Judicial review sought in inappropriate behavior matter

courtAttorneys representing a high profile man charged with inappropriate behavior involving a minor have asked for a judicial review of the matter.

The man appeared in court on Monday and his attorney asked for the review so that the charge may not be read to him.

After hearing from both the prosecution and the defense, the matter was adjourned for Friday.

A judicial review is a type of court proceeding in which a judge reviews the lawfulness of a decision or action made by a public body. It is not concerned with the decision reached by the body, but with the decision-making process.

Meanwhile, another high-profile man allegedly involved in inappropriate behavior involving a minor appeared in court on Monday and the charge was read to him.

The man was given bail of $15,000 last week and that remained unchanged.

The man is to receive permission of the court if he is to leave the island, he is to report to the police station every Monday and Friday and should not have contact with the virtual complainant and her mother by person or through any agent.

He is expected back in court on July 31.

Since a minor is involved, the laws of Dominica prohibit the publication of the names of the accused.

    This matter keeps moving without proper evidence.In short what was the nature of the behavior?Was there any sexual contact? Was is done verbally?Was it done through influence? Was it a set up? What was the time frame?Where the matter began? How long was this taking place? How many people are involved? What arrangements were made during this allegation? What drove the police to arrest and charge? What kind of background check was conducted?Was any medical check done? Has an expert or experts come forward on this matter? What is the correct age range ?
    Can someone put light to the questions above?

    ADMIN: His name was released because he pleaded guilty to the charges. Unless someone pleads guilty or is found guilty in a court of law the accused name cannot be released in such cases according to the law. We’ve been saying this over and over through the years and yet it appears people cannot understand this simple thing.

      You are assuming that they are all guilty. Thats why we have courts so that your guilt or inocense can be established. As bad as the crime is there is a presumtion of innosence until proven otherwise. We must avoid jumping to conclusions and it is the right of the accused and his lawyers to use all the tools available to them to get an aquittal.

        Thank God I am a disciplinarian, from disciplined parents. If my daughter is disobedient, she will soon be cowege (hope I spelt this correctly). I will not put up with disobedient children. Children must be children. Underage children should not be roaming the streets, seeking adult male companionship.
        I am the type of person who will stand up and speak out – the truth. I will not water it down nor suppress it. People as you are very good at that and then you complain.
        I uphold no one who committed crimes of any sort. If the men lured the child, they are wrong. They must face the consequences of their actions.
        Teenage girls who are in trouble, I must know why and how it commenced. To get you more angry, if it is determined that the teenager followed them, I would throw the case out of Court. The men should be reprimanded to stay away from minors.
        Some parents do not respect themselves and their children. They are lax. Keep your children home at nights.

    When a complaint is lodged, those concerned must be prepared to divulge all the necessary and important facts of the situation. Nothing worthwhile to this case should be hidden from the public. That is the way it should be. Too often the public only hear/read one side of the matter. They are left to form their personal opinion of what transpired; some false ones.
    It must be determined how this sexual behavior against the minor came about. I do think the public would be interested to know the commencement of it, when and where it took place, under what circumstances and how the minor happened to be in their company.
    Was she coerced, lured or encouraged? Was she a willing participant by being in their presence?
    While I recognize the adults should have known better, the above-mentioned should be part of the hearing.
    As an example, the minor is not eight years or so. She must have been no innocent child. It is right and just to investigate her habits.

        I have stated the men should have known better. Too often people as you try to shield children wrongly. This is the reason why they are uncontrollable. Take what you get!
        These are future adults who should be nurtured/trained/disciplined accordingly. What type of adult will such a type make? One day children will take their rightful place in society. They must be well-brought up in order to fulfill their duty in life.
        Some are correct to state, God help Dominica. Is this the type of children you would like to see brought up in Dominica?
        Even though the men are guilty and are found guilty by the Court, if this child were my child, she would be properly disciplined. However, discipline commences when they are much younger. It is a bit late to discipline a teenager. Such types are already far gone.

        Did you ask yourself why this child was in their presence? It is too bad they did not shoo her away. They would not have found themselves in that situation and even to lose their job.

