Kenneth Rijock gets sued

Rijock is based in Miami

Prime Minister, Roosevelt Skerrit, along with Foreign Affairs Minister, Francine Baron, National Security Minister, Rayburn Blackmoore, and Police Inspector Pellam Jno Baptiste, have filed a lawsuit against controversial Miami-based blogger Kenneth Rijock, for failing to retract statements made concerning the issuing of thousands of blank Dominican passports to Moroccan Ambassador to Dominica, Mohamed Benjilay.

Host of ‘Talk on the Block,’ and ‘The Hot Seat’, Matt Peltier, and radio station, Q95, are also being sued in the matter.

The lawsuit was filed yesterday, May 15th 2017, at the High Court in Roseau based on Rijock’s failure to retract, apologize and pay compensation for the allegations that he made.

Senior Council, Tony Astaphan, told state-owned DBS Radio that the Prime Minister is not taking this matter lightly and described Rijock as a partaker “in conspiracy with persons affiliated with the United Workers Party to smear the Government.”

“Despite our repeated denials and our repeated answers to him and exposure of him as a con artist and a fraudster and a liar, he has continued on his merry way,” he said. “We’ve decided that we are going to put a stop to it, and we have decided to file this case.”

Saying that he had received information from a person inside the government, Rijock alleged in a blog entitled, ‘How many thousand blank passports from Dominica has been sold in Syria?’ that earlier this year, the Ambassador to Dominica of the Kingdom of Morocco, Mohamed Benjilany, visited Dominica and met repeatedly with the Prime Minister, Roosevelt Skerrit.

He further alleged that sources inside the government advised that the total number of blank passports Benjilany took possession of could be as high as 10,000.

The Ministry of Justice had, at first, dismissed the statements by Rijock as a “malicious, entirely false and an unjustified slur,” and brought clarification in a statement following the discovery of Rijock’s blog.

Astaphan said an eye is now being kept to see if this lawsuit will evoke some response from Rijock.

“We will now see whether Mr. Rijock is going to come forward with his big mouth or whether he is going to run, hide and stay away from the court of the Commonwealth of Dominica,” he stated.

Astaphan affirmed that Rijock is in no way a journalist but rather a smear artist who uses his blogging avenue for the wrong reasons.

“He is a smear artist who uses his blog for extortion and other purposes including seeking to blackmail people or extort money or to embarrass people who will not do or say what he wants or give him what he or his clients wants,” he declared.

Astaphan said that he hopes Rijock will come down to Dominica to present his facts and evidence or “stay away like the coward I think he is.”

He added that Peltier is in “deep water” for encouraging this “reckless behavior” by Rijock.

“Matt Peltier too is in deep water. Tim Hector would have said ‘Mr. Peltier is in deep doodoo’ because Matt has been encouraging this reckless behavior, this intentionally dishonest behavior by Rijock, together with Q95, and they are going to have to pay a heavy price for it as well,” he remarked.

The lawsuit is a turn around from claims Astaphan made in February that a lawsuit against Rijock would be too expensive and a waste of time.

“We were told that suing him would be an extraordinary waste of time because what he writes is such utter garbage,” he stated back then. “The government would be wasting money. The best thing for us to do would be to ignore him and to focus on what is being said in Dominica.”

    Many US based media outlets are notorious for releasing and spreading inaccurate information on smaller countries and even US celebrities. I see no problem in Skerrit requesting that they retract their statements if it’s inaccurate.
    Regardless that he is a US blogger doesn’t give him the right to write damaging reports that are untrue or inaccurate. He should show proof or get sued.
    If someone was to spread rumors or half truths about us, we would be just as upset. Small islands need to take a stand against such rubbish.

    Those of you who are saying that this lawsuit is a waste of time and that Tony is just bluffing are quite frankly shocked that this lawsuit actually got filed. It would be disingenuous of Rijock to run and hide. His presence in Dominica would be a great opportunity for him to present his evidence if he has any. Initially, he was bold to say what he said so now is the time to walk the walk and talk the talk. Rijock’s presence at this case would be of importance for the UWP so I call upon the UWP to encourage him to come to Dominica unless they know othetwise. If Rijock has any integrity he will abide by this lawsuit.

