Man gets two years for unlawful sexual connection

courtMarcus Samuel, who pleaded guilty to unlawful sexual connection in January 2012, has received a two-year jail sentence by high court Judge Errol Thomas.

According to the facts as presented by State attorney in the office of the Director of Public Prosecutions (DPP) Fernillia Felix, the Virtual Complainant (VC) was 12 years old at the time of the incident. She knew the accused for seven years as she was friends with his sister and normally visited the home to spend time with her.

On January 6th, 2012 at about 12.30 pm the VC was at the home of the accused playing video games along with other friends including the sister of the accused.

The VC along with Samuel’s sister decided that they were going to shower. Samuel told his sister that he wanted to use the shower before the VC. The VC then went into the bedroom to remove her clothes, locking the door in the process.

The accused then knocked the door and told the VC that he had forgotten his phone in the room and that she should open the door for him to retrieve it. He was told to wait since the VC was undressing, but he indicated that he was waiting on an important call.

The VC opened the door for him to retrieve the phone and Samuel asked her to get it for him, which she did.

But then Samuel locked the door, asking the VC for a kiss in the process. She refused, saying that she had a boyfriend.

He then said that said that if she gave him the kiss, he would open the door. He got his kiss and Samuel then unlocked the door.

The VC went to take her shower and went back to the room wrapped in a towel. The accused was not in the room

However, while the VC was in the room, he appeared, locked the door and ask for oral sex, which was refused.

Samuel then told the VC that if she did not meet his demands, he would tell her adopted mother that she had a boyfriend.

The VC eventually gave in to the Samuel’s demands.

The incident was reported to the VC’s adopted mother who reported the matter to the police resulting in the arrest of Samuel.

In mitigation his lawyer, Glen Ducreay, asked the court for a none custodial sentence since his client was a first time offender and had pleaded guilty very early in the matter.

“He has expressed remorse for his actions, he is a good young man and knows what he did was wrong, he is not blaming the society but he is asking for a second chance for his mistake,” Ducreay said.

Before sentencing, the Judge said Samuel used his “tricks” to get to the room for his objectives.

He said that there is a prevalence of sex offences against minors and young children in Dominica which needs urgent attention.

    Two Years Only? Wow. Well i guess i will do it again, its only two years. LOCK THOSE BASTARD UP! If this was my one n only daughter, I’d be the one facing the sentence today!

    I still think he should get the maximum sentence. You all need to register those kind of creatures. When someone steals and murder their pics are taken from their face book page or wherever it can be found but those sexual offenders identities are protected when in fact they destroy lives. I just don’t get it.

      Did THEY molest the child? Was sentence handed down by “THEY?” If “THEY” were not in office would the sentence been different? If “THEY” were not in office would the child or another child not get molested? SMH.. Some of us really need help.

    He certainly used his tricks on the girl. He is remorseful? He knew this is an underage child. He should have been sentenced to at least five years.
    Those who commit such crimes should be imprisoned for a certain amount of time. Probably they will learn a lesson and their actions against children will be eradicated for good.

    If that was my 12 year old daughter, Judge Thomas would be sentencing me to life in prison for my response.

    A girl of 12 years of age ,a man made advances on you asking for Kiss, the reply should have been, I am too young and I am not into that yet, that would calm the man down, Instead I have a boy friend meaning you are not new to the game. So called friend. The man should have known better, yet again the girls body are more expensive than rubies, yet again they treat it as soft liver. What can a government do if girls have no pride with their body. We were turn unique so give a thought to the supreme being who made you and give him honors. The mothers only lesson to their children is about sexual intercourse. How can the government help when this always take place in private. If and when they are caught ,In the slammer

    Anybody would express remorse to get a lighter sentence.

    I expect what he felt was regret not remorse. It was nor regret that he committed the act but regret that he was arrested and charged.

    It is noted that the victim was 12 years old at the time. Does Marcus Samuel qualify as a pedophile :?: If so you can expect him to reoffend. He should also be receiving counselling or therapy.

    Even though she eventually gave in to his demands she was under the age of consent therefore consent meant nothing. In Canada I expect what he did would draw a charge of statuary rape. The fact that he threatened the girl to get what he wanted amounts to a form of blackmail or extortion and may be considered in that light.

    Everyone calling for “urgent attention” on this matter but nothing seems to be happening on a higher level. There is something sick in our society, and punishment alone won’t cure it. A serious educational campaign needs to happen to not only warn these perps, but give practical advice about what to do when the thought or urge crosses their mind. Inform them of the risks to themselves, the victims, their families. And in addition to locking them up, put in place a system of education and community service so they come out of the process truly understanding the impact of their actions.

    I can’t believe after years of these urgent calls for attention the government still continues to be silent on the matter. Then again…we all know why…

      There must be a revival of the fear of God and respect for the Word of God.

      The moral code God has given us in the New Testament should be taught by parents in the homes, and by teachers in the schools. It should be reinforced by nurses, guidance counselors, and physical education teachers in the schools.

      Even in churches today there is a lack of clear teaching on the proper place of sexuality in marriage, and the boundaries God has placed upon sex. All sex outside a legal one man with one woman marriage is fornication which simply means illicit sex. This includes every form and expression of sex outside marriage.

      Those who are found guilty of sexual crimes against children or adults (especially children) should be enrolled in a mandatory education program and taught the lifelong psychological consequences their actions can have on the victims. This should include real statements from victims.
