If Thompson Fontaine was bluffing, it would appear that Prime Minister Skerrit has called his bluff.
Prime Minister Roosevelt Skerrit, through his attorneys, on Thursady filed a lawsuit in the High Court against Dr, Thompson Fontaine. Among other claims, Skerrit’s team believe that Fontaine started allegations that Skerrit was involved in the selling or granting of a Commonwealth of Dominica passport to Darwood Ibrahim, a notorious Indian national.
In response to an earlier threat of legal action issued by attorneys for the Prime Minister, Fontaine appeared unfazed and threatened to countersue. He said then “Again I want to add that I will do anything in my power to get the main actors involved in the sale of Dominica’s passport before a court,”
However, Legal adviser to Mr. Skerrit, Senior Counsel, Anthony Astaphan, told a news conference on Friday morning that “ at 3.26pm (Thursday) a claim form and a statement of claim was filed in the High Court of justice.”
Astaphan said that for many years the Prime Minister had been subjected to a series of manufactured lies over a period of time. “We believe that the more recent campaign engineered by Thompson Fontaine, has its genesis in a conspiracy of persons claiming to be patriots, the fictitious or phantom Jeremy Sinclair and then a brief but ill-fated romantic dance with the editor of the Weekly Blitz” He stated. He said Mr. Skerrit took the view that “ these allegations about the passports and Dawood and Singh and parallel Iranian programme and counterfeit money and conspiracies and illusions and collusions with criminal elements in China and so on went way beyond a personal attack on Roosevelt Skerrit and was in fact an attack on the national integrity of the country, an attack on the individual security of Dominica and was an attack to internationally and regionally discredit the Government of Prime Minister Roosevelt Skerrit.”
Astaphan told reporters at the conference “the straw that broke all of this was Thompson Fontaine’s deliberate manufacturing of evidence that there was the British advisory on Dominican passports which turned to be completely and absolutely false, the sensational lie that the royal family had boycotted or snubbed Dominica because Dominica was not part of its jubilee itinerary when we had gotten the explanation from authoritative sources that Dominica, as a republic, is not part of the British realm and had not invited the Royal family and there were no significant British investments here.”
“Enough is enough” said the Senior Counsel “particularly when we began to see these postings of passports and profiteers of shame and Dawood using Dominica’s passports and certain articles written by Jeremy Sinclair, Thompson Fontaine and some guy from Bangladesh or India, being posted in the International and regional media or on the world wide web and we began to realize that there was something fundamentally wrong with that.”
He said despite having received a letter from attorney, Lennox Lawrence, and the categorial denials by Ministers of Government other than the Prime minister and himself, Fontaine insisted that he had the evidence and that PM Skerrit couldn’t sue him, wouldn’t sue him and refused to apologize because, according to him, Prime Minister skerrit knows what the truth is.
In addition to a series of articles and emails that were published on the internet and a series of articles that were published on the Dominican.net, the matter which has been filed also contains some allegations made on Q95 FM radio station “and as a result of which” says Astaphans “ we have decided that as a matter of policy and purposivenes to join the owners of Q95FM in this case because the time has come for us to make the question of the responsibility of the radio stations a landmark issue for the courts to decide”
According to the Senior Counsel, the matter concerns the allegation of sales of passports, parallel programmes, conspiracies with international terrorists etc.. but he says despite a brief reference to consulates in the matter, the legal team has not yet decided whether it will file a separate matter related to the alleged sales of consulates or whether the claim would be amended to include them.
Dr. Fontaine has previously said that his intent to countersue in the courts in Dominica is based on his firm belief that the people of Dominica need to know the truth about the sale of Dominican passports, and one way of doing that is by ensuring the main culprits are brought before the courts and under oath made to answer.”
He says he remains “resolute in my demand that the wanton sale of Dominica’s passport be ended and proper accounting of the funds received be made.”
Dominica News Online is nevertheless attempting to get a comment from Dr. Fontaine on this latest development.
If the it goes against the PM, will he RESIGN or APPEAL.

