Earl Grant wanted for questioning in connection with GON Emanuel matter – DPP (with audio)

Acting director of Public Prosecutions, Julien Prevost, has disclosed that he is taking steps to prosecute a matter involving former magistrate Glensworth Emanuel.

Prevost, who recently became Ag. DPP, said Friday morning that he had just received the police file on the matter and had spoken to the chief magistrate and the police on it.

According to Prevost, there is enough information in the file to have Earl Grant, otherwise known as Seco, answer to certain questions.

“So I would like to put him on notice that unless he comes willingly to the country before the end of the month, I will be seeking the assistance of the attorney general to have him extradited to Dominica,” he said.

Prevost said that he will be having discussions with the investigating officer in the matter and he hopes some progress is made before his tenure as acting DPP ends.

EmmanuelEmanuel’s home was reportedly fire bombed on Christmas morning in 2010.

Grant’s status as a person of interest in the matter is based on a confession by Denny Shillingford in which he implicated Earl Grant as one of the ‘organizers’ who had hired him to carry out the bombing. He said at the time that he was coming clean because the “organizers did not stick to their end of the bargain.”

    Dominicans should not be quick to condemn or to invoke conspiracy theories about the actions and intent of Mr. Prevost. He is doing the right thing. Let the actions of the DPP speak for themselves. Let’s see how the police will react or act. Let’s hear what LEN & will say tonight on the animal programme- if anything. Most importantly, let’s see how the magistrate court () and high court () will deal with the matter when and if it gets there. We have a long way to go, many more stones to overturn and many more knots to untie. We cannot start shouting hooray! However, between you me -without a doubt, this ought to give us some hope.

    I sincerely doubt that anyone will be charged, arrested and prosecuted for this crime. Those who murder in cold blood continue to walk the streets freely. So why should I be convinced that things will be different this time around.
    A bus driver was recently murdered in Layou. I am waiting patiently to see if the wheels of justice will prevail for the family of the deceased.
    I am not aware if anyone was prosecuted for the murder of “Munga” also known as (Omarie Smalls). His family also deserves justice irrespective of how he lived his life as a human being. In a civil democratic society, we do not allow nor should we sanction mob justice. I hope the new Director of Public Prosecution have the same list of unsolved murders in Dominica that we all have. Let’s see just how many cold-cases are solved under his watch. Only time will tell.

      Ismael let s not be conveniently blind. The SICO SECO case is not a old case. The evidence trial is clean , free of shrubs and in our faces everyday. Those who continue to attempt to derail the case are in our faces everyday. Mr Emmanuel is alive and Denny Shillingford the confessor is t the disposal of the justice system ,morning, noon or night. Sico Seco promised to get back to Dominica two years ago to answer to the allegations .
      This case is as hot as the overhead electrical cable – all that is required is that one close circuit contact.

    You cannot extradite someone without having charge them with a crime. So unless the Prevost charge the man with a crime his cause is only frivolous.

    Mr. Prevost is a pathological politician. That wavering quality, will prevent him from acting impartially on this case. So his bogus press conference was only staged to mislead the plaintiffs into a deceptive perception that justice is working. In reality no real justice is ever going to be served.

    First, I would like to commend your attempt to change lanes as you take your brief appointment; however, I have a few questions:
    1) Mr. Prevost has anything changed on the case file from the time Mr. Pestina left the post to you taking up the mantle?
    2) If no, why did Mr. Pestina not pursue Mr. Grant coming to Dominica for questioning as you are doing now?
    3) Is this about smoke and mirrors? In order words, given election is around the corner the strategist are making a move to give the impression to the electorate that something is being down to swing the sentiments of prospective voters.
    4) Are you going to have Mr. Isidore called in to clear his name during the questioning as Mr. Shillingford has implicated him in the matter?
    5) While this may be indirectly related, are you going to investigate the reason 42 charges were not read to Mr. Isidore?
    6) Are we looking at a case of prejudice where Mr. Grant might be the fall guy? Well, you don’t need to answer this question but I thought that it is necessary to bring it up given Mr. Grant is not a high profile person in the public.
    7) Are the persons who previously downplayed the return of Mr. Grant return more confident now given a two new magistrate appointment might seem to bring comfort to any legal matter pertaining to the issue at the aforesaid level?
    Sir, I am really concern how this look as I love my country and, it does not send the right message to other countries and our citizens here and abroad.

