Police chief launches investigation into Corbette/Roberts case

The Office of the Chief of Police has launched an investigation into what transpired at the Roseau Magistrate’s Court on October 2 in a matter involving suspended police inspector Lincoln Corbette.

Reports indicate the chief of police is ‘unhappy and displeased’ with what is going on with the case and what Corbette and his attorney are attempting to do.

Corbette is facing a charge of wounding in which he allegedly shot Nicholas Roberts in the vicinity of a primary school in Roseau on July 13, 2011.

Roberts was also slapped with six charges but on September 18, 2012 Corbette appeared in court saying that he was no longer interested in pursuing the case.

The matter then took another turn on October 2, when Roberts appeared in court and said under oath that he too was no longer interested in matter.

It is reported that Roberts, who is incarcerated at the State Prison, was brought to court without the knowledge of the DPP.

Roberts told the court that he was no longer interested because Corbette did not actually shoot him. “They say he (Corbette) shot me …I was wrestling with him for the gun and my hand pressed the trigger and shot myself. I am not and will not testify against him … I am at fault,” Roberts told the court.

He denied that he was not threatened, beaten, or offered money to make that statement.

But the office of the DPP has vowed to continue the case against Corbette, with or without Roberts.

“The DPP has conduct of the matter … it’s the State who brought Mr. Corbette here and we are confident that even if he refuses to testify we will have a case for him to answer …justice must be served and this matter is of grave public interest. We can stand without his evidence and we oppose all application made to have the matter stopped,” Clement Joseph from the office of the DPP said.

However Corbette’s lawyer, Steven Isidore, called the decision of the office of the DPP, “well calculated, not genuine, inconceivable and coloured.”  He told Magistrate Candia Carette George that she was the presiding magistrate and had the “power to deal with the matter especially since the VC (Roberts) had satisfied the court with the necessary requirements.”

George then stated that while the decision of the DPP (state) was “novel to her” she did not know what the prosecution’s case was since both parties had received “disclosure” on the matter.

But not amused, Isidore, in his quest to have the matter thrown out, called the decision “an exercise in futility” which further clogs the court system. “It’s not the charge that’s important, it’s Mr. Lincoln Corbette … it’s a personal vendetta and I say so without reservation it’s deliberate,” Isidore argued.

But Joseph stoutly refuted Isidore’s claims stating, “There is no personal vendetta against Mr. Corbette … it’s a matter of justice being done and to establish a primia facie case.”

The magistrate said she will make a ruling on the case on November 11, 2012 .

    Well, well, well, if Dominica had to grow after each fiasco that takes place here, we would be bigger than de whole of north america. How de police commissioner want to investigate? Why he doh send some of his police to arrest Isidore and complete the arrest warrant that they de same police refuse to execute? They were all in greens by de court trying to prevent de arrest. So if Corbette is arrested and charged,what about Mills, what about Seeko Secko, what about the Isidore Emanuel case? Eh ben way papa, justice is Dominica more crooked than crooked itself.

    While I not totally against what Corbette did to defend his daughter let the case call and the facts come out and find him innocent (which I am confident will happen).

    However, there are other factors at play. It is said in some circles that there is questionability about the uprightness of Insepctor Corbette and that the Police Chief is using this case as an opportunity to get rid of him. However, if there are questions this is not the way to resolve them.

Just to complete the circle…who is the magistrate, who is her father and what is the connection to this little circle ?? The system should at least appear to be working

    Has anyone taken a good look at Corbette’s hands. How can a little (shekelec)flimsy man like Roberts wrestle with Corbette and shot himself. If that man had ever attempted to do such, he would be a dead man. They would have to use a spoon to scoop his remains from the ground. Didn’t the school principal say Roberts had a rake coming at Corbette. Although he was coming at him he was still shot from behind. Well, well (smh) all you not easy in this Commonwealth of Dominica.     Boy all you can let Skerrit them fool you. How can you all not see the political gimmick at play in this story?
    1.The chief of police like the PM is from Vielle-case. He is a very strong supporter of the pm and was hand picked by Skerrit to be the pc, though he was not as qualified as many others.

    2.Mr Isidore was and might still be an advisor of the PM. This same lawyer was involved in a lot of transactions of Skerrit. This same lawyer is Corbett’s lawyer in this questionable case which the police chief is investigating.

