Three strikes and you’re out – Alix Boyd-Knights tells UWP members

The seats of the United Workers Party (UWP) in the Marigot and Salisbury constituencies have been declared vacant by the Speaker of the House of Assembly Alix Boyd-Knights, meaning they now stand without parliamentary representatives.

The speaker officially informed the media of the matter this morning at a press conference, following the issuance of letters yesterday to Edison James and Hector John, the elected members for the Marigot and Salisbury constituencies respectively.

According to Boyd-Knights, James and John had been vacated as members of the Parliament on the grounds that they had been absent for three consecutive House of Assembly sittings, without presenting an excuse or requesting leave-which are procedures required to be followed in such circumstances, according to the Standing Orders which govern the House.

The elected members of the Marigot and Salisbury constituencies were absent for the three consecutive times Parliament convened on February 4, March 29 and April 29, since the December 18, 2009 general elections. While the elected member for the Roseau Central constituency Norris Prevost of the UWP missed the first two sittings, he appeared at the House on April 29, to take his Oath of Allegiance.

“So here it is, there were three members of the Opposition, who when summoned to the first meeting of the House after the elections I think on the 4th of February did not come to the House. In baseball terms; strike one,” the speaker explained.

“The second meeting was going to be held on the March 29 and we received letters … Three members of the Opposition wrote letters, and the letters read, “ They were dated 16 March,  but they were actually delivered to the House on the 26 of March and the one from Mr James read: ‘Dear Madam I wish to  advise that I will  not be able to attend the meeting of the House scheduled to be held on Monday 29, March, 2010 … it is for these reasons that I cannot attend…,” Boyd-Knights said.

Standing Orders

According to the Speaker, Standing Orders 15.1 and 15.2 which applies to members not attending sittings of the House states that a member ought to inform the Speaker of their inability to attend the sitting of the House, and request leave if they will miss three straight meetings.

“ The first one says … that if you just missing the odd meeting you can go under Standing Order 15.1 just simply to say well [I’m out of state, or I am not well so I won’t be coming to the House]. The second part tells you, in order not to run afoul of missing three meetings without excuse you have to do something else. You have to write … The person has to ask for leave, and they have to do so previous to the meeting,” Boyd-Knights explained.

“It (Standing Order 15.2) says… [If without leave or order of the speaker previously obtained, any member is absent from three consecutive meetings of the house to which he has been separately summoned during the same session, such member shall vacate his seat],” the Speaker said.

Boyd-Knights added, “…Standing Order 15 gives me no power to alter letters; to turn a letter of information into a request for leave to miss parliament, yet they want me to do that. So there it is where I have no powers they want to give me and where I have powers they don’t want to give me. ..and so because of the fact that I have no discretionary powers in the matter I simply have to do what the Standing Orders tell me to do. I have had no choice but to inform the two gentlemen that their seat is now vacant and all parties concerned have been so informed.”

No leave granted

The House Speaker explained that she replied to each of the members letters stating their letters merely advises that they will not be able to attend the meeting of the House March 29, 2010, and no actual leave was requested.

“Since no leave of excuse was requested by you in your said letter you are hereby advised that no leave has been given to you to be absent from the said meeting,” Boyd-Knights explained in response to James and John a through letter.

Boyd-Knights said that  Prevost took his oath and is now an active parliamentarian unlike the two other members.

“So that individual, Honourable Norris Prevost has done what he has to do as far as his remuneration [is] concerned, and you know the privileges that he has to enjoy as a parliamentarian. Unfortunately the other two elected members did not do so, and so I was faced with a situation where members missed three meetings. I don’t have any as had been suggested discretionary powers here,” she said.

Boyd-Knights responded to claims made over the media that she had been biased in not granting leave to the three members of the House after granting leave to other members of the House on previous occasions.

She further pointed out two instances where she granted both UWP Parliamentarians Earl Williams and Edison James leave from the House for separate reasons, after they provided their letters informing her of their inability to attend and their request for leave, which she granted.

“Over the media some persons or one of the political leaders were saying that I am biased because I gave Earl Williams permission and I didn’t give the others…” she added.

