Facebook page to call for resignation of DPP

A new page on social network giant, Facebook, has said it will soon be leading a petition to call for the removal or resignation of Dominica’s  Director of Public (DPP),  Gene Pestaina.

The page,  called Justice for Rachel & Sophia, was founded after it was revealed that the DPP had decided to discontinue a case against Sarah Lyn Augustine.

Augustine is alleged to have stabbed her five-year-old daughter Rachael Vigilant 45 times and her two month old baby Sophia 31 times at their home in Mahaut. The incident, which shocked the nation, took place in the wee hours of September 16, 2010.

“One day at a time guys,” the page announced in its latest Facebook post. “Our next step is to get a petition going calling for the removal of the DPP (or his resignation)”.

According to those behind the proposed petition, DPP Pestaina is unfit to hold the petition of Director of Public Prosecution

Gene Pestaina told Dominica News Online on Monday that his decision was based on a psychiatrist’s report and the intervention of the Canadian authorities.

A report by Consultant Psychiatrist Griffin Benjamin concluded that Augustine, alleged to have murdered her two children, “is mentally fit to plead and answer the charges against her”.

However the DPP said he was more interested in another part of the same report that indicated that “Augustine was diagnosed as suffering with Post partum Depression, a clinical illness characterized by a major depressive episode”.

He also took into consideration, he says, offers of help from the Canadian authorities to provide necessary psychiatric facilities for Augustine.

“We don’t have any suitable psychiatric facility here to deal with this lady, she would be tried, very probably convicted, sent to jail for a length of time and waste away,”  Pestaina said in explaining why he arrived at the decision he did.

The FaceBook page posted by those opposed to the decision is demanding answers from the DPP.

“We want answers as to why she was allowed to leave the state? Why is the DPP discontinuing the case? Why is there no justice for the dead children?” the founders of the page wrote. “Now that the case is being discontinued, what is going to happen? Is there any justice? Two kids are dead and this is like a joke.”

    All this is just proof of what I’ve been saying for a very long time now. If you’re caught with the smell of weed on you then you are sentenced to 25 to life. If you kill someone no matter how high the evidence is stacked up against you YOU WILL GET AWAY with it…no doubt.

      Miss laday KI, I am not judging – I am saying that “UNTIL THEN” (she is proven well) she cannot be trusted among others because there is a posibility she will strike back if he condition is not taken care of. Every act of evil is influenced by a demonic spirit. I cannot fathom anyone one stabbing a tender-fleshed baby the number of times this mother did. She is unquestionably SICK and should not be TRUSTED among others, “UNTIL THEN” (She is proven to be OK). I never said God didn’t forgive her – but that doesn’t mean one have to be naive.

      Are your residing in Canada? if this is the case and you are a family member get your facts straight, there is no such thing in Canada as being in a mental facility till death, if, i say if she is in a mental institution she will be then transfer to a home, human rights are for those who were wrongfully convicted/convicted of crimes they did not committed, get our fact right

    I agree completely with Waitikubuli on the way of viewing this situation. The young lady is sick therefore she needs attention. Now because is sent back to her country doesnt mean that she is over there having life sweet. The US and Canada are known for the toughest mental institutions. Going there is 10 times worse than serving any sentence in Dominica’s prison.
    Sarah also has to live with that hunting spirit for the rest of her life. I believe that in itself is punishment enough.
    Those 2 little angels are with the heavenly father a far better place than all of us right now.
    So instead of wishing the worse for this obviously sick young woman, as a nation we need to pray that the demon who controls her would flea and never return.
    To the father and other family of the babies. You all are in our prayers and we know that God has them currently in his hands. It now your duty to follow his will and pray to be with them and God someday.

    I am taking a spiritual view on this, as many have justified this based on God forgiving Sarah.

    Yes, GOD forgives. He is a forgiving, merciful and gracious God. But what is forgiveness? Is it that we can do whatever we want and then just run to God and say, Father God, I have sinned, please forgive me? And then be on our merry way? Many have said that “God will forgive Sarah Lyn Augustine” and I agree that He will if she “SINCERELY “repents; however, that doesn’t mean she should not be held responsible for her actions HERE ON EARTH. When God forgives, He is blotting out our transgressions from His record in HEAVEN; thus, rekindling the relationship (spiritual) with Him so we can be called a Child of God. Being forgiven of her sins, means that she has secured a place in heaven if she maintains her position as a child of God. This, however, doesn’t mean that she should be TRUSTED in the same “office” which she betrayed-(Society).