    I listened attentively to Matt and Rijock’s interview. All Matt did as a journalist was to ask questions based on what Rijock was saying about this Government. Are we for real in Dominica?     So you are basically spending all this money and taking up valuable courts time to prove the guy a coward? How then will that prove the governments innocence in the allegations made against them?

    You mean, you have no legal way of ensuring that Rijock is able to put his foot here and answer to his alleged crimes or even better – you have no way of making him PAY any judgement that may be awarded to the aggrieved?

    WHAT THEN IS THE POINT OF THE LAWSUIT? Save face or for you to make some money?

    How does one sue a “controversial Miami-based blogger” for remarks clearly made via blog, and presumably made from the safety of Miami? Instead, demand that the US silence Mr. Rijock, and when they do not, declare war! Mr. Skerrit receives plenty of insults, including remarks on this page that incivility during cricket is his fault. If his administration thinks Mr. Rijock’s charges are credible: rebut them. If not: grow a thicker skin. So the administration must be right, because it has gone to court? It is unknowable whether the cost to the public treasury is paid to boost the credibility of the passport or to boost the credibility of the politicians.

  18. It is said, sometimes the more educated people are; it is the more stupid they are: This so called lawsuit is a frivolous law suit. It is stupidest, most hilarious lawsuit of the twentieth, and twenty-first century!

    Unless I am delusional, there are two defendants, it seems to me one resides in Dominica and one resides in the United States. This is a civil matter, there are no courts in America with jurisdictions extending to Roseau in Dominica. And surely no Kangaroo court in Dominica has jurisdiction within any state in the United States.

    If the case was filed and heard in America, and Roosevelt and the other corrupted prevailed a judgment against Peltire would be meaningless, that judgment could not be executed against him in Dominica. As for Kenneth Rijock, if I was him I would simple sit back have a cup of tea or coffee, and laugh at the Dominican stupidity, because no matter the verdict it will have absolutely no effect on him in this country.

    Nothing more than their scare tactic that they know will go nowhere, but just to give their supporters the impression that Skerrit is not afraid. Tony Astaphan resides in Florida, and it is alleged that pm Skerrit owns a house in New York, though of late we know he not putting foot in the US: but if they are serious about going after Rijock, why not do hire a Florida lawyer or even use Mercury Crisis Management since they are paying them over $90,000 a month for crisis management since they are based in Florida and they have some very good attorneys and know some good attorneys that could go after Rijock? Don’t be fooled Dominicans because these cowards cannot go after Rijock in any way, shape or form, because they do not want to open any can of worms that will affect them and their supporters

    • Guy Lawyers in America work by the hour: The last one I retained, charged me $160.00 dollars per hour!

      He told me the only reason he is that lenient with me, is because we are supposed to be causally acquainted. Sort of friends to each other. Now in case like that, there would have to be a deposition, so that means there would be five Dominicans to be deposed.

      Skerrit’s deposition could take longer than thirty days; times eight hours. So, 8 X 30 = 240 hours X assuming $500.00 dollars per hour in thirty days, you are looking at approximately $120, 000.00 over thirty days. now some law firms may charge thousands of dollars per hour, depending on their reputation, and the category in which the case falls.

      It is nothing like Dominica, lawyers do not work for thank you or peanut change in America, most lawyers in America would not even waste time on a case like that.

    This is extraordinarily laughable and unserious.
    Tony Astaphan has perfected the art of legal intimidation of adversaries in Dominica and he has decided, rather foolishly, to extend his boyish prank internationally, hoping to silence a critic who is outside the reach of the kangaroo courts in Dominica. If he wants to be taken seriously he would be well advised to tell his clients, especially the reckless prime minister he serves, to be more careful in their dealings internationally, and or face the wrath of the United States.
    This is not the way to deal with the mess which Skerritt alone has created. What is needed is a recognition that Dominica has an image problem and that can only be resolved by an honest reflection and a determination to follow a different course. Anything less is grandstanding and a diversion which will not make the problem go away.
    Good luck Tony, but you are really punching above your weight.

