simply explain what the meant; matter closed! In America I can say anything about anybody, as long as I do not make a terrorist threat, nor libel or slander anyone, I am free to say what I wish okay.
What is happening in Dominica right now, is happening because we are under a dictatorship which many Dominicans have not yet recognized. When one can arrest someone for simply saying the people who keeps Dominica backwards, will first have to die in order for the country to make some progress, and then finds himself locked up for something like even though he apologized for what he said that tells me that our laws in Dominica are different to any other civilized place on earth. The game in Dominica is no longer political,it is all about malice, and vengeance.
There is nothing legal about filing a law suit against Lennox Linton, and against Luga, they targeted no individual by name; people have rights, the intentions of the people in power is to breath fear in the opposition, muzzle them, hence they will not be able to expose the lies and corruption of this government. The Police’s action will go nowhere. Luguy threatened no one. He never expressed plans to harm anyone. The Prosecution will have to tell the Court who are the people who felt threatened by the Senator’s comment. Lugay spoke of “people who keep Dominica back”, but who are thse people?