    3.Do you expect the PC will do anything that may expose mr Isidore? Would Skerrit allow it? would they allow their key partner in corruption allegation be exposed especially if Robert was paid some money to lie under oath? Do they not know the possible consequences of exposing easy-door?
    4.Do you expect the police commissioner to expose the Prime Minister by putting Mr Isidore in an uncomfortable mess, especially when his job was extended this week until end of year? Lie that! They cannot fool me.
    As stupid as I am, my gutt feeling is,they are try to create a false impression here so people could believe that they are interested in justice.

      This man is facing two other charges at the court for other children he assaulted AFTER this incident took place. It is obvious he is a sick pervert. Or maybe we are waiting for something more drastic to happen to see who is the real criminal here. I feel no sorrow for him.

    This is an interesting one. My opinion is even though both parties do not wish to pursue the case, I do believe for ethical reasons the case should still be called with both parties providing their testimony of what occurred. It cannot be ended without a hearing. Reason being, it involved a policeman, a civilian, gun shot(s) and injury. It is a serious matter. However, during the testimony both parties reserve the right to say that they have decided not to pursue it further.
    Keep in mind that the accused is referring to being shot by Corbette and that he did not willfully shoot him. This is his evidence. My instinct informs me that he was not the one who decided to take the police officer to Court. If I recall reading on DNO was it not his mother who said she wanted justice? Therefore, after considering it, he decided to drop the case. Has anyone thought of this? We must give both of them the benefit of the doubt.
    For whatever the reason people change their story in Court all the time. It is their prerogative to do so. There is nothing the Court can do about it. In this case, they will not be charged. The Court, the magistrate’s/judge’s hands are tied. They will have no alternative but to close the case. A case cannot be continued if both parties decide not to pursue it and they cannot be penalized.
    Therefore, DPP take a back step. Reinstate Corbette in his position with adequate compensation for lost wages. You should never have suspended him. He was performing his duty, preventing a child from being raped and the perpetrator from escaping. You could have allowed him to work in the office until the case is called. It is not as if he stole or raped a female.
    You have violated the Dominica Law in a worst way and did injustice to Dominicans when you allowed Sarah Lyn Augustine who murdered her two children to depart from Dominica without a hearing. You also ignored Dr. Benjamin’s diagnosis that she was fit to stand trial. You demeaned Dominica’s mental facility, Dominicans in general, stating that it is inadequate for her to receive treatment. If others have been receiving treatment there, why not Sarah? In any case, Sarah’s case was not yet called. After hearing the evidence, the Court would determine if she was mentally ill or not at the time she murdered her children. You decided to allow her to leave prior to her Court hearing.
    We deem you guilty of this negligence and crime. We are still waiting to hear the truth, if we ever will. I am sorry to know that you still hold this position.

    tel me which Dominican who wants to know they send their child to school one day and u get a call fr a teacher or propably u catch the person in the act rapping ur child, how would u feel, wat would u have done? Corbette is a police officer but he too is human and any human being would have acted like him or worst. for sure i would have gotten rid of him and the matter would have been delt with after for sure a dead man carries no tails…. dont get down on that on Corbette cause he may nt be on ur political side think of if it was ur child, an inocent child.

    Sorry for being so foolish but statements made in this article, and public opinion in other matters left me hanging. So please help understand some things here.
    1. What does the police chief expect to accomplish during this investigation? Was the magistrate’s court the crime scene?

    2. Should the so-called investigation find fault with layer Steven Isidore, since the chief of police is unhappy with what Isidore and Corbett are doing, will the public get to know their finding?

    3. Is this just pure politics? The chief of police was handpicked by the PM, Mr. Isidore was the PM’s advisor… you know what I talking about; The PM cannot afford to have Isidore’s character exposed, so what are we to expect to get out from that?

    4. Since the DPP is so concerned about justice as expressed by them, why not tell us what they know about the Christmas day bumbing and demonstrate to all that they are really after justice of all?

    5. Police chief, you are unhappy with waht Corbett and his lawyer did on October 02; is there anything that the same lawyer might have been questionable that you not happy with?