According to Mr Baron of the chronicle, there is a line, a very thin line between defending a client and active participation in wrong doing. If you believe like I do, that the government of Dominica is involved in improper governance, then tony’s behaviour as it relates to roosevelt skerritt crosses that line.

I take time out to make the following statement. I have read on so many occasions on this board that Senior Counsel Anthony Astaphan is doing things that are against or breaking the law.
I therefore ask anyone with the proof that if he Senior Counsel Anthony Astaphan has circumvent the justice and judicial system please report the matter to the OECS Justice Dept.
I must say Anthony Astaphan is one of the bright intellectual barrister that roams the caribbean court houses with respect.
People need to understand that Talk Shows are not court houses and therefore what is said on the radio may not always be the truth.
In a court of law you need written,oral,documentary evidence to prove your case.
The court of public opinion does not have any standards and therefore we must be very careful about what we say or do.
The caribbean has produce so many bright lawyers, who has gone on to be Judges and Chief Justices all over the whole.
I therefore would advised Dr.Fontaine and Q95 FM to try to get a good lawyer to help them with the law suit. As someone said before Barristers for this case will not come cheap.

In the 21st century the court is about truth and not springing surprises or ambushing the trial, sadly in the case of tony that is all he seems to do and is allowed to get away with it. For example, these days disclosure is a very essential part of civil matters these day, this because as I said before, the court is about finding out the truth. What happened in skerritt’s case? The judge refused disclosure which would have helped in ascertaining the truth. As regards evidence, the rules of evidence have changed radically so that now no lawyer should be allowed to just claim that this evidence is not good evidence. All evidence no matter how obtained as long as it is relevant should be allowed once it voracity and authenticity can be ascertained. What we see happening is tony getting away with all these things and in some cases even lying to the court.

In my view, the most disturbing thing about all this litigation initiated by Tony, is the manipulation of the justice system, by Mr Astaphan. In any society, the justice system should be impartial, independent, and possess sufficient integrity, free from individual as well as political manipulation. In Dominica and other OECS teritories, the obvious influence of certain individuals and politicians mkes a mockery of justice for the people of these Island States.
It raises serious questions about the maturity of our jurists, as well as us as independent peoples, to progress in a stsgnant and sometimes retarded legal system that denies, and delays justice for the common person.
We certainly are not sufficiently mature to have CCJ as our final arbiter of justice, and according to the ghief justicem who, by the way, is the most compelling case yet against the CCJ, admitting that the process takes too long, and that in some cases magistrates and first instance judges fail to provide reasons for their decisions, thus depriving aggrieved parties right of appeal. These are fundamental issues that our so called journalists shy away from, and some of our peusedo intellectuals, will not talk about. But in all of this Tony can depend o the court to come to his rescue by appointing and/or refering cases to mediation to save he and his clients face.

I am not concern about Skerrit scare tactics on this one. I know Dr. Fontaine personally and he is a very well calculated man. He assesses and review things carefully before he concludes or comment on them. Although he is Dominican, he doesn’t have the small minded mentally like these Dominican politicians and most Dominicans overall. He is a big thinker and a big picture man. He starts with the end in mind. Therefore Dr. Fontaine is totally ready for this law suite and will win it hands down. Have you realize that Dr, Fontaine has been quiet on the issue except for the fact that he maintained that he will not apologize…The question is Skerro, are you ready for the counter suite?

