May Criminal Assizes kicks off on Tuesday

When the May Criminal Assizes opens at the High Court in Roseau on May 14, 2013, a new person with be holding the position of acting Director of Public Prosecutions (DPP).

The holder of the substansive post, Gene Pestaina, has gone on pre retirement leave and Julien Prevost, a local attorney, who is no stranger to that post, will act in that position.

There are so far 16 listed matters on the court’s Cause List including murder cases involving Shane Degallerie and Edward Green, which were traversed from the January assizes.

Other matters on the list include charges of causing grievous bodily harm with intent, incest, handling stolen goods, theft, unlawful sexual intercourse, wounding with intent.

At the end of January assizes, Justice Bernie Stephenson ruled that the murder trial of Shane Degallerie was to be “top of the list” at the commencement of the May Criminal Assizes.

Degallerie has been on $30,000.00 bail while Edward Green remains on remand for over five years, on allegations that he murdered Damien Dorival.

The State’s cases are expected to be led by acting DPP Prevost along with State attorneys Arthlyn Nesty and Sherma Dalrymple

    .such an act as releasing a murder suspect on bail,not this way……why must lawyers lie in escape of people who they know committed a crime?(money?,respect) …….these re contributions to the decline of moral conducts,shame shame shame…the Only book of law is the BIBLE.forgive men ,may they ask forgiveness themselves from GOD.and i believe that there must be an organisation that people may may be aware of offenders in there community,seeing thar men does not repent of their lawlessness,hence repeats his habbits …..

    Well I hope the prisoners that they bring to the court are not infected with chicken pox, because then there will be an outbreak. Actually they need to cancel these assizes until this situation at the prison can be fully assessed and dealt with, with proper medical management. This is really an emergency, but we like to down play things in Dominica, and not use preventive measures, but PREVENTION IS ALWAYS BETTER THAN CURE.

    The legal system in Dominican is a Joke! Everyone , regardless of how grave their crime is , is given bail.
    This , undoubtedly demoralizes the police in their efforts to fight crime.
    When I heard the former magistrate said that, on many occasions he had received calls from politicians on how to rule on a case involving a defendant in his court and if he did not rule in a particular way his job won’t be guaranteed. And as said that was done. He is now out of a job.
    So these are small mentality that we are faced with in Da. Where politicians mingle in legal matters where they have no business or experience in. SAD!!

    Well I am waiting for justice for Justin. His life was taken but the longest rope has an end..This case moves from one criminal assize to the other but this too must end..Justice for Justin.

    It is time that they deal with the backlog. The criminals are emboldened because the high court of justice delivers at a snails pace. I guess we are taking our cue from the American system.