    Let’s look at two examples.
    #1: Adam and Eve disobeyed God (they sinned). God forgave the both of them by covering them with “blood”. YET, He drove them out of Eden “Lest they stretch forth their hands and eat of the tree of life”. Ostensibly, He did not TRUST them in the position He originally placed them- a place where they could “freely” eat – but they had betrayed that trust and as such they were no longer deemed responsible to be in such a “position”. Hence, though forgiven, they had to be placed “outside” where they TOILED for their “bread” instead. In addition, the level of trust was so low, that GOD even placed flaming swords at the entrance of the Garden to ensure that they don’t try to “sneak” in because GOD knows the heart of man. YET, they were already forgiven and still children of GOD- but they had a trust issue.

    #2: Saul was King of Israel – a child of GOD. He disobeyed the orders of God – and what happened? GOD rejected him from being KING. “ Because you have rejected the word of God He has also rejected you from being KING”. Notice, it doesn’t say that he was rejected from being a child of GOD, but from the position of being KING. In other words, God could no longer trust Saul as a King- he had an issue of trust.

    I am saying this to say that, God may have forgiven Sarah providing that she sincerely repented, but shall she be kept in “eden” lest she put forth her hand and strike again? Shall she be trusted among others? Depression is more spiritual than anything. Many have claimed that she had PPD, this is nothing more than a demonic spirit that took over that child and the truth is, no amount of medication can fix that – the demon has to be cast out from her if she is to be “normal” again. Given that her family is very “spiritual” or Christians (correct me if I am wrong), they, of all people, should understand that truth. Can they ascertain that she is “spiritually” well to roam around? Until that spirit of murder/depression(aka PPD) is cast out she needs to be in a place where she cannot strike again. THOUGH, she might be forgiven- yet she has a trust issue.

      Most of your analysis here are of my sentiment as well.

      It is not my desire to hear that Sarah is put away in a prison cell and wasting away for years and years. I am sure that is not God’s will for her either. But human beings needs to learn that quite often they need to “be still and know that God is who He said He is”

      Sarah did a very bad thing–driven by the influence the devil. She must go through some form spritual discipline and training of her mind–only God is able to work this out with her, by the power of His Holy Spirit. Of course she will need faith, and the aid of God’s servant on earth.

      Unfortunately, with Sarah roaming the streets of Canada, feeding on worldly pleasures, there is no chance of her experience the need for God’s grace–His mercy and compassion. God wants sincere repentance from people, before He will beging to change them.

      Without that desire of repentance in Sarah, she remains an enemy of both, herself, her Life and of God, in as much as He loves her and He wants her to live. For God has given us “free will”.

      Through this “free will”, we make the choice to accept Life in Jesus Christ, or to feed on the lies, deceptions, the wicked and evil schemes of Satan–the poison that kills and destroys us.

      Sarah has chosen death, and those people who think that they are protecting her right now, have simply made her inner suffering and the torments of her mind worst–not better.

    I may agree with wat is being said however neither she or her kids are born here and never lived here permanently. so the Canadian government had every right to intervene and yes there is documentation that she was legally extradited. I even have the name of the facility she is staying at. and if anyone were to contact them they would be told that she is a patient at that center. so please people although we may not 100% i can tell u that Canada is still gonna try her. I’m her cousin and I have a copy of the canadian news paper where her story and face is plastered. Even if i am family I still would like justice for my 2 innocent cousins.

    I smell a ‘cat’. That is the only thing I can come up with as the reason the DPP cannot think straight. He has also started a very bad precedence because if the pychiatrist say you fit for trial and they did not try you, then all people diagnosed with psychiatric problems now serving sentences can appeal.

    Mr. DPP, can you produce the document in which the canadian authorities agree to give the woman psychiatric help? I am not saying she is not ill or does not need help, but she should not go scott free. She should serve her sentence in a nut house if she is nutty.

    This is truly a sad and heartwrenching case. No normal human being is capable of performing such a heinous crime. This young lady needs help; torment and guilt is already her judgement. To relive these memories for the rest of her days…Lord deliver this young lady and all the family members affected by this situation.

    I would have expected the DPP to at least get another Psychiatrist’s view on the issue not just to dismiss because one doctor said so. i believe the right thing to have done as the DPP was to get a second opinion not out of disrespect to dr. Benjamin but as a means of being fair to the the father of the children

    I mean, it is appauling to see the comment of people who are suppose to be educated let alone of Christian up bring. Jesus was quick to forgive all our sins even after being nailed to a cross innocently. And everyday he is forgiving us for committing the same sins over and over. Do you think God will love her any less because she killed her children , while some of your sleep with someone else’s husband, steal, lie, or manipulate persons every moment of everyday? No he is certainly not. For Paul was a murderer however God used him to be the Bible’s most influencial story teller. So please while we are so quick to judge, remember you also are being judge.

