ECSC to rule on dual citizenship matter

After almost four months, Judges of the Eastern Caribbean Supreme Court (ECSC), will deliver their judgement, via teleconference, in the dual citizenship matter involving Prime Minister Roosevelt Skerrit and his education minister, Petter Saint Jean.

The decision will be handed down when the ECSC convenes in St. Kitts on March 11.

The opposition United Workers Party (UWP), appealed a decision in January 2012 in which  High Court judge, Gertel Thom, rejected petitions by UWP election candidates, Maynard Joseph and Ron Green which sought the disqualification of Skerrit and Saint Jean as elected members of parliament.

According to the UWP, the two men were in breach of an electoral code since they reportedly held French citizenship on Nomination Day, ahead of the December 18, 2009 general election.

The appeal was heard in November 2012 and a decision on the matter was expected to have been delivered before the end of 2012.

Monday’s decision will be the final decision in the matter as the ECSE is the final court of appeal for constitutional matters in the region.

    Face the facts: Ronald Green became a US citizen before the age of 18… he was not an adult and could not make decissions in that respect. The most important thing is that he was born a Dominican.
    However, Skerrit and St.Jean became foreign citizens AFTER the age of 18 (when they were big men)… therefore, as the constitution says “they had made a conscious decission to become citizens of a foreign country, and hence have to give up foreign citizenship to be involved in Dominican political office”.
    Let us read the constitution for what it is… it was not written in blue, red, green or yellow ink; it was written in BLACK ink on WHITE paper.

    In December 2012 Obama went all over the U.S. telling us how the Republicans are fighting for the rich.Because they don’t want him to raise axes on the millions.And if they do not stop this obstruction,the poor and middle class will see a tax increase come January 1st. So the Republicans caved in and let Obama have his way.
    I received my first check for the year,wednesday the 2nd of January 2013.You know what? Obama is taking an extra $300.00 in taxes from my wife and I every month.It is called the payroll tax.

      It was a 2% social security break you were getting for the last few years. It could not go on forever. He did not raise your tax he took back what he was using to help you out when you needed it( recession time). Btw if all he took back was $75 a paycheck each then you not in the 1% of this country, so 9 out of 10 of his polices will benefit you. I on the other hand have plenty to complain about and you don’t hear me whining. If you don’t like it you can go back to Dominica and see what your government there can do for you.

    fair is fair but it just baffles me that the same people from UWP that there condemning the pm and st jean are not better. haven’t they checked past yrs. one of them was a US citizen or whatever the case and labour never took him to court. so even if it happens the way some dominicans want and they “boot out” skerrit is not the likes of UWP that ever coming in power anytime soon. these men have no concrete plan for d/ca. not now and i don’t think anytime soon. Come better than dat UWP and just leave the man finish his term.

    Obviously the fundamental point is that a person is found guilty of a crime yet there is no discussion of jail, fines, or being blocked for life from being able to run for government? What exactly is the penalty here if he is found guilty?

    What ever happens I doh care..I on the fence.the current bunch of politicians in dominica has always been greedy.Too much partisanship in this land.No wonder we lagging behind when we should be on par with other caricom countries.     In times like this that i feel more ashamed to be a Dominican. Can someone honestly tell me that Ron and the UWP would do a better job for Dominica?
    What is all this about really. Is this about Dominica not having an international airport? Come on my people do your own research.
    Do you know that St Lucia had to pay American airlines for every empty seat on the plane.

    American eagle flights to Da were filled twice a year during carnival and independece. People think that an airline is maintained like a car or
    truck. You all are way off.

    Their teleconference verdict is just a show as they know very well whose side they on and they will not embarrass the previous judge. They know the true verdict is to teach the PM that the constitution deserves to be respected, but then again these guys are not their for justice.
    If they were going to rule against Skerrit they would have handed down their verdict long time ago in Bethlehem. Four months later? too late Skerrit the winner by default.

        The court in this case doesn’t decide whether skerritt and st jean are guilty of violating the constitution. My sense as a layman is that the ruling of the court will be something along the lines of. “We dismiss the claim of intelligibility: as an appellate court, we are unable to decide on this question. Furthermore no evidence has been lead to support that claim.
        In the count’s view the judge at first instance erred in her judgment that she did not have the power to order disclosure. We recommend that the case be retried and disclosure be allowed “.
