Inquire into police investigation of firebombing – Emanuel

Glensworth Emanuel

Attorney Glensworth Emanuel has written a petition to Prime Minister Roosevelt Skerrit and President Eliud Williams calling for a public inquiry into what he said is a failed police investigation into a firebombing incident at his home in 2010 and the existence of a conspiracy to pervert the course of justice.

Citing the Commission of Inquiry Act Chapter 19.01 of Dominica Emanuel described the police investigation into the matter thus far as a “grotesque, unbelievable, bizarre and unprecedented failure” which has not brought those responsible to book.

The petition, dated October 15, 2012, pointed to the ‘advanced age of the virtual complainants’ and asked that the matter be inquired into without ‘fear or favor.’

The petition reads in part, “Whereas on the 25th day of December 2010, the home of Mr. Glensworth and Mrs Greta Emanuel of St. Aroment was the subject of arson and ostensibly attempted murder; and whereas the arsonist has confessed; and whereas the arsonist in his confession inter alia names his contractor/handler; and whereas the named handler remains a fugitive from Dominica; and whereas due to the effluxion of time and the failure of the Dominica Police Force to act reasonably and diligently there is fear of the existence of a conspiracy to pervert the course of justice.”

The petition, which was signed by 12 other persons, called on the inquiry to be convened and report on the “failure of the police investigation to date.”

This is not the first time Emanuel is writing to the authorities concerning the incident and calling for an inquiry into it.

In 2011 he wrote to then president, Nicholas Liverpool, expressing his concerns. “Regarding this investigation, I am constrained to the view that there is a conspiracy to pervert the course of justice within the Police Force,  the Commissioner of police and the Executive Branch of the Commonwealth of Dominica,” he wrote. “In these grave circumstances for all concerned I hereby call upon you, Your Excellency to use your good offices to prevail upon the Government to establish a Commission of Inquiry into these matters with the utmost urgency.”

    This matter was investigated and closed a long time ago. Tony astaphans investigated it on the labour party talk show and interviewed the suspect. Once that was done the policed closed their case u know.

    i understand everybody frustration, but tell me this, is this the only unsolved crime in dominica, does any one knows how much it cost to conduct a public inquiry, what if everybody who are victims of unsolved crime request a public inquiry, remember confession alone is not substantial material of evidence, you need real evidence to take someone before a court or to charge someone, well thats the norm of dominica police anyway, the arrest and charge and then they go and look for the evidence,

    To Cricketer and Observer- Agreed, the tried and tested procedures of police investigation must be allowed to take their course- ideally without the kind of partisan, political. However, we are not in the ideal world. Let’s not be blinded by our recent reality that we live in society that is becoming increasingly corrupted and in which those in power dictate the pace and type of justice we get.

    Perhaps you should consider providing the police with some tips in conducting their investigations into this matter, recognizing that arson is a relatively easy crime to perpetrate but a challenge to investigate. It requires great skills and competence to sift through the evidence leading to an arrest and eventual conviction.

    There are some basic things that Cricketer/observer may have liked to share with the police but just in case, you can’t, here are some of the things we hope the police has done and continue to do to ensure that someone is charged with the commission of this horrendous and dastardly act.

    One hopes that the police was on the crime scene as soon as possible- before those truth spinning SC could be on the scene so that they could preserve the scene in its original state. Examine the fire scene for sources of ignition, while eliminating accidental fire causes such as faulty electrical wiring, unattended candles or cigarette, malfunctioning appliances and sparks stoves etc.

    It is a given that the police had adequately secured the crime scene and prevented interference of non-investigating personnel so that the initial phase of the investigation were conducted with minimal physical interference relevant samples of the accelerants used to perpetrate the crime was collected and submitted for forensic examination.

    Of course, we do not believe you and the former Commissioner that Mr. Emmanuael has not been cooperating. I note that Mr. Emmanuel has described Carrette as a L.A.I.R. However, we would expect that interviews have been conducted with all interested parties to learn of possible motive of those who have broken the law including Denny, Secko, Easydoor et al.

    Where any interested suspect is unavailable in the jurisdiction for questioning, and it is known to the police where the person of interest may be found in another jurisdiction then the necessary arrangements ought to be made to have the individual extradited with immediate effect.

    It is also reasonable to expect that the police has gathered various types of evidence including eye witness accounts, forensic/lab tests and analysis and yes- confessions of anyone who allegedly committed the crime. All type of evidence is useful including hair, traces of blood, clothing, fibers, foot and finger prints, gasoline containers, rags and mode, timing and type of get away transportation etc

    Having done the above, we would hope that the police takes time to assess the various pieces of information and to put them in proper context.

    With the hope that all the above has been done, one assumes that the evidence collected would be well protected to preserve its integrity and the police would be professional enough to avoid leaking information to anyone inked to the certain named conspirators.

