Man pleads guilty to indecent assault

Defendant Keith Tyson pleaded guilty to a charge of indecent assault before Justice Birnie Stepehnson Brookes on Wednesday morning.

The charges were re-read to him after his lawyer David Bruney instructed the high court of a particular course of action which he will be undertaking in the matter.

Tyson was arrested and charged after indecently assaulting a 15 year-old-girl.

A pre-sentencing report was ordered and his bail conditions were continued.

The defendant was warned to stay away from the complainant, and the matter adjourned to 25th June, 2012 for sentencing.

On another matter, Lenson Merrifield considered himself lucky when the case against him of unlawful sexual connection, burglary, and indecent assault was discontinued by the Director of Public Prosecution (DPP), Gene Pestaina.

Merrifield, who has been on remand at the state prison, broke down in tears and thanked God, the attorneys and the judge for their decision to drop the matter.

This is the second matter which has been discontinued by the DPP since the high court assizes reopened in May (2012).

The first was a wounding with intent case against Julien Davis.

When the suspect is remanded awaiting his court date, he gets a taste and smell and feel of what may lie in store for his future. This is the best preventative medicine, regardless of the courts decision. Either way tears will flow.

When is Pestina going to retire, he does not seem to be functioning in the best interest of the state.

Never mind interest of the state. It would be very sinister if the DPP served the interest of the state only. Interest of JUSTICE comes above anything.

Don’t really understand why the DPP let it come to a court appearance and then drop cases when proceedings begin. If they have no case, couldn’t that have been decided before valuable time is wasted? So many cases in arrears for hearing already.

I totally agree with you, but this is what happens when you have people in posts that are accountable to no one.

To my mind, the court is the place where the poorest level of management is exhibited.
