UPDATE: PM, St. Jean will not give evidence in court; Astaphan vows to fight to the end

Justice Gertel Thom has set aside the subpoenas that would have compelled Prime Minister Roosevelt Skerritt and Education Minister Petter St. Jean to testify as part of the ongoing election petition matter, ruling that the two will not be required to give evidence in court.

Justice Thom also ruled that thirteen witness statements that were filed after the August 21 deadline will be admitted in court, that paragraph nine of Ronald Green’s witness testimony be struck out as hearsay, save for the first sentence and that the witness statements that spoke to information not included in the pleadings be admitted to trial.

The High Court could barely contain the tension and eventual, apparent overwhelming sense of satisfaction that erupted when court was adjourned for five minutes after the ruling was made. The decision by Justice Thom may have dealt a crucial blow to the United Worker’s party’s (UWP) case as much of it hinged on the testimony of the two. However, Senior Counsel Anthony Astaphan was not ready to declare victory after court adjourned this afternoon.

“It’s going to be a long case, we’re ready to continue and the Prime Minister and I are going to have discussions this afternoon as to the way forward tomorrow morning,” Astaphan said.

He was reluctant to put the matter to bed however indicating that although the subpoenas were set aside, the witness statements which have been allowed into evidence are still parts of the case that are yet to be dealt with.

Astaphan, who burst in tears when the ruling was made, stated, “Well, I really cannot make an assessment yet, because we spent the better part of the last week fighting on the basis of the subpoenas and the new witness statements that were filed. These witness statements have now been admitted into evidence. We need a chance to look at it, to read it before we can make a decision as to the strength or weakness of their case as opposed to our case, because we have always had confidence in our case. But I don’t want to come across like I’m pre-judging anything; it’s a matter for the judge to decide.”

He continued, “We’re obviously happy with the ruling, but it’s not a time for celebration. It’s a time for us to continue and fight this case through to the end.”

Meantime, Green, who was testifying as the trial continued this afternoon said that he had expected that the Prime Minister would have been allowed to testify, but declined to comment on the state of the case going forward.

Green is one of the petitioners along with Maynard Joseph against Skerritt and St. Jean.

Court has been adjourned until 9 am tomorrow.

The United Workers Party is asking the court to declare that both Skerrit and St Jean were illegally nominated before the 2009 general election because they held dual citizenship at the time.

    I wont comment too much to this foolery, but how about we focus more on why people need to travel to different countries to get simple medical care. Why is it that we are not equipped enough to treat something as ancient as shingles, and people die unnecessarily because we do not have a MRI machine…isn’t that of graver concern than who is what citizen…there should be systems in place to check the validity of candidates before they are deemed such anyway.

    Look politics… it just cah done. I am nearly fed up with it…yet it seems like it is the lifeblood of Dominica.
    UWP called for the Court to help; when the Court rules..then they say the Judge is unfair, scared to make decisions, justice system not fair etc.
    Labour looking for all little ways to escape on technicalities. Papa Astaphans is here to save the day and I must admit he does his research and puts holes in the cases brought against the Government. To even cry in the courtroom…wow… you can well understand how passionate the man is about staying in power.. he is indeed the behind the scenes PM or the next one in line.
    Ron Green is one of the petitioners and comes on the stand and in a few minutes he is guilty of everything that he is accusing Skerrit of….dual citizenship from age 17 yet has sat in parliament for many years.
    Skerrit may be popular but his leadership style, his seemingly humbleness is marred by subtle arrogance and working his own way and own style will only bring him down.
    So, I watch and wait, not with baited breath though… ’cause the saga will continue.

    Do we see the big picture? We do not have a justice system!! No matter who sits there, the result will be the same because we only recruit those we can buy. Men with no balls!! They lack the testicular fortitude to stand up against a tyrant and an alien. Can someone explain to me why they are not REQUIRED to testify? They were REQUIRED to sign and swear to an oath and yet they are not required to testify? Then it is up to some people to decide whether the witness statements are true rather than getting the truth from the accused.