    Finally, if for some reason, the police do not have the expertise to do the above to ensure a successful arrest leading to a possible conviction, them the police must establish communication across jurisdictions with other law enforcement officials and if possible seek external assistance. There is no reason for the investigations into this matter to be in such limbo because of the connection of individuals at the top of the political hierarchy.

    Good move by Mr Emanuel, the first question I would ask is why the arrest warrant issued by a court was not executed what influenced the police to fail in this duty, also Mr Astaphan has demonstrated the stance that the absconder is living on the moon, as he stated on the animal show, this demonstrates quite clearly what the true feelings are in Dominica regarding this. a damn disgrace if ever there was one

    mr mano should now that sspicion is one thing but one needs evidence to take any person before a court of law and the police cannot just bend to public pressure and rush to court without having enough evidence. many other houses have been destroyed by fire and some of them may have been acts or arson,did we ask the president to direct any inquiry and did we sign petitions to any authority?NO! I only hope that the polkice finally make a break through in the case and mano and co must know that they are not helping but compromising the investigations.

      Oh come on!!! – you want to lecture this experienced veteran lawyer, prosecutor, magistrate on the proper conduct of investigations and the collection admissible evidence leading to charges –not even a conviction? Get off it. Perhaps you may wish to give the police your advice.

      This is not a matter of public pressure and rushing to judgment. It is not just an ordinary case of arson. It is part of a complex web of political intrigue, corruption and deception. We have had many substantial breakthroughs in this matter starting from a public confession (albeit with holes) and the result of a forensic investigation from overseas. One do not see how anyone other than the police, the politicians and their well connected cronies who are impeding the investigations into this matter

      Cases have been brought to court, and successfully prosecuted on circumstantial evidence alone. I would submit that in this case the evidence is more than circumstantial and it is immaterial whether the confessor has a criminal record or not.Let the case proceed to court and if the alleged perpetrators turn out to be mere figments of someone’s imagination we will know soon enough. In this country one is sentenced to two months in jail for stealing two packets of cheese, within less than a week the alleged offence took place. To bring a case of alleged arson and attempted manslaughter to course is resisted by the judiiciary and the police. This is more than “utter nonsense” . It is perversion at the least.

    Inasmuch as every police officer has taken the oath to truly serve the Commonwealth of Dominica without favour or affection, political affiliation, malice or ill-will, and to cause public peace to be preserved;

    Insofar as every police officer has vowed to the best of his knowledge, skills and ability to faithfully discharge all the duties of a police officer according to law;

    But that officer-whatever his/her rank expresses satisfaction with the status quo, particularly in the manner in which this matter is being handled by the Dominica Police Force for the sole protection of the government and its supporters-that police officer is not being true to his solemn oath.

    To the extent that the Police in Dominica have a legal duty to apprehend, cause to be apprehended persons who have committed or who are charged with or suspected of having committed or having abetted the commission of a crime or offence, the Dominica Police Force has failed in the instant case.

    Whereas the President of the Commonwealth of Dominica was unconstitutionally installed to the office of the president, inasmuch as he serves in that capacity, whether legally of illegally, one hopes that he grants the relief prayed for by this senior citizen in his petition. This would go a long way in improving his image in the eyes of many.

    As a fellow citizen, I join in calling for the course of action prayed for by Mr. G.O.N Emmanuel and the other signatories to the petition.

        Suffice it to say, I am not a politician (nor do I aspire to be one), you won’t see me in a police uniform nor am I a legal practitioner. I shall reiterate that I am just an ordinary working citizen, who cares deeply about the development of my country and I am definitely not a crook to the extent that I will identify a wrong and condemn it as a wrong. I do and I am prepared to continue working in the future with any political party that is serious about the development of our country, upholding our laws and in particular our constitution.

        In terms of political representation, each and every citizen plays a role in the development of the country. We all cannot be politicians, members of parliament or ministers of government as in the current administration.

        We all contribute to Dominica’s development in our own little way. Nevertheless, the issue of representation for a constituency ought not be the decision of the leadership of any political party. This should be determined at the constituency level. The decision should be based on the request of constituents. It should be a call from the people.

        If the people of the Roseau Valley are convinced – as I am that we deserve more professional, honest and much better representation than we have at present- then I would support anyone who would have a better vision for the Valley and by extension Dominica and more so with the ability to articulate and implement that vision in a corruption free environment.

I feel embarassed for my country… i hope the new president for what ever he is worth will instruct the prime minister to instruct the minister of national security to instruct the police service commission to instruct the acting commissioner to act urgently on this matter of national security. i also hope that mr. emanuel and his wife are give full security for fear that they be subject to assasination/murder to kill that case once and for all and to prevent justice from prevailing… let me also see if DNO will print my comment and this will really determine if DNO is a tool of the DLP… :?:

    It is my opinion that whereas it is known that the confessor to the crime has a long criminal history, and whereas the legal system hesitates to recognize the words of a convicted criminal as truth, the fact that the criminal alleges that he was paid, or directed to commit a crime against another, the matter should not be allow to go uninvestigated.

