Gov’t did not interfere with Isidore court matter – AG

Attorney General Levi Peter says government has not wrongly interfered in a court matter involving lawyer Stephen Isidore and former magistrate Glensworth Emmanuel and has refuted claims he was involved in influencing the path of the proceedings.

Peter commented on the issue at a press conference called at the Government Information Service earlier today in light of allegations that there’s been unnecessary government interference in the proceedings in court.

“Mr. Linton and others had been misleading the public by claiming that the government is improperly interfering in the legal process in this matter and in this country more broadly,” Peter stated, referring to talk show host, Lennox Linton.

He described the claims as the “usual hyperbole of nonsense that some of our fellow citizens choose to engage in” and has also denied he gave instructions to state attorneys to influence the outcome of the Stephen Isidore-Glensworth Emmanuel legal matter.

“I Levi Peter, attorney general of the Commonwealth of Dominica confirm that I did not give and have never given any attorney, be they state or any description whatsoever, any instructions to a oppose or b support the application for leave to apply for judicial review made by Stephen Isidore. Neither did I or have I given any instructions to any attorney to oppose the application of Mr Glenworth Emmanuel, believed to be joined as an interested party in the said application of Mr Isidore,”

“Whether you ask 25 times … I am not going to disclose to you matters that are relevant to the attorney general’s office and are not relevant to you,” Peter said after being questioned by local media, as to who sought to influence the court matter.

The attorney general admitted however that he is concerned instructions may have been given by “another source”.

    In St.Vincent, Colin William the DPP did what was expected of him, he discontinued the Private Criminal case’s against Prime Minister Gonsalves and other ULP parliamentarians.
    Its like the Wild West in St.Vincent, law is a joke when the DPP keeps discontinuing private prosecutions, let the Court decide if there is a case to answer, and if there is guilt or not.
    The DPP Colin William is the ULP party spokesman and a former junior partner in Prime Minister Gonsalves former law office, should he as DPP be making what appears political foolery with the law.

    I just listened to this man’s speech on the news… Boy I just don’t know why these people assume that Dominicans are illiterate and that we don’t know what is really going on. He said that it is clear that the judicial system is working in Dominica. It just amazes me that the judicial system only seems to work for one set on this island. But don’t worry, Dominica are a very patient people and we will give them enough rope until they hang themselves with it.

    Firstly how independent is the AG from the political process?

    Secondly, if there is an arms length relationship, if the AG thinks there might have been some political interference, why is he not starting an investigation to get to the bottom of this?

    This kind of banana republic foolishness (akin to what goes on in African distatorships) must stop.

    I listened to a clip from the news conference and I have the following observations

    I think that Levi was well within his character and I say so because I know Levi very well. In fact he was very mild and professional. Just for kicks and giggles you guys missed Levi in action after a soccer game. Mr Levi was a very good soccer player by the way. On a serious note I think that the AG was very professional compared to other authorities in similar situation. I don’t think that any other member of the cabinet would have done such a good job.

    With regards to the issue it is obvious that the AG is now caught between a rock and a hard place and is embarrassed by the situation. We need not wonder who it is that is directing traffic around the AG. It is now obvious that Mr Peters is just occupying the seat of AG. The real executioner is someone other than Mr Peter.

    It would be naïve to think that no other government has interfered with the office of AG however the current situation is unprecedented. Never have we seen a government scrambling to get involve in a private matter between two private citizens. It would be unreasonable to not deduce that something smells rotten. If it stinks then it rots.

    Mr Peter is not obligated to disclose the internal details of his office procedures but he was also sending us a message. It seems that Mr Peter was bent on protecting his integrity. Mr Levi is a man of integrity that I know for sure.

        I tend to agree with you on that. If we read between the lines we may notice that Mr Peter is really frustrated and I know he wants to do the right thing. My point is Mr Peter is caught up in a web of deceit. Maybe he should resign like you suggested. .

    What was that all about Mr. AG?

    Well, after listening to this press conference I have to admit that the government ministers need help dealing with the press. This gentleman despite his claim of being out of state need to be cognizant that Dominicans are aware of emails/cell phone use to address serious matters, or does he want the listening public to believe that being out of Dominica relieves him of the responsibility as AG; if that is the case then was there and acting AG while he was out? If yes was the decision made by the acting AG? If yes, is this person being dealt with for the confusion? Sir, you are a public servant first and a private citizen after therefore if you did not find it fitting to be asked questions why did you call a press conference.

