Man remanded in connection with bar shooting

One individual has been charged and remanded at the state prison in connection to a shooting incident at the All Nations Bar in Newtown early Monday morning.

Alpha Alexander appeared before Magistrate Ossie Lewis today on three firearm related offenses.

He pleaded not guilty to one of the charges, a summary matter, but was not required to plea to the others as they are indictable. These will be heard before a judge and jury at the high court following a preliminary inquiry.

Alexander’s bail was denied after the prosecution objected to his release on the grounds that Alexander would interfere with investigations and witnesses if at large.

The firearm, according to the prosecutor, has not yet been recovered. “We feel that if we have more time we can recover the firearm,” the prosecutor told the court.

Alexanfer’s lawyer, Zena Dyer, countered by stating that the prosecution did not provide reasonable grounds for bail to be denied. The lawyer  labeled a request from the prosecution to have her client’s conviction record revealed during today’s bail hearing as one which was not in keeping with court law.

Dyer argued that a defendant’s conviction card should only be presented during a bail hearing if the accused has a history of committing similar offenses, especially while on bail. She claimed that this was not mentioned as one of the prosecution’s grounds for objecting to bail.

Dyer also argued that there is “absolutely no evidence” to prove that Alexander will interfere with investigations or witnesses and asked that any evidence be shown. She further accused the police of not having evidence to support their charges.  “If they have evidence give us now,” she stated.

The prosecution refused to provide any evidence in the matter stating that there was no obligation to provide evidence during a bail hearing.

Dyer accused the prosecution of keeping her client locked up as a means of punishing him.

Magistrate Lewis remanded Alexander for a week in order to give more time for police to compete investigations.

Lewis said that if the defendant was indeed released today, he could have interfered with the course of justice, which is reasonable ground to deny bail.

His bail will be reviewed on March 11 and the preliminary inquiry is scheduled for June 20, 2011.

Disclosure was ordered to be made by May 15,2011.

    anytime a man does a crime and did not serve time for it he will do it again and again .dominicans wake up STOP praising criminals .its young men like him that is allowing our country to become what it is becoming . domanicans were are our moral values were is our young people?what are we doing have we forgotten the words of our national emblems EX:
    the red central emblem symbolises commitment to social justice . the last words of our national pledge i promise to work diligently and help build a prosperous and peaceful nation. what about the verse of the national song that says : and a people strong and healthy full of Godly reverent fear i belive that when people like alpha comes be for the court that the national pledge should be repeated by the accused .

    I had the opportunity to talk to Alpha on numerous occasions when he was last imprisoned. He was well loved by the prison staff. Very helpful, stayed out of trouble etc. That young man promised me just a few weeks before he was to be released that he would NOT return to a life of crime. His plan was to learn a trade, try and do some classes and get a job. Has our system failed Alpha in not giving him follow up care? I’m not gonna point fingers or blame anyone, but I’m deeply saddened that Alpha went back down the road that had him imprisoned for most of his youth.

    Send Alpha prison, he comes out, goes back in and the process continues. It is evident that our system is not working. There is no true reformation taking place in the prisons.

    I really donn get why people crushing the dyer family. You have prosecution and defending lawyers. Hey specialize in two different things. Without them both, there is no way the system would work. Some specialize in both, yes, but then they all over the place. How would you feel if you knew you was innocent and only dyer defended you? Blame he criminal not the lawyer. It’s a job like any other.

    Must admit! Known this guy since in high school doing crimes. Obviously by now he has gotten his phd in illegal activities. Law is law so no evidence is a problem but it is about time we rid our streets of rubbish and clean up our country

      He wasn’t released and to be honest. I know and practice law and if the police don’t have evidence then they cannot really hold him. Also, he is not obligated to release previous conviction information because that’s the law. It’s like that all over the commonwealth. We adopted a British system so…

        Not yet having retrieve the firearm, according to the police, is not the same as not having evidence.

        The Truth, if you say you know and practice las, then you will no that a firearm in not the only evidence one should look for in a shooting, though it would be critical for the police in proving their case beyond reasonable doubt.

        That’s exactly what it is, our laws. The Cabinet, the AG, the justice system need to look at those laws that are helping lawyers to defend all those criminals that threaten the lives of Dominicans, and do as they please. They in and out of jail, like is the bathroom they going to, and steadily threatening the public. This is a serious problem, and the government that we put there to work for us need to see to that. We need to move with the times, because the criminals and the level of crime is surely keeping up with the changing times.

        Don’t blame the lawyers, BLAME THE CRIMINALS. They are hired to defend/represent them in court. What you want them to do say no because they are criminals? They are great defenders, thus the reason for they being hired over and over again. It is the nature of the business.

        It is common sense. ALpha is a bad egg that needs to be locked up in jail especially after serving time in jail for his involvement in the murder. I am happy he was denied bail for whatever reason, and he needs to be kept in jail until after carnival. BUT DON’T BLAME THE LAWYERS PLEASE