Boyd-Knights said that this is the first time in history that this situation has happened in Dominica.

    while everyone crying foul because dlp called three consecetive meetings ,did he tell the opposition dont show up .no ,mr james and hector chose not to sit in.so they where implementing a one party state .while i am not a supporter of mr james the person to beat him havent shown his face yet.i have to say marigot has taken a big step back the things that made marigot one of the most important constuency it`s because of our inteligence hard work honesty and the ability to make sound hard dicision.mr james has betrayed that ,he cant make any dicision that will benifit the people of marigot

    CONGRATULATIONS!!!!!!!! to the three elected MEMBERS OF THE HOUSE!!!!! you are not looking after your own interests compere to the other members and the speaker. You gentlemen are looking out for the interest of the country and the younger generation!!!!

    This honorable house has now become a muck house with the speaker who believes it’s her personal house and the “dimpled one” who believes its his personal country looking out for there own personal interests.

    These three members are doing more for the country out of parliament than all the others combine. Somebody needs to stand up for our democracy and that is just what they are doing.

    As far as i am concerned they do not need go into this MUCK parliament to represent the people who voted them. When there was that big fire at coulibistrie the MP for the area was there the next morning; on the other hand when the people of calibishie was demonstrating for there road their MP turned his back!!!!!!!!!!!!!!!!! REPRESENTATION DOES NOT COME FROM THE HOUSE BUT FROM LOOKING AFTER THE INTEREST OF YOUR PEOPLE!!! And you most certainly don’t have to go to parliament to do that!!!!!

    Mrs. Boyd-Knights needs to read and know the Constitution of Dominica. By her action it is clear that she is either knowingly in violation of the Constituiton, knowingly dishonoring it, or not aware of what it says.
    Her declaration that the seats are “vacant” and up for re-election is not valid.
    It appears that the UWP either knows the Constitution better than the incumbents or they just got lucky.
    It is high time that countries start upholding their Consitutions worldwide, especially if they were predicated on sound, unbiased principles. If they weren’t, some changes may be in order.

      I advise the Government to leave MARIGOT and SALISBURY alone and develop the rest of DOMINICA.
      MARIGOT people are decendants of GARAT Antiguans so they won’t care about representation in Parliament. Let James be there Prime Minister and get funding to develop that area. I just hope that them Garats will not march up to Parliament for help.

    We need to change our political structure in Dominica, 5 Years of Labour and 5 years of Workers, NO ELECTION AND CAMPAIGNS NEEDED. Both parties will present at Parliament for the development of the land. In that way, each has a chance to be in power and our people will be happy. Too much hatred, it seems like we have little boys and girls who want to be in power to play power, a win is a win and a loose is a loose. Please I’m fed up with that.

    I’m just loosing my confidence in UWP right now, we need to look towards the future to develop Dominica

    To whom do you hold your allegiance? Country or Party?

    We must think of the overall health of our island. Whether you are UWP or Labourite, there is one thing that most rational people will agree to: The lack of oppositional representation in a government can be detrimental to democracy. There has to be a level of checks and balances.

    In a household, does one person make all the decisions? If that is the case, then if a decision is made for the entire family to fall off a cliff, there will be no disagreement, and the family will fall off the cliff.

    “A voice which often agrees with itself can only go so far.”

    Here we are, cursing at each other, and playing side-chair politics trying to rap our brain around what has become of our beloved land. Sad, indeed.

    Friends let us stop the name calling and bashing and have serious discussion on this issue. We keep saying that we dont want a one party state and we should never want that. But by refusing to attend parliament the opposition is giving the government a freehand to have just that. It would have made more political sense for the 3 elected members to present their 4 senators which would have given them 7 seats and a chance to restrategize and keep the government on its toes.

    If Edison Hector and Prevot could have added Ron Sam Lennox and Matt as their senators or even Judith, chances are they could have formed a great response team even while the court matter is pending. The court results would determine their next course of action.

    As the official opposition they could demand answers on projects and polices then we could have taken them seriously. But we all have to agree that the route they took have not worked as was interpreted by Sam when he said: ‘Game is up!”. Justice Brian Alleyne had himself spoken to the elected oposition members about the implications of their actions. The failed to listen

    So now we find ourself in a situation where the government heads the country 18-1. That makes no political sense.