        I heard about some of those teenage girls in Dominica. These are no decent girls/ladies. Some men done it in the past and much of it but were never caught. While the rod is hot, now is the time for them to be exposed including those children/adults.

    Mr. Skerrit MUST be held responsible for the state of Dominica is in. It is true we have always had evil men in our society that did some kind of crazy thing once in a while. However these days we have nested an evil nation, thanks to Skerrit, who did everything to ensure all of our fences are broken.

I mean the church, our village / town councils, our police department, our schools, our sports, election commission, our health department, our judiciary, even our agricultural sector, have all been contaminated and no surprise we are reaping this kind of harvest.

    On August 26, 2015 Erika exposed us and we were caught naked. When Erika knocked and asked, where are thou Mr. PM? It was a no show as Skerrit was out doing his usual thing. Later we got to know where he was, who he was with, and still not sure what he was doing.     Dominica is in serious trouble and we, the people, must act NOW! No more partisan politics because they all have brought us to shame. It’s time for urgent action and here are some Godly suggestions we must do to save Dominica.

    1. Replace Charles Savrin with Mr. Ossie Lewis as president
    2. Mr. Lewis must dissolve the cabinet and appoint Mr. Claude Weeks as interim prime Minister and Mr. Michael Astaphan, as deputy.
    3.Mr. Weeks then must fire Daniel Carbon and appoint a qualified person that will protect our democracy.
    4.Mr. Weeks and Mr. Astaphan then appoint 7 honest and wise men / women to run the affairs of DA
    5. Replace Knight with Nicholas George, as speaker.

    They should conduct an independent & honest investigation into this whole thing, as well as other questionable clouds hanging over us. If any is at fault, they should be banned from future elections and face penalty if necessary, whether they are UWP, DLP, DFP. Skerrit should Never be involved in our politics

    A judicial review in Dominica has become a shameful ploy to stall proceedings ad infinitum. I suspect that in this case it is a sorry attempt not to get the person saddled with a conviction, which would have political consequences. I hope this request is denied and a prosecution follows at the earliest so that this matter is resolved and not allowed to fester. It does neither serve justice or the alleged victim and certainly is not in the public interest.

    Thanks for the clarification as to why the names are not revealed. While the adults should be held responsible, we have to deal with these children with adult minds, dispositions, and self-respect. What is happening with counseling in these schools? It seems there is a particular school that is, more often than not, being affected by these scandals. It is time someone tries to reach them in the school system.

    OMG! attorney asking for review again so that the charge may not be read to him? That reminds me of a similar situation that took place at the court just before the attempted murder of GON Emmanuel and his wife.
    We should review our decisions or what we may be about to do before we act and not after our name is called. We need to count the cost before we build to see if we have what it takes to finish our project, less when we cannot finish people start to laugh at us.

But what about referring to their profession or title, just as you did in 2014, when you identified an accused as a policeman?     Judicial review is now the new procedure to stall the process. Asking for judicial review should not mean it is granted. Does the judge have the power to grant or deny the request? It seems like it is granted every time with or without merit. It is an abuse of due process. Again my mind is simple and there are experts out there who can explain. Maybe everyone should use when charged in a crime.

        Bail is in the law books. However it is not always granted based on certain conditions. So I am asking is the request for judicial review granted once asked or has to meet a certain condition. Judicial review sounds like it should be used for an unusual circumstance when the legality of the case is in question. As I said my mind is simple. It seems that it is used more as a tool to halt or prolonge the judicial process based on who is in court. I don’t have a problem in lawyers asking for judicial review but just like the do for bail it should meet a certain condition. It cannot be a situation where you ask for judicial review and get a yes. No point going to court.

      Whatever the next level they feel, the truth must be told in Court. The men’s life, their integrity and reputation are at stake. This is why nothing should be withheld.
      I am not referring to personal matters which took place but how did the young girl find herself in their presence, as stated in my previous comment. In other words who is the perpetrator, the tempter and the guilty in this crime. Let us hear it. We want to know.
      15 year-old girls are quite capable of tempting men. If I could, I would love to sit in this hearing but adults may be prohibited.
      This should be an interesting case. I hope it sets a precedent for all concerned, adults and minors as 15 year olds.
