Opposition leader, Lennox Linton, has been told to pay £25,992.12 to Kieron Pinard-Byrne within seven days or bankruptcy proceedings may be taken against him.
The notice, which was served on Linton on August 30 at his home, is the latest twist in a libel court matter between the two men which spans over a decade.
The letter stated that the amount must be paid with interest of five percent per annum.
The sum is the final judgement obtained on April 27, 2017, “by the Creditor in the Privy Council Appeal No. 0064 of 2014, intituled Kieron Pinard Byrne v. Lennox Linton, whereon execution has not been stayed, or secure or compound for the said Judynent debt to the satisfaction of the Creditor or you must satisfy the Court that you have a counterclaim, set-off or cross demand against the Creditor which equals or exceeds the sum claimed and which you could not set up in the action or other proceedings in which the Judgment was obtained.”
The letter stated that if Linton does not comply with the notice within seven days “you will have committed an act of bankruptcy in respect of which bankruptcy proceedings may be taken against you.”

Pinard-Byrne, who is a chartered accountant, said in the entire matter, Linton had not sought the protection of the court.
“Mr. Linton stands in default of court ordered legal costs, he has not to date [sought] protection of the court from his creditor in a declaration of bankruptcy. His standing is therefore untenable and a disgrace to Dominica’s rule of law and media profession’s ethical standings,” he noted, describing the matter as an affront to any victim of character assassination in Dominica.
He added, “I reiterate in accordance with my professional ethical standards, I sued Mr. Linton in 2003 in the public interest. It now follows as night follows day given Mr. Linton’s default modus operandi over the past 15 years that he may be brought to account under the Bankruptcy Act of Dominica accordingly I instructed my legal counsel to have served the prescribed bankruptcy notice upon Mr. Linton and that was done.”
Pinard-Byrne stated that in all his years as an Irish-Dominican, he has never seen Linton observe the Golden Rule and even mentioned Linton’s recent trip to China.
“For Dominica’s reputational sake, it may be hoped that Mr. Linton may have learned something of the honorable ancient Chinese art of saving face during his recent educational visit to China and belatedly take the honorable course in his life in part in counsel by Confucius, ‘What you do not want done to yourself, do not do to others. To know what is right and not do it is the worst cowardice.'”
The matter centers around the Layou River Economic Citizenship Program and the Layou River Hotel project and goes back to 2002 when Pinard-Byrne sued Linton because of an article he published on a website and statements made about the same program on a radio show, on which Linton, who was a journalist then, was a guest.
In his suit, Pinard-Byrne said he was libeled by Linton.
The matter went through the local courts, to the Eastern Caribbean Court of Appeal and finally to the Privy Council which ruled that Linton did indeed libel Pinard-Byrne.
That’s a lot of money to be throwing down the drain. I could use that money to build my third floor. That’s laughable the way this man want to have himself. I mean what can be done for them to pardon mister. Eddison James had sued Ian Doughlas, and he paid him off without any problem. So why Lennox cannot do the same. Why he have to let them force bankruptcy on him. Plus the ministers case against, look problem. I myself waiting to hear what’s going to happen after the 7 days. I used to like my country Dominica. Currently, I have no interest in this island. Dominica is a hot mess right now and is not on my radar of countries to visit. My dad visits us in North America, so I rather explore the world with my children. They were in Dominica for my mother’s funeral four years ago and I am not planning to take them there, no matter how many reunions they have. Man bite Dog, if you are aware: you might be aware of the word “Receivership;” Or ” receiver ” defined as “treasurer.” That is a person appointed to hold in trust, and administer property under litigation, that is a person appointed to settle the affairs of a business involving a public interest or to manage a corporation during reorganization.
In some cases when a company goes into receivership, depending on the amount of debt the company or corporation owes, the assets of that entity may not cover the debt, hence the receiver has no alternative than to shut the business down, and sell what is in the place of business, and disburse the proceeds among the debtors.

Rather than suggests a reasonable payment plan to the gentleman to pay the debt owed, Mr. Linton proposes a payment plan beyond Pinard Byrne’s lifetime. To simply aggravate the wronged man further. Dominica must be a place where, the law’s of the land and people are different to any other place on earth. Dominica is the only place on earth where a legal system allows government or individuals to declare an individual, or entity bankrupt.
People usually declare bankruptcy when they have no resources to pay their debt. Dominica is the only where people are sent to jail because they owe people. Now, right here in Los Angeles, if I owe the state, the government, and cannot pay my debt there are different ways I can file bankruptcy. One way is under a certain chapter, where I retain all that I own, and the State of the debtors I owe can touch me.
The other is I can make arrangement, to pay my debt over a period of years. You know one of the reasons people like me may never set foot in Dominica again is because of situation like this which would cause me to take the law into my hands!

Volumes of judgements for libel has been handed down throughout the Caribbean for many,many years, and lots of media houses,radio personalities,politicians,and man in the street have had judgement against them. Please don’t castigate Dominicians and Dominica for following the laws on the books.
In English Law if you cannot pay a judgement of the court,the claimant can approach the court to appoint a Marshall to seize you property to make good of your debts.
English laws are the same for ALL British Commonwealth countries that access the Privy Council,unlike the USA where the laws can be quite different from state to state,except for Federal Laws.

You have to meet certain requirements to be an MP. You cant be bankrupt and expect to represent people you are a moral risk. Please people read and educate yourselves on issues.
Constitution of the Commonwealth of Dominica, chapter III, par 32, sub 3 & 4a:
“A Member shall vacate his seat in the House….if declared bankrupt”.
I’m sure that Mr. Linton is aware of this and would have worked out a suitable strategy to avoid this becoming a reality.
It would behove all Dominicans to be as familiar with their Constitution as they are with their Bible. It is far shorter and eminently more readable.
Meanwhile we still don’t have our Layou Hotel and the money intended for its development and construction appears to have gone with the wind.

If you declare bankruptcy you are disqualified as a parliamentarian, that is the law. I hope Mr. Linton does not allow it to come to that.

There are two provisions in the constitution regarding bankruptcy pertaining to Members of Parliament:
– an undischarged bankrupt can not stand as candidate for election as a Member of Parliament.
– if a sitting Member (after he has been duly elected, taking into account the above) is subsequently declared bankrupt he must vacate his seat.

Since the UWP know the criteria to become a member of parliament. Could it be he is looking for a way out of parliament because winning an election is not within his grasp anytime soon.
So could the ploy be on his part to leave parliament and blame anyone else even the law. Dominican, you may have a point but I believe you may have it in reserve, it makes more sense, because Marigot is a UWP strong hold. If there is a by-election in Marigot the UWP would still win.
