UPDATE: Kurt Pemberton gets four years for chopping girlfriend

Pemberton was sentenced on Friday morning

Bus driver Edison Kurt Pemberton was on March 17, 2017 sentenced to four years and seven months in jail for the November 2015 brutal cutlass attack on his then-girlfriend, Bianca Blanchard.

The incident took place at her workplace in Roseau.

Pemberton pleaded guilty the charge of grievous bodily harm with intent in January 2017.

Justice Victoria Charles-Clarke then ordered a social inquiry report on Pemberton.

That report painted him as a peaceful person and that incident was out of character.

Brief facts of the case

Bianca Blanchard and Edison Kurt Pemberton were in a relationship and the two lived together at a house in Pointe Michel.

On November 23, 2015 both left home at about 7:15 am on a bus driven by Pemberton. At about 10:00 am, Blanchard received a call while at work and as a result went to the Pointe Michel bus stop and boarded a bus for her home in Pointe Michel.

On arrival, she attempted to open the door but it was locked. She used her keys and on entry, met Pemberton in the house and he said to her, “somebody call you already.”

She also saw a young lady in her bedroom and asked her what she was doing in her house. Pemberton told her that he had brought her to use the washroom and the young lady repeated the same thing.

He then told the young lady to “go” and in the process held on to Blanchard who asked him to hand over the keys for the house, which he did. They both left the house and he followed her to the bus stop and insisted that he had nothing with the young lady.

The two took a bus and left for Roseau but stopped briefly at Newtown and then went back to work.

Pemberton then went to Blanchard’s workplace about an hour later asking for the key to the house so he could collect his belongings. She refused, telling him that he had damaged her furniture in her house the last time and the matter had gone to court and he was yet to pay the $10,000 fine.

She then called the Court section to verify if he had paid and was told no. She reminded him that if he did not behave she would be calling them to arrest him.

She also told him that later she would get the police and then have him come for his belongings.

Not pleased Pemberton told Blanchard that he would be back.

He returned later with a cutlass wrapped in cream paper and said to her, “you want me to go to jail…I will kill you and go jail.”

He then started hitting her with the cutlass and told her that her niece would be next.

He swung several blows towards her neck but she put up both her hands and started screaming.

Pemberton then left and went to the Roseau Police station and gave himself up to the police.

Among her injuries were a 20-cm wound to right hand; a 9-cm wound to right hand; a 6-and a 5-cm wound to left forearm among many other injuries.

She was immediately taken to surgery and spent a number of days at the Princess Margaret Hospital and was unable to use both hands.

The doctor said that she will never get 100 percent use of the hands again, both are now deformed and she is doing continuous therapy.

Mitigation

Pemberton’s lawyer Wayne Norde, in his mitigation, told the court the while he admits that the facts are “not pretty” he begged of the court to “temper justice with mercy” and be lenient on his client who was remorseful and willing to apologize to the victim in open court.

Norde also said that the behaviour was “uncharacteristic” of his client who felt that some “supernatural forces had beseeched him on that day.”

Sentencing

The maximum sentence is 10 years.

Justice Victoria Charles-Clarke said the aggravating aspects of the case were that the attack was premeditated, it was a case of domestic violence, a cutlass was used and the Blanchard continues to experience trauma and Pemberton was “unwilling to accept full responsibilities for his action, blaming it on supernatural forces.”

The Judge used seven years as her starting point and gave him the 1/3 reduction for his early guilty plea and sentenced him to four years and seven months.

She also ordered counseling for anger management.

The one year and four months spent on remand were taken as ‘time spent’ from the sentence.

    Say what we ant here. The young lady left her work and went to her home on the basis of certain information that she received. We can all assume that some neigbour/friend/passenger on the bus saw what was taking place and called her. That simple phone call or information caused the lady lifetime injuries and emotional pain. Shame on that person whoever you/they are. Your conscience will eat you to death. each time you see the young lady.

    That is a sad day for justice in Dominica. Based on the facts of the case as reported here, there was every intention to seriously hurt the young lady including attempting to murder. Everything was done in cold blood in the very presence of her co-workers in an office fitted with security cameras.

    Like the ex-convict from La Plaine he might just circumvent the system with a display of “good behavior” at Stockfarm. That may just qualify him for a further reduction. CAHNGE THELAW TO MAKE IT PRROVIDE FOR A MINIMUM PERIOD OF INCASCERATION BEFORE ANY CONSIDERATION COULD BEGIVEN FOR AN EARLY RELEASE.

    The lawyer must read the foregoing quotation and the next. Tell me what is out of character relative to this gentleman? “Pemberton then went to Blanchard’s workplace about an hour later asking for the key to the house so he could collect his belongings. That social enquiry report ( “a peaceful person and that incident was out of character”) is VERY SUSPECT. It cannot even come close to an objective report of the “animal” we are dealing with. Peaceful person?

    How comes the social inquiry reported him as a peaceful person with no incident when according to Blanchard he had previously damaged her home most likely in a fit of anger??? Nonsense. A person who can get that enraged to be so brazen as to brutally attack their partner at their work place could never have had a spotless record. Life is a chain of events with each one leading up to the other. She should have left him a long time ago. He deserves his four years and more.