    So many people, who were so vocal in their protests about the lack of justice in this case are now sceptical when one man dares to stand up to challenge the established order. I’m not angry but it certainly makes me sad to think that a decade of browbeating has reduced us to such a state of negativity. Is there any guarantee that there will be a conviction? Of course not, but we should applaud any valiant effort to secure one. I see chinks in the walls of what once was thought to be an impregnable fortress and will turn out to be nothing more than a house of cards. I have not given up hope and faith on justice and nor should we as a people if we truly care about our little country.

    I am curious and would love to know. Where is this Earl Grant – Seco? What country did he go to? Is he landed there? Probably not! Where is he hiding? If he is not landed he stands a good chance of being extradited. The government of that country will not keep him if he is wanted for questioning on a criminal matter. Pursue him Ag DPP.

      Hello. He reside in New Jersey and I saw him at the Dominica picnic last year. The American Government will not extradite him just because he is wanted for questioning . There must be an Indictment or an Arrest Warrant for them to extradite him. They must serve the warrant to the US Attorney of the Southern District or through Interpol. Mr Prevost will be in office for a short time therefore I don’t think this case will be prosecuted because it involve politics.

    Congratulations Mr. Prevost. Congratulations Mr. and Mrs. Emmanuel. Thank you Mr. Linton, Matt, Angelo, Blessings, Coipel, members of the UWP, lovers of justice and all patriotic Dominicans. This is good news- however one looks at it.

    Collectively, even if it is just for a while, our faith in the justice system has been temporarily raised (not restored).

    Regretfully, the entire justice system has been on a wild frolic of its own or on remote control of the politicians in recent times demanding, as it were, that the people it ought to be serving in the OECS should simply shut up, fold and disappear into the Caribbean Sea.

    We must join the choir of praise and express some satisfaction that this long protracted matter is now benefitting from real attention and action by the relevant authorities.

    The announcement of Mr. Prevost, who has only recently taken up the functions of DPP (a.g) should raise some serious questions about the competence, commitment, professionalism, integrity, willingness and desire of Mr. Pestaina. Whatever the reason(s) that the former DPP failed to act on the matter- presumably having in his possession the very same information now available to Mr. Prevost brings his conduct in office into question.

These are examples of dishonesty. There exists many known legal criminal tortfeasors and the public will know more about such academic fraudsters in time. I believe that we must allow the buss of justice take its course without placing any sinkholes in its way resulting in disastrous consequences.       You are angry at his comments because of the names of the political figures he mentioned. However perhaps without the voices of these political figures he mentioned the Gong Emanuel situation would become dormant, never to be heard of again.

      Whereas we should all appreciate Prevost efforts and intentions, I would hope that he is not simply talking as the rest has done, and by the time he goes to bed, he wakes up with amnesia like the rest before him, and forget about it.

      I wish he will not soon receive a phone call in which he will be directed to drop the matter, thus allowing the culprits to remain free walking above the laws of our land with their noses up in the sky.

      I would hope that the Gong Emanuel case is not the only one he intends to revisit, or revised, I wish that he will be reminded that there are lots of unsolved cases through out Dominica. Again I wish to remind him that my murdered nephew blood cries out of the ground for justice.

      His poor mother, my sister still greaves over her son, and the way the police in Wesley, and Dominica for that matter handled the situation, justice for one should mean justice for all.

      I am aware Prevost is capable of the same amnesia as the rest, I know this for a fact: there is a British Rastaman in Dominica who called me a thief, I called Prevost, and try to retain him to deal with this guy in court, after our telephone conversation, and an exchange of E-mails, I heard nothing from Prevost.

      And yes Prevost if you are reading this associate me with 35A River Street Roseau, and your brother Jonathan Prevost MD, Daddet, and the late Wordsworth Telemaque Nurse and all; I am the same one.

      My hope is that when you find justice for the rich, and elite, you will also seek that same justice for my poor sister, and her murdered son, and I am not forgetting the murdered boy who confessed to the murder of my nephew, he also has a poor mother who lost him.

