Senior Counsel Tony Astaphan has warned Opposition Leader Lennox Linton that the only arrangement that will be accepted in the matter involving chartered accountant Keiron Pinard-Byrne is the payment of $79,324.86 in seven days and nothing more.
Linton was ordered to pay the sum following a judgement of the judicial committee of the Privy Council delivered in captioned appeal on October 12, 2015.
Pinard-Byrne had accused then journalist Linton of libel in a lengthy court matter and the Privy Council had reinstated a judgement of the High Court of EC$50,000 plus $14,000 in legal costs plus 5 percent per annum interest.
Attorneys for Pinard-Byrne delivered a letter to Linton on January 7, giving him seven days to pay the sum.
“The only arrangement that we will accept is payment in seven days or else,” Astaphan said on Talking Point on state-owned DBS Radio.
Astaphan pointed out that the question of enforcing the judgement is something that is universally accepted, pointing to a case in St. Vincent where the owner of a radio station had to mortgage something to pay a debt in a libel matter against Prime Minister Ralph Gonsalves because the court was going to appoint a receiver manager.
“Because if you cannot pay a specific debt, then for all practical purposes you are bankrupt and a receiver is appointed and in the Keiron Pynard-Byrne’s case you have to pay for your mouth,” he pointed out. “After a due process has taken place and a court said you have to pay damage to somebody’s reputation you must man up and pay for it.”
Astaphan noted that after the Privy Council’s ruling, Linton went and attacked the Council and Pinard-Byrne.
“I mean how much longer must somebody tolerate this without demanding payment?” he said. “And if you don’t pay it, the forfeiture – well forfeiture is probably not the right word but it means the same thing – seizing your property to satisfy a debt and if it means your home, it is your home simple as that.”
Meanwhile, Astaphan blasted efforts to raise money to assist Linton on privately-owned Q95 FM, describing it as a political gimmick.
“I have always believed when these political leaders have had to pay monies and have telethons is just a political gimmick, to rile up your political base and is a mean of and attracting and getting sympathy for you,” he said.
Tony Astaphan …….. How can a person of his stature go on public radio and literally gloat about the impending downfall of another human being.
This man needs a crash course in diplomacy and subtlety. He obviously gets great satisfaction and thrill with the current state of affairs relating to Mr. Linton.
Astaphan’s words smacks of vindictiveness and settling old scores.
On the other hand Mr. Linton must learn a lesson from this. Being the leader of the opposition and a prominent politician does not give you a free licence to make false public statements without seeking the facts of the matter.
Too many politicians in Dominica love jumping on the bandwagon and making wild unsubstantiated comments publicly, without prior clarification of the facts.
There will be no winners from this sorry mess. Mr. Linton must also ask himself; why did he allow this matter to get so far????