    The question is what implications does this have for the pending court matters? My limited knowledge of law is the matters were filed when the members were duly elected. This new development have since made them ordinary civilians. Suppose there is no bielection before the matter is heard in June, What then? Things were made worse when Prevost went ahead and took his oath. One of the three have now considered the government legitimate, having filed court matters claiming that the goverment was illegitimate just a few months ago.

    This is an interesting subject that requires serious dicussion on our part as concerned citizens.

    Its all well and good to announce that Marigot and salisbury are workers strong holds and rightly so. But despite our political differences I was of the view that Hector could make a significant contribution to local politics having been involved in community work for so long. Obviously he had much to learn but he could have paved his way and be his own person. He settled to sail with two others for what he felt was a just cause. One bailed and he is left with one who could call it a day anytime, because he has been there done that. What then?

    Making history is one thing, but making history that puts a country to shame whether as a result of government or the opposition is another.

    LAPLAINE calls the opposition members stupid and immature, Yet he/she is crying for them to be in the House with those who believe irregularities in an election do not matter. Democracy is more than about an election on one day with irregularities in the process. Good governance starts with free and fair elections. Like it or not.

    A peaceful household with an understanding and objective Mother cannot be the reason for underachievement or criminal activities. The wider environment in which people leave has greatly influenced many such people. If right thinking Dominicans, unlike you LAPLAINE, would accept that all over the world people are crying for Electoral Reforms to ensure free and fair elections, Dominica would be a much better place to live in. You would want people to think that all what DLP and Skerritt do is right but others who dare question corruption, greed and nepotism are all fools.

    All what the UWP did when Julius Timothy was finance minister and member of the party was wrong, But that same person is now embraced as a God sent saviour of the nation in the DLP GOVT. What wickedness and hypocrisy!!!

    The DLP, Skerritt colleagues and supporters are afraid of Electoral Reform is like the devil fraid HOLY WATER. They are pretending not to hear the cry from the slogan of Electoral Reform. Go back and reread revealation and when you get a clear understanding of the Biblical prophecies and their interpretation come back. You may also find out that while you are suggesting a relationship between Skerrit and the mark of the beast, that you are probably embracing that mark more than Skerrit himself or his government because many who profess to be “Christians” are merely Churchians or pew warmers “having only a form of Godliness but deny the power thereof”.

    In any house with a family where the mother in that house always shows a bias towards anyone child or openly shows preference for one child over the next, or favouring one brother against the next, chaos ensues. The house becomes divided. Quarrels and hatred prevail. Acts of revenge are contemplated and subsequently carried out. The House, that structure of blocks and steel or durable local wood, cannot be converted into a home of decent, peaceful. law-abiding citizens. The Mother’s attitude and behaviour must change in order that the togetherness among family can become a reality. Arrogance and lack of objectivity creates more friction.

    Dominicans never allow wicked and corrupt ways to predominate over your spiritual faculties. The opposition should allow no one to take their god-given rights of ensuring free and fair elections in this beautiful nature Isle. The opposition is doing just what many, many people fought for years ago for the right to vote.

    Dominicans must be able at all times to exercise those rights FREE FROM FEAR IN A PROCESS WHICH IS FREE AND FAIR. ELECTION REFORM IS A MUST FOR FREE AND FAIR ELECTIONS IN DOMINICA.. TRUST ME. WHY THE DELAY PM, DLP.and SUPPORTERS? CONVINCE ME. WHY THE DELAY? The World is begging for it. Yes Electoral reform.

      Have you also looked at the fact that in peaceful households you have does that are underachievers, blacksheep, potentail criminals, spoilt beyond measure, the condoned, those that give in to misguided peer pressure, even when given the best opportunities and same level playing field? Most times, it turns out, that those are the very ones that blame everybody else and everything else for their lot life and the consequencies they face. Apparently, you have given to that mindset of downplaying what is right and overplaying the bad manners of grown men! Do you really believe that the problems of the UWP is election reform and a downward spiral of democracy in Dominica? Think again! The leaders of the UWP are simply spoilt and immature, and callous in their approach to nation building. Just say it as it is and stop beeating around the bush!