    Based on the information these are junior staff members to the extent they were told two separate pieces of information that placed them in the unenviable position of back-peddling. The lack of planning of a cohesive message seem to have played a role in a less than flattering situation that the AG is trying to explain, and making a total mess of it in the process. The AG needs to understand that being defensive and trying to be little journalist only gave everyone a measure of how education/position is not everything. This reminded me of very intelligent professors who do more justice to themselves to do research instead to standing in front a class to teach a subject they wrote their thesis on.

    During the press conference I tried to imagine myself being a young person looking for a leader or let alone a mentor, but this performance speaks volume about how limited these individuals are in Dominica and whether our democracy is in crisis mode. Can you imagine tax payers money is used to maintain such arrogance? What alternative does anyone have in Dominica but to fall in line and accept this man explanation; but I am happy to note that there are some independent thinking people who are not afraid to ask tough questions. Curtis and Jnobaptiste show us how step the landscape is to work in Dominica. I hope these Politian realize that the very people who put them in power to serve are listening while they earn a salary, whether as an appointed or elected member they have a right to serve the public. Yesterday was a sad day in Dominica’s democracy and I feel that if the leader of a country sets the tone of leadership everyone who work for him follows and as such this tone of arrogance started from the top.

    KINGSTOWN, St. Vincent, CMC – Three candidates for the main opposition New Democratic Party (NDP) in last month’s general elections have bought a total of ten private criminal complaints against Prime Minister Dr Ralph Gonsalves and three of his ministers in relation to “different character assassinations” during the election campaign.
    NDP senator, Vynnette Frederick, has brought two complaints against Gonsalves and another two against Minister of Health, Cecil McKie, who defeated her in West St. George.

    Nigel Stevenson, who won in South Leeward, has brought two complaints against former area representative Sen. Dr. Douglas Slater, the Minister of Foreign Affairs.

    NDP chairman Dr. Linton Lewis has brought four complaints against Minister of Housing Clayton Burgin, who defeated him in East St. George.

    Chief Magistrate Sonia Young has summoned Burgin, Slater, and McKie to appear in court on Friday, January 14, to answer the charges.

    Lawyer for the NDP, Kay Bacchus-Browne, said that the party’s legal team, which includes Nicole Sylvester and Trinidadian Keith Scotland, “absolutely [does] not agree with [the Chief Magistrate] not issuing the [summons] against Dr. Gonsalves.

    “There can be no reason, no distinction between the one she issued and did not issue and therefore we are going to take appropriate action in court to challenge her refusal,” Bacchus-Browne said on Wednesday.

    “These are private criminal complaints under the Representation of the People’s Act, which, if proven, will disqualify the persons we complained (about) for five years from even voting or from being a Member of Parliament,” she said.

    She noted that if found guilty, the persons can be fined EC$750 (US$278) and sentenced to one year in jail.

    “They are also very serious complaints and the evidence we have is quite firm,” she said.

    “We are confident that on the law, we have all the evidence necessary to win,” Bacchus-Browne further said.

    However, Bacchus-Browne noted that the Director of Public Prosecutions, Colin Williams, “has the power to take over and discontinue private criminal actions and we have precedence where he did this before with the complaints we brought against Dr. Gonsalves and also some other complaints too”.

    Bacchus-Browne, however, said that if the DPP takes such a step her team is prepared to challenge him all the way to the Privy Council, the nation’s highest court.

    Asked if she was anticipating that the DPP would discontinue the charges, Bacchus-Browne said, “Let us say that it is very probable. However, I will wait and see what happens.”

Imagine an attorney general of a country conducting himself in this disrespectful, unprofessional and arrogant matter.. This man is saying that Government did not intefere, that he didn’t give any instructions, but the instructions came from another source.. Is he telling us that the instrctions to the court and to the police came from a source outside of Government, a foreign source probably.. GOD HELP OUR BEAUTIFUL DOMINICA with the pirates who have invaded her yet another time…

    I understood where the AG was coming from in terms of his explanation. I accept his explanation. However Mr. AG I was very taken aback and concerned by the manner in which you interacted with the individuals at the press conference. To me you sounded very arrogant, pompous and egotistical. That is unbecoming. That may not be your personality but you know what they say about first impressions. Please try to temper your anger and hostility and instead pray to the Almight for one of the greatest assets that money can’t buy – humility.