    Also Mr. Pestaina cannot on his own make a decision of that magnitude, but alot of thought and discussion had to be make by three sides of the judicial system.

    And finally before you call for the resignation of the DPP, look around you bigger crimes are being committed everyday. So blatant that you cant even see it. You celebrate a man who said publicly ‘No law or Constitution can stop me,’yet you expect that when crime happens for the law to take the side of Justice.

    I am a mother, a wife, a sister, a daughter and I am Dominica.

    So when you are quick to point the finger for someone else’s sin. Stop and look in the mirror.

      First of all, Paul was a murderer because he thought he was doing the right thing, he was ignorant of what a christian really was…..this woman knew exactly what she was doing, she murdered the children because of her own selfish reasons! Secondly, you need to stay on point, the issue is not about ppl lying or sleeping with other ppls husbands, the issue is about this woman who killed her children! Again, the PM is not the issue, Dcans chose to let him get away with it, you cannot compare apples and oranges

      @ repulse.this is a sad and painful situation for all parties.there is a thin line btwn sanity and insanity.the girl might have xperienced a moment of madness.if she was medi- diagnosed as fit to answer the questions, but at the time of the incident suffered from ppd then she should be instituionalized and treated. we do not know on what grounds she was allowed 2 leave state.it is understandable that ppl have ques/concerns,first time i’ve heard of an incident like this(s/one allowed 2 leave state under those circumstances etc).if she is under c/da med. authority in an institution, she will b unable 2 harm anyone.if it’s a daughter, sister, mother, neice,we would want her 2 get treatment instead. if it’s a person with no strings(ranks-local language),how would the situation b treated? so u now understand the public outcry?spiritually, the girl is possesed and need serious deliverance, it’s not a joke living in a house with a spirit of death.fighting 2 hold unto something God want u 2 let go off can cast u a lot.now b practical with all the bible quoting, the same people who condemed the famous pastor,who had inside info.on him,who even spread the story, stop pretending the girl did nothing wrong.stop the name calling and blaming others.murder is murder.(u all r behaving like the pastor followers) a rose is a rose is a rose.stop trying 2 make god look like a fake.like all of us who have done wrong, she may deserve a second chance.

      Please be careful. There is no information in the Bible that says Paul was a murderer.

      All that I have read, as others report about Paul and he, about himself, is that Paul persecuted the Church of Jesus Christ.

      He was named Saul at the time, on his way to Damascus, when Jesus stopped him, and asked him: “Saul, Saul, why are you persecuting Me?” Act 9:4

      Persecution means that Paul pursued, harassed, hunted down, bullied, discriminated against, pestered, and chastened after believers in Christ–not murder them– because like most of the Jews of his days, Paul did not accept Jesus Christ. But he was one with a great zeal for God.

      Paul had a great zeal for God, but he did not know that God was the Jesus Christ, whom he would not accept. Only God’s Holy Spirit can convict people of that Truth.

      For that reason Jesus knew that Paul would be one of the most influential servants by whom He would do His work of Salvation–but it was not like it was a piece of cake for Paul. That is one of the reasons he was so influential–as God’s Holy Spirit worked through him. Paul had the blessed gift of courage.

      Jesus said to Ananias, the man whom He chose to physically heal Paul from his sudden strike of blindness: “He is a chosen vessel of Mine to bear My name before the Gentiles, kings, and the children of Israel. For I will show him how many things he must suffer for my name’s sake”. Acts 9:15-16 Yes! Paul did suffer many things for the sake of Jesus Christ.

      Paul himself spoke about his actions against the Church many times in his letters. Here he tells the Church in Phillipi, when he taught them to not have confidence in the flesh: “If anyone else thinks they may have confidence in the flesh, I more so: Circumsized the eighth day, of the stock of Israel of the tribe of Benjamin, a Hebrew of the Hebrews; concerning the law, a Pharisee; concerning zeal, PERSECUTING the Church, concerning righteousness which is in the law, BLAMELESS”. Phillipians 3:4-6

      Note that the Law of Moses said “thou shall not kill” That law remains for us to this day. But Paul tells us that he was blameless–meaning without a single blame– as far as the righteousness of the law was concerned. How can people say that he committed murder?

      Let us be careful when we speak the Word of God.