    Desperate measures by desperate people. Trying to put a stranglehold on critics at home will only drive the assaults on our regime to be directed from abroad via social media, which would be virtually unstoppable and far more intense and damaging than what we experience now. Q95 can broadcast from overseas via the internet from the U.S.A., Canada or any other jurisdiction for that matter. Not only would it be cheaper but reach all corners of Dominica.

    I want to know how this lawsuit is going to gain any grounds etc.

    Some countries will ignore any legal action coming from another country. For instance, you can almost never legally prosecute somebody in Russia if you’re in the US. Same is true for Nigeria. I believe it’s true for India. So lets see if this is another case of monies being wasted where it can go for the better good of the country.

      That in Dominica is so foolish it makes no sense at all! We call that a pappy-show, its comical. I had a case here in Los Angeles involving property in Antigua. I prevailed, the other person involved, and Antiguan lives here in Los Angeles too.

      Although I won the case the presiding judge told me he has no authority to enforce the judgment in Antigua, since Antigua is a foreign country; his court has no jurisdiction over Antigua.

      I went to Antigua, with the proceedings of the case and the judgment, to a Lawyer, he simply looked at it and told me “America is another country you nur.” We Dominicans always have to find a way to make jackasses out of our selves to the rest of the world!

    This guy is bluffing. Tony are you bilking the Dominica Treasury with your many frivolous law suits on behalf of Skerrit? ( that is a question). If that is the case, can you find some other legitimate legal work? ( a question).

    Conclusion: It takes a fool to make or have access to money and it takes another man ( maybe a lawyer) to take it and spend it). That is what Dominica is all about today- Sad!!!

        My bad. We do have a restricted extradition treaty with the US.

        That being said, they could legally request for Skerrit to be extradited to the US to stand trial, if he is found to be in violation of AML rules.

        Expat, you forget. Mr. Astaphan is also a resident of the U.S.A. and he could be sued there easily. That is probably why his name is not included in this suit. Tony’s residence is not that far from Kenneth Rijock, in Weston, just up the road from Ft. Lauderdale. Tony is not stupid

    Tony is a coward and knowing him and the rest the way I know them, I don’t believe they filed any lawsuit against Rijock, and if they did in pretence, expect it to be fake and I can guarantee you they do not want Rijock to come down to Dominica to expose them. I hope they did not ban Rijock from putting foot in Dominica.

      You know that he does want to come to Dominica. I would like him to come because sure enough the opposition will be exposed for who they really are. The man knows he will not be able to deliver what the opposition wants.

    Great! This …. must be held accountable. As for Matt, he keeps attempting to manipulate the people that there is a movement to shut down q-95, however, many of us are much wiser. Matt, the station is in jeopardy of being shut down because of your irresponsibility. You allow many of your guests and callers to state hearsay without interruption. As a result, the Company will incur a lot of debts, resulting in closure. We must stop abusing the privilege of freedom of expression, stop using it to state untruths. This will be the demise of q95 and not a movement to shut it down. The owner must make changes in order for the Station to remain afloat. Those who refuse to adhere by the rules are liabilities, and must be given the pink slip. I won’t fall for your crap next week to pledge. Matt, q95 is in shambles because of people like you and your malicious intentions to sway the populace base on rumors. Take some responsibility, will you?

    What next?
    Mere distractions from the real issue, an impoverish Dominica ruled by a corrupt regime. So Lets say this man is successfully sued, what will be the cost benefit to Dominica? In my opinion, this is a personal thing between this man and Skerrit. Dominica has nothing to lose or gain from this case.

      The man has smeared the Office of the Prime Minister of the Commonwealth of Dominica. If it means nothing to u, then what can I say hmmm. But I do believe we (Dominicans) should retaliate to the full extent of the law. That man is a disbarred lawyer, and (later) convicted criminal involved in the most notorious acts and should never be trusted. He was disbarred by his own, with reason and then convicted by his own, again with reason. He admitted to doing these crimes, and now wants to point fingers. Dominicans should have never given that man a hearing, shame on allu.
