G.O.N Emmanuel case not forgotten – Carbon

Newly appointed Police Commissioner, Daniel Carbon, is assuring Dominicans that an alleged firebombing matter involving former magistrate Glenworth O.N Emmanuel has not been forgotten and the police are investigating the matter.

“I want to assure citizens of this country that this matter is being investigated professionally,” Carbon, who took on the job full time on January 1, 2013, said. “We must find the truth on G.O.N Emmanuel, we must investigate this matter, to dot every I and cross every T.”

The top cop is also refuting claims that investigations into the matter have been put on hold. “That is not true at all, people will speculate … the fact is we must investigate the matter with the view of finding the truth … people can say whatever they want.”

Concerning reports that someone has confessed to carrying out the act, Carbon said it would be unfair take such person to court without strong evidence. “You will have confessions, people will say they confess to the crime,” he said. “It will be a mockery and travesty to justice that someone is making a public confession, you take this confession, you take this accused, this suspect, and bring him to court on the basis of the confession and he gets away …that will be a travesty to justice. So we must ensure that we find the truth, satisfy ourselves that we have the evidence, strong evidence to bring the matter to court.”

DNO attempted to contact Emmanuel for a reaction to the new police chief’s statement but we were told that he was unavailable at the time.

However in the past he has made his opinion known on the investigation into the matter. In a letter to then president Nicholas Liverpool in late 2011 he said he believes that there was a conspiracy to pervert the course of justice within the Police Force, and involving the Commissioner of police and the Executive Branch of the Commonwealth of Dominica.

    Emanuel has been well and truly sliced up.. he will get nothing and nowhere. Why? Dominicans don’t really care if he gets it in the neck – it is not them, so c’est la vie. However, there is a saying that goes like this:-

    They came for the Muslims, I was not a Muslim, so I did nothing. Then they came for the Christians, I was not a Christian, so I did nothing. Then they came for me and there was no one to help me.

    Mark my words. In 2015, Mr. Carbon, Police Chief, will be regurgitating the same thing, “Investigations are continuing.”
    Oui say La paix. They done. Case close.
    Then when pressure falls, “Investigation continuing.” Heartless. No feelings for the plight of other human beings as ourselves. Excuses after excuses by the Cabal and loyalists. Defence and protection by all means, of selected criminals involved in their criminal activities. Burn, burn, burn. Secko boy, so you not coming back to your country again? Why?

    “Big Boys” should not be touched. Judicial Review ? Up to now the Emanuel vs. Isidore case, 42 charges of fraud and other corrupt acts cannot even begin. No case. Big Boys would be implicated?

    What happen to the documents, about the Famous Rubbish bin Bobol, submitted to the DPP? didn’t the DPP’s office send it to the police for further action? no evidence too? Bin bobol didn’t take place then?

    The Court’s arrest warrant to arrest Isidore was disobeyed by the former Chief. why no arrest of that ‘Big Wig cabalist?” Isn’t that warrant still valid?

    Given all what is happening in our injustice system, do not bank on any good news re. the attempted murder of those senior Dominicans. they are hoping that crime will soon be forgotten and their friends will go along their merry way. Businbess as usual.

    U mean 2 years after dat terrible incident de Dominica Police Force is yet to find evidence to prosecute denny shillingford? Don’t just say u don’t have evidence. Have u investigated Earl Grant yet? Denny said he did de job on Earl’s behalf. Has Earl been questioned as to whether Denny is talking the truth?

    If u not going to investigate Earl its IMPOSSIBLE for u to say without a doubt that Denny is innocent?

    Finally, I find it very troubling that a crime of that nature can happen in such an affluent neighborhood. Since Tony Astaphan lives just a stone throw away. Isn’t he or his neighbors scared that a similar occurrence could happen with more disastrous circumstances?

    I am troubled by Mr. Carbon’s first few statements as the new Commissioner of Police. While the gentleman must be given a fair opportunity to show his real capabilities, for now -it seems that we have more of the same. The manner in which the Commissioner loosely makes statements is of concern.

    The Commissioner said, “We (the Police) must find the truth on G.O.N Emmanuel..” and went on to say correctly so, “we must investigate this matter..” but then incorrectly states, “..to dot every I and cross every T.” Really?? So until then, we should expect nothing.

    The function of the police is now to find truth!!!!!-Oh how we need clarification from Dr. Aaron as to the definition of truth – a moral concept not necessarily a legal concept. What is truth vis-a vis the role of the police in criminal matters? Does the police really have a duty to ensure that every “t” is crossed and “I” dotted? Are we really to believe that all cases are prosecuted based solely on hard, direct evidence and there is now no role for circumstantial evidence, where dots are connected by a skilful attorney or prosecutor? Is there any role of a sensible jury in assessing truth or the judge is guiding the search for justice?