Yes I said it just before christmas. I knew all along a radio station was going to get caught in a libel suit.
The owner/owners of this station will now have to protect his/her Investment. He/she can not allow so call talk show host to just say what they want without proof.
People are on this board saying they support Thompson but have yet to notice the radio station is in hot water if this case goes the PM way.
I can tell you as of this day NICE RADIO STATION in St.Vincent may have to shut down soon. This station had the same problem Like Q95. This station is owning the PM of St.Vincent well over a $1,000,000.00ECD and they can not come up with the cash.
Again it was Astaphan that did these cases in St.Vincent. The lawyers were from Trinidad and he won them. As a matter of fact the lawyers for the radio station have not got full payment as we speak.
I feel hurt for the owner/owners of the radio station,but at the same time I can not yet understand why would a person with that type of investment(s), not look after it or protect the business.
The station owner/owners must now look to secure a lawyer to advocate his/her case in the court of law. The price for these type of lawyers are not cheap,most time you are charge,1)the time spent in court per hour,2)time spent preparing the defendant brief,3)base on the value of the radio station..etc….
This is a very expensive excise and there is no one on this board that will put his or her hand in the pocket to help the owner/owners.

Radio stations must have a 20 Second delay release button.
Each talk show must have a PRODUCER,EDITOR and a RESEARCHER.
The radio station must deposit between $250,000.00 to $1,000,000.00ECD to conduct a talk show. This money will be deposited at bank just in case there are any libel suit.

Theses cases have nothing to do with the governance of the country by its government. If persons are receiving passports then skerritt by his own admission is involved since he has the final say but that doesn’t mean that he can sue anybody in his personal capicity, for claiming that passports were issued to criminals.

Meanwhile, Roseau is being swamped with Chinese businessmen and women. Construction projects awarded to Chinese construction workers, while Dominicans remain unemployed watching chinese construct state Palace. —- How many Dominican passports, including DIPLOMATIC ones, have been sold?
—- How much $$$$$ have the Treasury received from those sales?
—-How many foreigners and their names who have our diplomatic passports in their possession?
—- What is the role of those foreigners with our diplomatic passports?
Information should be available on such important National matters and DNO has the Right to seek, access, receive and impart vital info to its readers. The Constitution gives us that RIGHT. The Universal Declaration of Human Rights guarantee that RIGHT. The research findings should make interesting reading and would inform all of us as far as our properties(Dominica passports) and the sale of those are concerned. We all need to know. The people are too much in the dark about such affairs. We are waiting for the info DNO.

Then the PM attempted to sue Matt and then through his lawyers initiated a settlement of sorts or rather sort to “retract” that same law suit, alledgely paying Matt’s legal cost. There are So many other such situations and MANY MORE to come. As a friend of Prime Minister Roosevelt Skerrit I call on him to RESIGN in the Public’s Interest in light of ALL of these allegations and accusations. I am of the firm belief that, “WHERE THERE IS SMOKE THERE IS FIRE”. I make this call particularly against the back drop that whilst the PM and his associates cried “email hacking” in 2009, the same Prime Minister came TWO HOURS later to read his ELECTION DATE ANNOUNCEMENT speech VERBATIM (word for word) after it was read by a female voice 2 hours earlier. This is a clear indication that the emails circulated around that time alledgely came from the same source/means and therefore we have NO choice but to believe them since the PM’s famous speech confirmed their CREDIBILITY! We LABOURITES are not as foolish as we appear to be. We are just “watching” as things unfold for, truth trampled upon shall rise again!

The PM has flipped flopped on numerous issues and the very fact that he read an election speech word for word as it was read 2 hrs before his delivery, speaks VOLUMES and this has given CREDENCE to all the emails crirculating around about his alledged ownwership of VILLAS etc….. He LIED to the public about a $400,000 modest 3 bedroom house in his home town of Vielle Case and even promised to make public the approved plans. I have dealt with Skerrit and know well that there’s more to him than meets the eye! Roosevelt Skerrit I again call on you to resign in the public’s interest! SKERRIT needs to concentrate on fixing the Criminal Justice System on the island rather than trying to use it. My guess is that it is in his best interest to use it while it is so badly broken so he can win something from those pseudo lawyers and judges in Dominica who don’t seem to remember what they taught them in law school.