    The above seems to be a closed sentence with no general information; when you say you will seek assistance from the attorney general, you forgot to state which attorney general are you referring to, to what country the said attorney general belong.

    A you talking about the AG of Dominica, or some other place.

    Secondly in order to have someone extradited from a country, to another, both countries must have an signed extradition treaty in place.

    Their must be an agreement in effect.

    It is common knowledge that Seco is in the United States, however, unless Dominica and America has an signed extradition agreement; your efforts may by futile. Ming you this guy is a citizen of the United States, so you had better familiarize yourself with the laws of this country before you sit in Dominica, and talk crap embarrassing yourself.

    And if you are referring to the attorney General of the United States, I believe his name is Erick Holder, and it might be appropriate for you to refer to him by his name!

    I wish you will read this and conduct yourself appropriately, and accordingly!

    And since you are after cold cases as Emanuel, there are two unsolved murders in the Village of Wesley, one of the victims is my late nephew found with his throat slashed. Be informed that someone confessed to his murder. The confessed murder, who went to the police admitting killed my nephew was arrested, and suddenly set free by the Wesley police who claimed he was incompetent.

    However days after he was set free, he was found with his throat slashed in the same fashion as that of my nephew, there is a killer out there, so I hope while you have time solving the Gong Emanuel attempted murder, you will look into the murder of my nephew also.

    Justice for Gong Emanuel, a Dominica elite; Justice for the poor and unfortunate, none elitist, my late nephew also, his blood cries out of the ground for justice!

        As for the person who wonders if they know where Grant is in the United States, do not worry, this is the easiest place to find people, this man I understand was called to serve on jury trials here, I heard him in an interview stating he had jury trial about two years ago.

        You can only serve on a jury in this country if you are a citizen, born or became a naturalized citizen, the only way he will not be found here is if he flees the country, to another place that does not exist on this planet.

        I will tell you how easy he will be caught: You know how Dominicans like to drive, well he must have a driver license, and that is registered at the DMV: and must have his current address on the license; and his social security number must be on any bank account he has which must also have a current home address in order for him to get his monthly bank stalemates, showing his banking activities, balance ect.

        Even if he is a vagrant which I doubt, and is on some skid-row, he cannot hide there either.

      The fire occurred in December 2010. We are in the year 2013. You stated that Earl Grant is a US citizen. It takes between 3 and 5 years to be a citizen. I do not know how many years for the U.S. For Canada it was changed a few years ago from 5 years to 3 years. In my estimation, it was not a good decision on the part of the government but some interest groups as those who migrated here and are now in politics are responsible for this. Some of them who got their citizenship in three years were foreign terrorists who lived in Canada and off the avails of taxpayers’ money through social assistance and also were studying here with either government grants or loans. They lived here and obtained their citizenship under false pretext. As I recall 9/11, talk about people hating a country and using it at the same time? Traitors!
      My point is, was Earl a long-time US citizen/ resident and resided in DA or was he on vacation at the time of the fire? Or did he give instructions from the US to set the fire and why? However, it appeared he was residing in DA at that time of the fire. All of us would surely like to know how he happened to be a US citizen and instructed another to set fire the property. In any case what did Mr. Emmanuel did to him to cause him to be a suspected perpetrator? Why did he stoop so low and wicked to get someone to commit this crime? Citizen or not, if he is wanted for questioning about a crime, the US authorities might extradite him. By the way, the Ag DPP is being discreet to avoid mentioning the country and the Attorney General’s name. If he mentions his name, everyone will know where Earl Grant is presently residing. At this time I do not think it is wise for him to do so. You already spilled the cat out of the bag. We will hear more.

    Let me give Jack his jacket. We may have every reason to call this administration names such as: corrupt, lazy, visionless, and even communist; one thing though, I agree they know how to put a deceptive plan in place to fool people.
    Folks, Mr. GON Emmanuel’s house was firebombed on Christmas of 2010 and up to today no one has been charged or arrested. Since then, the following things happened:
    1. We have changed presidents as the former one retired
    2. Changed Police Chief-former retired again
    3. New DPP as former again retired
    4.The person who confessed to have committed the crime and told the nation who was the mastermind behind the whole thing is now serving time behind bars, not for his confession but for other crime.