    This case has already been won by the defendants. The rest is just a matter of formality. O ye with no conscience!!

    It is a criminal matter to lie on oath.
    Prior to the nomination day a full page warning was printed in the newspaper.
    Warning the authorities that a crime was about to be committed.
    Why ha ve the police and the DPP not investigated this crime?
    If it was printed in the news that Hector John had dual citizenship and he was about to make a false declaration at nomination day, the electoral commission, the police and the DPP would have investigated and arrested him.
    This case should not be private individuals against the state rather the opposite.

My question is, would it be ok for one of the men from Iran who has Dominican citizenship run for election and become our prime minister and then sell us to Iran or any other contry and we know nothing about it……Just some facts we have to think about.

    To those who cant maintain dialogue for nation building, it’s important to avoid recklesness in our utterances because this island is very small and there will always be time when we WILL need on another and our intolerance might be the hurdle to unity.

    The opposition brought out a public issue.

    The opposition brought money back to the treasury on several occassions.

    The oppositon is a legitimate part of governance in the state.

    There are so many reasons why we should be careful to remain objective..

    It’s all about natural disasters.

    It’s about our children being assured that we adults can work it out, no matter what…

    And when we do wrong, we should concede to truth.

    How on earth our culture of fair play is disappearing before our very eyes. We are dishonouring ourselves with this blantant high handedness when some people who may seem that they can do better than what is happening in govt are demonised?
    In the same vein, it is also the right of the ruling partiy to secure themselves for the love of service.

    From our neutral grounds, we would like to suggest to the DLP supporters that our behaviour is always the example we set for our children.

    His Majesty Haile Sellassie 1-Christ the king advised us that our spiritual knowledge doesnt have to be too complicated.

    He told us that the Ten Commandments are enough to save us from eternal damnation.

    Anyone with an understanding of the legal system and the manner is which it ought to operate, wouldn’t have expected any other ruling in relation to the respondents or defendants giving evidence.

    Note only was their set guidelines to be followed, the judge was also obliged to rule in accordance with presidents set in Case Law.

    One this does not mean that the case is over.

    Her Ladyship will after this long battle, have to rule based on the evidence that the plaintiffs will have presented in court during trial.

    Well from all reports d case should proceed at 60 km/h if UWP doh come up with some other tricks and get those two DLP politicians mothers , god-mothers, nennen, aunty and zami to take d witness stand!!!

    Anyway Toni had laugh Athie in 2005 election campaign when Athie did cry opposite DBS Radio. Today Nabes tell me Athie smile when they tell him Tony Cry in Court.

    But it was tears of joy!!! Yes Fada!!! UWP have to get something eah . You cannot tell me School open this week Monday and poor little Malick pass his common entrance exams in June earlier this year and d child going to High School for his very first time and d little boy Father inside of a court room to answer foolish questions about if he qualify to run for election.

    Everything Skerrit say does always be taken literally and UWP have to find a money from their more brainwashed supporters to always go in a court to challenge everything Skerrit say!!!

    If they ask Skerrit a question and he tell dem is not their dam business who he give fork, spoon and knife to eat food they vex. If he expresses confidence and say not even the constitution can stop him they blue vex!!!

    I had warn all you people that d judge would look at the substantive matter at hand and set aside trivialities that would waste the court’s time.

    Had the judge entertained these trivialities all UWP supporters would be dancing saying to one another that the case is in the bag!!!

    Why?

    Because dem man handcuff themselves. You see d man on Q on a Saturday afternoon does try and bowl spin on DLP politicians with supposedly innocent questions that have a basis for entrapping people.

    So d Q Saturday Radio man try and get creative with QC MENDOZA when it was cocas and case strategy preparation but Seansean was there!!! Doh ask me how he did get inside. D Q man say Seansean have a lot to help with d case. But Seansean doh have his own home ; so when owner of house call d man spill d beans and d news reach Tony!!! Wow!!

    Good thing Doggie is now their friend and what a double agent is he!! He send info to d DLP camp saying how d next plan is for Mendi to have election chief perjure herself on the stand with Bible in hand if they cannot get Skerrit out of office!!!

