UPDATE: Father angered that son’s alleged killer is out on bail

One individual here is questioning the fairness of the law, after the young man who allegedly murdered his son was granted bail.

Joseph Pinard-the father of Duane Pinard who was murdered at Castle Comfort in November 2008- says the justice system in Dominica is crooked.

“The justice system is crooked. Something is dirty and it needs to be cleaned up. Is there under table deals? Is there something going on? Is it that the prosecuting system is weak and needs to be overhauled?

He said too many persons involved in the countries murder cases are being granted bail.

“Something is not working. Something is wrong. The powers that be need to look into our justice system,” he said.

He said he is angry and dissatisfied with the justice system and “murderers are just walking all around Roseau. What a shame…what a shame,”.

Update:

Yannick Lander, who had been on remand after being charged with murder a few days after young man’s death, was bailed on Tuesday at the High Court of Justice for the sum of $300,000 with two sureties. Twenty thousand dollars of that bail sum was to be paid in cash.

A preliminary inquiry for the matter is presently ongoing at the Roseau Magistrate’s court. A high court trial is expected to follow.

    mr. pinard was is cousin and i jes now hear the news had to see if it was true and i cant believe my eyes reading this article dem full a water and my heart is heavy wid hatred! dat man shoulda neva let dis man come outa deh. god was watchin when dis man kill off my kinfolk god was watchin when dem give him bail and he gon watch when dis man get served! by hook or by crook he will get served! he was betta off inside.

    Bullshit….everybody buttering up their tongue but honestly and on a real no one feels our PAIN. All of us are sinners alike yes. But taking someones life is a one sin that cant be forgiven! No one knows the lost we have to live with. Bail? really?…and when it happen again people going to hold thier head? i say when, Yes because right now im sure the Animal ego sky high now, he feeling like he can get away with anything. My lady im glad you can hold your son and show my him love. But what about us? Thats a serious hard slap. After almost two years we're back to square 1, Trust me. Lord knows what he doing.     If SVbaker brother, sister or any family member was the victim his comment here would be different. Lander is not the victim he is the one who committed the act. Duane's family and friends have every right to vent their frustration. Everyone in Dominica knows that there are lawyers who would do anything for money even if it means letting a Murderer walk free. No one is going off passing judgment we are just stating it as it is and the way i see it the justice system in Dominica needs some emergency repairs. If the repairs are not made soon Dominica will be a sorry state. Why should a murderer be on bail, going around living life normal like nothing happened and another family is suffering because of his acts. When a murderer is granted bail and given instructions to remain indoors – who is going to monitor him, who is to say that he will not cross paths with the family who is to stay that he will not be shipped out of the country. People have a right to be emotional, if you lost a loved one would you be passive?

    Prejudgementalism is not even a word.if u were truly a Dominican you would realize that everything is based on status. The jury does not need to know the people involved directly but high status will definitely influence their decision. In Dominica there is always a witness, so for you to think this guy is innocent, you're just being naive. Wake up and get real. This is 2010 and something needs to be done about all these criminals.

    Please allow me to make a brief comment here. I am as well as a substantial amount of citizens that the events over the last decade and more has given every reason to cast doubt over our legal system.
    The quality of lawyers who go to law school their questionable ethics,morals even the quality of education etc.
    This recent case of Lander being out on bail seems to be a lightening rod in the legal system.
    Why are so many people going off at a tangent to pass judgement on a case is yet to heard let lone ruled upon? To term the statements made online as partisan premature, irrelavant,emotional is to put it mildly.People are going as far as associating inplicating, the charged individuals father's work function with the case. This behaviour manifestes , bias and prejudgmentalism on the case. If a jury is selected from our emotional ,sentimental, ill-informed, polarized, prejudgmental population then the outcome will be questionable to the other side.

