A Vielle Case man, who was a facing a charge of murder, was found guilty of the lesser charge of manslaughter on Monday.
Clement Labassiere was accused of killing his grand uncle, Ambrose Leblanc, but a nine-person jury could not reach a unanimous decision on the murder charge.
He will know his fate when he appears in court for sentencing on March 13.
The incident which led to the court case occurred on February 16, 2011 during which it is reported that Labasseiere inflicted a mortal blow to the head of 74-year-old Leblanc after a land dispute in Vielle Case.
Leblanc died three days later.
Labassiere said in court that he had thrown a plastic pipe at Leblanc because he was destroying his crops.
The incident occurred after Labassiere had successfully appealed sentences handed down by Magistrate Tiyani Behanzin in April 2010, at the Eastern Caribbean Supreme Court of Appeal.
He had walked out a free man after being incarcerated for 10 months on a number of charges including assault and battery.
Labassiere had faced charges of threats, throwing missiles, battery and five charges of assault and was sentenced to a total of 27 months jail in 2009.
However, according to the Court of Appeal Labassiere should have spent less time in jail.

The law people of the land needs to make ammends to the act and bring back hanging in the gallows. too many murders on our island – man killing man and walking out free. As they free them up within a few days we hear of another murder. What is going on? someone need to answer. Too many criminals are walking out free on our streets – lives are too important to have people kill you as if you are a fly or cockroach.
Hang them all – by their legs, their necks or their hands. Let them suffer.
now te court of appeal should now go to jail for that murder because,they are the one`s that make him think he can do what he want.cound`nt they have seen this guy was trouble? for they, thinking 27 months was to muchin jail.

A 9 month jail sentence, not even prison, is too much for taking a man’s life. Wether or not Ambrose was destroying your crops, I am certain there were other ways to handle the situation. Should you not call the police? I thought that is what the justice system was there for. Well, I hope the residence of Vieille Case / Enbas stays away from you. Bad blood is not easy to clean, and with your experience of going into one door and going out the other, I think you have NO REMORSE.
Ambrose is gone, the rest of the family are still there. Your family. The property is always going to be there. I do not think anyone should die such horrible deaths regardless of the circumstances. The justice system really SUCK.
the court is a joke man this man them should make him spend his rest of his life in the jail we from the same village and Mr. Ambrose like a family to us

i always say that the justice system works had in hand with the criminals
the police are the one messing up the incvestigation by not doing proper works so blame them and not the courts who goes by evidence provided
man kill his uncle and he get such easy sentence,court system is a joke,going to hunt you for the rest of your life.
I really hope they send this guy away for a very long time. No one from V/Case wants him back in the village. It was just a matter of time before kill someone. I hope he is smart enough not to come back to Ambas. May your soul rest in peace Mr. LeBlanc.

this is draconian law that we practice in Dominica… on top of that there are no guidelines i guarantee that this guy will walk out after his appeal. he was charged for murder and not manslaughter… come on the prosecution must get its facts right.
secondly i am no lawyer but watch a lot of law and order to know better…. lawyers do the job that you are paid for and stop running around making deals with the prosecution. this will get you all no where but also in the hot water one of those days

Don’t worry, they let him out so he can murder somebody else and that way they might see it fit to let him serve another 9 months.

What you sow, that’s what you will reap. MONEY and LAND always causes jealousy, greed, and even murder between family members all over the world.
As humans, we have to fight for what is ours, but if it is greed, it is not right. At the final point, we all die and leave everything behind.
What shall it profit a man if he shall gain the whole world and looses his soul. The best thing we as human beings should do is, try to get along especially with family members. Life is too short.
Where is his uncle? he is dead. Where is he going to be if he is find guilty? in jail. We have a right to be angry, but what we do with the anger we have to think about. Everyone acts on our nerves, but we have to have self control.

If he had spent the time in jail the first time he would not have been out to kill the old man. This guy apparently has anger issues.

had he known he would have taken his 27 months and be out by now (free). He would not have been out to kill the man in 2011. Somehow we all have to pay for our sins so let my friends in high places think appealing cases black is white will actually save them from the final judgements , its just a matter of time , I hope they learn the message from this case . God is not a police man. He sees and is never asleep. Just one day is all he needs.