The speaker did what was within her rights and responsibilities by ensuring that the representation demanded and voted for by Dominicans is given! Do not blame the speaker if Parliamentatians James and John choose not to pick up the mantle handed to them by their LOYAL supporters! These supporters should demand an explanation from James and John! What was their purpose for missing three, count it, three consecutive meetings when their sole job is to represent the people who voted them in at these times!! Where was the representation for the people of these two constituencies? If I were these hard working decent folks I would be thinking twice about my vote in the by-elections! The DLP has had no issues with representation thus far! My representative – in Portsmouth – is ALWAYS!!!! in parliament, to the exclusion of EVERYTHING else! Maybe these folks need a change of Reps. and Colours!!

    While the Dominica Labour Party in Govt quickly called three meetings of the House of Assembly just to get rid of three opposition members, the same DLP has done nothing to bring those people who made millions from the sale of Dominica passport to justice. Nobody has been made accountable. no transparency. In fact, Dominicans were fooled into believing that those persons would keep to their promise of building the Layou River Hotel. Were those persons friends of DLP? Of course The person appointed Dominica’s ambassador to China, David Hsui, was a main player in all that fiasco. He was an adviser to the Govt. Pinard-Byrne was.another close confidante of DLP, Now those men were in court in the BVI against the same GOVT they were advising. Dominicans try to understand what is going on in your land.

    Two foreign business men acted against the laws of the land when they carried out work without first obtaining a license to operate. Yet nobody, neither law enforcement nor Planning Division have taken any action against those foreign concerns.

    Still in every Dominican minds is the leniency which the Venezuelans enjoyed, a slap on the wrist, after the police coast guard chased and apprehended their boat in Dominica waters allegedly engaged in drug trafficking. A million dollars made up of different currencies was found. What happened?

    How many strikes for Minister Ambrose George who has been fired twice or thrice by his PMs from posts held? Was anyone taken to task for sending counterfeit dollars to students in Cuba? Are those not serious enough to warrant legal action?

    What about the investigation on the rubbish bin and Fertilizer purchases by Govt? Who will be taken to task?

    What about the incident in the Marigot Police Station involving the disappearance of thousands of dollars. Was anybody brought before the courts to answer charges? Was anybody charged?

    What about the fly-by-night NGO, CITIZENS FOR A BETTER DOMINICA. What about Susan Olde and US$4000,000.00 for earthquake relief? Where did the money go?

    Which lawyer said that he made a mistake in calculating the correct fees to be paid to the Treasury with regards to land deals? Was any action taken? How comes the Treasury simply accepted the amount that was not paid in the first place?

    Dominicans please check those biblical sayings that give us some interesting notes about those who harbor wickedness in their hearts.

IKt is hard to believe that Edison is a former PM and the rest of them are all educated men. Nobody is acting with “indecent haste” to get them out of Parliament. After all they are not IN the Parliament. THEY said they are boycotting the Parliament. How can they now logically say they are being pushed out of the Parliament. How ludicrous can they be? What they call indecent haste is merely a justifiable interest in getting proper representation where it matters, in the real Parliament of the People, to get proper representation for the people of Marigot and Salisbury, and the quicker we do this the better for our democracy. Any genuine movement for the restoration of democracy would agree with this. Let’s get on with it. Let’s get those by-elections quickly and take it from there. The display of those chaps is simply pathetic, childish and anti-democratic. It is such a disgrace, this appeal to the ignorants among us, what we are witnessing from the UWP.     Just like the people of the world, Dominica included, fought for their rights to vote for the persons of their choice, once again Dominicans will be struggling to ensure democracy prevails. The people of Dominica will ensure that free and fair elections are conducted according to the laws of the land. Edison, Hector John, Norris, Ron history will absolve you.

    All over the world people are calling on their Govts to institute reforms in the election process. Many examples can be cited. Just recently, the Antigua Labour Party raised concerns, filed petitions against irregularities that occurred in the elections in Antigua in March 2009. The court cited that in some instances things were not done according to the laws and so ruled in favour of the ALP.

    In Africa, Europe, Asia, the Caribbean, US, Middle East, everywhere, the constant cry is for electoral reform, for free and fair elections. People are demanding:
    (1) CLEAN ELECTION LIST. Why should the names of dead persons be on a list to vote? Does that make any sense? How can any one of sane mind accept that in Dominica with a population of about 69000, an election List has 67000 persons on it eligible to vote? Be fair my people. Let Common Sense prevail.