    If the case has become to complicated for local police investigators, it the responsibility of the Government to do everything within it power to seek outside intervention, seek help the United States FBI, or the British Scotland Yard.

    This is a matter that should not be allowed to become dormant, and unsolved. I also suggest that the government engage the services of either the FBI, or Scotland Yard detectives to investigate the murder of my nephew in the Village of Wesley who was found murdered with his throat slashed!

    It is important to not that someone in the Village of Wesley confessed to the murder of my nephew, the police however, ignored his confession; the ironic events which followed proved that the man who confessed indeed knew something, probably had evidence which could have lead to the capture the actual perpetrator of the crime.

    Days after the police set the confessed murder free, he also was found dead in the village with his throat slashed in the same fashion that my nephew throat was slashed.

    Commonsense dictates that the person (s) who killed my nephew are the one of the same who murdered the confessor to ensure his silence.

    This is an indication that their is a murderer or murders walking the streets of Wesley, must likely ready to kill again.

    If if the attempted murder of Emmanuel is left to go uninvestigated, and the culprit left to unpunished, that to me is simply issuing a licenses to criminals to do as they wish in Dominica, as long as they know that their deeds are protected by conspiracy, or simply swept under the rug!

    I know poor people such as my sister who’s child is murdered anticipates no justice, however, if the powers that be in Dominica has any conscience as the blood of my nephew cries out of the ground, perhaps some politician in Dominica will call for an investigation of the many unsolved crimes in the country.

      I totally agree with you. If this case has become too complicated for local police investigators, it the responsibility of the Government /Commissioner of police to seek the assistance of competent foreign investigators.

      It would appear that either our local police do not have the expertise and competence in investigation crimes, especially when closely linked to the politicians.

      You would notice though that whereas the evidence of a confessed criminal is trashed in some instances, the very police and the corrupted lawyers are boldly and confidently presenting the evidence of a repeat offender, convict and prisoner, who they have apparently bribed as the primary witness and on the basis of which they have asked the court to dismiss a case against a well connected police officer.

        I would want justice done – yesterday. I would have given he investigators a short statement for their “pocket book” on the scene of the crime like most of us people and then go to the police station and have a formal statement recorded. If hat has not been done, according tot he police, then that would have been my behaviour in my search for justice – yetseday.

        The partisan politicking of this very important matter will not bring justice to the victims. Only a duly established tribunal, whether it is a court or a commission of inquiry can do that. So far every effort to pursue the matter through the court system seemingly has been frustrated I am told by educated people who parade their partisan loyalty before duly established legal processes.

        The affected couple need justice – absolutley. The perpetrators of the this dastardly crime must be found and punished. By the way all of us are suspects in the matter. Even those like me who cry out the loudest for justice.

        But the tried and tested procedures including the police investigation must be allowed to take place without the kind of partisan, political overbearance that has been the hallmark of this case since the first moment after the incident.

      You know even if I support Emmanuel’s position, one can’t help but noticing the signatories of his petition.

      Even in his time of horror, it is not hard to detect a prejudice altitude in his petition. In a situation like this, the man should present thousands of signatures from the common man in the streets to the Prime Minister.

      Instead it would appear he was very selective in providing the names of his collogues on his petition. Frank A Baron is almost a hundred years old, I do not see his signature on that petition, what I see is simply a type written name.

      United we stand divided we fall:

      For such a petition to be effective the nation should be behind you in the interest of justice for one and all, nevertheless, the way I see it; this man does not seems to be aware that there are anyone other concern citizens in the country, except those he has selected.

      Could it be he believes that the apparent elitists he selected will cause the Prime Minister to jump!

He deserves justice, just as your family does my friend and neither of you should have to go out there for public support. If you feel that he should have more support than those who have been brave and bold enough to put their pen to paper in his support, then why don’t you start the petition by signing your name and then asking others to go to a specific location to include theirs on it?     DNO had these Ministers, Politicians who support this Government espically those who have families of the same age, had this be the Honourable Prime Minister’s Mom or dad, would that be the same response by the police, Dominica seems to be applying boundaries when comes to execute justice espically to our senior citizens who does not support this regime, In labour Party Religious theme “God is Good all the time, All the time God is Good”. and finally he God is Looking over Us all the time thats why he protected the Emmanuel’s on the very night when he was born.

    It is about time this matter be seriously looked into.
    It is a shame that in this day and age we still have not seen any one by charged with this terrible crime.
    No one is above the law, so even if it is one of the guys who is in our party , he must be brought to justice.