    You see what burning UWP and d gang of 39 is that they get commitment from America to launch invasion if there be violent crimes committed against Dominican citizens. So America now trying and take government from far and say they helping build coast guard port way down in d gulf in tartan.     Now while UWP in court an advisor of Freedom write and tell US Embassy in Bridgetown how he fraid for his life and he requesting protection!!!! D evil that men do!!!

    Everybody know Charlo is getting old and had medical complication after too much of d little blue tablets.     I want to know where it appears in the bible that a man is a wicked man when he contests an election illegally. How does a man become a bad man when he contests an election illegally. For those who did not know, Ron Green contested the elections as an American citizen (3)three times 1995,2000,2005. So does that make him a bad man. Carbon from Wesley contested the elections twice as an American citizen and was living and working in USA while he was a member of parliament in DA and getting paid by the DA peolpe. There were others from the UWP party who were members of parliament while they held foreign passports.
    The wrath of God is not coming down against anyone for illegally contesting elections in DA.
    Tell UWP to find a different way to use the $6M Tiwan gave them to try to topple the Skerrit GOVT. This battle is not a battle born in DA so all those innocent UWP supporters need to wise up. Tiwan hates Skerrit for his change in foreign policy in favour of China.

    Your point is a bit misguided. The guys who stand trial do so as defendants and the State as prosecutor.

    These guys have been arrested and charged, and sometimes their houses/cars/businesses/bank accounts searched.

    The PM or St. Jean was never arrested.They were brought to court by a citizen not the country and therefore the citizen has to get his evidence to prove his case. He can not ask the police to do it for him by arresting or searching people’s home, nor can the accused ask the prosecution to help him.

    Today’s court ruling was just a procedural matter. Mouth of the South was absolutely correct in stating that the case is far from over and he got some thumbs down for it. The real case is based on a UWP petition to throw out the LaPlaine and Vielle Case 2009 election results because of the dual citizenship issue.

    Another comment reduced it to an English language matter. He writes, “If he had present evidence it would incrimate him”. He stated further, “If the evidence was going to set him free, you think he would hold it back”? That’s the crux of the ruling.
    1. A defendant (respondent) does not have to present evidence. That’s the job of the plaintiff (petitioner).
    2.A defendant is presumed innocent until proven guilty. So the whole notion of, “if the evidence was going to free him”, holds no place in the judicial system.

    In this case the petitioners (UWP) are saying, “we know that they are guilty, but they have the evidence. We must make them talk”. They have defense attorneys, my friends. It’s their option to take the stand or not. That’s the law. If they violated the dual citizenship clause, that will be determined later. They will and should be subjected to the full brunt of the law. If they haven’t violated the constitution, let’s wait and see. But there’s nothing to celebrate now.

    “Guilty but innocent” is the verdict of justice Gertel Thom. Though not surprising it’s very shameful. Is this what we call justice? This reminds me of before when a batsman knew he was out, his batting partner knows he is out, everyone on the field knows he’s out, Tv replays confirm that he is out, the umpire knows he is out but somehow rules in his favor. That’s how umpires used to bahave before nutural umpires came on the seen. Too many of them used to get paid to decide the outcome of a match.
    I would like someone to tell me why an experieced lawyer like Tony Astaphan cried when the verdict was given, Yes I know he was happy because he was the only winner in this case as Skerrit will continue to abuse the law and pay large sum of money to Tony in order to get bailed out. The only reason he cried is because he saw wrong has triuphed over truth, evil has triumphed over good, and crookedness has triumphed over justice. However, like the batsman that was given not out when he knows he was out, so too will Skerrit and St. Jean will have guilt to deal with the rest of their lives because they know justice was denied. At the end of the day, both of them are loosers, Justice was again on the loosing side, Dominica lost big time, and Astaphan was the only winner by default since tax payers paid him large sum of money to defend curruption.