    Are we to accept that an investigation that has been tainted by the interference of the politicians and senior counsels and which has been so protracted should be allowed to be further prolonged to allow the police time to cross all “its” and dot all the “Is”, when two months after the incident a burnt vehicle is allowed to be moved “allegedly” without the police having thoroughly checked it as part of its forensic investigation and the police seems reluctant to pursue /interview a main suspect , who has fled the jurisdiction and is openly conducting radio interviews with a senior counsel and talk show hosts?

    How many times have we heard the DPP stopped prosecution for lack of “relevant or appropriate, reliable evidence presented to the DPP for prosecution by our police? Is there a fear that once again the inefficiency of the police will be exposed by presenting unreliable evidence from sloppy investigations?

    Yes, the police has an obligation to convict the guilty and to make sure they do not convict the innocent victims as the senior counsel’s current radio prosecution strategy suggests.

    Let’s assume that indeed, the police is dedicated to ensuring that a criminal trial is commenced in this matter in order to ascertain the true facts surrounding the commission of this Christmas 2010 crime, isn’t it the state (including the Office of the DPP) who has the obligation to present all evidence and direct the prosecution?

    Two years ought to have been sufficient to complete investigations into this rather routine crime to enable the state prosecutors to bring appropriate charges for prosecution before the court. I take solace that the police intends to proceed with prosecution of a matter whether or not the politicians are further embarrassed based on the reliable evidence that will more likely ensure a conviction in the best interest of justice and in the public interest.

      A man is reportedly found dead in the height of Morne Prosper. Joe Blue confessed that he killed the man by slitting his throat with a cutlas. The. Autopsy and evidence shows that the man was shot in the head with a .22 calibre weapon.

      As a police investigator would you arrest Joe Blue and take him to court? Or would u investigate the matter further to find who in fact shot Joe Blue?

        No need for hypotheticals. Just deal with the facts as they are known. There is a lot that could be said about your hypothetical situation but it may serves us all best if a full response is not provided.

        We simply need the police do a timely and reasonable investigation and where all the evidence is unavailable, a good investigation/prosecution can successfully connect the dots. It seems as if the police is not prepared to do that much if efforts are not being made to interview Seko, who the former Commissioner referred to as a person of interest.

If he has lied he should be charged with wasting the courts time, bearing false witness, tampering with evidence, etc etc.Nothing hypothetical here, this is how REAL JUSTICE is served up, meantime the true criminal is persued,tried and given his just meal.

    An alleged fire bombing is one that can not be verified in fact. In fact a house was firebombed. In fact an individual’s life was threatened and could have died. Someone has confessed. A full year has passed and a newly installed police chief is saying the same things that the last one said. In one year it appears no progress has been made. I am afraid this makes our police look incompetent or there is some motivation for not bringing this case to a prosecutable conclusion. Why?

    Sorry to say Mr. Emmanuel send lots of young man in jail was he was a magistrate so any one of them could try to hurt him as pay back. I wish them luck in solving this case which is long overdue. It’s very difficult to take an excon word as evidence because most of the time their stories are fabricated.

Had it been the house of Anthony Astaphan would that be the same approach in solving this crime? If a paro who had been in jail, cofessed to crime,is Carbon going to disregard the statement of the jail bird,because he is a paro and had been in jail.

    And by the way get the results of the forecnsics tests from Barbados. If you already have it, then act on it Sir.

      Actually Peeping, you do not have to reassure yourself by using a different name. You are the same person as “No Name “ and “Can’t find a Job “ among many other names as part of the overall effort to deceive the public. I must say that the rational of the Police Chief, which you and others seem to be highlighting worries me as it should worry all law abiding citizens.

      Let us not forget, we are talking about a matter that took place in December 2010 (climbing on 3 years) and the fundamental role of the police is NOT TO FINF TRUTH according to the new Commissioner. This is the role of another functionary within the criminal legal system (judge/jury based on the evidence as presented by the prosecution and challenged/cross-examined by the defence). Legal justice and moral truth of the Commission are not the same concepts.

      The role of the police is to investigate crimes, criminal violations, criminal activities or criminal offenses. The police identifies criminals and helps or commences the prosecution process but is not necessarily responsible for the prosecution itself. (We have a DDP)

      As Dr Aaron would say, truth finding is not the function of the police. The police investigates, finds and secure the relevant evidence for prosecution within a relevant time frame in a professional manner without interferences of the politicians. This role includes interviewing suspects, victims, getting investigative leads (through eye witnesses, confessions etc) and to ensure that processing of crime scenes are done and completed in a timely and efficient manner during the process of collecting reliable evidence. The responsibility of the police also includes identifying and arresting suspects who are on the run and assessing the veracity of confessions etc.
