Group petitions ECSC on Isidore/Emmanuel matter

A group of citizens here, under the umbrella of the Citizens Forum for Good Governance, have written a complaint to the St. Lucia-based Eastern Caribbean Supreme Court (ECSC) in a matter which they say is severely undermining and sabotaging the administration of justice and rule of law in Dominica.

The matter has to do with 42 criminal charges brought against attorney Stephen Isidore by his former partner Glenworth Emmanuel in 2010 which according to the group needs “an urgent corrective intervention suo motu from the Eastern Caribbean Supreme Court (ECSC) to prevent further injury to the integrity of the legal community at large and criminal justice system in this jurisdiction.”

In the complaint, a copy of which was obtained by Dominica News Online, the group said it is seeking action from the ECSC in applying ‘legal and disciplinary sanctions’ for what it described as “very troubling irregularities, breaches and criminal antecedents that have emerged in this matter.”

The group said it has now been 697 days since the criminal complaints were made against Isidore; 686 days since a warrant was issued for his arrest and 680 days since Isidore was able to secure a Stay against further proceedings in the matter and since then nothing has transpired.

“Predictably, there has also been no Judicial Review hearing to determine whether the Chief Magistrate acted in accordance with the rule of law in issuing the warrant for Mr. Isidore’s arrest, although this exercise ought to have been done within a time-bound frame, and expeditiously,” the complaint said. “You will surely appreciate that such delay-tactics are not only tools wielded to escape the consequences for the offences committed by the accused, but they seriously undermine and sabotage the sanctity of the judicial structure.”

The group said it is particularly concerned of the implication all this might have on judicial system in Dominica. “What is truly appalling, and which we hope will certainly hold the attention of the ECSC, is that no one seems to care about the dangerous implications for the integrity of our criminal justice system, or the irreparable harm done to the public at large,” it said in the complaint.

The group lamented the fact that in the meantime Isidore, who is facing charges of serious criminal offences, continues to practice law in Dominica. “It is, in our respectful view, quite simply scandalous, that notwithstanding the gravity of the criminal misconduct for which he is charged, Mr. Isidore can still be engaged in legal practice in Dominica, or anywhere for that matter, and the absence of adequate statutory provisions for disciplinary action should not be used as an excuse,” the group said.

The complaint mentioned the alleged firebombing of Emmanuel’s home and the non-action that followed. “Regrettably, to date, the police have  steadfastly refused to charge the  confessor, and the person accused of paying for the crime,  clandestinely left Dominica on April 20th, 2011, 544 days ago, aided and abetted, perhaps, by the enforcers of the law themselves, and has  not returned since,” it said.

Speaking to Dominica News Online Athie Martin, a member of Citizens Forum for Good Governance, said the purpose of the complaint is to “seek justice.” “We are seeking justice,” he said. “It is time we get the justice system to deliver justice.”

On Monday members of the public were given the opportunity to sign the petition before it was sent to the ECSC.

    When the OECS COURT OF APPEAL OR OECS SUPREME COURT meets here in November, I am certain that there will be calls for demonstration by that group because they will be saying that the court has not responded to their letter/petition.

    We can all see through they windows of the UWPWEE….MORE BLUE HERRINGS….When will that madness end. They are flogging the law and absuing democracy. Dominicans are sick, trired and fed up with this political insanity. Their past leader fled the state and they seem silent on this issue . Why not ask for his extradition back to dominica ?

    Clearly what they want is chaos. The oecs court of appeal is one of the most respected supreme courts in the western hemisphere and they will not be drawn into partisan poltricts , not now not then not ever.

      Don’t hold your breath. That will not happen. The organizers of this action are not as ignorant as you seem to be. I bet you that if they were to try this, they won’t have the support of the people as they have now. We know better.

      Oh! When will you all get it? This is not a UWPWEE issue. This is not even a national issue. It is bigger. It involves the integrity of the OECS justice system. The madness will end when the politicians and the Bar Association see the urgent need to pass the Legal Profession/Practitioners’ Act and when we are serious about holding lawyers accountable to the standard of ethics demanded by the noble profession.

      It is those lawyers with 44 counts against them, who defend corruption and undermine the integrity of the justice system. It is those who are flogging the law and abusing our fledgling democracy. Dominicans are indeed sick, tired and fed up with this political insanity that the Labour party has perpetrated and encouraged.

      Please, no one wants chaos. No one is inviting the court to be political. The Court has a responsibility to ensure that its officers conduct themselves in an ethical and professional manner at all times.

    The initiative is timely and necessary in light of the inexcusable absence of a Legal Practitioners Act in Dominica.

    It must be applauded and supported by all Dominicans in light of the ugly and unprofessional conduct of some legal practitioners, combined with pockets of inefficiencies in the management of the justice system in Dominica.