    (2) ID CARDS. In this 21st. century, No ID Card? Don’t we wish to make it easier for any election officer to correctly identify any voter in this day and age? In Dominica, parliament discussed and decided on the importance of ID CARDS recommended more than five years now by the Chief Elections Officer/Electoral Commission and to get those done. Authorities did not follow up parliament’s decision so dollars were not made available to the Commission for the activity before the 2009 elections. The request of the Electoral Commission was not granted. Who is serious or want Electoral Reform? Why money not made available, yet millions went into elections campaigns?

    (3) EQUAL ACCESS TO THE NATIONAL RADIO STATION DBS. Why not let all ideas contend? Even the fool has his story to tell. Why not allow the people in an election process to receive information and to listen to all sides and opposing views? That action is against the Universal Declaration of Human Rights Article 19. People have the right to know, to seek, and receive information as it pertains to their lives.

    The GOVT is not bulging. There is stubbornness in putting the mechanisms in place to make sure our elections do not seem but is actually free and fair. Until and unless those reforms mentioned above are implemented and the laws pertaining to the same are upheld by all parties elections in Dominica will be controversial, problematic, not free and fair and will be a farce and blow to our democratic process.

    Let us do what is right my people. A stitch in time saves nine. Three sittings of the House just to oust opposition members to hasten a bye-election cannot advance the economy and put people to work. How many Dominicans, supporters of the DLP or the opposition can remember any significant debate or discussions in those sittings on development issues that will make the standard of living better?

    The million dollar question now is whether a bye-election, held without those reforms done, will be free and fair. Will persons in the diaspora receive plane tickets again to come just to vote and return next day? Will huge amounts of money and material stuff in cash and/or in kind be bowling around to manipulate at a time when jobs are being lost, jobs are scarce, agriculture and manufacturing in serious problem?

    HISTORY WILL ALWAYS BE ON THE SIDE OF THOSE WHO STAND UP AGAINST INJUSTICE. Mandela and Martin Luther King were not understood by many of their own, hated in several circles for doing the right thing, standing up against corruption, racism, nepotism and injustice. TIME WILL TELL

    The Speaker did what had to be done, and i agree with her 100%. It was a willful attempt by the UWP to try to upset parliament and overide the constitution. The UWP should have gone to parliament and let the courts deal with their matters. If they win their seats again(which i doubt) will they continue to miss parliament? Time alone will tell.

    Well if it’s one thing I’ve seen this past election, is that these hard times have lowered the sense of morality and the price of a vote in Dominica. Anyway, I have seen people laid off from work, road projects that can’t be completed, and a whole set of stuff that suggests that the country is now in financial problems, or at least have serious financial concerns. I want to see how much money is going to be spent getting these two vacant seats filled. This is going to be interesting.

    As i said before, there should be sanctions against the elected individuals who refused to take their seat in parliament. My suggestion is that they should be barred from participating in the next two or three elections/ to also include the upcoming by-election.
    If these guys are allowed to participate in the by-election and they are selected again by the people of Salisbury and Marigot and again decide to boycott parliament, then this is just making a mockery of our democracy and a waste of money, time and energy.
    if the current constitution does not make allowances for such sanctions, then this is what Mr skerrit should use his overwhelming majority in the house to address and amend the constitution.

    It is very important that we analyze before writing anything that comes out of our mouth. A bi-election in the Salisbury and Marigot constituency is a waste of time and money. There is no way the Labour party will win these seats. So it is better we try to bring these two representatives back to Parliament than waste time contesting a seat that will be won by the same representatives.

    Both Edison and Hector will contest the seat although they are sure to win, but what is of concern is that after Ron Green and the UWP and the MRD went all over the airwaves and in the so called People’s Parliament branding the last election of December 18, 2009 as fraudulent, and one rigged with bribery, etc. as well as calling on the Government to resign and call frest eection within 18 months because the government is ILLEGAL, what will be their next move.

    The Ron Green, Edison and Sprags Hector John called and are still calling for the following, a clean up of the electors list, and Voters ID Card among others, will they and the MRD hold their ground and say, ” We are NOT contesting if the above demands are not met”. unless those conditions are met, or will they continue with the same 68000 voters list to save their skin.

    This is where we will be able to differentiate the men from the boys, the talkers from the doers and the idle talkers from the business talkers. Will they put their tails between their legs and dance to the tune of the so called ILLEGAL government.