    6. Could this case and other similar ones be the reason behind the extention police chief got? I waiting to hear.

      He allowed Sarah Lyn Augustine who murdered her two children to return to Canada without a hearing, citing that Dominica does not have the facilities (mental) to treat her when Dr. Benjamin said that she was fit to stand trial.
      If his story was true, arrangements should have been made with the Canadian authorities/Canadian police authorities and a mental institution. The Canadian police/Canadian authorities would receive her at the Toronto airport and then transport her to the institution and be immediately admitted to commence treatment. If someone is a murderer and is mentally ill, this is what should have taken place. The person should not have been released to family or friends and in mainstream society.
      There is no doubt that the airlines she traveled on were not aware that she murdered her two children. This should also include all immigration officials during her in transit and also those at the Toronto airport. In all fairness, they should have been notified because she is a murderer who murdered her two children. We cannot and should not let this case rest until justice is served for those two poor little murdered children at their mother’s hands. If it is proven that she was mental, i.e., after a case is called, then we will have to be satisfied even though we disapprove but she has yet to face trial.
      He said that he was in touch with Canadian authorities. He has yet to reveal to Dominicans who are the Canadian authorities he communicated with, trusted and released Sarah to. Dominicans have a right to know. My suspicion is that the Dominican authorities were her family. Was he paid for this? Surely, he would not have done this without monetary compensation. His work and home phone lines should have been tapped. We would then know the truth.
      The Canadian Law System is such that if someone commits a crime/murder, a psychiatrist will examine the person. If the diagnosis reveals that the person is fit to stand trial, the case will be held. If the person is unfit, the person will be incarcerated in a mental facility and must undergo treatment. If after being treated the person is deemed fit to stand trial, then the case goes to Court and the hearing will begin. The Canadian Law does not let go of a case and a murder case at that. The hearing must proceed once the person is fit to stand trial. If not, the person will remain in the mental institution for life.
      That story that the DPP told Dominicans is a melee. I do not believe one bit of it. This case may return to hunt the DPP in a worst manner. It is not yet over. What goes around comes around. Therefore, who is the dishonest one? Is it not time for the DPP to resign?

    I remember a donkey was given $400 worth of carrot to work for a certain farmer. donkey took the carrot in the night however the following morning when the donkey get to know that the work he did the night before for a certain farmer was worth millions donkey decide $400 worth of carrot wasn’t enough.Donkey decide he want $400,000 worth of carrot.
    Today one farmer is no where to be found and another farmer still out there negotiating with donkeies to help carry his heavy load.

    DNO I am wondering whether we will hear the voices of those preachers like Peter Augustine, Pere Thomas and others. The last time I checked Jesus preached about corruption and even the appearance of corruption. Jesus even call those corrupt individuals out.

      Asterix people like me, Jude Nicholas, Garry and Observer ,we must defend corruption at any cost. Sometimes we would go down to the sewer just to protect our cream cheese supplier.       Are you dumb? Corbette claims his daughter was molested. If that is factual, why would he want to discontinue the case? Why doesn’t he want justice for his daughter?

      And the Magistrate has a responsibility for ensuring that justice is not compromised or corrupted. It is not because the two parties in a case want to discontinue the case that this is necessarily the end of the case. The two may be involved in perverting the law and the system of justice. Based on what has gone before, the Magistrate must ask questions about the dramatic turn in the case.

    It appears that not even Corbette and his lawyers trust the justice system. That is funny too.If it is a personal vendetta then why not let the trusted justice system decide whether or not the case against Corbette is smoke and mirrors. Instead corbette is running the same trail with a guy who supposedly tried to take his gun away from him.So while Corbette and Nicholas ran
    away on their honeymoon Isidor is continuing to show that he the magician lawyer.

    We do not need an rocket scientist to decider this one!

    What we have here seems to be quid pro quo in action in every sense of the word; now it is going to be extremely difficult for the chief of police to confirm that. An officer of the law discharged a fire arm, or used a weapon in an act wounding a suspect, and in the process both the victim and perpetrator has all of a sudden lost interest in their case.

    Wether or not Corbette was on official duty when the incident took place, the fact that he wounded someone is a matter for the justice system: Dominica is not the Wild, Wild West, where people once had the right to discharge a fire arm at random and simply walk, never mind wounding or killing their victim.

    What is more astonishing, is that the victim has also decided to forfeited his constitutional, and legal right to pursue justice.

    I smell a rat; there might be circumstances where the victim’s and perpetrators may wish to settle a civil matters out of court, however, in this case it is criminal, and should be resolved in a court of law.

    After all a police officer is involved, and I do not believe he is above the law; the attorney involved credentials should also be called into question. If there is a Bar Association in Dominica, or an Caribbean Bar Association for that matter, his actions should be drawn to the Bar Association attention, which should indeed removed him/her from the Bar.

    This is a case were the police should peruse a case against the assailant ( the police officer), since he unnecessarily abused his power by brandishing a weapon in public, and wounding his victim in the process.

    Now he pretends not to have any interest in the case proves he is either at fault and is simply evading justice.