    Using Julian Prevost to say what he said is nothing more than a big joke. After all, JP is a law student and one of the best legal minds in Dominica. The man knows law folks. Now how can a man like JP, a former UWP cabinet member, and now newly appointed DPP make the following statement to the media? ” There is enough information
    to have …Seco answer to certain questions. So I would like to put him on notice(where do you put him on notice sir? On the media or through his attorney or in person?)that unless he comes willingly to the country before the end of the month (today is already the 17th)I will be seeking the assistance of the AG to have him extradites to Dominica.” JP, were you reading a letter you sent to Seco / his attorney to the media? If not a letter, how are you sure he heard you seeing he lives in the Us? What if he is not able to buy his ticket since we only have 14 days before month end? Can you legally get him extradited just to answer CERTAIN questions? Assuming that he hears you, did you give him sufficient time to seek time off from work? I know you are a well educated attorney while I only work with attorneys here in the US, but to be honest with you JP, I would be able to win my case here without paying an attorney. This is nothing but a May Day Joke that should have been made on ALL FOOLS DAY.

      Let us face it. If the AG DPP is not successful in having this man extradited to Dominica, one day he may return home. The government should ensure, if he returns, to arrest him as soon as he sets foot in DA. Immigration and airline clerks at all points of entry should be informed. His picture should be given to them or posted at those points of entry especially at the airport.

        Dorival, when I read of it I was deeply saddened for those two children although they are surely in Heaven, secured in the arms of Our Lord where no harm can come to them.
        I wonder when she registered her children in Canada as dead, if she did, what reason she gave for the death records.
        Let me further inform you. I wrote to my Toronto MP. I also wrote to the Toronto ethnic newspapers. Not one responded to me. If the secretary passed it on to him, the MP may have forwarded it to someone in authority. What I should have done was to write to the Toronto Star and Toronto Sun or telephone them. I may just do that.
        I went so far as to telephone the Social Assistance’s office. One referred me to another. That last one made note of what I stated. I told her that the information is on DNO’s Website. I gave her the Website address. While talking to her she accessed it and told me that she made a note of it in the record that should Lynne ever apply for social assistance, they will deal with her. I telephoned a children’s aid office and spoke to one in authority. The information was also recorded. I was informed that they personally cannot do anything about it at this time and to telephone Crime Stoppers. I did not do so.
        I do not know if it is the Holy Spirit or whoever keeps on prompting me to telephone the police station or the Chief of Police office and speak to them. I want to ask them about this case. I am busy as well but the day will come when I will.
        As I go about my business I have seen some policemen and am tempted to ask them for advice but there are always people around. All is not lost. I will get that opportunity someday, hopefully soon. Nothing happens before its time.
        I do believe that Lynne should be brought to justice for the murder of her two children; that she should not have been allowed to leave Dominica; that it was a plan to secretly allow her to leave for Canada. The truth will come out someday. I will not forget those two dear children who also suffered at their mother’s hands prior to dying. How this must have hurt the Most Sacred Heart of Our Lord Jesus Christ. They are little angels and are happy in Heaven.

      The Acting D.P.P. says he “…spoke to the Chief Magistrate…” Since when it is proper for a Prosecutor to “speak” to a Magistrate about a matter which will be coming before the Court? That reeks of impropriety and will result in any case brought against the “wanted for questioning” man being stayed unless the Chief Magistrate recuses himself/herself immediately from any involvement in any way with this matter. It is very inappropriate for any Lawyer to “speak” to any Judicial Officer about any matter which is pending, or about to be brought before the Court.

    It is alleged ,Mr. Prevost is a sympathizer of the Skerrit Labor Government.Wether or not he is, I know the man to have a strong personality. I also know him to be a no YES man,I applaud his decision.It will be interested to see wether the Government will assist his office by making funds available inorder to get Seco extradited,should he decide not to come back to Dominica on his own free will. Some persons are still not aware that police officers need our permission to talk to us. and they cant just search your vehicle without probable cause or a warrant and without that they need your consent. If there is none of the above and they continue to search the car the evidence is out case is thrown out.

