Court strikes out theft matter against former NCCU staff

The Roseau Magistrate’s Court has struck out a case involving a former staff member of the National Cooperative Credit Union (NCCU) for want of prosecution.

In 2015, the police alleged that Dwight Timothy had stolen an amount of money from the institution and was arrested and charged with theft.

But the matter was adjourned for a number of times and the court has ordered that it be struck out.

“Court believes the request for further adjournment is not justifiable in all the circumstances of this case and it would be unfair and unjust to subject the accused of any further anguish through another adjournment,” a statement from the Magistrate’s Court reads. “Consequently, the matter was struck out for want of prosecution. The accused is discharged and the terms of his bail are lifted.”

Timothy said the accusation had made him a victim of cyberbullying, defamation of character and has suffered health issues because of it.

“I feel obliged to let my well-wishers know that through constant family support, countless counseling, mentoring, and faith in God, I was able to persevere despite the negative publicity and constant harassment,” he stated.

He said that he had lost a chance for an international scholarship to pursue a Masters in Finance.

“I lost my credibility in the financial world and at my university,” he stated. “Though this ordeal hindered my progress, I was still able to maintain my mental health throughout. In addition, I completed my final semester of my dual bachelors in banking and finance and attended by 2016 graduation in St. Kitts.”

Timothy also said that although his relationship with the NCCU ended on an unpleasant note, “if these unfortunate alleged accusations did not occur, I am confident that my career within the institution would have blossomed.”

“The institution gave me an opportunity to obtain a foundation in my field of study and assisted me in public speaking and sales and marketing skills as I managed a quite a few education session on their behalf,” he remarked.

He said he was never prepared for the shocking allegations and it still seems like a bad dream.

“I kept patient and placed all my trust in God and longed for the day I would receive justice,” Timothy stated. “I pray that one day I will be fully vindicated from these false accusations and I will get the desired peace of mind.”

    Face it people NCCU has lawyers on retainer, they can afford the best. Knowing that banks prefer not to go public would take him to court if he was INNOCENT? The got off now not because he is innocent but because of delay by the prosecution. ……………. Child don’t shout for joy just cross your fingers and hope it goes away. If you have the people money let it go because karma is worse than any court of law. What you say you lost is nothing compared to what you will lose in the future, is it worth it?

    If he is truly innocent of the charges he should file a lawsuit against the credit union. Sue for damages, mental issues, lost scholarship, defamation of character etc. Build your house on that, go do your masters. Shate man. They should have had all their evidence before embarrassing the man so. Three years and nothing to show?? Have people thinking the man is a voleh. My dear if you are truly innocent justice will prevail.

    Simple test.. If your salary cannot match your lifestyle, the trips, the night outs, the women, the cars, the flossing…… No loans, No western union, not investments on the ground.. No family funding…. No drug deals, no wealthy woman maintaining, No man, .. That blessing have to be a dream….

    Too many times our people are accused of stealing these large sums of money and then, by virtue of someone’s incompetence the courts have to make an *** out of itself.. its a shame.

    “Court believes the request for further adjournment is not justifiable in all the circumstances of this case” Clearly reads all circumstances. Prosecution had three years; therefore as the journalist on Matt claims that this was thoroughly investigated. Then this matter should have been over since 2016 with through evidence. Arrested and charged on suspicion three years later he is still being harassed? even after being set free? No Man!!!

    Whatever Carlisle says, unless you are found guilty by a court you are innocent before the law. Carlisle should be ashame of himself. We have courts to pass judgements, not so called journalists.

    ummm…so you not taking any legal action against NCCU for all these things you said you suffered? Your credibility and so forth. Or is this a case where the bank has sought it to be in its best interest that you walk away quietly to avoid any negative publicity and to damage the institution’s imagine. ‘

    I can very well understand his situation.I believe that computers make mistakes. I have seen it happen. When there is a hiccup in the electricial power these things can happen. It is sad to see humans, especially honest humans have o take the blame for that.

    The case was dismissed for “want of prosecution” meaning, he can be arrested again if evidence shows up. This definitely is not the same as “winning” the case. NCCU is also at liberty to commence a civil suit. In all honesty, Timothy deserves his day in Court. No case should be dismissed for “want of prosecution” especially when there remain some fundamental questions to be answered.

      See what happened in the case of the man from Savanne Paille? Two months after he was a “freeman” he was again arrested and is now on remand at the Dominica State Prison.
      Case was discontinued for want of prosecution.
      Its not over until you face the court.

Life is not without trials and you should understand as stated in the Bible. count it all joy …. The end is patient. Ann I am so happy for you. Give Jehovah all the praise.     The young man’s reputation has been irreparably damaged. Who is going to compensate him for the damages? This is quite unfortunate for this ambitious, erudite, God fearing, young man. Despite such a heavy burden to carry, he was still able to advance himself academically. This speaks volumes to his testicular fortitude. I wish for his future endeavors to be blessed with loads of success.

    Alot of times people go through these things in Dominica and when vindicated get no restitution. Sometimes they are just grateful it is over. My hope and view is that this guy is able to get some tangible restitution. These types of accusations no doubt would have crippled his career prospects…..Good luck as you seek to rebuild your life

        so you call 3 years in court a delay a delay to provide at least 1 witness a delay to provide any form of evidence? the journalist on radio already found him guilty yet the court hasn’t actually the “Court believes the request for further adjournment is not justifiable in all the circumstances of this case” ALL CIRCUMSTANCES key word!!