    Here is an example, I had a girlfriend who wanted to victimize me, you know been a jealous girlfriend: She called the police and told them I punched her in her face, knocking her down.

    I was falsely arrested on her complaints, one week later she went to the district attorney, and told them she wanted to withdraw her complaints because she lied, I did not touch her.

    The district attorney told her, that they believed her first allegation, and the police will continue to peruse the matter wether she wants to peruse it or not.

    I almost went to jail innocently, I am not saying how I kept myself out of jail, only to say it cost me a little over twenty-five thousand dollars to keep out of jail.

    And so again I suggest if we are operating under the Common Law system of justice, there must be a law in Dominica giving the police every right to pursue this matter in court, thus bring both victim, and perpetrator to justice, wether they both wishes to quash the matter.

    The violation which is a felony in both victim, and perpetrator’s case should stand.

    And by the way, me girlfriend gave me back me over twenty-five grand me pay to stay out of jail eh!

        You see, one guy said he does not believe the girl friend story, I doh know why, I kept the details untold, I suspect the person want to know what process I used: I know but I doh talking eh.

        That is foe only I and my attorney to know, and for that person to be eager to find out.

        I need to inform the person that in America wether you commit a crime or not, once you are charge with a crime, you had better have a very good lawyer to defend you, or it is likely you could go to jail innocently, and my girlfriend gave me back my money because had it not been for a simply lie she told, there would be no reason I should have been into the situation in which I found myself at that particular moment.

        My girl/boy, believe it or not does not matter to me, they say only he who feels it knows it!

    perversness of our judicial system by the very ones who should uphold the laws. We are in serious trouble in Dominica unless these lawyers are held accountable for their outragous behavior.
    No doubt, someone was co-erced, and the DPP and the Chief of Police ought to conduct a thorough investigation into the case.
    Nicholas Roberts needs to know that he has gotten himself in a no-win situation with what happened in the court this morning. The citizens of the land must stand up for what is right. We can not
    allow these lawyers to undermine our judicial
    system, and get away with it. Enough is enough!
    There will not be any peace without justice.

As for the politicians he serve – oh boy they to would be the companions of some inmates.So according to Skerrit in a “real country” this lawyer after all what we know to be questionable practices would not be presenting such filth before the “honorable” court in Dominica.

    corbette know all to well that what he did was wrong….he and the guy did not wreslte at all. while he tried to defend his daughter was a good thing he used his firearm and shot the guy. he and his lawyer are trying to throw out the case…cause all now so he is on suspension from the force and that is frustration him. he wants to go back to work….if it was the other way round would he have asked the court to withdraw the matter against the guy for shotting him? i don’t think so.

    Boy desperation is a heck of a thing. So Corbette didn’t even remember that the guy was restling with him and trying to take his gun? Corbette never said that the guy attempted to take his gun.

    This lawyer of all person should know that when you mess with dogs expect fleas. How can a lawyer place his reputation on someone like Nicholas Roberts. Remember what Tony said about Denny – ” Do you expect me to believe ……” well the same could be said about Nicholas Roberts.

    An indication of how reckless this particular attorney can be. This guy need to be stopped. I hope the Chief of Police and the DPP are serious. In fact the statement made by Roberts is an actual insult to Daniel Carbon’s investigation of the incident.

    How can Dominicans sit back and allow characters like this lawyer to run railroad through the justice system. On second thought he can and why not?

    A convinient “MISTAKE” on the land transaction of AM and PM; Allegedly blind sided and involved in swindling his mentor and partner; Allegedly caught in making diplomatic offers to a french man in the sum of US $2 million? Suspect in the famous fire in Dominica; Washing garbage bin money from Antigua to Barbados and back to Dominica; executed payments for Suprya; millions laundered on behalf of the honorable “most corrupt one”;

    Let the honest ones like Observer, Peeping Tom, Jude Nicholas tell us that there is no smoke without fire and that all of these vague statements are aimed at destroying the most corrupt one.

Tell commissioner Carbon, stop behaving like a bull dog, he should be humble in the position he now holds, but let him remember that one day, yes one day he will be a civilian once again. If both men say they are not interested, then thats the end of the case. Other persons have done it and it ended there, so why are those concerned willing to push on when both men chose not to give evidence against each other. CASE CLOSED!!!!!!!

      Because it is a CRIMINAL matter. It’s not a civil case where both parties can just walk about. Roberts did NOT take Corbette to court – the STATE did. So, its left to the state to discontinue the matter. Very simple so CASE STILL OPEN!!!