    I feel what Mr. Pinard saying. D justice system is weak, favouring or dirty deals is the order of the day. Anyone who had known the 2 individuals mayb would agree with me. The accused is a “wanna-B.” He is a spoilt child who will do anyting 2 get what he wants. His mom is scared of him & paps surely doesn't take any chances. After dealing with both parties 4 some time, I noticed that the accused was a lil strange. His actions, his talks, his beliefs. He never wanted 2 work but he always wanted the “fine” things. Plus talk was going around saying he was using the “white man”. ALL IN ALL, If the society is at heart, why would anybody want 2 endanger the people. Lawyers cry 4 freedom for their clients. Claiming a man has mental issues shouldn't stand a chance. A mentally disturbed man commits a crime and yet still you want him back in society without he doing his time. What do u expect then? The higher authorities are crippling our society. “Shaben” can't come back but……. Justice must live. Wicked hearts must perish. R.I.P. My nigger.

    Everyone who has commented here should shut the F%^&* up! You all sound like the Pharisees and Scribes that persecuted Jesus Christ with no evidence. No the accused is nothing close to Jesus but that is still no excuse to cast judgment when you yourselves are sinners. Remember Jesus was on the cross with 2 evil men..one repented and went to heaven along with Jesus. Plus none of you A-holes were even at the scene of the crime to even know what the hell happened. so if you weren't there, didnt see the murder… and only speaking on hear say and what other people, who weren't even there themselves told you… then you have no right to cast judgment! To add, the person who spoke about ppl doing black magic and obyah…..thats just not called for man. Clean up your hearts and stop wishing bad on others regardless of the situation.

    Duane you are gone, your MURDERER is walking the streets, the family is in pain but we know that there is a God above. Sometimes we are impatient thinking that God is taking too long but I have learnt that He is an ONTIME God, he is never late and we the family take comfort in knowing that God is the FINAL judge. No lawyer can sweet talk God, no amount of money can make God change His mind. Vengeance is in Gods hand. Duane your murderer will never be happy, neither will those who are rejoicing now. they will be hunted by the act he committed, they will be hunted because your blood cries out for JUSTICE, they will know No peace unless they confess all to God. We the family we will continue to be strong for each other, we have a genuine bond of love which has proven to pull us through the most trying times of our lives, God has blessed us with peace in the midst of the storm which is raging around us. When we go to bed at time, it may be difficult to sleep but God gives us deep sleep. Can you sleep Murderer, can the people rejoicing with you say the same.
    I appeal to the judges, the lawyers who think that money is all – money is nothing and if you dont change GOD WILL SURELY JUDGE YOU.

    I've said it a number of different occasions the Judiciary system the Police System the entire court system needs an overhauling everybdy from the police how they investigate collect evidence and present there case in the courts to the Judges on the way the pass down judgement its as simple as that we probably need some independent bodies to assess the whole matter and give the public insight on the findings just my 2 cents from my minds eye….

    It is a great injustice for someone who is facing a murder to be on bail, but I disagree with the writer who said that the guys father knows all the policemen. Policeman cannot grant bail, that has to be done by a judge, so if anyone has to be blamed it would be the judge in that case. But yes justice is not served by having that young man roaming around town.

    Mr Pinnard, Something is definetly wrong with our country ! There should be a loud outcry as pertains to the injustices that plaque our country- There is NOT ! For the drug trade that continues to thrive- There is NOT ! Nobody will dare ROCK THE BOAT , But one of those good days,we- our country is going to pay- I think it would serve our leaders well to review and learn from the article written by Mr Tennyson of Barbados as pertains to the Jamaica fiasco- BE WARNED and TAKE HEED ! !

    Don't worry Mr. Pinard, the evil young man that killed Dwayne will overdose on the “coke” that he loves so much. His father will find him bathing in it. Remember he is an addict! He shall never stop. This shall be his demise. The justice system has failed once more. His father is in charge of FIU so he knows all the policemen. They stick together like glue and wood shavings. But I assure you that this addict will not last long. Remember he has been locked up and will have the craving more than ever now.
