UPDATE: Peltier gets easy time at court

After being summoned to appear in court on Monday, journalist and talk show host Mathias Peltier Jr had a relatively easy time, not having been asked to explain why privately-owned radio station Q95 was able to broadcast a recorded version of the election petition judgement of Justice Gertel Thom that was read out in court on January 10 by High Court Judge Brian Cottle.

Peltier and other members of the media were in court to hear Justice Cottle express disappointment with the development, telling those present in the courtroom that he had “great difficulty” with that.

Justice Cottle is reported to have said that he does not want his voice out on the electronic media, that he has been very accommodating to the media in Dominica, and that the court remains open to assisting them.

The judge made it clear however, that he was not pleased that a recording was done without the court’s permission, and that it was broadcasted.

While there had been reports that Peltier and his station along with the individual who did the recording could have been held in contempt of court, the judge went only so far as to say that those involved should let their conscience be their guide.

The recording matter is said to have lasted only a few minutes on Monday morning.

Peltier, who hosts the Q95 programme ‘Matt in the Morning’ told reporters after the court session that it was a learning experience.

Quizzed about who had supplied him with the recording of the court judgement, he declined to comment.

Peltier was issued with a summon on Friday by a local bailiff.

There had been reports that the Registrar General Reginald Winston was exploring legal options following the airing of a recorded version of the ruling in the election petition matter on Q95.

Winston indicated last week that no media house was given permission to record the proceedings.

He also indicated in the local media that those responsible for the recording and airing of the election petition judgement could be held in contempt of court.

    I believe we need to record all our court proceedings, be it a small case or big case. We are in a new era, the technological world. Let’s get with the program people. We want to get onto the international world, yet we down-size our thinking and bring down persons who try to uplift our policies. We need to change some of our legal old English laws as the world is evolving and we need to get with it.

    To all those proclaiming that Matt did something wrong, please tell me the section of law that was violated by Matt/ Q95 for broadcasting the audio version of the verdict. Did the judge explecitly order that the audio recordings of the verdict SHALL NOT be rebroadcasted? If so, is this is line with our constitutional freedoms? You cant charge someone with contempt unless they knowlngly violated a court order or a law baning such behaviours. The summons issued was a court order and as such Matt was obligated under law to respond appropriately.
    This nonesense is going too far and unless we the people take the necessary actions to protect our freedoms guaranteed to us by our very own constitution then we are doomed. The blinders that are worn by people today because of party colors have to be removed for the sake of future generations. Party blinders are taking us down a dangerous road that will eventually lead us all to destruction regardless of political affiliation.
    Since no one will prosecute those who should be prosecuted, and no one will honestly and truthfully judge those violating our constitution, the big question now is; who will judge the judge (s) who fail to ensure justice for all.

    Twist to this is superb, excellent marketing aspects for the # 1 radio station on Dominica
    Q95 has in its little time on air being far superior in terms of being flexiable and user friendly environment it represents a true grassroots movement for the locals.

    Q95 has by far the best talk show hosts on island, would do my very best to keep the afloat by working with the Feds, as this radio station in the end will be a hallmark of getting rid of a extremly Corrupt Regime.

    Q95 needs to start selling traffic to agencies like CBS,ABC,NBC radio links as a caribbean partner in Dominica.

    Their CEO should do all in his powers to get the statellite radio expanded globally…

    Two wrongs don’t make a right. A citizen cannot compare his or herself to the government. Yes I do agree that the government is the servant of the people, but the peole should obey the laws of the country and the government has to implement laws to protect the citizens of this country. I say all of this to say you cannot record people without their permission, much less in a court enviroment – it is just plain common sense! Where is justice, Matt should have be fined for what he did – plain and simple. Without laws there is anarchy. Go figure!

      This restriction may well be valid. However,if so it is also antiquated. Suppose I would take down the judge’s verdict, pronounced in public, verbatim in writing (shorthand) and subsequently publish it. Would that put me into contempt as well? Where does this end? Can judges also claim copyright for their public announcements, for example? This could have been handled more sensibly by simply making a public statement, without fuss, reminding people of this restriction, instead of exposing ourselves to outside ridicule by issuing a summons.

      You are correct. Permission must first be sought and granted. The Media, in his case, should be aware of that. He was fortunate to get off lightly. Only in DA you say?

    +people read and understand before we make a comment. the court did not give permission to tape or carry the proceeding live on radio or tv. it is a contempt of court to do so. is the same when you enter the court they would say turn of all cell phones or put on silent, but some of us are suffering from hearing problem and like to do what we want, when we want and when get caught we are sorry and try to blame someoneelse. Matt of all person, everyday crying down the wrongs of others, her should have known better and try not to do like the same people he is crying down. He excaped, but hope he he learn a lesson as he said.