His words – If you do not forgive your brother (Sister) whom you can see, then how can I forgive.     Well said Wendy! The next person could be our own loved ones and since now know of Post partum Depression (unheard of before as I myself gave birth to 6 children and never experienced Depression) but this is reality even if I did not get this. 2012 those tests and counselling and asking the “uncomfortable questions” as you put it should be done. We learn more as time goes by and we change as times pases by when we realise that there are things (situatiions) that we never took into account.

    Hate to hear the phrase ” that is how this had been over the years” We come up against new situations and we have to do things different as the situations chancge.

    The justice that will be done to Sarah will always be done by God’s authority. But as usual, God needs a physical person, who has His heart, His attitude, and His conduct–the traits of Love–through whom He can do His work.

    What this man, Pestaina, has done as usual, is to decide that he does not need God’s control and authority, so he has made the decisions by his own human wisdom and philosophy–always wanting to demonstrate human power.

    However, what Pestaina does not know, is that he has denied Sarah her very own life. It is not walking about all dressed up with make-up and hairdo’s

    Right now Sarah is as dead as dirt itself–simply waiting to pass away to become that actual dust that she now exist in.

    Sarah could receive the forgiveness of God, as He heals her heart of evil and wickedness; but not if she will not demonstrate some form of remorse, publicly, for what she has done. God wants that reaction from her, first and foremost.

    If Sarah was mentally ill, her mental illness was not of God–it was an influence of Satan, God’s enemy. I am saying that God would not, and did not conduct that gruesome act of Sarah.

    With God present in Sarah’s Life, she would not know that kind of torment in the first place. All forms of sickness is from the devil–most times it is the way that God allows Satan to buffet us, so that we might call to Him for deliverance as we observe the Power of His Love in us. That is why Sarah needs God’s healing; as soon as possible.

    It is unfortunate, that Gene Pestaina has decided to deny her that privilege of God healing and forgiveness, just because he wants to be famous–but what is the fame?

    Frankly, we do not need people like this man making decisions on our behalf!

    ????????? Tony and all the others. What if Augustine was your daughter? Not condoning the act but just ?????? If she was your daughter.. Would you have felt that same way or would you pray or go to lengths to have her acquited????? It is so strange that we can be so judgemental when the person is not a close loved ones of ours. If it was alledged our daughter had post partum depression and had done such an act, what would have been our opinion? Just wondering??? I would really like some objective comments not as Sarah Lyn Augustine but had it been my own daughter or very close relation, What would have been my opinion. The test is put ourselves in the shoes of the Family and as though she was one of our own?

    Well I do not support asking Mr Pestaina to resign rather concerned citizens should demonstrate in front of his office until he file criminal charges against Ms Augustine. Now, I assume that Mr Pestaina office requested a psychiatric examination of Ms Augustine by Mr Benjamin, who examined her. He then submitted a report which said that she is fit to stand trial and answer for her acts. The repost also said she suffered from “Post Partum Depression” which is not unusual for such incidents. We must demand that Mr Pestaina bring criminal charges against Ms Augustine and if she is found guilty she should face the consequences. We should not allow the Canadian Government to interfare with the internal operation of our Government and our Criminal Justice System.

How about being equally passionate about bringing the perpetrators of the attempted murder of a retired magistrate by people with political connections? isn’t this a bigger crime that is crying out for justice.
    This obssession with prosecuting a mentally sick woman speaks to a sickness in our society that claims to be Christian. What a crying shame when we have lost the ability to be sympathetic or at least be forgiving with respect to someone who clearly was not in a normal state of mind when she committed this heinous act. The hypocrites who are calling for her head cannot claim to be any more civilized than the woman whose scalp they are seeking.

      Hi, The Psychiatric Report did not say she is mentally ill rather it said she can answer for her act and she is suffering from “Post Partum Depression”. At a minimun Mr Pestaina could have requested that she be placed in a mental institution but getting off free after committing such crime is not right.

    The DPP should have resigned or been fired years ago…this is not the only instance where our justice system seems to be ineffective to the point of being almost inexistent!
    How many cases has the state successfully pleaded? How many criminals have been set free?
    If we do not have the facilities for the mentally incapacitated then the office of the DPP needs to petition OUR govt! Were the crimes committed in Canada?!
    Let Dr. Benjamin and whichever other shrink we have on island treat her at Stockfarm!