      The AG tried to mislead the public. He tried to make us think that what Lennox said did not happen. I almost believed the man. Then I heard more… These men make me sick, not to mention they embarass our country. He could have just said at the beginning the incident occured but it was not under directives of teh AG, but the AG’s office. I can not believe this man.

    It is apparent that levi is mixing matters. I sense chaos. Levi is blaming Linton while absolving himself and at the sametime throwing somebody from his side of the fence right under the bus.
    Why blame Lennox when at the same time levi is stating that there is unethical interference coming from their camp.
    The AG ‘s words will come back to roost. We should expect Tony Astaphan to come up with another lie to distort the truth which Levi has just revealed. knowing levi , hasty and argumentative as he is he wants to do the right thing. We all know that levi is in a compromising position and he seem eager to let people know that he is not part of the distorsion and illegal manupilation of the legal system. It is apparent but safe to say that the AG’s news conference was intended to insure that his image does not get mixed up with the images of those crooked gang .
    The blaming of Lennox was done to simulate loyalty to the present government operatives. solidarity assure the is just .

    More examples. More PROOF that our institutions, legal, LAW ENFORCEMENT, Electoral Commission, IPO, PUBLIC SERVICE Etc., etc., etc., are all being MANIPULATED, controlled by Govt.Operatives. Any country, where its institutions no longer act independently of political interference and in accordance with the Constitution and Laws of the land, is doomed to become A FAILED STATE, A DICTATORIAL STATE, A LAWLESS STATE.

    The first real task Levi Peter, as AG, has done is to try to FOOL the people of Dominica as regards action alleged to be taken in the case Emmanuel vs. Isidore. The Press Conference REVEALED so much as to the man’s character. He ridiculed Carlisle Jno. Baptiste asking him whether he understood English. But the questions posed embarrassed him, and made him MAMOTAY. Levi was DISTURBED.

    Dominicans, did you all watch closely the facial expression of that AG Levi Peters? He clearly contradicted himself many times and made himself pass like an idiot. He indicated that instructions to oppose or support the application for leave to apply for judicial review made by Stephen Isidore did not come from him or his AG’s Office but in that same Press Conference, he admits it may have come from another source. Which SOURCE LEVI PETER? WHICH SOURCE that you know about but refuse to disclose? The SOURCE (SAUCE) PWEYSON or a BACK-AND-NECK SOURCE (SAUCE)? You think all Dominicans STUPID LEVI?

    Instead of working on behalf of the STATE, it seems by such alleged actions AG’s are working on behalf of the culprit who commits serious offenses. It is not the first time. Remember the former AG, boasting, “WE must come out victorious” pertaining to Skerrit and the DUAL CITIZENSHIP CASE? Skerritt was an ordinary citizen at the time of Nomination in the last election and did something seriously wrong against the Law.

    The BAR ASSOCIATION it seems has become a BREEDING GROUND for AGs for the DLP Party in Govt. So they will not look back nor front to protect their friends and their party in Govt. even when wrongs are committed and they happen to be brought before the courts. There are many examples to prove. That Isidore vs. Emmanuel CASE is yet another classic example of protection by all means possible for the BIG BOYS and CLOSE ALLIES of those in POWER.

    Remember the WARRANT to ARREST ISIDORE could not be put into effect because of the excuse that the AG. Police Commissioner was out of State? Now again the AG., Peter Levi, tells Dominicans as well that he too was out of State so no instructions were given by him to the courts. He claims is from another SOURCE, but would not disclose to the journalists matters that are relevant to the AG’s Office.

    LONG TIME Dominicans realize that somebody influenced the courts with instructions to try to PROTECT the culprit with friends in HIGH PLACES. All now so, THE FRATERNITY is hard at WORK, EARLY MORNING, LATE NIGHT, CONCOCTING STRATEGIES to TWIST, INTERFERE and/or KIBOSH that case. MANY BIG companies and BIG BOYS’ NAMES would be Mentioned in that case. Dominicans, as time goes along, study closely, open your eyes and ears to see and hear what Levi Peter’s MAIN JOB will be as AG. His first task gives a vivid account of what to expect in the future. Dominica is in SERIOUS TROUBLE. TRUST ME.

    Mr Peter, you have used many words to say nothing; to give no clarity on the situation and to display your inflated ego. You have brought the office of the AG in disrepute. How could you not know what is going on in the office that you are in charge of? You give the lame excuse( like the Chief of Police) that you were out of state, I would have you know that this excuse is becoming overused. How very convenient for you be to be out of state at such a crucial time!

