Portsmouth woman charged for perverting course of justice

High Court fineA Portsmouth woman has been arrested and is now facing a charge of perverting the course of justice.

It is reported that the woman removed a minor, her daughter, from a sexual court matter and a bench warrant was issued for her arrest after the minor failed to appear to give evidence last week.

The woman appeared in court on Monday and is now on $10,000 bail.

She did not enter a plea since the matter is an indictable one.

As part of bail conditions the woman, whose name cannot be published since the case involves a minor, is to surrender all travel documents to the police and report three times a week to the Portsmouth Police Station.

The trial date is set for March 7th, 2016 in Portsmouth

In the states even if you withdraw, somebody going to jail. Why? because once you are a citizen or resident there you are owned by them. You are a WARD of the state. In essence you are seen as a resource of the country and they have a right to prosecute u when need be regardless of your opinion. Here we dont operate like that, sometimes thankfully so. that red number at the top of your birth certificate is your resource number. your “serial number or slave number. Which means that as she the mother is a Dominican, they can charge her for that. If the mother was a Venezuelan or any other national and citizen, the court may not have that power to do so. Why? because she wouldn’t have belonged to Dominica, but to Venezuela.

its a perversion of justice charge!! it does not matter if its Ghandi himself. The child cannot legally defend herself nor represent herself the mother is the legal guardian. the mother has prevented the course of law form taking place therefore doing the child an injustice! the State, any state has to keep the interest of the minor as the fist priority same as someone has the right to make a compliant or be arrested the court has the right to be able to execute justice. What if the child was abused by the mother or by her allowing the abuse to take place. being a child’s legal guardian would make the person above the law if the state was not able to step in.

stop letting your belief in something blind you to the reality and possibilities of everything else.

When D/cans observe certain regulations are changed, they must be thankful, in that, they objected to certain goings-on, as in this case. I am certain it is because of them that this woman was arrested. If they kept silent, in all probability the woman may not have been charged. This could be verified.
The woman did not take this court case seriously and decided to disallow her daughter from appearing in court. The message here is, do not mess around with the court. It is an offense to lodge a court case and then the day of the case to say you dropped it.
I could understand if, a few days prior to the court case, all concerned were notified about it. It could have been a different story but not on the day of the hearing to be a no-show. It was also wasted time.
This will also cause parents to ensure they nurture their under-age children appropriately and protect them from pedophiles. Those men who violate the rights of minors must be brought to justice.

Some of the mothers take settlement from the offenders whereas their children remain the victim. I am happy what the court did if the child was supposed to be in court, the mother was wrong to send her out of the country.

Is that the only thing that can break the laws of D/ca, I am not in no way condoning what took place but the constitution of D/a is being trampled upon and u all stay there with close mouth, is that the only law that was broken in D/ca u all are hearing of those who are breaking the laws every day and nothing is being done about it,
what about the fire of December 2010 with the 2 senior citizen and the lawyer whose name were mention and can never be charge after so many counts of injustices that was done by them come on stop being hypocrite ma “Dominicque” children and bring the perpetrators to justice all of them those involve with the minor and those involve with the fire of December 2010 you know the culprits bring them all of to justice D/ca ca desan pa lacha eve crime

Firstly i am well pleased that this so called parent has been brought before the court but i am going add another dimension to this story. The media has to withhold the name of the child perpetrator and parent but wouldn’t it help if there was a private family court for these cases? Small society and the victims become double victims made to pay the shame and disgrace twice over witj little or no psychological help. Good start but we are still years behind.

You see what Mothers can and continues to do to their own daughters? A Dominican woman in St Thomas has been charged for soliciting her own daughter for sexual favors from a man who was old enough to be her grand father, that Dominica there have a lot of wickedness in high places.

  9. January 26, 2016

I read this story in DNO when it happened and was shocked.

How did the woman even get out of the courtroom :?:

We are only now hearing of her arrest. What took them so long to reel her in :?:

I am not alone in thinking she should lose custody of her daughter at least until she has undergone evaluation and counseling.

The circumstances raise several red flags.

The allegation is that a law had been broken. If so this was an offence against the Commonwealth of Dominica, its constitution, and its flag. Nobody has any right to remove somebody who is alleged to be part of the case and is required as a witness.

People cannot help wonder why a mother would do this unless it is the same problem we see so much of
in Dominica. Is the mother receiving financial support from the guilty party :?: Or was she paid to do what she did :?: If so the problem runs deeper than was first imagined and the woman belongs in jail.

    Sincerely, Rev. Donald Hill. Evangelist.

One more thumb up for law enforcement. Take down all those who aid, abet or become an accessory in perverting the course of justice. Our children are our future so let us treat them right and help them lead the way.