      Stay with the British? Perhaps you have no difficulty with laws that allow alternative lifestyles where it is legal for Jack to marry John and Jane to marry Janet. The British did say that their foreign aid assistance would be reviewed as some countries which received British Aid still has laws that outlaw buggery. So stay with he Bristish if you wish.       Judge not… let God do the judging. I do believe that something needs to be done but putting her in jail is not going to solve the problem. all them crazy fools that walking the streets and running the office and stealing from the poor… these are the ones that needs to be put in jail.

      this girl has to deal with what she did and at the end of time she will answer for what she did… and I am sure she is hunted each day…

    Mental illness continues to claim victims including the one inflicted with the problem. No one chooses it. No one is exempt. Post Partum Depression should be addressed in the Labour Ward, observe for mother and baby bonding; affect; mental state; mood. Ask the uncomfortable questions- are you depressed? Are you having thoughts of hurting yourself or your baby? Are you hearing voices? How is your relationship with the father of the baby? What is your support system? Many times we are embarassed to ask these questions and the person in distress don’t kow how to speak on it. Mental illness takes various forms. This is 2012 we need to ask the uncomfortable questios, you are your brothers keeper. Something you say/ask may be the difference between life and death for the patient or the victim. It saddens me to see the mentally ill walking the streets of Roseau or wherever, their lives have value and the matter warrants further attention/discussion.

      Worldy people do not understand how The Father works, I will have mercy upon who I will have mercy! What if the young lady was their daughter or loved ones?     My personal opinion? The DPP should have allowed the case to go to trial.(The psychiatrist said she is fit to stand trial) and let the chips fall where they may. It is so unfair that such a heinous crime should be swept under the carpet. If a jury finds her not guilty fair enough but the DPP should not just take that insensible action

    Sophie and Rachel are in heaven. I feel for those children esp since I have a lil girl around Rachel’s age. I can’t imagine even touching her with a pin, much less to stab her 45 times and then say i suffering from mental illness. Alas, but they are dead and their souls are at rest.
    It’s unfair at all angles how they lost their lives and the one who gave them birth is free and happy and claims to be suffering from …. awa wi I can’t comment again on this topic it just hurts to much.

    Is the DPP for real. Did he say her life is going to be wasted in jail. THis is a joke, did he thought of the two dead kids, what about their dad, come on Prime minister look into the conduct of the DPP in this case and make an assesment on his performance as a prosecuter. This does not look bright in the fight against criminal behaviour. The young lady do the crime, the prosecuter duty is to try her at the courts and not be the defence council and feel concern for the accused. His duty is to ensure that this dangerous woman is placed behind bars to safeguard the pupulist. Did he look at the facts of the case, did he note with attention the surcumstances which led to her buchering her kids. Did he ask himself why didn’t she did it a year earlier. Did he, did he. While our political big heads fight amoung themselves for things that sometimes don’t matter. they should be looking at the way justice is being administered in our country. Look at the presentation of the reports at the court and the judgemnet for such crimes ie rape, sex assaults on minors and crime of violence. look at the lack of succes in convictions in murder cases at the high courts. Why is it that persons who commit crimes of serious violence on a human being are granted bail. should i remind the politicians of the murderers roaming the streets on bail. HAS OUR JUSTICE SYSTEM FAIL US AGAIN. IS IT THE LACK OF ZEAL BY THE PROSECUTION THAT VICTIMS ARE LEFT TO WONDER, WHATS THE PURPOSE OF FILLING A POLICE REPORT.Is there anyone i should mention we should blame on the demise of our justice system led by the DPP. At least we know that this is not the fault of the police as we always point the finger towards. it appears that there was evidence but due to the compasion shown by the DPP, a murderer yet again walks free. Did the DPP look at the case in europe where the young man killed about seventy persons. He was deamed to be mentally unstable, but the prosecution insist that he be sent for trial at the courts. Is the DPP following what is happening around the world. Is he aware that 80% of the killings in melitary facilities around the world are done by men who were deemed mentally insane by a doctor yet the stand trial and convicted. let the court deside what they should do with the lady. then you can propose to the government to build the facilities to deal with the persons who suffer mental challenges.

      Has anyone commenting thought of the Family?? This is someone’s daughter and it is her own children that she did this thing to. So the family is grieving alot. Daughter and Grand daughters. How would you commenters have felt if it was one of your own who did this? Put yourself in the Family shoes for one minute. Aunts, Cousins, mother, Uncles or this young lady Sarah Lyn are all going through pain. Don;t you think that the Family did not love love Sophia and Rachel? Sit and think of this! What if it was you as a family member in this situation – I am sure you would be grieved and confused as well. If you know Christ then you would turn to him and since we have to trust in him, then you would leave the decision to him and wouldn’t you have wanted this to be a decision that you would rejoice???? Just saying!