    The enactment of the long overdue Legal Practitioners Act is more important today than when it was touted by former AG Baron-Royer as a cheap political ploy to embarrass the former leader of the UWP.

    Such practical, drastic and immediate steps are necessary to bring some respectability and integrity back to the noble profession. Lawyers must appreciate and understand that when they engage in unprofessional conduct that is unworthy of an officer of the court, there shall be appropriate and timely disciplinary sanctions.

    In that regard, mechanisms must be in place to ensure professional accountability. If the Bar Association and the legislators fail to act, then the Court must come to our aid in ensuring that members of the legal fraternity strive at all times not only to uphold the honour and dignity of the profession but also to improve the administration of justice in Dominica

    I look forward to the favourable response of the Chief Justice in ensuring that the Court can continue to serve us in Dominica with accountable, independent, fair, prompt, efficient and effective justice. Dominicans are concerned with the status quo and we are fed up with the delay tactics being employed by certain dominant elements involved in the justice system in Dominica.

    We may recall that in a matter involving Linton v the Chief Magistrate of Antigua in 2005/2006, the Court was able to give a final judgment on an application for judicial review within 340 days. Therefore, we cannot accept 700 days of limbo with regard to a matter of 44 criminal counts against a lawyer of choice of the banks, the Prime Minister and his cronies as the new norm.

    Are we serious? Here is agroup of perhaps smart, intelligent and eminent Dominicans writing to the East Caribbean Supreme Court requesting the court to intervene in a matter they claim to be a serious matter. In support of their requests, according to DNO, all they have advanced as the basis for their complaint can be considered as only political arguments. They have not cited any legal basis (Archbold,Lord Denning etc.) for their complaints, no precedence, nothing that is contrary to law. Yet, they expect the court to deal with their partisan political matter. No wonder the UWP is losing all its cases. They are all steep in political arguments rather than the law. Then they turn around and blame the court for having sold out to PM Skerrit.

    I look forward to another call for boots on the ground outside the court in pursuant of this matter when the Appeals Court meet here next month for the Dual Citizenship case. This time I hope it is Athie who will lead the brigade. Perhaps he might have more luck with the marchers since Eddy seemingly is still down on the carpet waiting for the count to complete at 10 – a technical knockout.

      Apart from the horrifying ugly levels of corruption the past 2 administrations have brought to Dominica THIS regime in particular is fast catapulting Dominica into a that category of a failed state where there is a total collapse in all the systems required to ensure a fucntioning country and when that happens officially thats the end of donor money and seeing as we ourselves arent producing crap here and are mostly dependent on foreign aid!

      So with the legitimate donor channles shut down, that leaves drug money and other unsavoury sources to fund the country and we all know this regime has no problem whatsoever bringing in the ugliest elements into Dominica as long as they get their cut.

      So if this is the Dominica you want to leave behind for your children then clearly you dont love your children! My dog shows more love and care for her puppies! So bravo Dominica! animals are better parents than you are.

    All you have no work to do? So much things that needs to be done. Athie and the others get something positive to do. Set up a forum for the youths who are being destroyed by drugs and alcohol. Join up with Mr Bonty Liverpool and pool some resources to see if we can alleviate some of the drug problems here. Instead of letting these young people feel there is no hope for them, show them some concern. It hurts just today I saw a young woman who is so bright and studied overseas but alcohol has taken a hold of her. Go to Montego bay and seat and chat with those who are troubled. Show some concern instead of trying to instigate demonstrations with who will be the one at the front – but them who you teach that society and government owes them something so when you come with your inciting attitudes. they will be lead like sheep to the slaughter all because of you so called learned men as you call yourselves who are just wasting your time not contributing anything to society. Do you all want the peace of this Nation to be shattered? Let them look up to you as peace makers rather than confrontationalists. All you like noticing. Let the courts deal with their matters. Look to see what you can do for your country. People do not let the troubled youths see you as more troubled than they are. You are supposed to be role models. Come on give me a break and go clean the river or do some community activity. Pool your resources together. There are people whose homes need to be repaired.         friend this is a private matter between two business partners not a criminal matter it is for the ckivil court and mano knows well where he needs to file hs case he is a lawyer. police cannot enter in that magistrate cannot sign warrnt for that that is a high court/civil matter. time for some of us to stop listening to those that think they more smart and start readng for our selves what applies to what circumstance.

My hurtful position is that Dominicans fail day after day to admit that our government is directing us, or rather misleading us to a state f Grissom corruption and crime. The social fabric of the society is being compromised and the PM is literally taking advantage of the vulnerability and shortsightedness of the people.     I endorse the move. As a young woman I believe that it is about time that we distance ourselves from petty party politics and stand up for what is just.I am quite aware that many critics will loosely use the bible quote which states “Let he is without sin cast the first stone but least we forget the same bible also states “But let justice roll down like waters, and righteousness like an ever-flowing stream.”

