Portsmouth man gets 35 years for unlawful sex with minor

courtA man from Portsmouth, Fagan Jno Hope, has received a hefty jail sentence for having unlawful sex with a nine-year-old, from High Court Judge Errol Thomas.

He will spend a total of 35 years in the slammer.

Jno Hope, a convicted murderer, was found guilty by a nine-member mixed jury on three sex related offenses on a minor: unlawful sexual intercourse, indecent assault and buggery.

According to some of the facts of the matter, Jno Hope, who lived in the same yard as the child, had sex with her several times and on four occasions through her anus.

It is reported that Jno Hope forced the child to take EC$150 in order for her to remain silent.

He also threatened her if she told anyone about the matter.

He was given 25 years for the unlawful sexual intercourse and 25 years for the buggery to run concurrently and 10 years for the indecent assault to run consecutively. This adds up to a total of 35 years.

Jno Hope represented himself in the matter and has denied the accusations.

Recently, Clife Elijah Charles was sentenced to eight years in prison for sexually molesting three children, two in one day.

The sentence created a fire storm of controversy in Dominica with many saying it was too lenient.

Many believe the law for sentencing in such matters should be reviewed.

    For this to mean anything, the same has to be done to those perpetrators who are represented by lawyers. We cannot just throw the book at the weak who cannot afford a high price lawyer and call this justice. We should rejoice when all pedophiles are thrown behind bars for life. Justice for all!

    These parasites must be punished, but punishment is always retroactive, and not proactive. But prevention employing is proactive. If the focus is primarily on punishment, then we are implicitly waiting for the other child to be abused so we can punish the culprit.

    From what I’m reading this man is a murderer a rapist and it’s 25,25 and 10. Bernie who made off with all the people money here in the U.S is serving a hundred plus. That child life could be in danger sometime in the future.An adult by then I suppose.

    Many of us will be thanking God for enlightening the people in charge of sentencing these perverts!! This is the kind of sentence that fit the crime. I strongly believe that Cliff Charles’s sentence should reviewed immediately ! This man sexually abused 3 children in one day! He’s a threat to ALL children and should pay the price of his demonic ways. I also think that the reporting was far too graphic. We’re talking about a child. Her friends. & family will read this and this will cause further embarrassment. & humiliation to the victim. & family.     35 Years imprisonment. At least he will be incarcerated for a very long time. He should be closely watched that he does not escape.
    He has ample time to regret his actions. I hope he repents, beg God for pardon and become as holy as he could be. He will need counseling in this respect. I hope he receives it.
    He should not be given time for good behavior. If he survives while in prison and he is slated for release after having served those years, he should be interviewed by a prison panel to ensure that he will not return to his sickly habit of interfering with minors. If he is not rehabilitated, he should remain longer in prison. Some of these criminals never change.

    Making the matter worse is the fact that the man is a convicted murderer who should have been in prison. Better still. If you had capital even for murder this reptilian :twisted: creature would not have been around.

    I did not find one DNO commentator who thought the sentence was too severe. (If I missed one please fill me in.)

    Many commentators thought the sentence was too lenient. Some of these wished for the death penalty.

    There are the good people :-D in Dominica. I suspect they are in the majority. :lol:

    This sentence is an improvement on what the county has seen lately. I hope it is part of a much greater trend, an upward swing, that will restore true righteousness and godliness to the nation. I wish the same of my own country.

    Part 1: In as much as 35 yrs sounds good I still believe he should spend the rest of his life in prison so others would think twice before they commit such crime, and bearing in mind that this little girl’s life is destroyed even if she gets married later.

How could one get 8 yrs while the other gets 35? Maybe they need to revisit both cases and make sure they both spend the rest of their lives in prison. But then again, knowing how the judicial system in DA and politics work hand in hand, am I to conclude that Fagan might not have been a DLP supporter?     crimes like these will always stir righteous indignation & it is always good to strengthen the laws but no amount of laws can prevent immorality . looking at the number of such cases which have been brought before the courts & are now before the courts this is an indication that our society is on a downward spiral into the pit of decadence . i think that the punishment which the judge handed down sent the signal to those monsters in our midst that those nasty ways are unacceptable.