    Mr AG, do you not credit the Dominican public and media with any common sense? Are you trying to insult our intelligence? There is no excuse for your pathetic responses to the questions asked. If you knew that you would not be able to answer the hard questions, then you should not have had a press conference!

    Many of us Dominicans look at other news networks such as CNN, ABC, Fox and BBC and we see how press conferences are conducted and how questions are answered/handled. I would suggest that you take a page from those and not play the Dominican media and public for fools.

    You have not convinced the Dominican public that there was no interference from the government in this case. Don’t play us for fools Mr AG! The truth will set you free! This government will crumble and you will come down with it!

    Okay, Is AG. Peters saying that he is not the one really in control, or at the helm of the legal department and it’s officers in Dominica? Is he subtly expressing displeasure with the occurring events, the chain of command, and his seemingly lack of independence. I think that Mr. Peters might have found himself in an uncomfortable position and feels pressured from all sides. How he decides to deal with the situation is left to be seen.

    This goes to show how polluted the justice system on island is…I really thought that Mr Peters is the biggest man in his office,but his revelation seems to suggest otherwise.He needs to come clean to the public because “i smell a rat”..By the way this man is rude and out of place,by attempting to muzzle the journalists..The truth is what we are demanding from our leaders,and those in the government cabal,always feel offended whenever one seeks to find the truth from them..This AG has a long long way to go in order to prove himself,and based on what i have seen so far,i have my doubts that the state will be well served..

    Who is the other source that may have given information? You mean their could be another source that is higher than the government of Dominica? I wonder who is that source. I don’t believe Peter is trying to blame it on the police or acting commissioner. Oh, maybe Tony then? You have every reason to be concerned innocent Mr. Peter. You even got me concerned too.

    This is absulutely “Astounding” ! How is it possible, that our AG, the man who holds the highest LEGAL OFFICE in the Country, says Government did not interfere in this High Profile case, but someone else “gave orders”. Mr AG, can you tell us;
    a) Who has the authority to Quash an “ARREST WARRANT”, which I understand was issued by a Judge?
    b) Who has the authority to order the SSU to the courts, in FULL BATTLE GEAR, when there was obviously no THREAT TO OUR NATIONAL security ?
    If that authority does not lie with Govrnment, then this seems to a matter of GRAVE CONCERN !, and one would expect you would initiate some type of investigation,
    Who do you serve Sir, THE CITIZENS OF DOMINICA or SOMEONE ELSE ?
    Dominicans, remember WHEN THE CITIZENS ARE AFRAID OF THE GOVERNMENT, THERE IS “ANARCHY”, & DICTATOSHIPS THRIVE !! but
    WHEN THE GOVERNMENT IS AFRAID OF THE PEOPLE “DEMOCRACY THRIVES ” !

He must surely wonder whether he is there just for decoration, just like the fairy on top of a christmas tree! If neither he, nor the govt. interfered, who did?     Sir, Mr. Lennox Lynton has spoken the truth and nothing but the truth in re. to good governance and corruption on the island. Can you say the same for your well known coleague? Certainly not. The manipulation of the judicial system in the land is live and well, and you are an instrument of it. Our Constitution clearly defines the independence of the judiciary from the executive branch, but you are yet to ensure that such is the case. Stop treating our countrymen as fools, and serve your country IAW the Supreme Law of the land, then your legacy will be supreme compare to your predecessors. Thank You!

    The Role and Functions of the Attorney General

    The Attorney General has a dual role. He is a Member of Government with two separate constitutional roles, a governmental role and a role as the guardian of the public interest. In his governmental role, he acts as a Member of Government in the performance of his duties and in his role as the guardian of the public interest he acts independently in a quasi-judicial capacity, representing the community at large.

    In accordance with the provisions of the Constitution of the Commonwealth of Dominica, the Attorney General is responsible for the administration of legal affairs in the Commonwealth of Dominica. Legal proceedings for and against the State must be taken (a) in the case of civil proceedings, in the name of the Attorney General and (b) in the case of criminal proceedings, the name of the State.

    The Attorney General has responsibility for the Departments of Civil Law, Criminal Law, Legislative Drafting and General administration which are headed by the Solicitor General, the Director of Public Prosecutions, and the Permanent Secretary, who is the Accounting Officer of the Ministry of the Attorney General, respectively.

    The main objectives of the Ministry of the Attorney General are:

    * To provide legal advice to Cabinet, to all Ministries, Statutory bodies and Departments of Government both on local and international matters.