    To all dominicans who are disappointed in this verdict,it is part of a process.One has to remember that the onus of providing evidence belongs to the UWP team of lawyers.They have done a poor job in preparing their case because they had at least 20 months to uncover evidence where they may lie.
    To all dominicans who blindly support the DLP,this is a victory for process of the law.This verdict does not say that the P.M and Hon.St.Jean are innocent of the allegations of illegally contesting the general elections.
    Unless there is concrete proof from the French government stating the obvious,then this case is done.Tony Astaphan is a clever and seasoned legal mind and it is his job to protect his client regardless if they are guilty or innocent.
    On the morality side of the coin,Dominica is being taken for a ride by its leaders and it seems that for the time being they will get away with anything they do.Good does not follow bad.It takes a revolution to create a solution.
    In my hearts of hearts,Dominica is under a spiritual battle and not just the physical manifestation of men.Good leadership is clearly lacking from all the political parties in Dominica.The UWP are devoid of visionary ideas and a well thought out strategy to offer a contrast to the DLP.The DLP on the otherhand,have a thought out strategy based on a Welfare State and under the spell of a charismatic leader.They rely on disseminating govermental propoganda and poltical victimisation.They have threaten the press and marginalise anyone who dare speak out the truth.The masses in Dominica don’t know better,hence they cannot do better than what they have in PM Skerritt and his Cabinet.The UWP on the other hand are weak,disorganise and lack the financial resources to properly mount a meaningful opposition.

    I predict that both the acused will win their cases on technicalities. The constitution of Dominica has many loop holes that needs to be eliminated.Mr. Astaphan is a brillant Attorney who’s playing from a technicality standpoint which is his only hope. The laws regarding the behavoir of politicians and public figures need to be revised and amended to eliminate the options to use such technicalities. A Politician should not be able to publicly, verbally, claim to be of foreign nationality and not be made to Explain before the courts that he is still fit to hold political office in Dominica.       With due respect to Tony whom I have known in DA when he was a young boy at that time whoever thought he would have made such a brilliant defense lawyer. It is not that he was a bad child but that some children really grow up to make something good of themselves and go on to be brilliant and prominent professionals. They are to be admired and respected. Tony is to be commended and of course his parents.
      This is a good example to teach the children well. Likewise if you have children.

      The judge gave the correct ruling. U cannot change rules to suit or satisy the opinion of political activist. Mendes and his team knew that the defendants would not be allowed to testify, but they tried. What is disturbing is that political leaders will have their supporters believe that this ruling runs contrary law and justice, but let us not forget that a defendant remaintng silent is not a priviledge but a right.

      Tony Astaphan is a very smart man. He used his motives and he used it wealth of knowledge wisely, because although quantity is what you people look for, you seem to forget quality.

      There is substantive law and procedural law. Tony used his methods and by cutting through the grass and sawing down the woods he made it through the forest and found the VERY ONE flaw that the prosecution made. And that was not in the substantive matter in the case. He realized that the procedures were indeed wrong. Who would seek self-incrimination in a case on anyone, when they are represented by one of the masters in this field? NOT I! Tony is brilliant and If I was going up against him I would think like him and represent! At times that’s the only way to go. I believe the plaintiff’s reps saw that was coming, but none the less, they had no idea that Tony would ask for it to be thrown out! NEVER UNDERESTIMATE THE KNOWLEDGE THAT MAN HAS SEEKETH! The Lord gave us Knowledge, Wisdom and understanding. Use it to the best of your abilities.

      To those who saying so and so about Mr. Astaphan, rethink what you’ve said because if he was stupid, he would continue with bringing the evidence. But he was smart and he played his cards right! In procedure, you’re supposed to collect every evidence you believe that would go in your favor and penalize your opponent, while at times the defense can just sit and wait to see where u go wrong and use that to obtain judgement!!     That same Judge ruled against submitting the passports as evidence. Now she has ruled against the defendents testifying in court. So she has effectively wiped out all legal means of obtaining evidence and it is only a matter of time before she gives a final verdit in favour of St.Jean and Skerrit.

