Elizabeth Smith Nicholas is in trouble with the law.
Nicholas will have to pay the court $500 by August 31 or in default spend two months in prison for disorderly conduct on the Tarish Pit main road and battery of Clementina Mitchel. She will also pay $221 in compensation to the complainant for the pain and sufferings that she caused her.
The defendant appeared before Magistrate Ossie Lewis at the Roseau Magistrate Court Friday morning where she was found guilty of the said charges.
According to the complainant Clementina Mitchel, who took the stand during the proceedings, on April 6, she (the complainant) was walking on the Tarish Pit main road when she was struck with a stone on her left hand.
“Look your stone back, I hit you back,” the daughter of the defendant, who stood on the side of the road with her mom, allegedly said to the complainant.
Mitchel explained that she responded by picking up the same stone and chasing her attackers.
A fight then ensued in which the complainant indicated she was pushed in a drain and beaten. “The defendant thumped me in my back while her daughter kicked me in my chest,” Mitchel told the court while on the stand.
“I left to go home to clean my clothes, while I was coming from my home she hide behind a van and attacked me with a cutlass. We wrestled for a while and I took the cutlass and lash her with the flat on her back,” the complainant said.
When police met the complainant at the hospital during its investigation, the complainant showed authorities a medical report which indicated soft tissue injury in her right knee and left shoulder. Mitchel also had a burst toe.
The defendant, while admitting to aspects of the story, denied being the aggressor.
The medical reports along with the complainant’s admission of her role in the altercation helped the court to decide in her favour.
Dominica courts need to be more punitive – $221 for pain and suffering? Can that even cover the hospital fees?
taht’s a little bit of money – the sentence should have been harsher! This was aggravated assault which could have turned into a more serious offence. What if the attacker had cut up the woman with the cutlass. People like that need to be taught a serious lessons – there are consequences to decisions and the decision to attack someone with the cutlass should have been dealt with more harshly. I personally do not think that $500 is enough not the &221 …that’s a slap on the wrist!

Only in Dominica you say it could be called bullshit and condoned as nothing of consequence. You do not take this matter seriously.
A woman fighting with another and throwing stones/rocks at her, to the point of injuring her? The other one retaliated and got herself in trouble. It could be called a weapon which could kill the woman or badly injure her, even maim her and for life. It is something to be taken seriously.
People have a right to defend themselves.
We reside in an era where people sue for any and everything. The woman who was the perpetrator should be sued by the other one whom she attacked even though she may not have money; she would take prison for attacking her.
Consider the word “abuse” which is so prevalent in these times and those who abuse others are arrested, charged and/or imprisoned.
What would you call what the perpetrator did to the woman, even denying her the right to walk on the street without being attacked. She was attacked in a public domain. The other woman got off “scot-free” even though she has to pay a minimal amount of money? Money cannot purchase one’s life, health and welfare.
This woman would, hopefully, learn a lesson to live at peace if she were imprisoned. There are times it is necessary that the punishment should be harsh that it may change their attitude. This could prove beneficial to the attacker.
People who always find themselves in a melee and in trouble have a severe problem, including anger and a bad temper. They do not know how to run away from trouble and stay away from it. She needs help; also spiritually so.
There are such types as her all over the world. There are the peace lovers and peace makers and there are the troublemakers who cannot live at peace and will not allow others to live at peace. Their hearts are hardened and filled with hatred.
People are not only charged but imprisoned for a certain length of time. They are also given a restraining order, not to interfere with the other person or trespass on the person’s property. If they disobey the order, it will be a certain imprisonment for them. I am referring to the one who started this melee.
$221.00 for pain and sufering. Eben, they suffer papa.
What can I say? This occurs when tempers fly and people develop animosity for each other.
There are some people who appear to love trouble and live with trouble. Everywhere they go they cause trouble and are always involved in some sort of trouble. They do not know how to stay away from trouble and run away from trouble.
Why can people not live in peace? If they cannot get along for whatever reason, this does not give them the permission to harm each other. Stay away from each other. When you pass each other, do not look at the other. Pretend that the other person is not even alive and say nothing to provoke the situation.
This is what I would do if per chance I had a problem with someone. I do not look for trouble. I hate trouble and quarrels and love peace. Thank God so far I do not have a problem with anyone. I pray to God to preserve me from such situations.
It takes two. One who started and one who reciprocated which led to this fracas and injury. Both of them should be charged or imprisoned and for disturbing the peace.
Both of them need the grace of God. It may be that they are not practicing the faith. If they do, not as they should. Those who are genuine practicing Christians are peaceful ones. They also strive for peace and are peacemakers.
May God help those two and their family to become peace lovers rather than continued haters.

This has happened to many women. The men alike. They are jealous of either the other woman or the other man. Note recently a man was charged for a similar matter.
When such occur they should not contact “the other person” about the affair but the person whom they are in love with or are married to. A peaceful person and one who possesses class and dignity will do just that.
Is it worth fighting for a man or a woman where applicable and keeping hatred in the heart for the other person, even for life and having a Police record over it, even being imprisoned? I would think not.
A sensible person would also not get involved in a war of words and attack the other person. There are some adults who have much to learn and how to get along with others.
They mess up peoples affairs where man is concerned. Rubbish NO man or woman can take away someones elses man or woman. They will go if they want. If they think the grass is greener or if they think they can get away with it, they will.
Any one with pride and self esteem will not fight over a man or woman, and they certainly would not get their children involved.
