No bail for kidnap suspect

Kidnap suspect Shirley Allan who has been on remand at the State prison since March 19, 2012 was again denied bail after her lawyer Gina Dyer-Munro made another application on her behalf.

Allan is charged with kidnapping along with a few other individuals.

The prosecution led by Inspector Claude Weekes told the magistrate’s court that while Allan is presumed innocent, the charge is a “very serious one” and the two missing persons alleged to have been kidnapped are yet to be found.

“It’s a serious offense that she is charged with and it also carries a hefty penalty and if granted bail, we have no assurance that she won’t run away,” Weekes said.

He indicated that the police are in search of two other persons in connection with the offense, who are thought to be overseas.

“The police are net working with their counterparts in that light, Ms Allan is not being kept on remand as punishment, but it must be understood that two men are missing yet to be found and their parents are grieving, a mother and father is also in pain,” he stated.

Allan’s lawyer Gina Dyer-Munro called the situation “sad and unfortunate” and wondered when a decision will be made to grant her bail.

“She is a mother and is innocent of the crime until proven guilty, she is also a first time offender, the prosecution is making no moves and every week is the same,” Dyer-Munro told the court.

She called the situation “highly and grossly unfair”.

However her application for bail was denied by the magistrate who advised her to “go to the high court”.

“We have already started our application for the high court,’ she confirmed.

Also denied bail, was Iam Massicot who was shot by the police in the Marigot Credit Union Robbery.

He told the court that he needed medication and had been without for nine days.

      Cease your politics. What goes for the goose goes for the gander. Everyone should be treated equally, should this occur. I know, you will state this is not always the case.
      How many affluent people in Dominica do you know who committed crimes, murders and kidnapping? I recognize that all human beings may have that tendency, a good mind and an evil one and there are exceptions. I do not think that those who are in the position which you described would stoop so low and would have such a mind to do such a thing. It could be spontaneous but not deliberately. Therefore, since you are comparing them to those criminals and suspected ones, they do not fall into that category. Those people set out to harm others. From what I heard about this case and why the men were kidnapped, they also took the Law into their hands. They should be forced to speak up and inform the Police where they hid them and did with them. This gets me angry. For God’s sake, make them talk! Otherwise, keep them incarcerated until they do, if not forever until they die in prison. Based under the circumstances, they should not be released until the men are found and after the case is called, if per chance they are acquitted.
      They could be charged with hiding their bodies, depriving them of their human rights and committing indignities to their bodies. They have placed the men in an area where they cannot be found. The Police authority/Court does not have to wait for them to be found to try them, be it for kidnapping. There is evidence that they kidnapped them, have accomplices and are hiding vital information from the Police. In fact, refuse to speak, no doubt, at the advice of their lawyers.
      We are human beings and we should consider ourselves and our families who could fall victims, be it in different ways, at the hands of such people. Those people are bad eggs. They should make them deux parlez. Give them something which could cause it without injuring them but this is against the Law.

      It is the same situation in Canada. They would be interrogated for hours and also be given a lie-detector test. Dominica needs such a system, lie-detector, if it does not yet have one. If it does, by all means, do not hesitate to utilize it.
      It is high time that everyone, police authorities, judges, magistrates, defense Lawyers – the judiciary system and all members of the public as those who feel compassion for criminals/murderers, those who state that they should be granted bail, primarily recognize the rights of the victims prior to recognizing the rights of criminals. The victims are the ones who were victimized and whose human rights were oppressed and taken away from them. The family of the victims is also considered victims, being deprived of them, not knowing what has happened to them, if they are dead or alive and are grieving, as in this case. Criminals/murderers, be they suspects (for there is no smoke without fire), have forfeited their fundamental right and liberty of freedom. They should also not expect it unless they are acquitted of the crime/murder. The Law must be fair to all with no exception.

      anyway this young man made his bed.now he has to lie in it.no sympathy.

      Lady what you need to do is speak up, the truth shall set you free, do not cover up for no one, so that you can go home to you freedom

      But as far as i see it, if you keep remaining silence knowing what happened to the two boys, my dear you need to spend the rest of your life in jail , this is coming from a mother with young kids all we want to know is the whereabouts of the guys, and always remember that what goes around will come around to you it my not be today nor tomorrow but time will tell

    If i was her i’d take whatever plea they give me and take my shortened sentence, because its better if she give them the location of the boys… * or God forbid, their bodies* and get a shorter sentence than if they never find em and she stays in jail for a lot more yrs

    She does not deserve bail. She may very well run away and breach her bail conditions if granted same. Whether she is a first time offender she is a suspect in the disappearance of two men who are missing, yet to be found. Surely she knows something about their disappearance. Keep her imprisoned until the men are found. Those who treasure their freedom and want their freedom must live by the Law.

    I’m not a preacher nor am i a priest.I’m tired of preaching and it seems to be falling on deaf ears.(I know i’m not the only one preaching).Honourable Attorney General and minister of legal affairs,Director of public prosecution, its time to act.Please review and beef up our laws.Make them applicable to our times.Here’s what i’d like to read soon.(1)Armed robbery, no bail mandatory 25yrs-life imprisonment.(2)Kidnapping,no bail mandatory life imprisonment.(3)use of an illegal fire arm,during the commission of a crime of violence, no bail.Mandatory life sentence.(4)Possession of an illegal fire arm and ammunition, no bail.25yrs behind bars at stock farm.I have a few more,i’ll list them at another time . These are only intended to start the ball rolling.

      well i disagree wit u wat about when them same criminals terrorize decent people and they are friends with corrupt police and judiciary and you as a decent person take the law and deal them your justice. Think first before commenting because the lord helps those who help themselves and this person i described above can easily be you when they attack your family especially our children.

      When people plan to commit crimes and commit them do they ever think of those whom they will hurt and the repercussion of their action? I bet not. Otherwise they would not commit them at all. Their evil mind is so intent on committing a crime/murder and harming others that nothing else dominates their mind. I would think that before and after they hope they are never caught as some try to cover their trail and lie about where they were at the time of the crime, even getting others to lie for them.

    Pleaseeeee do not let her out she knows exactly what went down. Sad to say where there is smoke there is lots of fire. Waterboard her let her tell the police where the bodies are and where the others fly to. I feel the parents pain after all they do not know where their children are.The others that escape find them where ever they are ask the Government to extradite them back home and make an example out of them.Life without parole thanks.

    If the lady is not charged why would they hold her for so long. It is really not fair. The main suspects were allowed to leave a cell phone number and now they ran away from Dominica. The police have not started procedures to get those escapees back to Dominica for questioning.
    The reason why the police is reluctant to do so is because they may have to do the same for Sico Seco- that is inside information.

      I’m confused – what kind of suspect is she, if not a main one? A sub? Come on now – if they didn’t have enough to hold her with no bail they wouldn’t be holding her.
      Stop trying to make excuses when people are still missing, unaccounted for, nowhere to be seen; that’s the reality of the situation. There is no way she wont be granted bail if there is ZERO evidence linking her to the crime.

      I second the motion, please give the police information on the missing people. They have family too. When our animals go missing we put out notices and we make every effort to find them. please please, (I do not know the people) but I have children and I feel their pain. Give the police the information so that they could find the men, whether dead or alive.
