Smiling thief walks out of court a free man

courtWith a smile on his face, 52-year-old Glorio Antoine of Hillsborough Street walked out of The Roseau Magistrate’s Court on Monday a free man after he pleaded guilty to stealing and was given a suspended sentence.

Antoine, who told the court that he has “a disease for stealing,” was accused of the theft of four fiberglass hammers, two padlocks, two reading glasses, one screwdriver and one LED flashlight from Save A Lot on May 7, 2016.

He pleaded guilty to the offense and was sentenced to six months in jail but it was suspended for one year.

Antoine is known to the justice system from an early age and most of his crimes are now “time spent”. However, he has three convictions on the book.

Facts of the case

Court documents show that he entered the business place just past 12:30 pm, helped himself to the said items and walked out.

However, he was spotted by a duty manager and security was alerted and Antoine was apprehended outside.

He was brought back into the establishment and searched. The items were found hidden in his bag.

The police were called and he begged them for “a break” saying he will “cool out and will be a better person.”

Before being sentenced Antoine told the court that he has a 15-year-old son at secondary school who was in his care. He said he wanted a break to care for his son.

“I have a job…I am doing security and getting paid fortnightly,” he told the court.

However he also admitted, “I have a sickness…a disease for stealing.”

Sentencing

But Magistrate Bernard Pacquette was not impressed with the excuse.

He sentenced Antoine to six months in jail but suspended it for one year.

“I promise you I won’t even be back in court, if you see me you can add more jail time,” Antoine told the Magistrate.

He was reminded that the sentence was suspended for one year and should he return to court within that time, he will be heading straight to jail for six months.

Antoine walked out of the court smiling.

    Although kleptomania is a recognised illness, the repeated instances of theft in Dominica seem more like people developing a thieving lifestyle as a way of choice, because earlier crimes are not punished.

    Something bad, very, very bad is going to happen in Dominica one of these days.

    Kleptomania is an impulse control disorder consisting of an abnormal, uncontrollable desire to steal. This should not be confused with the stage children naturally go through before they understand the concept of ownership. Repeated stealing by an older child may be done simply for the sake of adventure, or it may be an indication of emotional disturbance.

      Unless this fifty-two year old man has a proven history of stealing from early adulthood, it is fair for me to conclude he is just a habitual thief, who know exactly what he is doing, and may be advised to plea guilty and blame his thievery on kleptomania. This man is going to use that crutch for the rest of his life each time he commits a crime of thievery, because he know some idiot magistrate will set him free; if he is actually kleptomaniac he need to be psychologically evaluated, and treated psychiatrically!

      Got a good laugh with that onecould not have said it better, cause i was thinking the same. But seriously!!! he needs help, its beyond him, he is begging for assistance, but see what happens, they may say we have no treatment in place to Deal with persons like him . and thats the unfortunate part. The magistrate is guided by the laws on our Books. Pay him at the End of the month. Only in Dominica. Lets pray for him and those like him. My opinion.

    The man has a severe problem. He admitted it. He is employed in security? Which employer could trust him?
    These habits are hard to break. Any hope of his rehabilitation?
    He asked for more jail time if he returns to Court. If he does, this time send him to life in prison; six months is not enough for habitual theft. :lol: :lol: :lol:

      God will forgive his sins and set him free. That is what the gospel is all about. There are former serial bank robbers who were saved by God’s grace and now preach the gospel.

    A man with a record like that have a job as security? I wonder who hired him. Fagin?Honestly by his own admission the man is kleptomaniac. Still, I pray other cases can come to court quick like that. He stole on saturday and on monday he is convicted. Why can that notm happen with mr. Emanuelle’s case against his former partner? He is not even allowed to file the case. What is wrong in Dominica?

      What is needed is for prayer warriors to come forth and bind the strong man. Spirit filled Christians need to enter into intercessory prayer unto the yoke of evil is broken because of the anointing. Nothing less than spiritual warfare will turn things around.

      Too many people with a profession but no possession.

    This guy is a habitual criminal , nothing is going to change him, he has stolen so many items from most of the stores in Roseau and his excuse is always the same. Before the year ends, he is going to break the 6 months suspended sentence and he will end up right where he belongs.

      BEB, this is what I tried to convey, even if he is a compulsive kleptomaniac, that is not reason enough to cause a magistrate not to send him to jail.

      There are compulsive child molesters here who has no control over their mental illness, the State put them in jail each time they are caught, they are register on public records that they are a danger to children and society. When they are caught and sent to jail they do not get a slap on their hands.

      If it is twenty years for that crime that’s what the get, and upon release they have to say where they intend to live. When they do the State via the police goes out and inform everybody in the neighborhood that a pedophile will be at certain address

      When people protest that criminal cannot reside in that neighborhood, these people are ordered not to be within certain thousand of feet near schools nor parks.

      Look at this: I am a hyperglycemic one summer, Los Angeles, and drove for about thirty-six hours going to Canada, my diet was poor, bread, and sodas, by the time I got to Missouri I felt I might be heading into a coma, so I speed up to go to a rest area, and take a shot of insulin, Highway Police chase after me: I told the man the reason I was speeding. I showed him my Insulin and needles and all the medication I take.

      You know what the cop told me? Yes, I believe you are diabetic, but I am going to write the citation, because being a diabetic doesn’t give you the right to exceed the speed limit. I curse the man out. I then decide to fight the case, I left LA in the middle of the winter drove to Missouri to defend, I spent almost five thousand dollars on the trip.

      After the police state his case, and it was my time to speak, I told the judge the same sad story I gave to the man who issued the citation: The simply ask me ” Mr. Telemaque, because you are a diabetic, do believe…

      I told him I had an emergency and that cause me to speed. I lost the case, I had to pay $106.00 for that citation.

      There is nothing wrong with that damn guy except he is a common thief, who should be banned from all shops, and stores and public places: He should be in jail! Understand this mental illness is real, but there is one thing most people do not know is that even crazy people are very much aware of what they are doing.

      If you are educated prior to be coming mentality ill, you do not loose your knowledge okay, that is why when lunatics in this country kill people they put them in jail, or even execute them! One’s illness is not an excuse for stealing and breaking the law!

        Personally I believe both the cop and the judge were unreasonable.

        The cop charged you because he thought he had to and maybe he did. The judge had a choice.
        I’m sorry common sense did not prevail. With men like that behind the bench it is no wonder the system is so screwed.

        If you had not got your medicine in time:

        You could have gone into a coma.

        You might have been killed.

        Others might have been killed.

        Your condition would have got worse not better.

        I expect you knew better than the cop or the judge how much time you had and were the best one to say what your chances were on the highway.

        I am surprised the judge would not take into consideration that circumstances alter cases. There are times when you must follow the spirit not the letter of the law. The police themselves and other emergency vehicles are at time exempt from the speed limit.