    Now why on earth should my tax dollars have to pay to feed this man for 35 years? This S.O.B should be hanged. Pity, the death penalty isn’t an option.
    Hope he gets his just reward in Stock Farm when he bends to pick up the soap!

    I also hope that the prison officers who take prisoners out to do day jobs (cleaning, etc) will not make the mistake of granting mister a pass to go out.

    Parents…… time to get serious and protect your children. The TV, neighbour, cousin, etc should not be the baby sitter. Play a meaningful role in your child’s life till he/she becomes an adult. Put away partying and all that. Give your child a healthy foundation in life by being a parent and educating the children.

    I weep for the victims of these acts. Almost a victim myself, I understand how it has the power to destroy your life, change who you are and force you to act ways that you do not understand.     I like that; the bastard actually got life: twenty-five (25) years incarceration in jail is a life sentence, by handing him thirty-five years ensures he will remain in jail for no less than seventeen (17) years.

    He should be given life without parole, in any event this sentence will set a precedence, which may cause the pedophiles who prey on children, and teenagers to refrain their inhumane habits!

      concurrent means happening at the same time. therefore 25 and 25 is still 25. the 10 years is consecutive which means to proceed in sequence. therefore 35 years altogether.

    I was not aware that such harsh sentences are part of our laws. So why are we talking about new laws when a judge imposes a light sentence on one of these perps. Getting rid of the judges that impose holiday sentences would be a better option.

      @ point, had he pleaded before the court it would’ve been reduced, that’s the part of the law where even if you pleaded you don’t get such a reduction, and it should be for each child and not grouped together, he damaged three kids lives and it was grouped as one, sorry but he should have some lifers stick in him in jail every day for the next 8yrs.

      In the common law system, which we inherited from the British; allows to sentence people to more than a hundred years okay! In America someone was convicted, and sentence to almost two hundred years.

      If the law permits the hanging, and electrocution of murderers, why do you consider his sentence harsh. The nine year old is damage for life, so why should even be allowed to live?

      There was a reggae song in the 1960, entitled ” Judge Hundred Years” that song was based on a true sentence of some sentence to more than a hundred years in jail!

        The child might be damaged for life (I have no doubt that at the very least this will be an ongoing issue for the child), but the child is still alive. Therefore, it is a fitting punishment that this being should suffer for the rest of his life. The child still lives, so the scum should live. His quality of life is a different story…

    So what services will now be provided to the child? They shouldn’t lock the man away…they should put his behind to work and have all earnings go to the child for mental and physical health care and to get the best education that can be provided!       Adds us to 60 years….. I think this was badly written….Also, too much details on the case was given. In the interest of protecting the child and her privacy, a little less information on the matter was given. The pain and shame alone is already a burden for her.       I think you are thinking that he should be in there for sixty plus years, since consecutively, means continuous without interruption. However, if you replace the word “consecutively ” with the word concurrent, you will find the sentences are all served at the same time.

      Or, shall I say running parallel to each other. You can be assured he was given a life sentence, if he is thirty-five years old, by the time he gets out he will be seventy years old. Assuming he is fifty, or close to fifty, by the time he gets out he will be an old man in his eighties, chances are he will die at stock farm!

      And don’t forget the homosexuals in there will deal with him according to way he dealt with the child.

    They need to bring back capital punishment… Maybe i’m just upset and not thinking rationally but there’s no place on earth for people like that in my book

    Finally! A judge with the balls to protect the vulnerable. i am a taxpaying Dominican and I have no problems with that!
    Let us now start working on prevention … finding those “animals” before they prey on our young.

      A judge with balls? I think the public cry made the difference because of the last case the SAME judge ruled on.

    I have never understood the concept of multiple sentences to run concurrently.
    I wonder if you can get fined for multiple offences to be paid concurrently?

    magistrate: You are guilty of two counts of stealing.
    the fine is $500.00 each. To be paid concurrently so just write a check for $500.00 & call it even.