Now, there is a cold case in St. Joseph (still within statute of limitation) where it is “alleged” a Senior Diplomat (today) abused a young girl from the high school, got her pregnant and when the bomb burst shipped her overseas with the parents consent. The fact STILL remains that she was a minor (below the age of consent) when that happened. My question to Commissioner Carbon is simple; When are you going to go after this case? You see, in a democratic society justice cannot only be for one set but rather all inclusive. I have hope that justice will soon find a way. The poor girl still suffers from the ordeal of having to go through this nightmare.

    Assertive, NEVER Aggressive!

    • Face the Facts
      January 26, 2016

Some parents are shocked and embarrassed and will consent to their daughter going overseas.
The Court does not listen to hearsay. If the parents did not report it, I suppose the court/police can do nothing.
It should also be ascertained if the school girl was forced into this sexual act or was she a willing participant.
You did not say if the girl had the baby or if the baby was aborted.
I think, in this case, it is better to leave it alone. God, in his time will take care of the offender and guilty, if he does not repent, make restitution, penance and sacrifice. Assuming the child was born, this also means, if he recognizes the child as his own and supports him/her.
The world is a world of sinners in various respects. I like to say, some more so than others. While some are accusing others, they sin in different ways. One is also aborting babies and also using contraceptives to avoid getting pregnant. This is a great offense in the eyes of God.

    • January 28, 2016

Was the girl under the age of consent :?:

Did the man commit “statuary rape” :?:

If the answers to these questions is “yes” was the man charged and tried :?: If not why not :?: (assuming the case was known to the police.)

If this is the case is justice dead in Dominica :?:

If this happened in some places I can tell you there might be a riot in the street even a lynching.

      Sincerely, Rev. Donald Hill. Evangelist.

What about the case in the kalinago territory where the 13 year old got pregnant and the mother stood bail for the boy whereas he is out and look now she is pregnant again at the age of 14 again…. wtf is wrong. Welfare needs to get a hold of this

      January 26, 2016

The Kalinagos were once called Caribs. Although they are Dominicans and reside in D/ca, their culture is different from other Dominicans. They handled their own affairs.
      Today it is different.
If the Welfare authority is aware of it, steps could be taken against the mother and/or parents, hoping they take these matters seriously. This mother does not look like she is a disciplined one and has no control over her 14 year-old.
There is a God above. Parents who encourage their minor daughters and sons in this will be answerable to God; likewise if they do not nurture their children appropriately. From these children will generate another generation and so on. Consider the nurturing of children from these children.
The pattern will continue from generation to generation. Just look at today. It is bad enough. What will the world be like in generations to come? Some of us, as some of our ancestors will be long gone. God help those future generations.

    • January 28, 2016

Sounds like the court needs an overhauling beginning with the bench.

How old was the boy? Was he the girl’s boyfriend? What was the relationship between him and the mother :?: You don’t have to be a mental health professional to know a normal caring mother would not do this. The outcome obviously proves this was not the right thing to do for either the girl, the young man (if he is the father of the second child), or the second child to be born.

Two families have been placed at peril.

Kalinago Territory has been dealt to kindness.

What kind of legal counsel did the mother receive?

Did the judge have any part or input in the bail proceedings? Forgive me for wondering how this got past him (her).

I could understand the mother losing custody of her daughter at least until she had been professionally evaluated and received counseling.

Sincerely, Rev. Donald Hill. Evangelist. (Pastoral Counseling Certificate)

This has to stop! We must change the law so that prosecutions for abusing minors proceed even if their guardians or parents withdraw. Too often they are bought off and the perpetrators escape scott free. They did right arresting this woman.

    • Me
      January 26, 2016

Finally, the law has started taking the parents to task for these crimes. Great job.

    • January 26, 2016

      Absolutely :!:

And the people want to know why they waited so long.

Only God knows what going on behind closed doors (so to speak) during that time.

The system exist not only to punish the guilty but to control the damage by stopping the perpetrators, and make the community safe.

If both children (boy and girl) are minors, the parents are responsible. Such a case has to be well weighed out.
Today, more parents are employed and are not able to supervise their children during the day, at lunch and after school. They may also not have proper adult supervision.
I do think children of today have too much freedom. They are allowed out in the evenings. God is and will be the parents’ Judge in time. He will hold them accountable, on that day, if not before.
I heard through US Catholic TV/Radio, a woman said she had an abortion at the age of fourteen. This may have been her parents doing or her mother’s. .She is making amends and has become a Pro-Life advocate – Right To Life.
Some, at a young age had two abortions. Some, at a young age had two abortions. Not all parents (mothers) are to be blamed. Some of these children are disobedient and want their own way. Therefore, they land in this trouble.