    MRD and Ron, Edison and Hector this is your chance to prove to Dominicans and the world that you all are men of your words, by saying no participation to any bye-election, failure on your part will be like the proverbial saying, ” Like a dog you have gone back to eat your own vomit”

    Unconstitutional or not? Was Prevost’s attendance and pledge strategic as a result of him being cognizant of the provisions in the constitution? Was James’ and John’s act of defiance justified or unconstitutional? If their act of defiance was unconstitutional, does that mean that they fractured the constitution; and hence, the action being taken is fully protected and justified under the constitution?

    Just a few questions for us to ponder without leveraging politics in the discussion.

      Eddison said openly UWP will not take part in any elections in Dominica unless their demands are met, which is, Clean voters list; voter id cards; Equal access to the state radio and a fresh election within 18 months!

      Lets see what they have achieved so far – voters list the same; no voters id card; DBS radio policy remained unchanged and the only sign of fresh elections is within 3 months in salisbury and marigot!!

      So will they go up? Well if they do it means that their words mean crap!!!!! if they abstain then there maybe some independent candidates, the Freedom Party and Para party will go up along with the DLP candidates, with no uwp in sight lets see who will emerge winner!!!!!

      THIS WAS A BAD MOVE BY UWP JUST ADMIT IT STICK TO THE TOOIC AT HAND, THATS THE PROBLEM WITH YOU PPL, HECTOR THINKS HE IS FIGHTING FOR OUR DEMOCRACY BY STAYING OUT OF THE HOUSE, HOW NOW IS HE GOING TO CONTINUE CHAMPIONING THE CAUSE? ZEZEY!!!!

    THIS IS WHAT OUR CONSTITUTION SAYS AS IT PERTAINS TO THE ABOVE (Section 3):

    Tenure of office of Representatives and Senators
    35.-

    1. A representative or a Senator (hereinafter in this section referred to as a member) shall vacate his seat in the House at the next dissolution of Parliament after his election or appointment.

    2. A Senator appointed in accordance with the provisions of paragraph (a) of section 34 of this Constitution shall vacate his seat in the House if his appointment is revoked by the President, acting in accordance with the advice of the Prime Minister, and a Senator appointed in accordance with the provisions of paragraph (b) of that section shall vacate his seat in the House if his appointment is revoked by the President, acting in accordance with the advice of the Leader of the Opposition.

    3. A member shall also vacate his seat in the House-
    if he is absent from the sitting of the House for such period and in such circumstances as may be prescribed in the rules of procedure of the House;

    in the case of a Representative, if he ceases to be a citizen of Dominica or, in the case of a Senator if he ceases to be a Commonwealth citizen;
    subject to the provisions of subsection (4) of this section, if any other circumstances arise that, if he were not a member, would cause him to be disqualified to be elected or appointed as such by virtue of subsection (1) of section 32 of this Constitution or by virtue of any law enacted in pursuance of subsection (2), (3) or (5) of that section;
    if he is elected to be President; or
    if (not being the Speaker or the Deputy Speaker) he is elected to act as President.
    If any circumstances such as are referred to in paragraph (c) of subsection (3) of this section arise because any member is under sentence of death or imprisonment, adjudged to be of unsound mind, declared bankrupt or convicted or reported guilty of an offence relating to elections and if it is open to the member to appeal against the decision (either with the leave of a court of law or other authority or without such leave), he shall forthwith cease to perform his functions as a member but, subject to the provisions of this section, he shall not vacate his seat until the expiration of a period of thirty days thereafter.
    Provided that the Speaker may, at the request of the member, from time to time extend that period for further periods of thirty days to ever, that extensions of time exceeding in the aggregate one hundred and fifty days shall not be given without the approval, signified by resolution, of the House.

    If, on the determination of any appeal, such circumstances continue to exist and no further appeal is open to the member, or if, by reason of the expiration of any period for entering an appeal or notice thereof or the refusal of leave to appeal or for any other reason, it ceases to be open to the member to appeal, he shall forthwith vacate his seat.
    If at any time before the member vacates his seat such circumstances aforesaid cease to exist, his seat shall not become vacant on the expiration of the period referred to in paragraph (a) of this subsection and he may resume the performance of his functions as a member