    * To arrange for legal officers or lawyers to prosecute in criminal matters on behalf of the state.

    * To appear in civil matters for and on behalf of the State.

    * To keep under review all the laws applicable to Trinidad and Tobago with a view to their systematic development and reform.

    * To prepare legislation for Parliament in accordance with directives form the Cabinet.

    * To prepare subsidiary legislation for Government Ministries and other Bodies.

    * To approve legal documents on behalf of the State submitted by Ministries, Government Departments and Statutory Bodies.

    Well I will tell all you like Mamo Attorney General Roland R.O.M. David did say in d house of Assembly: “If you doh like d laws of d Freedom Party Government, leave d Country!!!”

    Athie, Wiltshire, Para etal left d Country and they never went to d UN, to CNN, to Observer Radio in Antigua, to d World Bank, to d IMF, or even write to d EU to complain about Mamo.

    What dem man did instead was to get the NGO movement up and working in Dominica for the benefit of rural Dominica , especially rural women and that did make Mamo ball so loud that Dr. Lennox even record that in his latest Dominica Story History Book!!!

    If dem haterz take example from d Cuban House Designer that break ranks with Labor Party they will earn more respect in Dominica since they employing people and knowing full well that everybody must wipe at least three times a day and doh talk about school children whose frequency even higher than three.

    Was there consultation with the leader of the opposition prior to his appointment?? If not is he really the AG???
    “I Levi Peter, attorney general of the Commonwealth of Dominica confirm that I did not give and have never given any attorney, be they state or any description whatsoever, any instructions to a oppose or b support the application for leave to apply for judicial review made by Stephen Isidore. Neither did I or have I given any instructions to any attorney to oppose the application of Mr Glenworth Emmanuel, believed to be joined as an interested party in the said application of Mr Isidore,”

    what doesa this mean? “Whether you ask 25 times … I am not going to disclose to you matters that are relevant to the attorney general’s office and are not relevant to you,” Peter said after being questioned by local media, as to who sought to influence the court matter. Is the AG not the representative of the state to which we are tax paying citizens? Or does he think the AG is a criminal defense lawyer?

    The attorney general admitted however that he is concerned instructions may have been given by “another source”.
    Well then do your Job! Cancel and prosecute those who have comited crimes against the state!!
    Such as false declarations on nomination day.
    Treasonous acts of representing a foreign power while pm and minister of government!!!
    Signing over multimillion dollar non tendered contracts to fellow french men.

    Releasing arrested french fishers caught illegally destroying our marine resources.

    I listened to the press conference with this man and I was mortified! Who is Levi Peters? This man was treating members of the press like uneducated children. He even asked one of them if they understood English. Who are you to insult people who are just seeking the truth and clarification of issues? If Lennox Linton is spreading rumours and misleading the public, then the onus is on you to lead the public in the right direction by giving us the truth. Levi Peters came to this conference in full defense mode. You cannot be in defense mode. Just tell the people the truth.

    Now, I also heard the man say that he did not give any instructions but as far as he knows somebody gave the instructions. Are you admitting that our justice system is so warped that others who do not have the authority have the power to manipulate the justice system by giving instructions? So we out there are supposed to take your pathetic explanation and run with it. Oh, somebody instructed them but I am telling you is not me! Bull!! You are the one with the authority!! You are telling the public that it is all right for someone else to overrule your position? Do you have any testicles at all? It is called testicular fortitude! Learn it!

    With idiots like you who wasted someone elses money by attending too much school and with your overinflated ego think that people are beneath you, our country is destined for failure. You need to respect citizens of this country. You need to respect people’s opinions. Attending school does not make you smart. You sound like an educated fool.

    Now as a Dominican, I must express my disgust at the manner in which you Levi Peters treated the press, the manner in which you responded to questions, the tone of voice you used in that press conference and your total disregard of our intelligence. When you are thrown off your high horse, then we will be willing to listen to your lame excuses as to why someone who is not authorised was allowed to manipulate the justice system.

    I am at lost to understand if the AG job is for protection of the country why is he admitting that under his watch others are giving instructions to his staff to do what he would not tell them to do ,and he is on radio defending himself and castgating others for bring it to light. Should he not be castigating the person who did what he is “concern about”? Shouldn’t he be calling for an investigation as to who did it and exposing them? Is his reputation more important to protect that that of his office? Man what “leaders” we have to “guide” us. nou pwee!!!