    Isn’t the court ruling a public matter? So why is it that the Justice does not want it to be in the public domain? They should only have a problem if the recording is manipulated incorrectly. Doesn’t the court want the Dominican public to know what is happening or is it merely an attempt to muzzle the voice of the media and not just the media but those who speak out?
    Dominicans, open your eyes. When attempts are being made to censure the press, freedom of speech is under threat.

    If the Registrar really wanted to carry out justice, he should have made sure that the case was called within the period stipulated by law. he should have brought this to the judge attention .       The law in the OECS is clear..You can not record court proceedings without the authority of the court.

        @ SOUL QUEEN: contempt of court is contempt of court no matter who commits such. There is no separation of the same for the media from that for a private citizen. You are the one who is mixing apples with grapes. Further cucum also had unsavory comments of the judge as well. The audio recording of the descision was the very words of the judge and were not manipulated. How different was it from what was delivered in writing? There was absolutely no difference and the fact it was/is a public document. The bottom line is had it not been Q95 things would have been different.

    Well it is time the law is changed to make it legal to record and play back these judgements. What harm could possibly come from playing a recording that is on the public record?

    The judge does not want his voice heard on the public airwaves? Well judge, it may be time for you to find something else to do. We have a long way to go to bring these institutions up to speed in the modern age.

    The government should review all these law and modernize them. We no longer live in the age of pencil and paper.

    No doubt the Judge was right in law but one can not help feeling that this is akin to cracking a nut with a jackhammer, stemming from subjugation to pressure from a certain senior counsel and making himself look small in the process.
    But maybe this should not come altogether as a surprise. This is the same Judge, who resigned abruptly from his post as A.G. in Montserrat after Chief Minister, John Osborne questioned his competence and members of the Govt. were no longer prepared to work with him. The same judge against who’s decision, barring the defendants from presenting evidence in the Boston Life and Anuity v. JSA defendants case(BVI), an appeal was allowed by Chief Justice Hugh Rawlins on 21 Oct. 2008.
    Judges are only human, are not infallible and can- and do err and that’s exactly why Courts of Appeal exist.
    Judges, may pass a ruling in law but they will never enjoy immunity from public opinion,even if such a ruling is upheld.

      What documents are you talking about? A lack of documentation as evidence played a significant part in the judge ruling in favor of the PM. Remember that EVIDENCE isn’t ALLEGATION.

    This is an other tell-tale sign that our beloved land is about to experience the muzzling of its people, whenever they open their mouths about the wrongs and corruption that are taking place on the land.
    Whenever the talking senior lawyer goes on the Animal Show, and spews his discombobulated statements to confuse his ignorant followers, whom I sympathize with, for the only reason that they know not, there’s no mechanisms in place to stop this kind of lawlessness. That, is destroying and deviding the country. Also, a judicial system that panders to the corrupt political leaders, and ignores the Constitution of the land, renders no peace and justice for its people. Lougaoo Mem will continue to monitor the continued regression and deterioration of a system that is holy to the progress of the country. I say, the ultimate responsibility is in the hands of the people. And if they fail to change the course, then, they will fail the future of the children.

        Moushay Kakarat, please tell me the section of law that was violated by Matt/ Q95 for broadcasting the audio version of the verdict. Did the judge explecitly order that the audio recordings of the verdict SHALL NOT be rebroadcasted? If so, is this is line with our constitutional freedoms? You cant charge someone with contempt unless they knowlngly violated a court order or a law baning such behaviours. The summons issued was a court order and as such Matt was obligated under law to respond appropriately.

        This nonesense is going too far and unless we the people take the necessary actions to protect our freedoms guaranteed to us by our very own constitution then we are doomed. The blinders that are worn by people today because of party colors have to be removed for the sake of future generations. Party blinders are taking us down a dangerous road that will eventually lead us all to destruction regardless of political affiliation.

        Since no one will prosecute those who should be prosecuted, and no one will honestly and truthfully judge those violating our constitution, the big question now is; who will judge the judge (s) who fail to ensure justice for all.

      Press Freedom? Are you for real?

      Before you jump and try to make this thing political…ask a few questions as to whether the recordings were permitted by the court and whether the media asked for permission to do so.

      Based on the report, it seems that this was a violation… the story is not straight forward enough to know exactly what’s going on…so don’t make this political so quickly.

      You guys must learn to under stand that everything can go down to freedom of speech.

        Please point me to the chapter and verse in the Laws of Dominica which says that one should not broadcast court proceedings. I thought a court was a public place and a judgment of the court is a public act/decision.