    Having said this I believe that Mr. Isidore should be serve with court documents in regard to the alleged forty – two criminal charges brought against him. Is Mr. Isidore above the law? Is it because of his affiliations that these papers cannot be served? In the absence of justice one has to jump to many assumptions.

    While reading this news item, I was eager to see just how many people would actually be against this legitimate complaint.

    I already see the idiots are out and in full swing, concentrating on Athie and other irrelevant stuff. These people are so docile, they don’t realize that these irregularities in the court system affects everyone and will be at the doorsteps of EVERYONE in time to come.

    When will these bafoons forget about labour party, and political power and concentrate of the matter at hand? Not one of them can challenge any claim being made in the complaint, but they braying like donkey.

Just a reminder the casde was file somewhere in 2002 and the result was somewhere in 2011 i think that is OVER 3,000 days right… Then Lennox Linton turns around in his usual “I cannot be wrong” style and says, beating his chess on that, i will take it to the highest court of the land even to the PRIVY COUNCIL if i have to… so this battle has just begun and from your little book he is correct!!

      Second case Lennox Linton vs Renneth ‘Bubbles’ Alexis, the matter filed more than 600 days now, any update sarya??
      Well it seems justice when my (Lennox Linton) case takes forever but it is bad when the cow is on the other side of the fence, right so up to the ECSC we go to get rid of a young aspiring lawyer, WICKED SOULS!!!

    This is a positive move justice delayed is justice denied, an accused solicitor representing an accused person in a court of law is unheard of what on earth is going on in Dominica, it is an abuse of the court to use knowledge ,manipulate loop holes to stay justice indefinately, Stays are granted but only under strict guidlines and bound timeframes. that is clearly abused here,

    Any solicitor accused of any wrongdoing has an obligation to inform his clients of the accusation and the honourable man would step down until he is proven guilty or otherwise, not fly in the face and use wrongly a stay order,

    How can the court justify the ends of justice if the stay is granted indefinately which appears to be the case, it tarnishes severly the entire justice system and it loses the repect of the people who it serves, it needs addressing now and in a timely manner,

    Very good guys! This one is long over due! As a law abiding Dominican I am very interested in both matters but especially the Christmas firebombing of which both the police and government have shown no interest at all.

    Going back to DNO article of October 3 2012, where the police chief was not pleased with a court matter between police inspector Corbette who was accused of shooting Nicolas Roberts, the police chief was not pleased with what happened between Roberts, Corbette, and Corbette’s atorney and as a result, the chief lauched an investigation. There are some similarities here between Nicholas Roberts who had six charges against him and the firebomber.
    1. They are both incarcerated at the state prison.
    2. They both made a confession. In the case of the firebomber, he said he did it, he called the name of the person that paid him and drove him to the scene; he showed the injury he suffered, yet the one that paid him somehow fled the island and neither the police chief nor the government of all the people are interested in him.
    3. Yet in the case of Nicholas who said under oath that Corbette did not shoot him and sad said he is at fault because in wresttling with the police , he Nicholas pulled the trigger and shot himself; but somehow the police chief so want to get rid of Corbet that he is not pleased and has launched an investigation. Is this more important to the Chief than telling the nation of the Chistmas day bombing? If so, why?

    Why Athie and company don’t get something productive to do with what remains of their lives instead of constantly trying to agitate and engage in mischief-making??? let the courts sort out its matters. Athie needs to sort out how he’s going to meet his commitments to financial institutions in the country so that others can have access to loans. Now that would be something worthy of a petition!!!

    Wat about justice for all those who have been murdered and the murderers are set free, what about justice for these families. eh! Nobody ever wrote to the ECSE but today all u writting to ECSE for a man who use de same law to kill de poor people. “Steal one colgate, pay one thousand, even for a soap pay one thousand.” or six months in prison. Am not saying what happen to him is write and justice shouldnt be serve but look at the length some ppl are willing to go and this is because of politics. noting else.

      My question exactly!!! This guy from the time he emerged on the Dominican political scene he is involved in some form of protest. The country granted him a licence to bottle water, THAT DEAD, yet he tries to seek every opportunity to be in the news, once there is some form of protest call arthie, what a human waste!!! He should know by now he has no political future in Dominica.

      The cause that he now brings to the forth, must be investigated and if there is merit in the issue, it should be dealt with appropriately.

    This is a very interesting development. Dominica needs law and order very badly. The court needs to get it’s act together and show the public that when people commit offenses whatever they are they must come to justice, bail is truly not an option is it??