      Are you sure about what you have stated? I may be wrong but as far as I understand it, a person who is a suspect in the commission of a criminal act can be extradited.

      Even if it is expressly stated in the 1996 Extradition treaty signed between Dominica and the United States, under the UWP government that a warrant to extradite must show proof that a process of prosecution has begun, this is true in this case.

      As the DDP has stated, he has studied the files and he is satisfied that there is sufficient evidence to proceed. In any event, I am confident that whatever the requirements of law may be, the police and Mr. Prevost (who was at the time of signing the Extradition treaty part of the UWP) are well aware of the legal provisions.

      In spite of all the talk from the former Chief of police and former DPP, all they had to do was to do exactly what Mr. Prevost is now attempting to do. i.e., proceed with the extradition process by making a formal request to the US authorities, especially as it is not difficult to track the fugitive somewhere in Brooklyn, New York.

      As long as the fugitive is on US territory (as we believe he is), then the US authorities may arrest him and subject him to its extradition process. The extradition procedures to which he will be subjected really depend on the law and practice of the United States iaw the provisions contained in bi-lateral treaty.

Something really fishy here, i am of the opinion that they realize where the case is weak either because of the junior officer who was the investigating officer or some other technicalities where this Seco going to walk out a free man . These guys are smart and so i honestly that sounds to good to be true. Its impossible, there is no way Seco going to go down alone and for that reason and that alone i think thats just a smoke screen to hide or divert people attention from some other big bobol or issue that happened or is about to happen. Is it that they sense their party might loose the next election and the case will be called along with the 42 charges to and so they trying to keep some supporters by sacrificing one for the greater benefit of all. i am confused . if that case is really pursued by this DPP and successfully so then Julien was really a Real UWP man.       The UWP government signed a mutual Legal Assistance and Extradition treaties with the United States in 1996 to enhance joint efforts in combating international crime.

      The fact is although no sovereign state is under any obligation to surrender a suspect of a crime or an alleged criminal to another sovereign state pursuant to the principle of “Sovereignty”, which demands that one State should respect and observe the legal authority of another State over the resources and people within its borders, it is a generally accepted and established practice among actors in the international community (the basis of international law) that where no there is no treaty, agreement or the existence of an international obligation, democratic and peace loving States usually desire to do what is right and just. In that regard, even without an extradition treaty, another State could still feel obligated to cooperate with our local law enforcement officials in Dominica, if we were to demand his return as a credible suspect in the commission of a criminal act.

Your PS helping you identify somebody from the region!!!… what about the CCJ can they not help in identifying a suitable person.       Sometime ago in speaking to a friend in Dominica I was informed that Edward Green is in prison for approximately 3 years and his case is not yet called. I was informed about the reason why he is in prison. Why would they take so long to call the case? Would this be wrongful imprisonment?

    I do not think mr. Prevost would put his reputation and future on the line in such a public fashon if this were not for real. Whether he will get obstructed and his efforts frustrated , we shall see but this is avery positive sign. I am optimistic.

    Julien Prevost just assumed office and he said there is enough evidence to request Earl Granty return to Dominica to answer a few questions. Which begs the question: wasn’t that same information available to Pestina? What was he doing with that file? Why didn’t he pursue the case more vigorously?

        If there was a potential conflict of interest, all Pestina had to do was recuse himself from the case and appoint someone else to prosecute it. I would be very interested to hear the excuse/reason why it was left to languish while he was DPP. BTW, since he was clearly on his way out, what did he have to lose? Unless he felt the case would have dragged out and he did not want to start something he did not feel he could see to the end. But that is still not a good excuse because if he were to drop dead tomorrow life would go on without him. So I am waiting for a plausible explanation for the delay.

    I am glad this matter is finally getting some attention. I do not know for certain of Earl Grant’s guilt or innocence but this move by the Acting DPP signals a desire to find answers. This is great news indeed. Way too many offences are taking place in our Nature Isle and no one is being held accountable. All those who commit a crime should be brought to justice, for as the saying go: If you do the crime then you must do the time.