    This is unbelievable. Only four years. If he had killed her, no number of years would have been enough. The man gave up himself to the police, that should indicate that something is terribly wrong with him. He needs help and he will be out and functional in four years. Things are so unfair.     The punishment for such heinous acts has to have an impact on the perpetrator’s future behavior and in the absence of that, it is bound to be repeated even by others. Jail-time alone is not always the solution; in fact there never is a solution _ it is not like taking a toilet bowl from an abandoned house and can be recovered if you get caught or even relocating a nanny goat to your yard on the pretext that you saw a rope laying on the ground but did not know that the animal had attached itself at the other end. In this case, this entity has in essence, destroyed a fellow human both physically and psychologically. Some may call it a crime of passion or a case ‘possession’ but still that defense can not pass muster legally for it can not be proven. the convict is spiritually dead and needs ‘Light’. Years in the slammer will not turn on the switch. We need to find creative ways to deter such barbarism for it now seems to be a pattern. I recommend counseling even for those reading…

    In my opinion this sentence is not suitable for the crime against an innocent, defenseless woman in her workplace and second these types of sentences sends a very bad message to those who abuses women. On the contrary 100 years would not give her back everthing she has loss but it would definately teach him and others like him something to consider before doing these evil acts. Infact, in some ways she now lives the lifetime “sentence” with wound and pain that this so called person inflicked on her.

Mercy and grace we do not deserve even Pemberton. But for God. He knows the condition of our hearts.     God is not like us. Let the Lord’s will be done. Also in the young woman lives. Pray for her for complete healing so God will be glorified. No matter how we look at it, there was a deadly weapon, premeditation, a prior guilty ruling with $10K, a threat, motive, a new guilty plea, and finally a victim with life long pain and suffering from the crime.     While we all want to hang the …… in question, we still need to ask what is the responsibility of our young women. There was already an incident that landed before the courts. He was ordered to pay money for some damages so you knew of his violent nature. When we downplay events and say ‘he is not normally like that’ we actually encourage it. He had shown his character before so please don’t tell me he was a nice, nice boy. I do not condone any form of domestic violence. This young woman will now learn a powerful lesson; when a beast has already shown you his violent nature, do not take him back. Had you left the first time, there would not have been a second time.     So your live-in girlfriend was not enough for you? Shame! How old was this younger girl? I hope his girlfriend ditched him once and for all. This is a no-good man.
    Peaceful man and he had damaged her furniture? He almost killed her. Now her hands are deformed and she will never have 100 per cent use of them. Apology will not eliminate what he did and restore them to full use. What of her pain and suffering?
    The judge should have stuck to the seven years.
    Criminals do not deserve time off because they spend time in prison.

    So sad and extremely serious :!:

    What I see here are (1) Attempted murder, and (2) a death threat. (I would call it a death threat.)

    I do not know Dominican law but in Canada both these offences would land him in prison for a long time.

    It does not appear to me that the man was in danger so it was not self defence. The cutlass was uncalled for. This was hate. But yes, there was a supernatural force at work.

    Why didn’t the judge just treat him to dinner and movie nite at her residence? Where is the justice? Off course he was remorseful. He played you judge as a fiddle. The woman almost lost her life…..now her arms are deformed because they were used to protect her life and you all mean to tell me that the perpetrator gets only 4 years in prison? Common….Either something is terribly wrong with the justice system in Dominica or folks are paying way more money just to get a slap on the wrist.       Why do you think there are so many natural disasters happening lately? In my younger days growing up in Dominica, there would be rain for days and only rivers overflowed their banks. Crops were green and healthy. Now , all you hear is the entire island floods after 1hr of rainfall, landslides here and there and where there were no waterfalls, there are rivers and waterfalls. People cut other people up like they in a butcher factory,…those who survive are left deformed some way some how. Murderers and attempted murderers get less than 10 yrs in prison. . Remorseful my arse….he is remorseful now because knows his butt might rot in prison.

    This does not seem fair. Was it too difficult to build a case of attempted murder against Edison? What was Edison’s intention when he returned to Bianca’s place of employment with a cutlass and used it against her saying that he will kill her and go to jail?
    Bianca is scarred for life, emotionally and physically and is just lucky to be alive.

    Well given ur present health condition home miss Judy Frampton ensure u get ur stuff up dre. That is wat happen when people act them think. Y didn’t u just think and then act? Y dis u go to the office and acted foolish? I don’t feel sorry for people who act then think. Take a page from PM books brotger. He thinks think again then act. Just notice the trend of those who act then think. Some of them paid a lot in court and is paying and have over 200 thousand more coming for them to pay in some weeks time. And still 5 more cases coming on dre. Heat. Dat is wen ppl just act without thinking first. So hope u learn and other people learn as well. I wish u well given ur present condition sir.     I don’t think that is long enough. That girl is no doubt emotionally traumatised, will be put off having another man in her life, has been through surgery, has to live with the outcome of what he did there. I think he should have got longer for that.

    not sure but i think i heard the young lady is gripple so you mean the judge just tell another man go and a woman up and get 4 yrs wow which is only 2 years jail and drug man is 10 15 and 20 years they want to hand down :oops:
