Eight months in the lock-up for BlackBerry thief

prison23-year-old Rico Kennedy Warner of Tarish Pit has been sentenced to eight months behind bars after he pleaded guilty to stealing four BlackBerry phones on Carnival Monday.

According to the facts given in court, Warner stole BlackBerry Curves belonging to Niomi George and Sheraline Valmond and a BlackBerry Bold belonging to Ezra George and another belonging to Albert Simon.

It is reported that the phones were stolen from their owners on four separate occasions, in backpacks and a waist band, while they were jumping up on Carnival Monday.

Warner admitted to the police that he stole the phone.

In mitigation his lawyer, Darius Jones, pleaded to the court for a “non custodial sentence” saying his client had “not wasted the courts time, demonstrated remorse and his actions were not violent.”

But Magistrates Candia George said she viewed his actions as “calculated.”

She sentenced him to two months jail on each count of theft to run consecutively.

Warner, in the meantime, told the court he was sorry. “I was under the influence of alcohol….it was not my intentions to steal,” he said.

His rap sheet shows he has previous convictions.

    don’t get me wrong but i hate to hear u ppl who go overseas(USA/England) and living on food stamps criticising de Caribbean where u guys come from. usa/england got more crime than d/ca. to all u ppl dat hate tarish pit, gutter community or stockie ppl hav u guys ever take a time to realise why de kids do such stuff. they all are neglected by u corrupt goverments for decades so de kids hav to hustle to eat.

    Well, the sentences were slapped CONSECUTIVELY. That means 2 months, then 2 months, then 2 months, then another 2 months. Had he to serve the sentences CONCURRENTLY then he would have been back home by mid-April. But he’ll be spending Easter, and May Day and Pentecost Monday and August Monday with his new friends and renewed acquaintances at Stockie.

      Wae wae wae…some ppl stupid we. Obviously if you plead guilty then there was no trial where the Magistrate has to hear the police case and your side of the story for the next year and then find you guilty before sentencing you. So obviously that’s what the lawyer means when he said that Rico didn’t waste the court’s time.

    one of his victims was a friend of his from the same area. he heard her telling others in the band that her phone was missing and he did not give in, she later found out that he was the culprit. his nick name in the area is FINGERS so figure it out :twisted:

    Beware of thieves at such a time as carnival and in the crowd. Hold on tight to your belongings. The man stole four blackberries. I suppose his intention was to sell them. He had no intention of stealing? Big excuse which no one should believe.
    The lawyer stated that “he did not waste the Court’s time.” It is habitual with those lawyers to make such a statement. This is stupidity in itself and by no means a defense to have perpetrators acquitted.
    The man went before the Court as a thief. He committed the crimes and he must pay the price. No excuse for him. He knew very well what he was doing and his further intent was to dispense of the blackberries by no doubt selling them. He surely would not have kept them for his use.
    It is stupid to steal blackerries/cellulars. Those who provide the service could easily trace them. This is why the owners should ensure to make note of the serial number, etc. and as soon as they are aware that they are missing to report them to the Provider(s) so that they can immediately make note of them and cut off the service. However, it was carnival and in a place like Dominica I wonder if this step would have been effective at that time.
    Two months for each blackberry is insufficient and since he is a habitual thief.

    According to the DNO story, the prisoner was sentenced him to two months jail on each count of theft to run consecutively.

    Is the actual imprisonment eight months or two months?

      If the magistrate had said CONCURRENTLY then that would mean 2 months. CONSECUTIVELY means one after the other ie. 2 months for every charge. There were 4 charges and each resulted in a 2 month jail time. 2 months by 4 charges equals 8 months.

      Never place your wallet in your back pocket. Thieves can see the outline of it. It is a temptation to theft.
      I hope you learned a lesson from that. Some people who had their wallets stolen no longer carry one. Never place money or your cellular phone or other important matters in your back pocket especially when in a crowd; too many thieves around. Those items could also fall off from the pocket.

    When you have lawyers pleading to the court for leniency for orchestrated, well thought out and executed crimes because their clients have no previous convictions, not wasted the courts time, demonstrated remorse and all these non-sense, we cannot expect better. Can we?

    What this actually means from a layman’s stand point is that the lawyer knows you’re as guilty as sin and can’t be bothered to look up a real defence for you but has to say something to give the impression that he was working on the case. Now he takes your cash and enjoy’s it at happy hour at Fort Young.

      I was sitting in Court. the man said it loud and clear. GUILTY. that sounds clear to me in any language. What real defence u talking about. what planet u come from. So u want the lawyer to tell the man say not guilty. come up with a cock and bull defence. keep coming back to court for the next eighteen months to see if the man can get off and then complain that the system is too slow or the lawyer will say anything just for the money. Guilty means guilty. No defence

    Will it only be serious when someone gets hurt?

    what if one of the victims had tried to defend themselves against the robbery and someone had gotten hurt? Then, and only thn, would his actions be considered serious?

    Come on …criminals like that go on to bigger and better things. 2 mths in Jail for stealing a phone … next is 6mths perhaps for stealing money/groceries..perhaps 2 yrs for assault with a weapon? what is the amount of time for wasting tax payer dollars?

    Those lawyers. I wonder in what part of Dominica they are living. Do they think that they are immune to thieves who “plead guilty and show sign of remorse because they do not want to waste the courts time” when faced with the inevitable? That argument to my mind has been sorely abused by lwyers.