    The time is fast approaching when Dominicans will have to seek alternate ways of achieving Justice.

    In a sense, this is a good verdict for the opposition who now have to consider other means of political struggle.

    Under Skerrit:-

    1. There will be no electoral reform and so no chance for any opposition to unseat him in General Elections.

    2. There is no justice in the High Courts.

    3. Having your voice heard in Parliament under Alix Boyd Knight is out of the question.

    4. The President is impotent and has failed to protect the Constitution.

    5. The Comissioner of Police does not know what is going on in his Police Force, will not arrest Skerrit’s lawyer who faces 42 counts of criminal charges. No progress on the Mano fire.

    6. In the meantime Skerrit has the NJIC to wiretap and monitor all opposition conversations and meetings, texts and cell calls included, leaving the opposition unable to plan any political stategy without Skerrit knowing.

    7. And in the mids of all this Labourites are signing “We Shall Not Be Moveed”.

    So the political conditions in Dominica are rapidly deteriorating and the opposition will have to respond accordingly or perish.

    Now let the UWP subpoena the so called media outlets which have published reports that the PM has french passport and citizenship…since that was alluded to as the one of the reasons for the motion.

    Afterall, they seem to have been expecting the courts to rule that the PM and St Jean to testify as their witnesses when such would most likely have lead to self incrimination – an open ticket to an appeal.

    Now, the petitioners will have to find some sort of evidence, proof to prove their case without the testimony of the plaintiff.

    The rule of law is alive and well in the Commonwealth of Dominica! This case serves to demonstrate that the safeguards established in our constitution are functioning perfectly and that they are there to protect us all from the average man on the street, to the Prime Minister.

    Tony Astaphan’s case was made easy for him because he was able to quote Mendes own arguments (from a similar case in Antigua) back to him. The Judge simply had to apply the law without fear or favour and that’s what she did.

    Once again, the UWP “Losers” go down in flames! What a hopeless bunch of tired and confused old men!

    We have adopted a path that will lead to many difficulties in the future; Apart from the politics surrounding the issue at hand there is the underlying development of an attitude and culture, that it is OK to be reckless and disregarding of the law as long as one can be acquitted on the basis of legal technicalities. To the poor and underprivileged people I say beware because our children WILL NOT be dealt the same cards- not by any means. What we will see is an accelerating crime rate in Dominica – not only because of poverty but simply because our children are now learning from the so called leaders and scholars that a wonton disregard for law and order is acceptable as long as there is some legal coco macaque available.

    I am not politically affiliated – believe it or not. I would like to think that the judges decision is based solely on the framework of the judiciary system.     Some people call this a victory. The question is victory for who. Now what is clear to my simple mind is that the PM and St Jean is guilty of willfully disregarding the laws of the land.
    I’m not sure how to interpret Tony’s tears – Considering the fact that on several occasions Tony has publically denounced the very same dual citizenship saga in parliament . While Tony had a job to do defending his clients I can only surmise that those tears were more of a relief from the worries of not being able to be in control of the judiciary system and the possibility of loosing the very lucrative client in Skerrit.

    The rule of law is alive and well in the Commonwealth of Dominica! This case serves to demonstrate that the safeguards established in our constitution are functioning perfectly and that they are there to protect us all from the average man on the street, to the Prime Minister.

    Tony Astaphan’s case was made easy for him because he was able to quote Mendes own arguments (from a similar case in Antigua) back to him. The Judge simply had to apply the law without fear or favour and that’s what she did.

    Once again, the UWP “Losers” go down in flames! What a hopeless bunch of tired and confused old men!

      How does the ruling prove that the PM is not guilty of the accusations? This ruling is consistent with the previous one regarding the passports. As an observer it appears that the PM does have something to hide. Even Buju Banton was willing to take the stand in his defense.

        Thats exactly why in the earlier part of this case the judge did not allow the passports to be part of the evidence.They knew that down the road it would come to the defendants taking the stand. The system is so manipulated and what happened today was just part of the machinations all in an effort to let injustice prevail.
